CONTRACT OF EMPLOYMENT

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF EMPLOYMENT is hereby executed and entered
into by and between:
SQUIDWARD UNIVERSITY, a corporation duly organized and existing
by virtue of laws of the Republic of the Philippines, with principal office at
Brgy. 1 Laoag City, Ilocos Norte, and represented herein by its President, Mr.
Mel Guillermo and its Research Supervisor Ledda Yvonne Fiesta who is duly
authorized to enter into and hereinafter referred to as the EMPLOYER.
-andERICKSON GAZA, Filipino, single, of legal age and residing at Brgy. 2
San Nicolas, Ilocos Norte, Philippines, herein referred to as the EMPLOYEE.

WITNESSETH THAT
WHEREAS, the EMPLOYER is engaged in research program for the
development of education and its learning facilities;
WHEREAS, the EMPLOYEE has academic experience related to the
field of research and agrees to apply such knowledge for the EMPLOYER;
NOW THEREFORE, it is agreed that the EMPLOYER will employ the
EMPLOYEE and the EMPLOYEE will work for the EMPLOYER on the
following terms and conditions:
I.

JOB TITLE
The EMPLOYEEs position is that of a RESEARCH
ASSOCIATE and shall perform the following obligations:
a. Conduct literature reviews;
b. Collect and analyze data;
c. Prepare interview questions;
d. Recruit and/or interview subjects;
e. Maintain accurate records of interviews, safeguarding
the confidentiality of subjects, as necessary;
f. Summarize interviews;
g. Provide ready access to all experimental data for the
faculty researcher and/or supervisor;
h. Request or acquire equipment or supplies necessary for
the project;
i. Prepare, maintain and update research materials;
j. Attend area seminars and other meetings as may be
deemed necessary;
k. Summarize project results;
l. Prepare
other
articles,
reports
and
other
presentations;and
m. Monitor the project budget as approved by the
Supervisor.
The EMPLOYEE may from time to time be required to
carry out such other reasonable duties as the EMPLOYER may

COMMENCEMENT
The EMPLOYEEs employment with the EMPLOYER will
begin on the 28th day of July 2016.

III.

PROBATIONARY PERIOD
The first six (6) months of employment will be a
probationary
period,
during
which
the
EMPLOYEES
performance will be monitored. The probationary period may be
extended by the EMPLOYER. During the probationary period this
employment may be terminated by either party giving one week
notice to the other in writing.

IV.

HOURS OF WORK
The EMPLOYEEs normal working hours are:

This is a total of eight (8) hours of work daily and fortyeight (48) hours per week.
The EMPLOYEE shall be entitled to a ONE HOUR lunch
break from 12:00nn to 1:00pm.
The EMPLOYEE may be required to work such further
hours as may be necessary to fulfill his duties or the needs of the
Research Program. Whenever possible, the Research Supervisor
will give the EMPLOYEE reasonable notice of any additional
hours.
The EMPLOYEE is entitled to an unpaid lunch break of one
(1) hour which will be taken at such time as the EMPLOYER may
require.
V.

PLACE OF WORK
The EMPLOYEES normal place of work will be in the
principal office of the EMPLOYER located at Brgy. 1 Laoag City,
Ilocos Norte.

VI.

SALARY/PAYMENT
Payment is at the rate of Five Hundred Pesos (500PhP) per
day and is payable every 15th and 30th day of the month through
bank deposits from the EMPLOYER to the bank account of the
EMPLOYEE specifically made for such purpose. Thus, the
EMPLOYEE has the basic salary of Fifteen Thousand Pesos
(15,000PhP) per month.

Hours in excess of the 8 hours per day work are classed as


OVERTIME and are paid at the basic rate of One Hundred Pesos
(100PhP) per hour. Such OVERTIMES must not exceed the
allowable period of FIVE (5) hours authorized by the EMPLOYER.
VII.

DEDUCTION FROM WAGES


The EMPLOYER shall be entitled to suspend the
EMPLOYEEs employment pay in the event of the EMPLOYEEs
refusal to obey lawful order including but not limited to his
obligations as stated in Title I.
The EMPLOYER reserves the right and the EMPLOYEE
irrevocably authorizes the EMPLOYER, at any time during the
EMPLOYEEs employment, or in any event upon its termination,
to deduct from the EMPLOYEEs wages/salary and/or any other
monies due to the EMPLOYEE, an amount equivalent to any of
the following:
a. any overpayment of wages, salary, remuneration or
other payment made to the EMPLOYEE during the
course of employment;
b. the amount of any expenses claimed by the Employee
and paid but subsequently disallowed by the EMPLOYER;
c. the outstanding amount of any advance made by the
EMPLOYEE to the EMPLOYER;and
d. any cost of repairing any damage to or loss of property
of, any fines or charges imposed upon or any other loss
sustained by the EMPLOYER or any third party, caused
by the EMPLOYEEs breach of contract of breach of the
EMPLOYERs rules as a result of the EMPLOYEEs
negligence or dishonesty.

VIII. HOLIDAYS
The EMPLOYEE shall be entitled to Holidays whether
REGULAR or SPECIAL.
In a REGULAR/LEGAL HOLIDAY, the EMPLOYEE
shall be compensated 100% of his daily rate if the
EMPLOYEE does not work and a rate of 200% of the
regular rate if worked.
In a SPECIAL HOLIDAY, no compensation shall be
given if the EMPLOYEE does not work but shall be
entitled to 130% of the regular rate if worked.
IX.

CONFIDENTIALITY
The EMPLOYEE may not either or at any time after the
termination of his employment with the EMPLOYER disclose to
anyone other than in the proper course of his employment, any
information of a confidential nature relating to the EMPLOYER,
research subjects, salary and shall further not use such
information in a manner which may either directly or indirectly
cause loss to the EMPLOYER. Confidential information includes

but is not limited to financial information, technical information,


and other corporate information.
X.

TERMINATION OF EMPLOYMENT
During the EMPLOYEEs probationary period, this
employment may be terminated by either party giving a oneweek notice to the other.
This CONTRACT OF EMPLOYMENT shall be automatically
terminated by the EMPLOYER after the six (6) months
probationary period with notice given to the EMPLOYEE.
All notices shall be given in writing.

XI.

INDEMNITY
The EMPLOYEE will indemnify the EMPLOYER in respect
of any liability incurred by the EMPLOYER as a direct
consequence of the EMPLOYEEs negligence, breach of contract,
breach of duty or breach of trust in relation to the affairs of the
EMPLOYER.

XII.

GENERAL PROVISION
Amendment of any of the provisions of this contract shall
be in writing and shall be agreed and signed by the EMPLOYER
and EMPLOYEE.

IN WITNESS WHEREOF, the parties have hereunto voluntarily affixed


their signatures this 21st day of July 2016 at Laoag City, Ilocos Norte,
Philippines.
