Purpose of the testimony: Plaintiff, NATHAN DIAZ is presenting the testimony of
ATTY. JOSEPH BENAVIDEZ, to prove that defendant JON JONES personally received
the demand letter sent by FALLER, YUSI, CARREON & ASSOCIATES on behalf of
plaintiff sometime last 26 April 2015.
ATTY. JOSEPH BENAVIDEZ, of legal age, Filipino, a junior associate at
FALLER, YUSI, CARREON & ASSOCIATES, with office address at 20 Cypress corner
Pine St., Pasig city, after having been sworn in accordance with law and fully conscious
that I do so under oath and that I may face criminal liability for false testimony or perjury
by way of answers to the questions propounded to be by Atty. Barbara Alarkon, with
office address at 20 Cypress corner Pine St., Pasig city, do hereby depose and state:
Q1:

Mr. Witness, you mentioned that you are a junior associate at FALLER,
YUSI, CARREON & ASSOCIATES; as such, what your duties and
responsibilities?

A:

I have various duties and responsibilities as a junior associate of Atty.

Beatrice Faller sir. I handle all the cases that Atty. Faller entrusts to me
personally and with that, I make sure that I draft all the pleadings for my
cases, meet with clients, act as a liaison officer for my clients in sending
demand letters, contracts and the like, appear in court, represent my
clients in whatever process like arbitration proceedings, and other
corollary responsibilities that entail me in each case that I handle.

Q2:

In the course of your aforementioned duties and responsibilities thereof,

do you recall the name of Jon Jones in the case handled by Atty. Faller?

A:

Yes, Maam.

Q3:

What information do you have in your records regarding said Jon Jones?

A:

According to our records, by personal service I served a demand letter to

Jon Jones sometime last April 26, 2015. I have the Delivery checklist for
the day of April 26, 2015 and I request that it be marked as Exhibit C

Q4:

I am showing to you a demand letter dated August 26, 2009 addressed to

Jon Jones of Pasig City marked as Exh. D-4. Are you familiar with this
letter?

A:

Yes Maam, thats the receiving copy of the letter which was delivered to
Jon Jones. I was the one who personally delivered said demand letter to
the residence of Mr. Jon Jones for my boss client.

Q5:

In the receiving copy a, name J Jones and signature are indicated herein.
Do you know whose name and signature this belongs to?

A:

Yes Maam, it is Mr. Jon Jones.

Q6:

How did you know that he is Jon Jones?

A:

When I delivered the demand letter to the residence of Mr. Jon Jones, I
asked for Mr. Jon Jones to receive the letter that I am about to give and he
affirmed that his name is Jon Jones so he received the said letter and he
signed it in front of me, Maam.
