ORDINANCE NO. 12685-2013

AN ORDINANCE MANDATING ALL FOOD ESTABLISHMENTS INCLUDING RESTAURANTS,
CAFETERIAS, CATERERS, FASTFOOD CHAINS AND OTHER RELATED FOOD SERVICES IN THE CITY
TO INCLUDE ONE-HALF CUP SERVING OF RICE IN THEIR MENU WITH THE CORRESPONDING
ONE-HALF PRICE AS AN OPTION FOR THE PUBLIC CUSTOMERS
Whereas, the Department of Agriculture is promoting the responsible consumption of rice as
embodied in Presidential Proclamation No. 494 by His Excellency President Benigno Simeon C. Aquino III;
Whereas, it is cogent to enact an ordinance for the purpose to lessen rice consumptions;
Now, Therefore:
BE IT ORDAINED by the City Council (Sangguniang Panlungsod) of the City of Cagayan de Oro in
session assembled that:
SECTION 1. - All food establishments including restaurants, cafeterias, caterers, fastfood chains and
other related food services in the City is hereby mandated to include one-half cup serving of rice in their
menu with the corresponding one-half price as an option for the public customers.
SECTION 2. - Any person, natural or juridical, found violating the provision of this Ordinance shall be
penalized with the following administrative fines:
A) first offense
C) third offense

P1,000.00;
B) second offense
P2,000.00;
P3,000.00 plus cancellation of the business permit.

Failure of the offender to settle his/her administrative fine shall cause the filling of appropriate case in
court against him/her, upon conviction he/she shall be penalized with a fine of not less than
P3,000.00 but not more than P5,000.00 or an imprisonment of not less than eight (8) months and one
(1) day but not more than twelve (12) months, or both such fine and imprisonment at the discretion of
the court.
SECTION 3. - This Ordinance shall take effect after 15 days following its publication in a local
newspaper of general circulation.
