SEC. 7. The members of the Board of Trustees shall serve without compensation other than a per diem of one
hundred pesos each per session of the Board and that expenses incurred either in attendance upon meetings of the
Board or upon other official business shall be reimbursed as authorized by resolution thereof, subject to existing
budget laws on honoraria and allowances.
SEC. 8. In addition to its general powers of administration, the Board of Trustees shall have the following powers and
duties:
(a) To receive and appropriate for the purposes specified by law such sums as may be provided for the support of the
College;
(b) To confer degrees upon successful candidates for graduation of the College. It may also confer the usual honorary
degrees upon persons in recognition of learning, statesmanship or eminence in science, agriculture, forestry, industry
or public service related to such fields;
(c) Subject to Civil Service Law, rules and regulations, to appoint, upon recommendation of the President of the
College, the registrar, the deans of the different schools of the College, the heads of departments, professors,
instructors, lecturers and other employees of the College and to fix their compensation, subject to Presidential Decree
No. 985 and other pertinent budget and compensation laws; to prescribe hours of service, duties and the conditions
of work as it may deem proper; to grant to them, in its discretion, leave of absence under such regulations as it may
promulgate, any provision of law to the contrary notwithstanding, and to remove them for cause after investigation and
hearing pursuant to Civil Service law governing disciplinary action;
(d) To approve the curricula and rules of discipline drawn up by the College Council as hereinafter provided;
(e) To provide fellowships and scholarships for deserving faculty members and students;
(f) To prescribe rules for its own government and for this purpose, to enact such regulations not contrary to law, as
may be necessary;
(g) To receive in trust legacies, gifts and donations of real and personal property of all kinds and to administer the
same for the benefit of the College or of a department thereof, or for aid to any student in accordance with the
directions and instructions of the donors, and in default thereof, in such manner as the Board of Trustees may in its
discretion determine;
(h) To provide vocational training and retraining of adult citizens and out-of-school youths; and
(i) To name after prominent Filipinos or heroes any building, annex, ground, or branch of the College.
SEC. 9. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time the
meeting of the Board is called. All processes against the Board of Trustees shall be served on the President or
Secretary thereof.
SEC. 10. On or before the fifteenth day of June each year, the Board of Trustees shall submit to the President of the
Philippines a detailed report, setting forth the program, condition, and needs of the College.
SEC. 11. There shall be a College Council composed of the President of the College as chairman and the faculty of
the College who teach collegiate courses as members. The council shall have the power to prescribe the curricula
and rules of discipline, subject to the approval of the Board of Trustees. It shall fix the requirements for admission to
the College, as well as for graduation and the conferring of degrees, subject to review by the Board of Trustees. The
council alone shall have the power to recommend students or others to be recipients of degrees. Through the
President of the College or a duly authorized committee, the council shall have disciplinary power over the students
within the limits prescribed by the rules of discipline.
SEC. 12. The body of instructors and professors of the College shall constitute the faculty of the College, with the
President of the College as the presiding officer.
No member of the faculty of the College shall attempt directly or indirectly, under penalty of dismissal by the Board of
Trustees, to influence students or employees of the College towards any ideology, political or otherwise, which
preaches the overthrow of the government through violence or subversion.
SEC. 13. There shall be a secretary of the College who shall be appointed by the Board of Trustees upon
recommendation of the President of the College. He shall be the secretary of the Board and also of the College, and
shall keep the records of the College as may be determined by the Board of Trustees.
SEC. 14. The Treasurer of the Philippines shall be ex officio treasurer of the College. All accounts and expenses
therefor shall be audited by the Commission on Audit and all disbursements shall be made in accordance with
existing auditing rules and regulations.
SEC. 15. Heads of bureaus and offices of the national government are hereby authorized to loan or transfer, upon
request of the President of the College, such apparatus, equipment or supplies as may be needed by the College and
to detail employees for duty therein when in the judgment of the head of the bureau or office, such apparatus,
equipment, supplies or the services of such employees can be spared without serious detriment to the public service.
Employees so detailed shall perform men duty as is required under such detail, and the time so employed shall be
counted as part of their regular official service.
SEC. 16. The requirements provided in this Act as may prove adverse to the present faculty and employees of the
Lagangilang Agricultural College who may be absorbed by the Abra State Institute of Sciences and Technology shall
not apply to them, except for the position of the President of the College who shall be appointed by the President of
the Philippines upon the recommendation of the Board of Trustees. The Board shall nominate the best man in the
Ilocos, particularly in Abra, who has the best qualifications, both in education, training and experience to be
recommended as President of the College. Future appointees to the said College shall be subject to all the
requirements provided in this Act.
SEC. 17. All parcels of land, buildings, equipment and facilities owned by the Lagangilang Agricultural College, as
well as all obligations and appropriations thereof, shall be transferred to the Abra State Institute of Sciences and
Technology. The necessary sum for the operation and maintenance of the new state college shall be provided for in
subsequent General Appropriations Acts, until which time the operation of the institution as an institute shall be
deferred, provided that its new name shall take effect upon approval of this Act.
SEC. 18. This Act shall take effect upon its approval.

Romblon Agricultural College. Of the first group appointed, the President of the Philippines shall designate one to
serve for one year, one to serve for two years, one to serve for three years, and one to serve for four years.
Thereafter, persons appointed to succeed such members shall hold office for a term of four years and until their
successors who should be experts in the same field shall have been appointed and qualified. In case of permanent
vacancy, the position shall be filled by appointment by the President of the Philippines. Such appointee shall hold
office for the unexpired term only.
When the Minister of Education, Culture and Sports is unable to perform his duties as chairman of the board due to
illness, absence or other cause, or in case of a vacancy in the office, the Deputy Minister of Education, Culture and
Sports shall temporarily perform the functions of the chairman of the said board. The chairman may assign qualified
officials to represent him with full authority in the board.
SEC. 7. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time a
meeting is called. All processes against the Board of Trustees shall be served on the president or secretary thereof.
SEC. 8. The members of the Board of Trustees shall be entitled to an allowance of cue hundred pesos per meeting
actually attended but not more than three hundred pesos a month: Provided, That they shall be reimbursed for actual
and necessary expenses incurred either in attendance upon meetings of the Board or upon other official business
authorized by resolution of the Board, subject to existing budget laws on honoraria and allowances.
SEC. 9. The Board of Trustees shall have the following powers and duties in addition to its general powers of
administration, and the exercise of all the powers of a corporation as provided in Section 36 of Batas Pambansa Blg.
68, otherwise known as the Corporation Code of the Philippines:
(a) To receive and appropriate for the purposes specified by law such sums as may be provided for the support of the
Romblon State College;
(b) To confer degrees upon successful candidates for graduation of the Romblon State College. It may also confer
honorary degrees upon persons in recognition of learning, statesmanship or eminence in any of the fields of
specialization of the Romblon State College, or in recognition of public service: Provided, That such degrees shall not
be conferred in consideration of or to reciprocate some personal favor;
(c) To authorize the President of the Romblon State College to award proficiency certificates or diplomas to students
who have completed non-degree courses;
(d) To appoint, on recommendation of the President of the Romblon State College, a vice-president, deans, directors,
secretary of the Romblon State College, registrar, heads of departments, professors, instructors, lecturers and other
officials and employees of the Romblon State College; to fix their compensations, subject to Presidential Decree No.
985 and other pertinent budget and compensation laws; hours of service, and such other duties and conditions as it
may deem proper, to grant to them at its discretion, leave of absence under such regulations as it may promulgate,
any provisions of existing law to the contrary notwithstanding, to remove them for cause after an investigation and
hearing; to establish Chairs in the College, and to provide for the maintenance or endowment of such Chairs as may
be necessary;
(e) To approve the curricula and rules of discipline drawn by the College Council as hereinafter provided;
(f) To provide fellowships for qualified faculty members and scholarships to deserving students;
(g) To prescribe rules for its own government and to enact for the government of the College such rules and
regulations, not contrary to law, as may be necessary to carry out the purposes and functions of the College;
(h) To receive in trust legacies, gifts, and donations of real and personal property of all kinds, to administer the same
for the benefit of the College, or the departments thereof, or for aid to any student or students, in accordance with the
directions and instructions of the donor, and in default thereof, in such manner as the Board of Trustees may in its
discretion determine. All such donations shall be exempt from all taxes and to be considered as deductible items from
income tax of the donors; and
(i) To authorize the establishment of other branches of the College and to designate other schools of secondary levels
within the Province of Romblon: Provided, That the funds for the purpose shall come from its appropriation.
SEC. 10. On or before the fifteenth day of the second month after the opening of regular classes each year, the Board
of Trustees shall file with the Office of the President of the Philippines a detailed report, setting forth the progress,
conditions and needs of the College.
SEC. 11. There shall be a College Council consisting of the President of the College and all members of the faculty
teaching collegiate courses. The Council shall have the power to prescribe the curricula and rules of discipline,
subject to the approval of the Board of Trustees. It shall fix the requirements for admission to the College, as well as
for graduation and the conferring of degrees subject to review by the Board of Trustees. The Council alone shall have
the power to recommend students or others to be recipients of degrees. Through the President of the College or its
duly authorized committee, the Council shall have disciplinary power over the students within the limits prescribed by
the rules of discipline.
SEC. 12. The body of instructors and professors of the College shall constitute the faculty of the College.
SEC. 13. No member of the faculty of the College shall attempt directly or indirectly, under penalty of dismissal by the
Board of Trustees, to influence students or any person in the College towards any ideology, political or otherwise,
which preaches the overthrow of the government through violence or subversion.
SEC. 14. There shall be a secretary of the College who shall be appointed by the Board of Trustees upon
recommendation of the President of the College. He shall also be the secretary of the Board and shall keep such
records of the College as may be determined by the Board of Trustees.
SEC. 15. The Treasurer of the Philippines shall be the ex officio treasurer of the College, and all accounts and
expenses therefor shall be audited by the Commission on Audit or its duly authorized representatives.
SEC. 16. Heads of bureaus and offices of the national government are hereby authorized to loan or transfer, upon
request of the President of the College, such apparatus, equipment, supplies or the services of such employees as
can be spared without serious detriment to the public service. Employees so detailed shall perform such duty as
required under such detail and the time so employed shall be counted as part of their regular official service.
SEC. 17. All assets of the Romblon Agricultural College, whether fixed or movable, records and personnel, are hereby
transferred to the Romblon State College.
SEC. 18. All existing appropriations for the Romblon Agricultural College are hereby transferred to the Romblon State
College, to be disbursed in accordance with the provisions of this Act. The necessary sum for the operation and
maintenance of the new state college shall be provided for in subsequent General Appropriations Acts, until which
time the operation of the institution as a college shall be deferred, provided that its new name shall take effect upon
approval of this Act.
SEC. 19. The Minister of Education, Culture and Sports is hereby directed to take such steps as are necessary for the
immediate implementation of this Act.
SEC. 20. All laws inconsistent with the provisions of this Act are hereby repealed or amended accordingly.
SEC. 21. This Act shall take effect upon its approval.

operation of the institution as a college is deferred, provided that its new name shall take effect upon approval of this
Act.
SEC. 19. The Minister of Education, Culture and Sports is hereby directed to take such steps as are necessary for the
immediate implementation of this Act.
SEC. 20. All laws inconsistent with the provisions of this Act are hereby repealed or amended accordingly.

