AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT is made, executed and entered into by:
RENZAE MARHOS MONTAEZ, a minor, single, Filipino, and
with residence and postal address at Pagdalagan, San Fernando
City, La Union, Philippines, hereinafter referred to as the MINOR,
represented by his mother, MARY JANE CABAUATAN, of legal
age, single, Filipino, and with residence and postal address
at Pagdalagan, San Fernando City, La Union, Philippines;

ANGEL MONTAEZ, of legal age, married, Filipino and with

residence and postal address at Parian Este, Bauang, La Union,
Philippines, hereinafter referred to as the FATHER;
WITNESSETH;
WHEREAS, the FATHER acknowledges that the herein MINOR is his
illegitimate child, the Affidavit of Acknowledgment was executed as part of
the Certificate of Birth of the herein MINOR;
WHEREAS, the FATHER acknowledges his responsibility to give support
in accordance with the pertinent provision of the Family Code of the
Philippines to wit:
Art. 194. Support comprises everything indispensable for
sustenance, dwelling, clothing, medical attendance, education
and transportation, in keeping with the financial capacity of the
family.
The education of the person entitled to be supported referred to
in the preceding paragraph shall include his schooling or training
for some profession, trade or vocation, even beyond the age of
majority. Transportation shall include expenses in going to and
from school, or to and from place of work. (290a)
Art. 105. Subject to the provisions of the succeeding articles, the
following are obliged to support each other to the whole extent
set forth in the preceding article:
(1)The spouses;
(2)Legitimate ascendants and descendants;
(3)Parents and their legitimate children and the legitimate and
illegitimate children of the latter;
(4)Parents and their illegitimate children and the legitimate and
illegitimate children of the latter; and
(5)Legitimate brothers and sisters, whether of full or halfblood (291a)
NOW THEREFORE, in view of the foregoing, and of the covenants herein
after set forth the FATHER agrees to give support to the MINOR under the
following premise:

(1)The FATHER shall provide support due to the MINOR in accordance with
the Family Code of the Philippines;
(2)The FATHER shall from time to time or as the need arises communicate
with the mother of the MINOR to discuss the needs of the MINOR as to
how support should be divided between them;
(3)The FATHER shall provide support in monetary consideration in cases
where the MINOR needs medical attention such is not limited to
hospitalization, doctors professional fees and medicines;
(4)The FATHER hereby agrees to give an initial monthly financial support
of FOUR THOUSAND PESOS (Php 4,000.00) which will cover the
contribution of the FATHER as far as his obligation is concern in
compliance with the aforementioned quoted provision of the Family
Code of the Philippines. This amount is subject to change as the
MINORs needs are also expected to change with the lapse of time;
(5)The FATHER hereby agrees to give to the mother of the MINOR the
amount of money above-mentioned in two (2) instalments to be given
any day within the first and third weeks of every month;
(6)The FATHER being the illegitimate parent of the MINOR recognizes that
parental authority is vested only on the mother of MINOR;
(7)The mother of the MINOR hereby undertakes also to extend visitation
rights to the FATHER every SATURDAYS and SUNDAYS provided that the
MINOR is willing and has no previous commitments and said visitation
rights will not interfere with his (MINOR) education;
(8)The FATHER hereby undertakes to return to the mother the MINOR
upon the call of the mother if said MINOR was given to him in
accordance with his visitation rights; and
(9)This Agreement is entered into to secure that the MINOR is duly
supported under any circumstances and takes effect immediately.
IN WITNESS WHEREOF, the parties hereby affixed their signature this
September 27, 2016 at San Fernando City, La Union, Philippines.

foregoing instrument and acknowledged to me that the same are their
free act and voluntary deed.
This instrument, consisting of three (3) pages, including the page on
which this acknowledgment is written, has been signed on the left margin of

and sealed with my notarial seal.
