SPECIAL CLAUSES FOR A PEACE CORPS MEDICAL CONTRACTOR

CLAUSE XXIV. SPECIAL REPORTING REQUIREMENT


A.

Medical Reports:
The Contractor shall submit a monthly report of incidence of disease and any other reports required or as provided by
the technical guidelines and a semi annual evaluation of the in-country health care program to the Medical Director in
Washington. Such reports shall be in the format and detailed as prescribed by the Office of Medical Services.

B.

Interim Reports:
The Contractor shall submit written reports as may be called for from time to time by the Peace Corps Country Director.
These reports, if requested, shall include, but not be limited to, the following areas:

A candid assessment of the post medical program and the potential of successfully accomplishing the goals of
the program.

2.

Major problems that arose and recommendations for anticipating and minimizing such problems in the future.

3.

Recommendations for improvements of the medical system in the country and Peace Corps administrative
procedures.

Final Report:
A final report, covering the services provided, may be required by the Country Director, the Director of the Office of
Training and Program Support, or the Director of the Office of Medical Services, Peace Corps, Washington, DC before
final payment will be authorized.

D.

Other Deliverables:
The Contractor shall submit all other deliverables specified in the statement of work in a timely manner.

E.

Release of Information:
All rights in data and reports produced under this contract shall become the property of the U.S. Government. All
information gathered under this contract by the Contractor and all reports and recommendations hereunder shall be
treated as privileged information by the Contractor and shall not be made available to any person, party, or
government, other than the Peace Corps, except as otherwise expressly provided in this contract.

CLAUSE XXV. CONFIDENTIALITY.


It is understood that the Contractor and her alternate stands in a special relationship to the Peace Corps and will treat all
matters which result from the relationship with the confidentiality required of the relationship. Failure of the Contractor to
maintain the confidentiality of such information shall be grounds for the immediate termination of this contract by the Peace
Corps Contracting Officer based upon Contractor's inadequate performance. The Contracting Officer shall determine as a
question of the fact whether such confidentiality has been violated by the Contractor. In the event the Peace Corps
Contracting Officer terminates this contract pursuant to this clause, the Contracting Officer shall advise the Contractor in
writing setting forth the basis for circumstances involved.
CLAUSE XXVI. TRAINING

In the event the Contractor receives non-government training that exceeds 80 hours, the Contractor agrees to execute
a Continued Service Agreement before actually taking the training. The Agreement shall require the Contractor to
continue providing services to the Peace Corps for a period equal to at least three times the length of the training
period, unless the contract is involuntarily terminated. The Contractor shall reimburse the Peace Corps the amount of
the additional training expenses in the event the Contractor voluntarily terminates the contract before the training or the
required period of continued service is completed.
In the event the contractor fails to complete any contract year, base year or any option period, the contractor herein
agrees that he or she shall be responsible for reimbursing the Government for any training expenses for continuing
medical education and medical on-site training the Government has incurred on behalf of the contractor during that
period unless the contract has been terminated involuntarily by the Peace Corps.
CLAUSE XXVII.

SUPPLIES, MATERIALS AND EQUIPMENT

The Government agrees to provide the Contractor the following supplies, materials and/or equipment for use in the
Contractor's performance of services under this contract:
A.

All necessary, proper medical supplies and medicines including biologicals for the Contractor's treatment of
Peace Corps Trainees and Volunteers. Such supplies and medicines shall be used exclusively for the
treatment of Peace Corps Volunteers and Trainees and other persons deemed eligible by the Country
Director.

B.

The necessary office furniture and equipment.

C.

The Contractor shall protect and preserve property in the possession of the Contractor in which the
Government has an interest. Damage to, or loss of U.S. Government Property when it is due to the
Contractor's negligence shall result in the Contractor being liable for repair or replacement thereof. The
Government may withhold from amounts otherwise due the Contractor any amount the Contracting Officer
determines to be necessary to protect the Government against loss because of Government materials,
supplies and equipment in the possession of the Contractor.

CLAUSE XXVIII. RECORDS:


The Contractor shall maintain appointment books, medical records, documents, prescription notations and other
evidence of services rendered under this contract. The records shall be subject at all reasonable times to inspection
and audit by the Director, Office of Medical Services or his or her authorized representative.

CONTRACT No. PC/_______


STATEMENT OF WORK
Peace Corps Medical Contractor

(In a large post with the need to hire more than one PCMC, CD might choose to have the senior medical contractor
serve as the coordinator for the unit. In this case the following clauses might be used)
MEDICAL UNIT COORDINATOR SERVICES:

Oversee the PC/__________ Health Care Program and it's contractors. This includes:
Defining and drafting Statements of Work for all medical unit staff.

Participation in selection boards for the purpose of interviewing potential new staff members and making
recommendations to Country Director regarding hiring.