The powers and duties of the President of the College in addition to those specifically provided for in this Act, shall be
those usually pertaining to the office of the president of a college.
SEC. 6. The Board of Trustees snail be the governing body of the College to be composed of the Minister of
Education, Culture and Sports, chairman; Ministry of Education, Culture and Sports, Regional Director, Region VI,
vice-chairman; representative of the National Economic and Development Authority (NEDA), member; President of
the College, member; president of the alumni association of the College, member; and two members to be appointed
by the President of the Philippines upon recommendation of the Minister of Education, Culture and Sports.
The first group of appointive trustees shall serve for two (2) years and four (4) years, respectively. Thereafter, the
appointees shall hold office for a term of four (4) years. In case of permanent vacancy, the appointee shall hold office
for the unexpired term only.
In the absence of the Minister of Education, Culture and Sports, the Minister shall authorize a representative,
preferably the Deputy Minister or at least a director, to sit in the meetings of the Board: Provided, however, That
during these meetings the Regional Director of the Ministry of Education, Culture and Sports, Region VI, shall preside
as vice-chairman of the Board.
When the Minister of Education, Culture and Sports is unable to perform his duties as chairman of the Board due to
illness, absence or other cause, or in case of vacancy in the office, the Deputy Minister of Education, Culture and
Sports shall temporarily perform the functions of the chairman of the said Board. When both the Minister and the
Deputy Minister of Education, Culture and Sports are unable to exercise the powers of the chairman of the Board of
Trustees, the members of the Board shall elect from among themselves a temporary chairman who shall act as
chairman thereof.
SEC. 7. The members of the Board of Trustees shall be entitled to a per diem for every meeting attended subject to
pertinent budget laws, rules, and regulations on compensation, honoraria, and allowances: Provided, That they shall
be reimbursed for actual and necessary expenses incurred either in attendance upon meetings of the Board or upon
other official business authorized by the resolution of the Board subject to the aforementioned laws, rules and
regulations on compensation.
SEC. 8. In addition to its general powers of administration, the Board of Trustees shall have the following powers and
duties:
(a) To receive and appropriate for the purpose specified by law such sums as may be provided for the support of the
College;
(b) To confer degrees upon successful candidates for graduation of the College. It may also confer honorary degrees
upon persons in recognition of learning, statesmanship, or eminence in science, industry, trade, technology or public
service related to such fields;
(c) To appoint, upon recommendation of the President of the College, the vice-president, the deans of the different
schools of the College, the secretary, the registrar, the heads of departments, supervisors, professors instructors,
lecturers and administrative personnel, based on demonstrated ability, scholarship, research studies made, and
educational qualifications. To prescribe hours of service, duties and the conditions of work as it may deem proper; to
grant to them in its discretion, leave of absence under such regulations as it may promulgate, any provisions of law to
the contrary notwithstanding, and to remove them for cause after an investigation and hearing pursuant to civil service
law governing disciplinary action;
(d) To approve the curricula and rules of discipline drawn up by the College Council as hereinafter provided;
(e) To provide fellowships and scholarships for deserving faculty members and students;
(f) To prescribe rules for its own government and for this purpose, to enact such regulations not contrary to law, as
may be necessary;
(g) To receive in trust legacies, gifts and donations of real and personal property of all kinds and to administer the
same for the benefit of the College or of a department thereof, or for aid to any student in accordance with the

(h) To appropriate funds for research and development projects such as tools, machines, equipment, and new
products and the publication of research studies made and books written by the faculty members of the College;
(i) To provide non-formal education to adult citizens and out-of-school youth; and
(j) To name after prominent Filipinos or heroes any hall, building, annex, ground, or branch of the College.

SEC. 17. All parcels of land, buildings, equipment and facilities owned by the Iloilo School of Arts and Trades, as well
as all obligations and appropriations thereof, shall be transferred to the Western Visayas College of Science and
Technology.
SEC. 18. The existing appropriations for the Iloilo School of Arts and Trades are hereby transferred to the Western
Visayas College of Science and Technology, to be disbursed in accordance with the provisions of this Act. Thereafter,
the necessary amount required for the operation and maintenance of the new state college shall be provided for in
subsequent General Appropriations Acts, until which time the operation of the institution as a college shall be deferred
provided that its new name shall take effect upon approval of this Act.
SEC. 19. This Act shall take effect upon its approval.

Pambansa Blg. 230 for the Ministry of Health intended for new or expanded hospitals. Thereafter, such sum as may
be necessary for its operation and maintenance shall be included in the annual General Appropriations Act.
SEC. 4. This Act shall take effect upon its approval.

