WHEREAS,theCityofMountVernonhasapprovedplansfortheconstructionofresidentialhousing
projectswhichincludemultifamilyresidentialunits,andwhichareexpectedtoincreaseenrollment
intheDistrictsschoolsand

WHEREAS,theMountVernonCitySchoolDistrictissubjecttoataxlevycapwhichdoesnottake
intoaccountadditionalcostsduetoanincreaseinenrollmentand
WHEREAS,theCityofMountVernonandtheMountVernonIndustrialDevelopmentAgencyare
contemplatingofferingsignificanttaxincentivestohousingProjectsandreducingthetaxliabilityof
suchProjectsbyenteringintoagreementsforPaymentsInLieuOfTaxes(PILOTAgreements)and
WHEREAS,PILOTagreementsreducethetaxliabilityoflargepropertyowners,shiftthetaxburden
tosmallertaxpayers,andreducethetaxcapintheyearinwhichthePILOTagreementstake
effectand
WHEREAS,theBoardofEducationbelievesthattheapprovedandproposedresidentialProjects
whichreceivetaxincentivesthroughPILOTagreementswillcompromisetheeducationalbenefits
andopportunitiesavailabletoallstudentsintheMountVernonCitySchoolDistrictand
WHEREAS,therestructuringplanthathasbeenadoptedinconnectionwiththebondreferendum
doesnottakeintoaccounttheoverwhelmingnumberofnewstudentswhowillbeattendingthe
districtsschoolsasaresultoftheapprovedandproposedresidentialprojectsassetforthabove
and
WHEREAS,basedupontheexisitingphysicalcapacitylimitationsthatexistduetothe
restructuringoftheschools,theDistrictneedsthetimetonegotiatewiththecitytoobtainthe
landandfundsrequiredtoconstructnewfacilititestoaccommodatetheanticipatedgrowthand
WHEREAS,theBoardofEducationoftheMountVernonCitySchoolDistrict,byresolutionformally
adoptedatitsmeetingonSeptember6,2016,requestedtheCityofMountVernonenacta
moratoriumonapprovalsofallPILOTagreementsinvolvingthedevelopmentofresidentialproperty
locatedwithintheMountVernonCitySchoolDistrictforaperiodofoneyearand
WHEREAS,theCityofMountVernonandtheMayoroftheCityofMountVernonhavefailedto
respondtotheDistrictsrequestinanymannerandcontinuetonegotiatePILOTagreements
whichadverselyaffecttheeducationalservicesofferedtostudentsoftheMountVernonCity
SchoolDistrict
NOW,THEREFORE,INLIGHTOFTHEFOREGOING,BEITRESOLVED,theSchoolAttorneyishereby
directedtocommencealawsuitagainsttheCityofMountVernon,itsofficers,employeesand
agents,andsuchotherpersonsorentitiesasshallbenecessarytoprotecttheinterestsofthe
MountVernonCitySchoolDistrictandtheeducationalservicesavailabletostudentsoftheDistrict.

WHEREAS,theMountVernonCitySchoolDistrictissubjecttoataxlevycapwhichdoesnottakeintoaccountadditional
costsduetoanincreaseinenrollmentand
WHEREAS,theCityofMountVernonandtheMountVernonIndustrialDevelopmentAgencyarecontemplatingoffering

significanttaxincentivestohousingProjectsandreducingthetaxliabilityofsuchProjectsbyenteringintoagreements
forPaymentsInLieuOfTaxes(PILOTAgreements)and
WHEREAS,PILOTagreementsreducethetaxliabilityoflargepropertyowners,shiftthetaxburdentosmallertaxpayers,
andreducethetaxcapintheyearinwhichthePILOTagreementstakeeffectand
WHEREAS,theBoardofEducationbelievesthattheapprovedandproposedresidentialProjectswhichreceivetax
incentivesthroughPILOTagreementswillcompromisetheeducationalbenefitsandopportunitiesavailabletoallstudents
intheMountVernonCitySchoolDistrictand
WHEREAS,therestructuringplanthathasbeenadoptedinconnectionwiththebondreferendumdoesnottakeinto
accounttheoverwhelmingnumberofnewstudentswhowillbeattendingthedistrictsschoolsasaresultoftheapproved
andproposedresidentialprojectsassetforthaboveand
WHEREAS,basedupontheexisitingphysicalcapacitylimitationsthatexistduetotherestructuringoftheschools,the
Districtneedsthetimetonegotiatewiththecitytoobtainthelandandfundsrequiredtoconstructnewfacilititesto
accommodatetheanticipatedgrowthand
WHEREAS,theBoardofEducationoftheMountVernonCitySchoolDistrict,byresolutionformallyadoptedatitsmeeting
onSeptember6,2016,requestedtheCityofMountVernonenactamoratoriumonapprovalsofallPILOTagreements
involvingthedevelopmentofresidentialpropertylocatedwithintheMountVernonCitySchoolDistrictforaperiodofone
yearand
WHEREAS,theCityofMountVernonandtheMayoroftheCityofMountVernonhavefailedtorespondtotheDistricts
requestinanymannerandcontinuetonegotiatePILOTagreementswhichadverselyaffecttheeducationalservices
offeredtostudentsoftheMountVernonCitySchoolDistrict
NOW,THEREFORE,INLIGHTOFTHEFOREGOING,BEITRESOLVED,theSchoolAttorneyisherebydirectedtocommence
alawsuitagainsttheCityofMountVernon,itsofficers,employeesandagents,andsuchotherpersonsorentitiesasshall
benecessarytoprotecttheinterestsoftheMountVernonCitySchoolDistrictandtheeducationalservicesavailableto
studentsoftheDistrict.
