The 3rd Regular Session of the Sangguniang Bayan started with a call to order from the Presiding Officer
25at 9:30 AM. All Members were recorded as present. The prayer was led by Hon. Ruel F. Ilao where the
26review of the Minutes of the 2nd Regular Session followed and to effect the corrections, approval has been
27deferred on motion of Hon. Ruel F. Ilao. Corrections were made on lines 32, 61, 65, 66 78 and 89.

WHEREAS, to facilitate speedy transactions and in compliance with Pag-Ibig Circular No. 355 which

WHEREAS, this needs the Sangguniang Bayan endorsement and concurrence.

WHEREAS, Section 2, Rule XI, Book V of Executive Order (EO) No. 292 and its Omnibus Rules on
165Appointment and other Personnel Actions, as amended, describes Job Order and Contract of Service as
166follows:

a. The contract covers lump sum work or services such as janitorial, security or consultancy

services where no employer-employee relationship exist;

b. The Job Order covers piece of work or intermittent job of short duration not exceeding six

months on a daily basis;

c. The Contract of Service and Job Orders are not covered by Civil Service Commission (CSC)

laws, rules and regulations, but by the Commission on Audit (COA) rules; and

d. The employees involved in the Contract of Service and Job Orders do not enjoy benefits

enjoyed by government employees, such as Personnel Economic and Relief Allowance (PERA),

Cost of Living Allowance (COLA) and Representation and Transportation Allowance (RATA).

WHEREFORE, on motion of Hon. Renji A. Arcilla and seconded by Hon. Ruel F. Ilao, resolve to approve
179as it is hereby approved that the Municipal Mayor and the Municipal Vice-Mayor be requested to take into
180account and consideration the aforesaid request and also if appropriations can be provided.

WHEREAS, this could create an atmosphere that we are serious with our drive to curtail the growing
201number of patronage for illegal drugs;

WHEREAS, this also is a good example for government workers and would preempt any probable users

207approve as it is hereby approved that the Municipal Mayor, through the Municipal Health Officer, work for the

Referred before this Committee by the August Body for appropriate action (legal recommendation and/or report) is
233the July 8, 2016 letter of the Honorable Chief Executive addressed to the Sangguniang Bayan to terminate the existing
234MOA between this Municipality and Barangay Taysan, this municipality executed on the 21 st day of December 2011
235pertaining to the temporary management of parking area inside the Public Market and the operation and maintenance of
236the public toilet.

His letter said that per assessment in the Public Market and provision of duties in the MOA at Barangay Taysan,
239San Jose, Batangas, pertaining to the maintenance of toilets and operation of parking, substantial neglect has been
240determined on the part of the second party, hence, determined violation of the agreement, and that he had initiated the
241assumption of functions assigned to them and termination of the MOA for a better management, thus requesting an
242urgent authority to terminate the said MOA.

Careful scrutiny of the provisions of the existing MOA, particularly Item 12 thereof, it provided that The FIRST
245PARTY reserves the right to recall the authority for traffic and toilet management on a one (1) month notice to
246the SECOND PARTY.

While it is true and clearly provided under Item 12 of the said MOA that the FIRST PARTY, THE MUNICIPALITY,
249THRU THE LOCAL CHIEF EXECUTIVE, has the right to recall the authority for traffic and toilet management, the FIRST
250PARTY, THE MUNICIPALITY, THRU THE LOCAL CHIEF EXECUTIVE is first duty bound to notify the SECOND PARTY
251of the formers intention to recall or terminate the agreement by inviting and/or calling the latters attention regarding the
252alleged agreements violation/s, and in the event the SECOND PARTY fails to rectify a violation within thirty (30) days
253from service of notice, that will be the only time for the Municipality to terminate or to recall the agreement.

The purpose of notice is to satisfy due process by giving the SECOND PARTY the opportunity to be heard, to
256explain their position and side on the alleged violation and also chance rectify the alleged violation, if there is any.

Withal it is humbly recommended that a resolution be issued advising the LCE not to immediately proceed with the
259plan immediately terminating the MOA, and advising also the LCE, with all due respect, that latter should issue first a
260notice notifying the SECOND PARTY of their alleged violation/s and give them first the opportunity to be heard and to
261explain their position.

The LCE should also be advised to inform the SB whatever development might arise after notifying the SECOND
264PARTY, and in the event that the SECOND PARTY will fail to rectify the alleged violation, then that will be the time for
265this SB to issue the corresponding authority for the LCE to proceed with the termination of the agreement.