"SEC. 19. Duty to have license.Except as otherwise specifically provided in this Act, it shall be unlawful for any
person to operate any motor vehicle without having in his possession a valid license to drive a motor vehicle.
"The license shall be carried by the driver at all times when operating a motor vehicle, and shall be shown and/or
surrendered for cause and upon demand to any person with authority under this Act to confiscate the same."
SEC. 2. Section twenty of the same Act is hereby
SEC. 3. Section twenty-two of the same Act is hereby amended to read as follows:
"SEC. 22. Application for driver's license, fees, examination.Every person who desires to personally operate any
motor vehicle shall file an application to the Director or his deputies for a license to drive motor vehicles: Provided,
however, That no person shall be issued a professional driver's license who is suffering from contagious diseases,
such as tuberculosis, sexually transmitted diseases and epilepsy or who is an alcohol or drug addict or dependent.
"Each such application, except in the case of enlisted men operating government-owned vehicles, shall be
accompanied by a fee of five pesos, and shall contain such information respecting the applicant and his ability to
operate motor vehicles, as may be required by the Bureau.
"The Director or his deputies shall also ascertain that the applicant's health, sight and hearing are sound and normal,
and is physically and mentally fit to operate motor vehicles. To this end, the Director or his deputies shall require a
certificate to that effect, signed by a reputable accredited physician.
"An examination, theoretical and practical, to determine every applicant's ability and fitness to operate motor vehicles
to be conducted by the Director in such form and manner as he shall prescribe shall also be required. A manual
containing the general scope of the examinations and such information as may be necessary for the guidance of the
applicants and for the purpose of effectivity and implementation of this Act may be published in an official language
and distributed at no cost to the applicants.
"No application for a driver's license shall be received, unless the applicant:
"(1) For a professional driver's license, is at least eighteen years of age, possesses a valid student-driver's permit and
has undergone instruction in the operation of motor vehicles for at least five months under a qualified
instructor: Provided, however, That the period of time the applicant has operated a motor vehicle with a nonprofessional driver's license shall be credited against the period of instruction required herein; and
"(2) For a non-professional driver's license, is at least seventeen years of age, possesses a valid student-driver's
permit and has undergone instruction in the operation of motor vehicles for at least a month."
"SEC. 23. Issuance of driver's license, fees and validity. If after such examination, the Director or his deputies find
that the applicant possesses the necessary qualification and proficiency in the operation of motor vehicles, is able to
read and write any of the official languages or a major dialect and knows how to read and interpret various traffic
signs, signals and road markings, a professional or non-professional license may be issued to such applicant upon
payment of the fee prescribed in accordance with law, but prior to the issuance of said license, the applicant shall
present himself in person and have his photograph taken by the Bureau. All driver's licenses issued shall be signed in
the presence of the Director or his deputies and shall bear, among others, the full name, date of birth, height, weight,
sex, color of eyes, blood type, complete current address, right hand thumbprint of the licensee, license number, and
its date of issue and expiration.
"In the issuance of licenses, the Bureau shall use such process or adopt such measure as will prevent any alteration
or falsification of a license or will enable the Bureau to detect any unauthorized license.
"Except for student permits and new licenses, all driver's licenses shall be valid for three consecutive years reckoned
from the birthdate of the licensee, unless sooner revoked or suspended: Provided, however, That, subject to Section
twenty-six hereof, any holder of a professional or non-professional driver's license who has not committed any
violation during the three-year period shall be entitled to a renewal of such license for a five-year period."
SEC. 5. Section twenty-four of the same Act is hereby amended to read as follows:
"SEC. 24. Use of driver's license and identification card.Every license issued under the provisions of this Act to any
driver shall entitle the holder thereof, while the same is valid and effective, to operate motor vehicles described in
such license: Provided, however, That every licensed professional driver, before operating a public utility vehicle
registered under classification (b) of Section seven hereof, as amended by Batas Pambansa Bilang 74, shall secure
from the Director, upon payment of the sum of five pesos, a driver's identification card which he shall, at all times
while so operating a public utility vehicle, display in plain sight in the vehicle being operated. The identification card
shall be issued simultaneously with the license.
"It shall be unlawful for any duly licensed driver to transfer, lend or otherwise allow any person to use his license for
the purpose of enabling such person to operate a motor vehicle.
"No owner of a motor vehicle shall engage, employ, or hire any person to operate such motor vehicle, unless the
person sought to be employed is a duly licensed professional driver."
SEC. 6. Section twenty-six of the same Act is hereby amended to read as follows:
"SEC. 26. Renewal or replacement of lost license. Any license not renewed on or before the last working day prior
to the expiry date of such license as provided for in the third paragraph of Section twenty-three of this Act shall
become delinquent and invalid, except when the license is surrendered to the Director or his deputies on or before the
last working day prior to the expiry date of such license as hereinabove specified in order to avoid payment of the
delinquency fees.
"For a renewal of a delinquent license, there shall be collected as delinquency fee, in addition to the basic fee as
prescribed, an amount equivalent to fifty per cent of said basic fee.
"Every applicant for renewal of license to operate any motor vehicle shall present to the Director or his deputies, in
person, the license issued to the applicant for the previous period, together with the basic fee hereinabove prescribed,
and, in the case of professional drivers, three copies of a readily recognizable photograph of the applicant taken by
the Bureau. In case the applicant for renewal has committed three or more offenses within a period of one year, or
has suffered any injury or illness that impairs his ability to operate motor vehicles, he shall be required to undergo a
theoretical and practical examination in order to determine his ability and fitness to operate motor vehicles.
"Lost License.In case the license has been lost or cannot be produced, the licensee shall apply for a duplicate of
the original on file with the Bureau by filing a sworn statement that such license has been lost and that a thorough and
diligent search was futile and in accordance with the procedure which the Director is hereby authorized to promulgate,
subject to the approval of the Minister of Transportation and Communications.
"The Director or his deputies are hereby authorized to administer the oath in connection with such application."
SEC. 7. Section twenty-seven of the same Act is hereby amended to read as follows:
"SEC. 27. Authority to suspend, revoke and reinstate driver's license.Without prejudice to the authority of the court
in appropriate cases and except as herein otherwise provided, the Director shall have exclusive power and authority
to suspend or revoke for cause any driver's license issued under the provisions of this Act.
"(a) The Director may suspend for a period not exceeding three months or, after hearing, revoke any driver's license
and may order such license, whether confiscated by, and/or in the possession of, any other law enforcement agencies
deputized in accordance with paragraph (d) (I) of Section four of this Act or not to be delivered to him whenever he
has reason to believe that the holder thereof is an improper person to operate motor vehicles, or in operating or using
a motor vehicle in, or as an accessory to, the commission of any crime or act which endangers the Public. Any deputy
of the Director may, for the same cause, suspend for a period not exceeding three months any driver's license issued
under the provisions of this Act: Provided, that such suspension may be "appealed to the Director who may, after
reviewing the case, confirm, reverse or modify the action taken by such deputy.
"(b) Whenever during any twelve-month period a driver shall have been convicted at least three times for the
violations of any provisions of this Act or of any regulations issued by the Director or any municipal or city ordinance
relating to motor vehicle traffic not in conflict with any of the provisions of this Act, the Director may revoke or suspend
the license of such driver for a period not exceeding two years.
"(c) The license suspended or revoked under the provisions of subsections (a) and (b) of this section shall not be
reinstated by the Director, unless the driver has furnished a bond in accordance with Section twenty-nine of this Act
and only after the Director has satisfied himself that such driver may again safely be permitted to operate a motor
vehicle.
"(d) A decision of the Director revoking or refusing the reinstatement of a license under the provisions of this section
may be appealed to the Minister of Transportation and Communications."
SEC. 8. Section twenty-eight of the same Act is hereby amended to read as follows:
"SEC. 28. Driver's bond.The Director before reinstating any driver's license which has been suspended or revoked
under the provisions of the preceding section or of any provisions of this Act, may require such driver to post a bond in
the sum of five thousand pesos conditioned upon the satisfaction and payment of any claim which may be filed or of
any execution which may be issued against such driver in any case wherein said driver may be held answerable while
operating motor vehicles. The bond required in this section shall be in such form as to render sureties liable at least
for a period of not less than one year nor more than three years: Provided, however, That upon written application to
the Director for release from such bond, the Director may, after revoking or suspending the driver's license, authorize
the release of the bondsmen. from further responsibility thereunder:Provided, further, That should the Director decide
not to revoke the license of a driver who has been convicted of homicide through reckless imprudence, or of the
violation of the speed limit or of reckless driving at least three times within a twelve-month period, the said driver shall
post a bond in the sum of not less than ten thousand pesos, conditioned upon the payment of any claim which may be
filed or any execution which may be issued against him in any case wherein said driver may be held answerable while
operating motor vehicles."
SEC. 9. Section twenty-nine of the same Act is hereby amended to read as follows:
"SEC. 29. Confiscation of driver's license.Law enforcement and peace officers of other agencies duly deputized by
the Director shall, in apprehending a driver for any violation of this Act or of any regulations issued pursuant thereto,
or of local traffic rules and regulations not contrary to any provisions of this Act, confiscate the license of the driver
concerned and issue a receipt prescribed and issued by the Bureau therefor which shall authorize the driver to
operate a motor vehicle for a period not exceeding seventy-two hours from the time and date of issue of said receipt.
The period so fixed in the receipt shall not be extended, and shall become invalid thereafter. Failure of the driver to
settle his case within fifteen days from the date of apprehension will be a ground for the suspension and/or revocation
of his license."
SEC. 10. Section thirty of the same Act is hereby amended to read as follows:
"SEC. 30. Student-driver's permit.Upon proper application and the payment of the fee prescribed in accordance
with law, the Director or his deputies may issue student-drivers permits, valid for one year to persons not under
sixteen years of age, who desire to learn to operate motor vehicles.
"A student-driver who fails in the examination on a professional or non-professional license shall continue as a
student-driver and shall not be allowed to take another examination at least one month thereafter. No student-driver
shall operate a motor vehicle, unless possessed of a valid student-driver's permit and accompanied by a duly licensed
driver.
"The licensed driver duly accredited by the Bureau, acting as instructor to the student-driver, shall be equally
responsible and liable as the latter for any violation of the provisions of this Act and for any injury or damage done by
the motor vehicle on account or as a result of its operation by a student-driver under his direction."
SEC. 11. Section thirty-two of the same Act is amended to read as follows:
"SEC. 32. (a) Exceeding registered capacity, issuance of conductor's license, validity and fee.No person operating
any motor vehicle shall allow more passengers or more freight or cargo in his vehicle than its registered carrying
capacity. In the case of public utility trucks or buses, the conductor shall be exclusively liable for violations of this
section or of Section thirty-two, letter (c) hereof: Provided, That the conductor before being employed by any public
service operator shall get a permit or license from the Bureau and pay the fee prescribed in accordance with law, for
said license or permit issued in his favor, which shall be valid for three years, and the same is renewable on or before
the last working day prior to or on his birthdate, attaching a readily recognizable photograph taken by the Bureau and
after presentation of a medical certificate of fitness of applicant.
"Passenger trucks may be allowed to construct any cargo-carrying device at the rear or at the side of the truck,
subject to the approval of the Director: Provided, however, That the total weight of the device, including tie cargo, shall
not exceed one hundred kilos.
"(b) Carrying of passengers and freight on top of vehicles.No person operating a motor vehicle shall allow any
passenger to ride on the cover or top of such vehicles: Provided, however, That, subject to such conditions, as maybe
contained in permits that may be issued by the Director, baggage or freight may be carried on the top of a truck so
long as the weight thereof does not exceed twenty kilos per square meter and is distributed in such a manner as not
to endanger the passengers or stability of the truck.
"(c) Riding on running boards.No driver shall allow any person to ride on the running board, step board, or
mudguard of his motor vehicle for any purpose while the vehicle is in motion."
SEC. 12. Section fifty-six of the same Act is amended to read as follows:
"SEC. 56. Penalty for violation.The following penalties shall be imposed for violations of this Act:
"(a) For registering later than seven days after acquiring title to an unregistered motor vehicle or after conversion of a
registered motor vehicle requiring larger registration fee than that for which it was orginally registered, or for a renewal
of a delinquent registration, the penalty shall be a fine of fifty per cent of the registration fees corresponding to the
portion of the year for which the vehicle is registered for use.
"(b) For failure to sign driver's license or to carry same while driving, one hundred pesos fine.
"(c) Driving a vehicle with a delinquent or invalid driver's license, two hundred pesos fine or imprisonment not
exceeding ten days, at the discretion of the court.
(d) Driving a motor vehicle with delinquent, suspended or invalid registration, or without registration or without the
proper license plate for the current year, three hundred pesos fine or imprisonment not exceeding fifteen days, at the
discretion of the court.
"(e) Driving a motor vehicle without first securing a driver's license, five hundred pesos fine and imprisonment or not
exceeding fifteen days.
"(f) Driving a motor vehicle while under the influence of liquor or narcotic drug, a fine of not less than one thousand
pesos or imprisonment of not less than three nor more than six months, or both, at the discretion of the court.
"(g) Violation of Sections thirty-two, thirty-four (a), (b), and (b-1), thirty-five and forty-six, a fine not exceed-ing one
hundred pesos: Provided, however, That in the case of violation of Section thirty-four (b) the vehicle or vehicles
affected may not be allowed to operate, unless the requirement provided in this section are complied with.
"(h) Violations of Sections forty-nine, fifty-one, and fifty-two, a fine of not less than twenty-five pesos nor more than
fifty pesos.
"(i) For using or attempting to use a driver's license, identification card, certificate of registration, number plate, tag or
permit in similitude of those issued under this Act, or falsely or fraudulently representing as valid and in force any
driver's license under this Act which is delinquent or which has been suspended or revoked, a fine of not less than
one thousand nor more than three thousand pesos or imprisonment of not more than six months, or both, at the
discretion of the court.
"For making, manufacturing, distributing or selling a driver's license, identification card, certificate of registration,
number plate, tag or permit in imitation or similitude of those issued under this Act, the penalties under the provisions
of the Revised Penal Code.
"If the violation is committed by a public officer or employee, the offender shall furthermore suffer perpetual absolute
disqualification.
"(j) For using private passenger automobiles, private trucks, private motorcycles, and motor wheel attachments for
hire, in violation of Section seven, subsections (a), (b), and (c), of this Act, a fine of two hundred pesos and
suspension of driver's license for a period of three months for the first conviction; a fine of three hundred pesos and
six
months imprisonment for the second conviction; and an imprisonment of one year and permanent revocation of the
driver's license for the third conviction.
"(k) For permitting, allowing, consenting to, or tolerating the use of privately-owned motor vehicles for hire in violation
of Section seven, subsection (a), (b), and (c), of this Act, there shall be imposed upon the owner of the vehicle a fine
of five hundred pesos and the certificate of registration shall be suspended for a period of three months for the first
conviction, and an increase of one hundred pesos in the fine and one month's suspension of the registration for each
subsequent conviction.
"(l) For violation of any provisions of this Act or regulations promulgated pursuant hereto, not hereinbefore specifically
punished, a fine of not less than one hundred nor more than five hundred pesos shall be imposed.
"(m) In the event an offender cannot pay any fine imposed pursuant to the provisions of this Act, he shall be made to
undergo subsidiary imprisonment as provided for in the Revised Penal Code.
"(n) If, as the result of negligence or reckless or unreasonable fast driving, any accident occurs resulting in death or
injury of any person, the motor vehicle operator at fault shall, upon conviction, be punished under the provisions of the
Revised Penal Code."
SEC. 13. The fees and charges herein provided as well as those provided in other sections of the same Act may be
revised by the Minister of Transportation and Communications, upon the recommendation of the Director, subject to
the approval of the Cabinet. Such fees and charges shall be revised at just and reasonable rates sufficient to cover
administrative costs and, whenever practicable, be uniform for similar or comparable services and functions.
SEC. 14. For purposes of simplicity, economy and efficiency in operations and implementation, the Director, subject to
the approval of the Minister of Transportation and Communications, is hereby authorized to promulgate rules and
regulations for the rational and equitable issuance and renewal of licenses during the first three years following the
effectivity of this Act, including the limitation of the validity of the licenses issued during the said period. Accordingly,
the Director shall proportionately reduce the fees corresponding to the period of validity of the driver's license.
SEC. 15. This Act shall take effect upon its approval.

