ORDINANCE NO. 10053-2006


AN ORDINANCE REQUIRING CARWASH ESTABLISHMENTS INCLUDING GASOLINE STATIONS
AND AUTOMOTIVE REPAIR SHOPS WITH CARWASH SERVICES OPERATING IN CAGAYAN DE
ORO CITY TO PROVIDE OR CONSTRUCT SETTLING CATCH BASIN FOR THEIR RUN-OFF OR
WASTEWATER, PROVIDING STANDARD SPECIFICATIONS IN THE CONSTRUCTION THEREOF,
PROVIDING PENALTY FOR ITS VIOLATION, AND FOR OTHER PURPOSES
Whereas, it has been observed that car wash establishments in the City do not have settling
ponds for their run-off or wastewater;
Whereas, this is one of the causes for the clogging up of the citys drainage, whereby solid
wastes from washed vehicles would directly flow into drainage canals;
Now, therefore:
BE IT ORDAINED by the City Council (Sangguniang Panlungsod) that:
SECTION 1. - This Ordinance shall apply to all carwash establishments and gasoline stations or
automotive repair shops offering car-washing services.
SECTION 2. - No person, natural or juridical, shall establish or operate a carwash establishment
or offer car-washing services in the City without providing for or constructing a settling catch basin for
run-off or wastewater.
SECTION 3. - The construction of carwash settling catch basin shall conform to the following:
a.

Carwash establishments shall provide a clear catch basin with a dimension of 1.0 m. x 1.0 m.
with a depth of 0.30 meter from the invert level of the overflow pipe towards the existing
drainage system;
b. It should provide a clear right of way and drainage structure of offsite drainage from the
settling basin towards a functional defined public drainage system;
c. Settling basins shall be installed within the property of the proponent, not within the road
right of way;
d. Bottom slab, walls and cover of this catch basin serving as settling basin shall be of
reinforced concrete structure 100 mm. thick for walls and bottom slab and 150 mm. for
cover. Vertical wall rebars shall be 12.0 mm. spaced 300 mm. o.c. extending towards the
bottom and the other side of the wall. Horizontal bars shall be 10 mm. spaced 300 mm.
o.c. extending towards the perimeter walls of catch basin. Cover rebars shall be 12 mm.
spaced 150 mm. o.c. both ways;
e. Deposited silts on catch basin/settling basin shall be removed regularly;
f. No car washing activities shall be allowed within the road right of way;
g. Controlling elevations and hydraulic slope of the drainage system to be constructed by the
proponent from the settling basin towards a public drainage system shall be based on the
invert level of the existing system with a slope of 0.30 percent minimum;
h. All construction drawings for the said settling basin structure and its drainage line shall be
signed and sealed by a licensed civil engineer and shall form part of the documents in
securing business permit, and shall be subject for technical evaluation to ensure that it is in
accordance with the required standard specifications.
SECTION 4. - No carwash settling basin or catch basin shall be constructed without first
securing the necessary excavation permit from the City Engineer.
SECTION 5. - No building/occupancy permit and business permit shall be issued to carwash
establishments and gasoline stations offering car-wash services which have not complied with the
herein requirement.

For this purpose, the permits and licensing division of the City Mayors Office shall require
carwash establishments including gasoline stations and automotive repair shops offering car washing
services when applying for business permits to first secure a City Engineer certification attesting
compliance with the provision of this Ordinance.
Existing carwash establishments without settling basin shall be given six (6) months from the
effectivity of this Ordinance to comply with the provision hereof.
SECTION 6. - The owner, manager or person-in-charge of car wash establishments found
violating the provisions of this Ordinance shall be penalized with by a fine of not less than P3,000.00
but not more than P5,000.00 or imprisonment of not less than six (6) months but not more than one (1)
year, or both such fine and imprisonment at the discretion of the court.
The offender may, however, opt to settle his/her liability administratively by paying the
following administrative fines within 72 hours from apprehension:

P5,000.00 and cancellation of business permit.

Failure to pay the said fine after the lapse of seventy-two (72) hours period, the City Legal
Officer shall forward or file the appropriate complaint or information at the Office of the City
Prosecutor or the Municipal Trial Courts in Cities in the City of Cagayan de Oro.
SECTION 7. - This Ordinance shall take effect after 15 days following its publication in a local
newspaper of general circulation.