1.3

Orienting/training of new staff members in conjunction with other PC/__ staff and M/MS orientation programs.

1.4

Coordinating other medical unit staff in order to provide technical/policy guidance, make decisions regarding
appropriate case management, provide assistance to the Country Director when evaluating job performance of Unit
component and recommend any disciplinary action to Country Director.

1.5

Providing initial coordination of all medical unit work schedules including vacation or leave time, on-call time and
distribution of work activities for CD approval.

1.6

Providing input into the IPBS and Operating Plan based on medical unit needs for upcoming fiscal year; as well as
participating in any reviews of these plans.

A.

MEDICAL CARE SERVICES:

1.

Provision of primary health care for all common illnesses and injuries to Volunteers/Trainees in Guatemala in
accordance with accepted high professional standards and according to the PC Technical Guidelines for Overseas
Medical Staff. A copy of the Technical Guidelines shall be provided by the PC at the time of execution of this
contract and is incorporated herein by reference.

2.

Establishment and maintenance of a specialist referral system for consulting locally on difficult medical problems.

3.

Arranging for prompt Volunteer diagnostic consultations with physicians, dentists, specialists, laboratories or other
facilities, in cases where the provision of medical care requires medical skills or facilities beyond the professional
capability of the PCMO or PC medical facility.

4.

Making of medical judgments concerning evacuating Volunteers with medical problems requiring special evaluation
or difficult treatments, or both, not available locally. Upon reaching the medical decision, will request the PC Staff for
administrative assistance. This may include accompanying evacuated PCVs; in which case PC/__________ will pay
transportation and applicable staff per diem.

5.

Dispense selected and approved medicines to Trainees and Volunteers.

6.

Maintenance of current, complete and accurate records of all Volunteer consultation and treatment (including
laboratory and X-Ray reports) in the Overseas Health Jackets and a daily log book of all Volunteer contacts in the
Medical Office or in the field, including name of Volunteer, reason for visit and disposition.

7.

Provision of health orientation to acquaint all trainees with the health care program, self-care procedures, local
health care facilities, endemic diseases, preventive measures and FECA coverage. Elaborates the PST health
session schedule with appropriate Training Staff and sets guidelines for provision of medical attention to trainees.

8.

Conduct a continuous in-service health education program for all volunteers by participation in workshops, midservice conferences and/or through frequent communications on health and safety.

9.

Immunization of all Trainees and Volunteers and continuous monitoring of the immunization program to ensure
compliance.

10.

Assist PCVs/PCTs with medical emergencies that occur outside of normal working hours in conjunction with the PC
Physician. Be available on an on-call basis 24/7. (in larger posts with more than one PCMC: as determined by
the medical duty calendar).

11.

Travel to retrieve PCTs/PCVs who have medical emergencies as necessary and bring them to ______________
City.

12.

Visit hospitalized PCTs and PCVs, as well as those confined to home to solve technical problems and provide
emotional support.

13.

Maintain and operate a Medical Office 40 hours per week for PCV/PCT sick call.

14.

Provision of scheduled site visits, as necessary, to evaluate the physical and emotional states of volunteers, and to
identify potential health or adjustment problems or both.

15.

Provision of counseling to PCVs/PCTs with mental health/adjustment issues. Evaluate seriousness of issues and
make counseling referrals as indicated.

B.

MEDICAL ADMINISTRATIVE SERVICES.

1.

Participation in staff meetings and staff retreats, providing assistance in the formulation of all local Peace Corps
policies regarding the health and safety of Volunteers.

2.

Prepare and submit monthly Disease Surveillance Survey statistical information.

3.

Review of all medical expenditures and provision of professional advice to the Country Director concerning payment
of medical services and supplies, to insure that expenditures correspond to services provided and that charges are
customary and reasonable.

4.

Maintenance of Volunteer and Trainee Overseas Health Jackets under combination lock, to ensure medical
confidentiality and compliance with the provision of the Privacy Act and Peace Corps Manual Section 268 - Medical
Confidentiality.

5.

Evaluation of the health and living conditions at Volunteer living and training sites. Preparation of written reports on
status and professional recommendations for site improvements, if necessary.

6.

Monitoring and evaluation of local medical services including physicians, labs, hospitals and clinics to ensure care is
adequate.

7.

Preparation of communications with M/MS on Volunteer health, surgical emergencies, hospitalizations, or other
health problems requiring professional consultations.

8.

Maintenance of effective communications and cooperation with Peace Corps Country Director and other members of
the Peace Corps Staff. Inform Country Director and other Peace Corps Staff of individual PCV/PCT status as
appropriate.

9.

Report to Country Director all assaults and other incidents involving PCV/PCT safety.

10.

Confer with Peace Corps staff to ensure adequate site placements for PCT/PCV with health restrictions.