"SEC. 46. Relating to School Property.Real property, such as lands, buildings and other improvements thereon
used actually, directly and exclusively for educational purposes, shall be subject to the real property tax based on an
assessment of fifteen percent of the market value of such property: Provided, That all the proceeds from the payment
thereof shall accrue to a special private education fund which shall be managed and disbursed by a local private
school board which shall be constituted in each municipality or chartered city with private educational institutions with
the mayor or his representative as chairman and not more than two representatives of the institutional taxpayers, and,
likewise, not more than two residents of the municipality or chartered city who are alumni of any of the institutional
taxpayers as members: Provided, finally, That in municipalities or chartered cities wherein the number of private
institutions with individual enrolment of pupils and students over five thousand exceeds fifteen, the members of the
private school board shall be increased to not more than fourteen members determined proportionately by the
Minister of Education, Culture and Sports The private school board shall adopt its own rules which shall enable it to
finance the annual programs and projects of each institutional taxpayers for the following purposes: student-pupil
scholarships; improvement of instructional, including laboratory, facilities, and/or equipment; library books and
periodicals acquisition; and extension service in the community, in that order of priority."
SEC. 2. This Act shall take effect upon its approval.
(b) It shall have the power to acquire public lands for its expansion and/or beneficial use; and to purchase equipment,
laboratory and library facilities which are required to carry out its educational objectives. It shall offer undergraduate
courses in liberal arts, engineering, fisheries, agriculture, and short-term vocational courses for development of
middle level skills within the first five years from the approval of this Act; and may, at the discretion of the Board, offer
graduate courses thereafter;
(c) It shall be authorized to undertake the construction of its buildings and other permanent improvements from such
sums as may be necessary for the purpose, and included in the annual General Appropriations Act in the name of the
East Visayan School of Arts and Trades, the Guihulgan Vocational High School, and the Bais School of
Fisheries: Provided, That the construction of its buildings and other permanent improvements, as authorized in the
Public Works Act of the Government, shall be undertaken by the College as herein provided, any provision of existing
laws to the contrary notwithstanding.
SEC. 5. The Governing Board; Manner of Appointment.(a) CompositionThe governing body of the College is
vested in a Board of Trustees which shall be composed of nine members, five of whom are regular members and four
are ex officio members. The regular members must be Filipino citizens and residents of the Philippines, two of whom
shall be well known educators in the Region, two shall be successful businessmen or professionals of the Region who
have shown and are showing interest in the cause of education in the Region, and one shall be a successful alumnus
of any of the schools to be incorporated with and integrated into the College, upon recommendation of its alumni
association, and who will be replaced in due time, when available, by a successful alumnus of the College and upon
recommendation of its alumni association when this shall have been organized. The four ex officio members shall be
the Minister of Education, Culture and Sports who shall be the ex officio Chairman of the Board, the Regional
Director of the Ministry of Education, Culture and Sports, Region VII, the Director, Bureau of Higher Education,
Ministry of Education, Culture and Sports, and the President of the College.
The regular members of the Board of Trustees, who shall serve a term of four years, shall be appointed by the
President of the Philippines. Of the five regular members of the Board to be first appointed as above provided, the
President of the Philippines shall designate two to serve for two years, two to serve for three years, and one to serve
for four years.
In the absence or inability of the Minister of Education, Culture and Sports the other Members of the Board shall elect
from among themselves a temporary chairman who shall act as Chairman. In case of a vacancy in the regular
membership of the Board, the President of the Philippines shall appoint a new member to serve for the unexpired
term only.
No person in the employ of the College or any other educational institution in the Region, except the President of the
College shall be eligible for membership in the Board.
The regular members of the Board shall each receive, for every board meeting attended, a per diem of one hundred
pesos: Provided, That in no case shall the total amount received by each exceed the sum of three hundred pesos for
any one month. Besides the per diem, they and the ex officio members, shall be reimbursed for actual and necessary
expenses incurred in attendance upon meetings of the Board or upon performing other official business authorized by
resolution of the Board, subject to existing budget laws on honoraria and allowances.
(b) QuorumA quorum of the Board shall consist of a majority of all the members holding office at the time the
meeting of the Board is called. All processes against the Board of Trustees shall be served on the chairman or
secretary thereof.
(c) Powers and Duties of the Board.The Board of Trustees shall have the folio-wing powers and duties in addition to
its general powers of administration and the exercise of the powers of the corporation:
(1) To determine and fix the dates and time of their regular meetings, as well as special meetings as the need for the
same may arise: Provided, That such meetings shall not be more than three times in any one month, nor less than
one time in any one quarter;
(2) To recommend to the President of the Philippines candidates for the Presidency of the College who shall serve for
a term of six years and who may be reappointed for another term not exceeding six years;
(4) To receive and appropriate to the ends specified by law such sums as may be provided by law for the support of
the College;
(5) To receive in trust legacies, gifts, and donations of real and personal property of all kinds and to administer the
same for the benefit of the College or of a department thereof, or for aid to any student or students in accordance with
the desire of the donor, and/or in default thereof, in such manner as the Board may in its discretion determine; all such
donations shall be exempt from the income tax of the donors; to import duty-free commodities for educational
purposes as an exception to existing laws;
(6) To appoint, upon the recommendation of the President of the College, vice presidents, directors, deans, secretary
of the College, treasurer, professors, lecturers, instructors, registrar, department heads, division chiefs, and other
employees of the College from among the qualified personnel of the merged schools at the time this Act is approved.
Only when there are no qualified personnel shall the Board recruit from the outside to fill vacancies;
(7) To fix the compensation and term of service of all personnel and such other duties and conditions as it may deem
proper, subject to Persidential Decree No. 985 and other pertinent budget and compensation laws, rules and
regulations;
(8) To approve the courses of study and rules of discipline drawn up by the College and fix the required tuition fees,
matriculation fees, fees for laboratory courses, diploma fees, and all special and other fees; and to utilize the income
derived therefrom for the maintenance of the College, together with the annual appropriation provided for in Section
seventeen hereof;
(9) To provide fellowships to qualified faculty members and scholarships to deserving students;
(10) To establish Chairs in the College and provide for the maintenance and endowment of such Chairs;
(11) To confer honorary degrees upon persons other than graduates of the College in recognition of learning,
statesmanship or eminence in education, sciences, or arts: Provided, That such degrees shall not be conferred in
consideration of the payment of money or other valuable consideration; and
(12) To submit an annual report to the Minister of Education, Culture and Sports within two weeks after the close of
each school year, about the performance of the College in the school year just ended, its progress, needs and
problems.
SEC. 6. The Administration.The administration of the College shall be vested in the President of the College who
shall render full time service.
The College President shall be appointed by the President of the Philippines, upon the recommendation of the Board.
He shall be assisted by a Vice President for Academic Affairs who shall be appointed by the Board upon the
recommendation of the College President. His compensation shall be fixed by the Board.
SEC. 7. Powers of the President.The powers and duties of the President, in addition to those which are usually
exercised by college presidents which are not inconsistent with the provisions of this law, are the following:
(a) To recommend to the Board of Trustees for appointment, a vice president, deans, professors, instructors,
lecturers, and other employees of the College;
(b) To promulgate for the government of the College such general ordinances and regulations, not contrary to law, as
are consistent with the purposes of the College; and
(c) To suggest to the Chairman of the Board special meetings of the Board when the need arises.
SEC. 8. The Secretary of the College.The Board shall appoint a secretary who shall serve as such for both the
Board and the College, and shall keep all records and proceedings of the Board. He shall communicate to each
Member of the Board notice of meetings.
SEC. 9. The College Council Powers.There shall be a College Council, under the chairmanship of the President of
the College consisting of faculty members with the rank of dean, professor, associate professor, and assistant
professor. Subject to existing laws and orders, the Council shall have the power to prescribe the courses of study and
rules of discipline; fix the requirements for admission to the College; serve as advisory council to the President; and
through a tribunal of not more than live members elected by the members, the Council, administers disciplinary
measures among the student body and faculty of the College.
SEC. 10. College Centers.The President shall organize the following centers whose staff shall be selected among
the members of existing faculty whose heads shall be known as Director of the Center:
(a) Research and Planning Center.The Research and Planning Center is charged with the responsibility of
coordinating all researches of the College and planning for its expansion and development in line with the philosophy
of the College and the national goals of the Republic of the Philippines.
(b) Guidance and Counseling Center.It shall be the duty of the Center to provide counseling and guidance
programs for the faculty, student and employees of the College.
(c) Student Service Center.It shall be the duty of the Center to look after the interest of the student body, provide
them with facilities for development and organize them into social action groups to help in countryside development.
SEC. 11. The Officers of Administration.The Officers of the Administration of the College are the President, the Vice
President for Academic Affairs, the Deans of the different colleges, the Secretary of the College, Center Directors,
and College Treasurer.
SEC. 12. The Faculty and Other Personnel of the College.The body of professors and instructors of each college
shall constitute its faculty. They shall be appointed by the Board of Trustees upon the recommendation of the
President of the College. In the recruitment of professors, instructors, and other personnel of the College, no religious
tests shall be required nor shall their religious opinion or affiliation be made a matter of examinatiozi or
inquiry: Provided, however, That no professor or instructor or any of its personnel shall inculcate sectarian tenets in
any of their teachings.
SEC. 13. Civil Service Requirements.Except the President and the Vice President for Academic Affairs, all
employees of the College shall be subject to the rules at the civil service. Highly technical positions may be exempt
from civil service eligibility upon approval of the Board as recommended by the President: Provided, however That all
shall be entitled to the privileges and rights of security of tenure, promotion in positions and salaries for meritorious
service, leaves and retirement benefits, as in the government service as now provided for by law.
SEC. 14. The Auditor of the College.The Commissioner on Audit of the Philippines shall be ex officio auditor of the
College and shall designate his representative who must hold regular office therein to be able to perform his duties
efficiently and satisfactorily as a regular official thereof. The designated representative shall be at least a Certified
Public Accountant with the rank of Chief of a Division in the Commission on Audit whose salary shall vary and
benefits shall be paid by the College.
SEC. 15. Loans or Transfers of Apparatus or Supplies; Detail of Employees for Duty in the College.Heads of
bureaus and offices of the National Government are hereby authorized to loan or transfer, upon request of the
President of the College, such apparatus or supplies as may be needed by the College and to detail employees for
duty therein when, in the judgment of the Bureau or Office, such supplies or employees can be spared without serious
detriment to the public service. Employees so detailed shall perform such duties as are required under such detail,
and the time so employed shall count as part of their regular service.
SEC. 16. The Board of Visitors.The President of the Philippines, the Members of the Cabinet, and the Speaker of
the Batasang Pambansa or his designated representative shall constitute a Board of Visitors of the College, whose
duty shall be to attend commencement exercises, to make visits at such other time as it may deem proper, to examine
the property, course of study, discipline, the state of finances of the College, to inspect all books and accounts of the
institution, and to make reports to the President of the Philippines upon the same, with such recommendations as it
may favor.
SEC. 17. All existing appropriations for the East Visayan School of Arts and Trades in Dumaguete City, the
Guihulgan Vocational High School in Guihulgan, and the Bais School of Fisheries at Okiot, Bais City, are hereby
transferred to the Central Visayas Polytechnic College, to be disbursed in accordance with the provisions of this Act.
The necessary sum for the operation and maintenance of the new college shall be provided for in subsequent
General Appropriations Acts, until which time the operation of the institution as a college shall be deferred, provided
that its new name shall take effect upon approval of this Act.
SEC. 18. Abolition and Transfer.The East Visayan School of Arts and Trades, the Guihulgan Vocational High
School and the Bais School of Fisheries are hereby abolished and all their personnel, unexpended appropriations,
and all their assets, fixed and movable, are transferred to the Central Visayas Polytechnic College.
SEC. 19. General Provisions. (a) The Minister of Education, Culture and Sports is hereby directed to take such
steps as are necessary for the immediate implementation of this Act. (b) All laws inconsistent with the provisions of
this Act are hereby repealed or amended accordingly.
SEC. 20. Effectivity.This Act shall take effect upon its approval.

