JUDICIAL AFFIDAVIT

I, MERYAM SANTIAGO, of legal age, married, Filipina and with address

at 86 Heran Street, Manila, after having been duly sworn, hereby depose and
say that:
This Judicial Affidavit is being executed in compliance with the Judicial
Affidavit Rule (A.M. No. 12-8-8-SC).
Atty. Jay M. Contreras conducted my direct examination in their office at
Unit 12D Kamikaze Building, 428 Doobidoo Ave., Tsinelas Heights, 1106
Manila City, Metro Manila.
I am hereby answering the questions asked by Atty. Jay M. Contreras,
fully conscious that I do so under oath, and that I may face criminal liability for
false testimony or perjury.
COUNSEL:

Do you know the defendant in this case?
A:
Yes, sir. The defendant is Roda Duterty. She is my neighbour and
we are good friends.
2. Q:
A:

How long have you been neighbors?

We have been neighbors since Roda moved in her house in 2005.

A:

You have mentioned the house. Is she the owner of that house?
Yes sir.

4. Q:
A:

How do you know of this fact?

During the construction of the house, it was Roda and her
husband that often visited the construction and they were also the
one who paid for the services of my husband.

5. Q:

You are saying that your husband rendered his service.

What kind of service are you referring to?
My husband is an electrical engineer and they have asked for his
assistance in laying out the electrical wires in the said house.

How about the land where the house is built?

Do you know who is the owner of the land?
Yes, sir. Roda is the owner of the land where the house is built.

How do you know of this fact?

During the construction of the house, Gibo, the husband of Roda,
mentioned that the land was inherited by Roda from her father.

You said a while ago that you and Roda are friends.
How did you became friends?
We became friends because, aside from being neighbors, our
husbands are also friends and my husband and our chidren attend
the same school.

Do you know if Roda Duterty has any siblings?
A: Yes, sir. I know that she have a brother.

What is the name of this brother?

His name is Ronaldo Dayana.

How did you meet Ronaldo Dayana?

I met him when he visited Roda in her house one time.

How did you know that Ronaldo is Rodas brother?

He was introduced to me as Rodas brother and it is obvious
in the close relationship of the two that they are siblings.

So aside from the fact that he was introduced as
Rodas brother to you, you also assumed that they were siblings
based on their close relationship?
A: Yes, sir.

Can you give an instance where it can be presumed
that they are siblings?
A: Yes, sir. Ronaldo, with his wife and children, has always visited
Roda in her house. He is also present during special occasions.

Does he still visit Roda until now?
A: Not any more, sir. Ever since they had a fight.

You said they had a fight. How did you acquire of this
information?
A: I now it sir, based on my personal knowledge because I was there.

So you are saying that you were there when they had a
fight.
A: Yes, I was there.

How did this fight occur? Can you state what happened?
Ronaldo was already drunk that time. Then he suddenly
approached Roda in the kitchen while I was helping her with
the dishes. Roda told him to stop drinking already as he was
already drunk. Ronaldo then told Roda not to bother him
and that she has no right to tell him what to do. Roda
answered that she was only concerned with him. Then
Ronaldo suddenly threw the plates we were washing. Roda
then asked his brother, Anong problema mo? Ronaldo then

started saying bad words and told Roda that she has a good
life because she was always favoured by their father.

And then how did this fight end?

After saying those words, Ronaldo left the house.

How about Roda? What did she do after the fight?

Roda just cried.

Did they reconcile after the fight?

From what I know, no, they havent reconciled until now.