SEC. 6. The Board of Trustees.The State College shall be governed by a Board of Trustees to be composed of the
Minister of Education, Culture and Sports as chairman and with the Regional Director of the National Economic and
Development Authority, the Vocational College Superintendent of the State College, and four (4) prominent citizens of
Region X to be appointed by the President of the Philippines as members.
Of the four appointed members, one shall be an authority in science, one in agriculture, one in arts and trades, and
one in technology. Of the first group appointed, the President of the Philippines shall designate one to serve for one
year, one to serve for two years, one to serve for three years, and one to serve for four years. Thereafter, persons
appointed to succeed such members shall hold office for a term of four years and until their successors, who should
be experts, in the same fields, shall have been appointed and qualified. In case of permanent vacancy, the position
shall be filled by appointment by the President of the Philippines. Such appointee shall hold office for the unexpired
term only.
In the event that the Minister of Education, Culture and Sports is unable to perform his duties as chairman of the
board due to illness, absence or other cause, or in case of a vacancy in the office, the Deputy Minister of Education,
Culture and Sports shall temporarily perform the functions of the chairman of the said board. The chairman may
assign qualified officials to represent him with full authority in the board.
SEC. 7. Quorum.A quorum of the Board of Trustees shall consist of a majority of all the members holding office at
the time a meeting is called. All processes against the Board of Trustees shall be served on the Vocational College
Superintendent or Secretary thereof.
SEC. 8. Allowances.The members of the Board of Trustees shall be entitled to an allowance of one hundred pesos
per meeting actually attended but not more than three hundred pesos a month: Provided, That they shall be
reimbursed for actual and necessary expenses incurred either in attendance upon meetings of the board or upon
other official business authorized by resolution of the board subject to existing budget laws on honoraria and
allowances.
SEC. 9. Powers and Duties of the Board of Trustees. The Board of Trustees shall have the following powers and
duties, in addition to its general powers of administration and its powers exercised by boards of trustees in
corporations as provided in Section 36 of Batas Pambansa Blg. 68, otherwise known as the Corporation Code of the
Philippines:
(a) To receive and appropriate for the purposes specified by law such sums as may be provided for the support of the
State College;
(b) To confer degrees upon successful candidates for graduation of the State College. It may also confer honorary
degrees upon persons in recognition of kerning, statesmanship, or eminence in any of the fields of specialization of
the State College, or in recognition of public service: Provided, That such degrees shall not be conferred in
consideration of or to reciprocate some personal favor;
(c) To authorize the Vocational College Superintendent of the State College to award proficiency certificates or
diplomas to students who have completed non-degree courses;
(d) To appoint, on recommendation of the Vocational College Superintendent of the State College, a vice president,
deans, directors, secretary of the State College, registrar, heads of departments, professors, instructors, lecturers and
other officials, and employees of the State College; to fix their compensations subject to P.D. No. 985 and other
pertinent budget and compensation laws, hours of service, and such other duties and conditions as it may deem
proper; to grant to them, in its discretion, leaves of absence under such regulations as it may promulgate, any
provision of existing law to the contrary notwithstanding; to remove them for cause after an investigation and hearing;
to establish Chairs in the State College, and provide for the maintenance or endowment of such Chairs as may be
necessary;
(e) To approve the curricula and rules of discipline drawn by the College Council as hereinafter provided;
(f) To provide fellowships for qualified faculty members and scholarships to deserving students;
(g) To prescribe rules for its own government and enact for the government of the State College such rules and
regulations, not contrary to law, as may be necessary to carry out the purposes and functions of the State College;
(h) To receive in trust legacies, gifts, and donations of real and personal property of all kinds, to administer the same
for the benefit of the State College, or the departments thereof, or for aid to any student or students, in accordance
with the directions and instructions of the donor, and in default thereof, in such manner as the Board of Trustees may
in its discretion determine. All such donations shall be exempt from all taxes and he considered as deductible items
from the income tax of the donors;
(i) To authorize the State College to undertake construction and/or repair of its buildings, machinery and equipment
and other facilities, any provision of law or executive order to the contrary notwithstanding: Provided, That the funds
for the purpose shall come from its appropriation.
SEC. 10. Progress Report.On or before the fifteenth day of the second month after the opening of regular classes
each year, the Board of Trustees shall file with the Office of the President of the Philippines a detailed report, setting
forth the progress, conditions, and needs of the State College.
SEC. 11. The College Council.There shall be a College Council consisting of the Vocational College
Superintendent of the State College and all members of the faculty with the rank of professor. The Council shall have
the power to recommend students or others to be recipients of degrees. Through the Vocational College
Superintendent of the State College or its duly authorized committee, the Council shall have disciplinary power over
the students within the limits prescribed by the rules of discipline.
SEC. 12. The Faculty.The body of instructors and professors of the State College shall constitute the faculty of the
State College.
The faculty shall be covered by appropriate civil service rules and regulations.
SEC. 13. Prohibitions.No member of the faculty of the State College shall attempt directly or indirectly, under
penalty of dismissal by the Board of Trustees, to influence students or any person in the State College towards any
ideology, political or otherwise, which preaches the overthrow of the government through violence or subversion.
SEC. 14. The Secretary of the State College.There shall be a Secretary of the State College who shall be
appointed by the Board of Trustees upon recommendation of the Vocational College Superintendent of the State
College. He shall also be the secretary of the board and shall keep such records of the State College as may be
determined by the Board of Trustees.
SEC. 15. The Treasurer of the State College.The Treasurer of the Philippines shall be ex officio treasurer of the
State College and all accounts and expenses therefor shall be audited by the Commission on Audit or its duly
authorized representative.
SEC. 16. Loans and transfers of equipment, supplies owl personnel.Heads of bureaus and offices of the national
government are hereby authorized to loan or transfer, upon request of the Vocational College Superintendent of the
State College, such apparatus, equipment or supplies as may be needed by the State College and to detail
employees for duty therein, when in the judgment of the head of the bureau or office such apparatus, equipment,
supplies or the services of such employees can be spared without serious detriment to the public service. Employees
so detailed shall perform such duty as required under such detail and the time so employed shall be counted as part
of their regular official service.
SEC. 17. Transfer of Assets and Records.All assets of the Claveria National Rural High School, whether fixed or
movable, records and personnel, are hereby transferred to the Misamis Oriental State College of Agriculture and
Technology.
SEC. 18. All existing appropriations for the Claveria National Rural High School shall be transferred to the Misamis
Oriental State College of Agriculture and Technology, to be disbursed in accordance with the provisions of this Act.
The necessary sum for the operation and maintenance of the new state college shall be provided for in subsequent
General Appropriations Acts, until which time the operation of the institution as a state college shall be deferred,
provided that its new name shall take effect upon the approval of this Act.
SEC. 19. The Minister of Education, Culture and Sports shall promulgate rules and regulations and take such steps
as are necessary for the immediate implementation of this Act.
SEC. 20. Repealing Clause.All laws inconsistent with the provisions of this Act are hereby repealed or amended
accordingly.
SEC. 21. Effectivity.This Act shall take effect upon its approval.

SECTION 1. The Sugbongcogou Municipal High School in the Municipality of Sugbongcogon, Province of Misamis
Oriental, is hereby converted into a national school to be known as the Sugbongcogon National High School. Said
school shall offer general secondary curriculum, vocational curriculum and other courses.
SEC. 2. The Minister of Education, Culture and Sports is hereby empowered to reorganize said school accordingly.
SEC. 3. The amount of one hundred thousand pesos for the operation of the school shall be funded out of the
appropriations authorized by Batas Pambansa Bilang 230 for the Ministry of Education, Culture and Sports intended
for new national high schools and an additional amount corresponding to fifty percent of its share in the budgetary aid
actually paid to it before such, conversion shall be released for its operation from the national assistance land to local
schools. Thereafter, such sum as may be necessary for its operation and maintenance shall be included in the annual
General Appropriations Act.
SEC. 4. This Act shall take effect upon its approval.

SEC. 4. The operation of said school for the current fiscal year shall continue to be funded out of local funds and from
its share of national aid to local schools. The requirements for succeeding fiscal years shall be provided in the
forthcoming General Appropriations Acts.
SEC. 5. This Act shall take effect upon its approval.

SEC. 6. The head of the Foundation College shall be the President to be appointed for a term of six years by the
President of the Philippines upon the recommendation of the Board of Trustees of the Cotabato Foundation College of
Science and Technology. The powers and duties of the President, in addition to those specifically provided for in this
Act, shall be those pertaining to the office of a president of a college. He shall coordinate, plan and implement the
policy of the Board of Trustees, and stall be assisted by two vice-presidents, one for academic affairs and the other for
administrative and land development affairs appointed by the Board of Trustees upon the recommendation of the
Foundation College President. The Vice-President for Academic Affairs shall have the immediate supervision of the
instructional and welfare program of the Foundation College. In addition, he shall act as President in the absence of
the latter. The Vice-President for Administrative and Land Development Affairs shall have direct supervision over the
administrative matters of personnel and the construction and development of the one thousand hectares of land of the
Foundation College and other duties prescribed by the Board of Trustees.
SEC. 7. The government of said Foundation College shall be vested in, and exercised by, a Board of Trustees
composed of the Minister of Education, Culture and Sports as presiding chairman, the President of the Foundation
College as vice-chairman, representative of the National Economic and Development Authority (NEDA), member, and
two (2) prominent citizens who have distinguished themselves in the professions or fields of specialization of the
College, one representing the alumni of the institution and the other chosen from prominent citizens of the province, to
be appointed by the President of the Philippines upon recommendation of the Minister of Education, Culture and
Sports, members. In the absence of some of the members of the Board, the respective alternates or authorized
representatives shall attend the meeting to constitute a quorum.
Members of the Board shall serve without compensation other than actual and necessary expenses incurred either in
attendance upon meetings of the Board or upon other official business authorized by resolution of the Board, subject
to existing budget laws on honoraria and allowances.
SEC. 8. A quorum of the Board of Trustees shall consist oi a majority of all the members: Provided, however, That
among those present are the Minister of Education, Culture and Sports who is chairman of the board, or the President
of the Foundation College, who acts as presiding officer in the former's absence. All processes against the Board of
Trustees shall be served on the President or Secretary thereof.
SEC. 9. The Board of Trustees shall have the following powers and duties in addition to its general powers:
a. To enact for the government of the Foundation College such rules and regulations not contrary to law, as may be
necessary to carry out the purposes and functions of the Foundation College, and to receive and appropriate to the
ends specified by law such sums as may be provided by law for the support of the Foundation College;
b. To confer degrees upon successful candidates for graduation, certificates for completion of non-degree programs,
awards of merit to those children and youths who graduate or show exceptional scholarship, leadership ability, manual
skills or moral conduct, and to award honorary degrees upon persons in recognition of learning, public service,
statesmanship or eminence in any field of specialization of the Foundation College;
d. To approve the curricula and rules of discipline drawn up by the administrative and academic councils hereinafter
provided;
e. To fix rules and policies in regard to foster home care, the criteria for children's admission to the Foundation
College and its functions and maintenance in addition to those specifically provided in this Act; and to fix tuition fees
and such other necessary school charges as the governing hoards may deem proper to impose;
f. To establish chairs in the Foundation College and to provide fellowships for qualified faculty members and
scholarships to deserving students for leadership and good citizenship;
g. To provide rules for the government of the Foundation College under such general ordinances and regulations not
contrary to law as are necessary in training the children for leadership and citizenship;
h. To receive in trust legacies, gifts, and donations of real and personal property of all kinds and to administer the
same for the benefit of the Foundation College or for the aid to any of the children or students in accordance with the
directions and instructions of the donor, and, in default thereof, in such manner as the Board of Trustees may in its
discretion determine; and
i. To authorize the construction or repair of its buildings, machineries, equipment and other facilities and the purchase
of necessary supplies, materials, and equipment, any provision of law to the contrary notwithstanding:Provided,
however, That the funds for the purpose shall come from the authorized appropriation of the Foundation College.
SEC. 10. On or before the fifteenth day of the second month after the opening of the regular classes each year, the
Board of Trustees shall Me with the President of the Philippines a detailed report, setting forth the progress, condition,
and needs of the Foundation College.
SEC. 11. In general there shall be a Foundation College council consisting of the administrative council and the
academic council. The administrative council of the College consists of the President as chairman, and the vicepresidents, deans, directors and other officials of equal rank as members, whose duty shall be to implement policies
governing the administration, management, and development planning of the Foundation College as approved by the
governing Board; and the academic council with the President of the Foundation College as chairman and all the
professors, custodial care administrator, members of the instructional staff of the college as members. The academic
council shall have the power to prescribe the curricula and rules of discipline, subject to the approval of the Board of
Trustees. It shall fix the requirements for admission to the Foundation College as well as for graduation and the
conferring of degrees, subject to review by the Board of Trustees, and receiving of certificates, diplomas, or awards of
merit. Through the President of the Foundation College, the academic council shall have disciplinary powers over the
children, and member council students within the limits prescribed by the Board of Trustees.
SEC. 12. The body of professors, teachers, foster parents and other technical employees, constitutes the faculty and
staff of said Foundation College with the President as the presiding officer. Its functions shall be to promote
professional growth among themselves, formulate rules and policies and a code of ethics or conduct for themselves
and to act as a body to judge disciplinary action against its members within the limits prescribed by the Board of
Trustees. Religious opinions or affiliation of the employees of the Foundation College must not be made the subject of
examination or inquiry, except that they are educationally qualified and proficient in the type of work required of them.
SEC. 13. There is hereby created a Board of Consultants whose membership shall be selected by the Board of
Trustees from the heads of institutions dedicated to the custodial care, protection, education, training of youths and
children, and such other persons whose technical know-how would be valuable assistance in carrying out the
objectives and purposes of this Act. Attendance of the members of the Board of Consultants at the Board of Trustees
meetings shall be made by invitation of the Chairman of the Board of Trustees to a member or members whose
technical advice shall be deemed beneficial to the welfare of the Foundation College.
SEC. 14. The Custodial Care Administrator and foster parents shall possess a high sense of integrity and proven love
for children, have morally upright and wholesome personality, and he physically and mentally healthy. There shall be
five types of foster parents; namely, 1) childless couples who have finished college education; 2) newly married
couples who are educationally qualified and technically trained to handle some phases of work in the Foundation
College; 3) elderly couples who have retired from government jobs or private firms but are still capable of being
employed as foster parents and provided that they have no dependents; 4) unmarried individuals who are
professionally or technically capable of becoming foster mothers or foster fathers; and 5) widows or widowers who are
educationally qualified with no dependents. The President of the Foundation College shall appoint foster parents to be
confirmed by the Board of Trustees who shall receive such salaries or compensation as the Board of Trustees may
determine, subject to Presidential Decree No. 985 and other pertinent budget and compensation laws.
SEC. 15. Each foster parent shall live in a government cottage with fifteen or twenty children under his or her care
grouped according to age, sex, interest or convenience, and shall be provided with enough space for gardening and
other income-producing projects. However, children under ten years of age shall not be divided into groups but shall
be allowed to mingle with one another to have a normal home life. The children shall be enrolled in classes according
to their aptitudes and abilities and in the vocational courses they are best inclined. They shall be given job
responsibilities where nominal payment for service rendered shall be paid them to prepare them for awe efficiency
and to enable them to grow into self-respecting citizens of the Republic of the Philippines.
SEC. 16. The foster parents shall be responsible for me supply and preservation of all house equipment, clothing and
general supplies needed by the children under their care and shall make a monthly report to the President of the
Foundation College regarding the expenses for each child. They shall coordinate with the child guidance counselor
and the doctor and dentist and other personnel to promote the wholesome personality of the children. They shall see
to it that the children are motivated to have individual or shared projects and shall act with loving care as real parents
to the children and provide them wholesome family life.
SEC. 17. The age limit of these children admitted to the Foundation College shall be from seven to eighteen years. At
least two years of college vocational training shall be given to those eighteen years old before they are released from
the Foundation College, through its Job Placement Office and to enable them fully for better qualification. Should the
child wish to leave the Foundation College before reaching the age of eighteen years, he may do so with the approval
of the Board of Trustees upon the recommendation of the Foundation College President: Provided, That the parents,
guardians, and relatives execute an affidavit of support for his care and education: Provided, further, That follow-up
supervision of the President of the Foundation College for the custodial care and education of the child is made
periodically until the child reaches the age of majority: Provided, finally, That should the parents, guardians, and
relatives fail to comply with the requirements set forth, the Foundation College has in its discretion to take back the
child in its custodial care. To enable the Foundation College to serve as many deserving indigent children and youth
as possible, the Job Placement Office of the Foundation College shall encourage adoptions of rehabilitated children
by families that are morally and financially qualified to love and care children as if said children were their own
children, subject to the supervision of the Foundation College until said children reach majority age.
SEC. 18. There shall be a secretary of the Foundation College recommended by the President and appointed by the
Board of Trustees. He shall keep such records of the Foundation College as may be designated by the Board.
SEC. 19. The Treasurer of the Philippines shall be ex officio Treasurer of the Foundation College and all accounts
and expenses thereof shall be audited by the Commission on Audit or its duly authorized representative. All
disbursements shall be made in accordance with rules and regulations prescribed by the Commission on Audit.
SEC. 20. Heads of bureaus or offices of the national government are hereby authorized to loan or transfer upon
request of the President of the Foundation College, such apparatus or supplies as may be needed by the Foundation
College, and to detail employees for duty therein if, in the judgment of the head of the bureau or office, such supplies
or employees can be spared without serious detriment to1 public service. Employees so detailed shall perform such
duties as may be required by the President of the Foundation College, and the time so employed shall be considered
as part of their regular official service.
SEC. 21. The superintendent of city schools and provincial division superintendents are thereby empowered through
their district supervisors and teachers to help recruit children of adversity who are either orphans, abandoned and
neglected children from destitute families, or children from broken homes or from families stricken by poverty,
calamities, sickness or other misfortunes. The barangay captain shall refer an orphan child to the barrio teacher for
the latter to help file an application for custodial care and education of said child to the President of the Foundation
College who shall approve the application papers after having been screened and recommended jointly by the district
supervisor, division superintendent and the deputized social service development official of the province. Youths and
children from all over the Islands including those from Manila Boy's Town, the Welfareville, the Children's Garden, the
Children Catholic Charities, the Youth Conservation Corps, or other public or private agencies may be admitted to the
Foundation College by special arrangement with the approval of the Board of Trustees: Provided, That the President
of the Foundation College accepts the placement: And Provided, further, That their living, education and travel
expenses to the Foundation College shall be paid by the agencies concerned.
SEC. 22. With special arrangement made by the Chairman of the Board of Trustees, the air force, army, and the navy
and other means of public transportation shall give free passes to those indigent children admitted to the Foundation
College including their chaperons.
SEC. 23. Out of the five thousand ninety-one hectares at Arakan Valley, Municipality of Magpet, Province of North
Cotabato, reserved for the Mindanao Institute of Technology (formerly) University of Southern Mindanao (presently)
under Proclamation. Order No. 428, one thousand hectares shall be segregated for the purpose of the Cotabato
Foundation College of Science and Technology, described as follows:
"Beginning at a point marked 'Forest Station 135' at the junction of Culaman River and Tinanan River thence following
the Tinanan River in a northeasterly direction for 5 kilometers, and at this point in straight horizontal line 2 kilometers
towards the Arakan River and likewise from 'Forest Station 135' at the junction of the Culaman River and Tinanan
River, to a point in straight line 2 kilometers away towards Makalangot, beginning at the end of kilometer 2 in parallel
lines of the Tinanan River in northeasterly direction 5 kilometers away until it meets the point of kilometer 2 to towards
Arakan River."
SEC. 24. All existing appropriations for the Children's Educational Foundation are hereby transferred to the Cotabato
Foundation College of Science and Technology, to be disbursed in accordance with the provisions of this Act. The
necessary sum for the operation and maintenance of the College shall be provided for in subsequent General
Appropriations Acts.
SEC. 25. This Act shall take effect upon its approval.

SECTION 1. The Ramon Torres Memorial High School in the City of Bago, Province of Negros Occidental, is hereby
converted into a national high school to be known as the Ramon Torres National High School. The curriculum of said
school shall include both academic and vocational courses.
SEC. 2. The amount of one hundred thousand pesos for the operation of the school shall be funded out of the
appropriations authorized by Batas Pambansa Bilang 230 for the Ministry of Education, Culture and Sports intended
for new national high schools and an additional amount corresponding to fifty percent of its share in the budgetary aid

schools. Thereafter, such sum as may be necessary for its operation and maintenance shall be included in the annual
General Appropriations Act.
SEC. 3. The Minister of Education, Culture and Sports shall implement the provisions of this Act so as to make the
said Ramon Torres National High School in operation during the first school term following the approval of this Act.
SEC. 4. This Act shall take effect upon its approval.

SEC. 4. The State College shall be headed by a President hereinafter referred to as the College President, assisted
by a Vice-President for Technology and a Vice-President for Academic Affairs: Provided, That each of the extension
units of the CSCST System mentioned in Section 1 of this Act shall be headed by a Superintendent. The powers and
duties of the College President in addition to these specially provided for in this Act, shall be those pertaining to the
office of a state college president in the Philippines.
SEC. 5. The governance of the Cebu State College of Science and Technology System is vested in a Board of
Trustees to be composed of the Minister of Education and Culture, who shall be the Chairman of the Board, the
College President, and the President of the Cebu State College of Science and Technology Alumni Association, the
Regional Director, MEC Region VII, the Chairman of the Regional Development Council, Region VII as members. In
the absence or inability of the Minister of Education, the Deputy Minister of Education and Culture or when these
positions are vacant, the other members of the Board may select from among themselves a temporary chairman who
shall act as Chairman.
The members of the Board of Trustees shall serve without compensation, but shall receive a per diem of fifty pesos
per meeting. All members of the Board of Trustees shall be entitled to reimbursement of actual necessary expenses
incurred either in attendance upon meetings of the Board or upon other official business authorized by resolution of
the Board, subject to existing budget laws on honoraria and allowances.
SEC. 6. The Board of Trustees shall have the following powers and duties in addition to its general governing powers:
(a) To appropriate such sums as may be provided by law for the operation and maintenance of the Cebu State
College of Science and Technology System;
(b) To confer titles or degrees in the fields of study stated in Sections two and three of this Act to successful
candidates for graduation;
(c) To confer certificates and diplomas upon successful candidates for graduation on courses other than degree
courses;
(d) To approve appointments submitted by the College President of all Superintendents of extension units, the dean of
instruction, college deans, heads of departments, registrar, associate professors, professors, guest lecturers,
instructors, teachers, and other employees of the State College system; to fix their compensation not otherwise
covered in Section thirteen hereof, subject to Presidential Decree No. 985 and other pertinent budget and
compensation laws, hours of service and such other duties and conditions as it may deem proper; to grant them in its
discretion, leave of absence under such regulations as it may promulgate, any other provision to the contrary
notwithstanding, and to remove them for cause after an investigation and hearing shall have been held;
(e) To approve the curricula and rules of discipline town up by the College Council as hereinafter provided;
(f) To provide fellowship for faculty members and scholarships to students showing special evidence of merit;
(g) To prescribe rules for its own governance, and to enact for the government of the State College system such rules
and regulations, not contrary to law, as may be necessary to carry out the purpose and functions of the State College
system as denned in Sections two and three of this Act;
(h) To approve the staffing pattern of the Cebu State College of Science and Technology proper and the extension
units as defined and submitted by their respective heads; and
(i) To receive in trust legacies, gifts, and donations of real and personal property of all kinds and to administer the
same for the benefit of the State College system or of the departments thereof, or for aid to any student or students, in
accordance with the directions and instructions of the donor, and in default thereof, in such manner as the Board of
Trustees may in its discretion determine.
SEC. 7. A quorum of the Board of Trustees shall consist of a majority of all the members. All processes against the
Board of Trustees shall be served on the Chairman or Secretary thereof.
SEC. 8. On or before the fifteenth day of June of each year, the Board of Trustees shall file with the President of the
Philippines a detailed report, setting forth the programs, conditions, and needs of the State College.
SEC. 9. There shall be a College Council, consisting of the College President, Vice-President for Technology, VicePresident for Academic Affairs, Dean of Instruction, College Deans, Registrar, and Department Heads.
The Council shall have the power to prescribe the curricula, educational qualifications of professors, department
heads, deans, instructors, teachers, and key personnel and rules of discipline, subject to the approval of the Board of
Trustees. It shall fix the requirement for admission to the College, as well as for graduation and the receiving of title or
degree. The College Council alone shall have the power to recommend students or others to be recipients of titles or
degrees. Through its President or committee, it shall have disciplinary power over the students within the limits
prescribed by the rules of discipline approved by the Board of Trustees.
SEC. 10. The body of teachers, instructors, professors, associate professors, department heads, registrar, college
deans, and dean of instruction shall constitute the faculty of the College with the College President and/or in the
latter's absence, one of the Vice-Presidents of the college, as the presiding officer: Provided, That no teacher,
instructor, professor, or lecturer in the State College System shall inculcate sectarian tenets in any of their teachings,
nor attempt directly, under penalty of dismissal by the Board of Trustees, to influence students or attendants for or
against any particular church or religious sect.
SEC. 11. The administrative officer shall be at the same time the secretary of the Board of Trustees who shall keep
such records of the State College as may be designated by the Board.
SEC. 12. The professors, associate professors, deans, registrar, and department heads, and superintendents of
extension units shall be covered by the appropriate civil service rules and regulations.
SEC. 13. The compensation per annum of the following shall be fixed at the minimum as follows: College President
forty-five thousand pesos; Vice-Presidentstwenty-four thousand pesos each; administrative officer who is the
secretary of the Board of Trusteesfifteen thousand pesos; Superintendents of extension unitseighteen thousand
pesos; department headsfifteen thousand pesos; college registrarfifteen thousand pesos; professorstwelve
thousand pesos; associate professorsten thousand four hundred pesos; lecturersfifty pesos an hour. Those
compensation may lie determined in accordance with Presidential Decree No. 985 and other pertinent budget and
compensation laws.
SEC. 14. The Board of Trustees shall fix the compensation of the employees and other personnel of the College not
otherwise covered in Section thirteen hereof whose appointments shall be recommended by the President of the
College, subject to Presidential Decree No. 985 and other pertinent budget and compensation laws.
SEC. 15. In the absence or inability of the College President or when this position is vacant, the Vice-President for
Technology shall temporarily perform the duties of the College President until such time when he returns to duty or
when another College President shall have been appointed.
SEC. 16. In order not to disrupt the present administrative operation of the Cebu School of Arts and Trades, and the
schools to be converted as extension units, the faculty of the school as well as the other personnel shall be absorbed
by the new State College system: Provided, That the incumbent Vocational College Superintendent of Cebu School of
Arts and Trades shall be appointed as the first College President who, upon his assumption to the position shall
recommend to the President of the Philippines the appointments of Vice-President for Technology and Vice-President
for Academic Affairs; all other officials and personnel whose appointment specifically vested in the President of the
Philippines shall be issued appointments by the College President consistent with the actual service Seeds of the
converted State College System to be approved by the Board of Trustees. Subsequent salary increases of Personnel
shall be approved by the Board of Trustees upon the recommendation of the College President.
SEC. 17. The Treasurer of the Philippines shall be ex officio treasurer of the College and all accounts and expenses
thereof shall be audited by the Commission on Audit or its duly authorized resident representative.
SEC. 18. All the personnel, properties, including buildings, sites, and improvements thereof, records, obligations,
monies and appropriations of the Cebu School of Arts and Trades and the schools mentioned in Section 1 to be
converted as part of the CSCST System are hereby transferred to the converted Cebu State College System.
SEC. 19. All existing appropriations for the Cebu School of Arts and Trades are hereby transferred to the Cebu State
College of Science and Technology to be disbursed in accordance with the provisions of this Act. The necessary sum
for the operation and maintenance of the state college shall be provided for in subsequent General Appropriations
Acts, until which time the operation of the institution as a college shall be deferred, provided that its new name shall
take effect upon approval of this Act.
SEC. 20. This Act shall take effect upon its approval.

hereby converted into a national high school to be known as the Sta. Cruz National High School.

accordance with the existing policy of the Ministry.
SEC. 3. The amount of one hundred thousand pesos for the operation of the school shall be funded out of the
appropriations authorized by Batas Pambansa Bilang 230 for the Ministry of Education, Culture and Sports intended
for new national high schools and an additional amount corresponding to fifty percent of its share in the budgetary aid
actually paid to it before such conversion shall be released for its operation from the national assistance fund to local
schools. Thereafter, such sum as may be necessary for its operation and maintenance shall be included in the annual
General Appropriations Act.
SEC. 4. This Act shall take effect upon its approval.

SEC. 2. The State College shall primarily provide higher technological, professional, and vocational instruction and
training in science, agricultural and industrial fields, as well as short-term technical or vocational courses. It shall
promote research, advanced studies, and progressive leadership in its areas of specialization.
SEC. 3. In addition to its present secondary and collegiate curricular offerings, the State College shall offer
undergraduate and graduate courses in the fields of science, agriculture and industrial fields as the Board of Trustees
may deem necessary. It shall also offer opportunity or short-term technical or vocational course within its areas of
specialization to meet the needs of the region.
SEC. 4. No student shall be denied admission to the State College by reason of sex, ethnic consideration, or religious
belief or affiliation.
SEC. 5. The head of the State College shall be known as the President of the Quirino State College. He shall be
appointed by the President of the Philippines upon recommendation of the Board of Trustees. His salary shall be
determined in accordance with Presidential Decree No. 985 and other pertinent budget and compensation laws.
The powers and duties of the President of the State College in addition to those specifically provided for in this Act
shall be those usually pertaining to the office of the president of a state college or university.
SEC. 6. The governing body of the State College shall be the Board of Trustees of the Quirino State College. It shall
be composed of the Minister of Education, Culture and Sports as Chairman, the Regional Director of the National
Economic and Development Authority, the President of the State College, and four (4) prominent citizens of Region II
to be appointed by the President of the Philippines as members.
Of the four appointed members, one shall be an authority in science, one in agriculture, one in arts and trades, and
one in technology: Provided, That at least one of the four appointed members shall be an alumnus of the former
Quirino National Agricultural School. Of the first group appointed, the President shall designate one to serve for one
year; one to serve for two years; one to serve for three years; and one to serve for four years. Thereafter, persons
appointed to succeed such members shall hold office for a term of four years and until their successors who should
be an expert in the same field shall have been appointed and qualified. In case of permanent vacancy, the position
shall be filled by appointment by the President of the Philippines. Such appointee shall hold office for the unexpired
term only.
When the Minister of Education, Culture and Sports is unable to perform his duties as Chairman of the Board due to
illness, absence or other cause, or in case of a vacancy in the office, the Deputy Minister of Education, Culture and
Sports shall temporarily perform the functions of the Chairman of the said Board. The Chairman may assign qualified
officials to represent him with full authority in the Board.
SEC. 7. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time a
meeting is called. All processes against the Board of Trustees shall be served on the President or Secretary thereof.
SEC. 8. The members of the Board of Trustees shall be entitled to an allowance of one hundred pesos per meeting
actually attended but not more than three hundred pesos a month: Provided, That they shall be reimbursed for actual
and necessary expenses incurred either in attendance upon meetings of the Board or upon other official business
authorized by resolution of the Board, subject to existing budget laws on honoraria and allowances.
SEC. 9. The Board of Trustees shall have the following powers and duties in addition to its general powers of
administration, and the exercise of all the powers of a corporation as provided in Section thirty-six of Batas Pambansa
Blg. 68, otherwise known as the Corporation Code of the Philippines:
(a) To receive and appropriate for the purpose specified by law such sums as may be provided for the support of the
State College;
(b) To confer degrees upon successful candidates for graduation of the State College. It may also confer honorary
degrees upon persons in recognition of learning, statesmanship or eminence in any of the fields of specialization of
the State College, or in recognition of public service: Provided, That such degrees shall not be conferred in
consideration of or to reciprocate some personal favor;
(c) To authorize the President of the State College to award proficiency certificates or diplomas to students who may
have completed non-degree courses;
(d) To appoint, on recommendation of the President of the State College, a vice-president, deans, directors, secretary
of the State College, registrar, heads of departments, professors, instructors, lecturers and other officials and
employees of the State College; to fix their compensation, subject to Presidential Decree No. 985 and other pertinent
budget and compensation laws, hours of service, and such other duties and conditions as it may deem proper, to
grant them, at its discretion, leaves of absence under such regulations as it may promulgate, any provisions of
existing law to the contrary notwithstanding; to remove them for cause after an investigation and hearing; to establish
Chairs in the State College, and to provide for the maintenance or endowment of such Chairs as may be necessary;
(e) To approve the curricula and rules of discipline drawn by the College Council as hereinafter provided;
(f) To provide fellowship for qualified faculty members and scholarship to deserving students;
(g) To prescribe rules for its own government and to enact for the government of the State College such rules and
regulations, not contrary to law, as may be necessary to carry out the purpose and functions of the State College;
(h) To receive in trust legacies, gifts, and donations of real and personal property of all kinds, to administer the same
for the benefit of the State College, or the departments thereof, or for aid to any student or students, in accordance
with the directions and instructions of the donor, and in default thereof, in such manner as the Board of Trustees may
in its discretion determine. All such donations shall be exempt from all taxes and shall be considered as deductible
items from the income tax of the donors; and
(i) To authorize the State College to undertake construction and/or repair of its building, machinery and equipment
and other facilities, any provisions of law or executive order to the contrary notwithstanding: Provided, That the funds
for the purpose shall come from its appropriation.
SEC. 10. On or before the fifteenth day of the second month after the opening of regular classes each year, the Board
of Trustees shall file with the Office of the President of the Philippines a detailed report, setting forth the progress,
conditions and needs of the State College.
SEC. 11. There shall be a College Council consisting of the President of the State College and all members of the
faculty with the rank of professors. The Council shall have the power to prescribe the curricula and rules of discipline,
subject to the approval of the Board of Trustees. It shall fix the requirements for admission to the State College, as

shall have the power to recommend students or others to be recipients of degrees. Through the President of the State
College or its duly authorized committee, the Council shall have disciplinary power over the students within the limits
prescribed by the rules of discipline.
SEC. 12. The body of instructors and professors of the State College shall constitute the faculty of the State College.
The faculty shall be covered by the appropriate civil service rules and regulations.
SEC. 13. No member of the faculty of the State College shall attempt directly or indirectly, under penalty of dismissal
by the Board of Trustees, to influence students or any person in the State College towards any ideology, political or
otherwise, which preaches the overthrow of the government through violence or subversion.
SEC. 14. There shall be a Secretary of the State College who shall be appointed by the Board of Trustees upon
recommendation of the President of the State College. He shall also be the Secretary of the Board and shall keep
such records of the State College as may be determined by the Board of Trustees.
SEC. 15. The Treasurer of the Philippines shall be ex officio treasurer of the State College and all accounts and
expenses therefor shall be audited by the Commission on Audit or its duly authorized representative.
SEC. 16. Heads of bureaus and offices of the national government are hereby authorized to loan or transfer, upon
request of the President of the State College, such apparatus, equipment or supplies as may be needed by the State
College and to detail employees for duty therein, when in the judgment of the head of the bureau or office such
apparatus, equipment, supplies or the services of such employees can be spared without serious detriment to the
public service. Employees so detailed shall perform such duty as required under such detail and the time so
employed shall be counted as part of their regular official service.
SEC. 17. All assets of the Quirino National Agricultural School, whether fixed or movable, records and personnel, are
hereby transferred to the Quirino State College.
SEC. 18. All existing appropriations for the Quirino National Agricultural School are hereby transferred to the Quirino
State College, to be disbursed in accordance with the provisions of this Act. The necessary sum for the operation and
maintenance of the State College shall be provided in subsequent General Appropriations Acts, until which time the
operation of the institution as a college shall be deferred, provided that its new name shall take effect upon approval
of this Act.
SEC. 19. The Minister of Education, Culture and Sports is hereby directed to take such steps as are necessary for the
immediate implementation of this Act.
SEC. 20. All laws inconsistent with the provisions of this Act are hereby repealed or amended accordingly.
SEC. 21. This Act shall take effect upon its approval.

to the Paglaum State College.
SEC. 18. All existing appropriations for the Negros Occidental College of Arts and Trades, the Negros Occidental
Community College and the Bacolod City National Trade School are hereby absorbed by the Paglaum State College
to be disbursed in accordance with the provisions of this Act. Additionally, the sum of one hundred thousand pesos for
the operation of the college is hereby authorized to be funded out of the appropriations authorized by Batas
Pambansa Blg. 230 for the Ministry of Education, Culture and Sports intended for new schools. Thereafter, the
necessary amount required for the operation and maintenance of the new college shall be provided for in subsequent
General Appropriations Acts.
SEC. 19. All laws inconsistent with the provisions of this Act are hereby repealed or amended accordingly.
SEC. 20. This Act shall take effect upon its approval.

transferred to the Laguna State Polytechnic College, to be disbursed in accordance with the provisions of this Act.
Thereafter, the necessary amount required for the operation and maintenance of the college shall be provided for in
subsequent General Appropriations Acts, until which time the operation of the institution as a college shall be
deferred, provided that its new name shall take effect upon approval of this Act.
SEC. 6. This Act shall take effect upon its approval.

the operation and maintenance of the state college shall be provided for in subsequent General Appropriations Acts,
until which time the operation of the institution as a college shall be deferred, provided that its new name shall take
effect upon approval of this Act.
SEC. 6. This Act shall take effect upon its approval.

SEC. 2. The amount necessary for the construction and operation of the hospital not to exceed seven hundred fifty
thousand pesos shall be funded out of the appropriations authorized by Batas Pambansa Bilang 230 for the Ministry
of Health intended for new or expanded hospitals. Thereafter, such sum as may be necessary for its operation and
maintenance shall be included in the annual General Appropriations Act.
SEC. 3. This Act shall take effect upon its approval.

the National Economic and Development Authority (NEDA), two (2) prominent citizens who have distinguished
themselves in their professions or fields of specialization, one representing the alumni association, the other chosen
from prominent citizens in the Province of Nueva Vizcaya, both to be appointed by the President upon
recommendation of the Minister of Education, Culture and Sports: Provided, however, That the non-ex-officio
members of the Board, except the President of the College who shall serve during the duration of his incumbency,
shall hold office as follows: one to serve for two (2) years, and the other to serve for four (4) years, the term of office of
each to be specified in his appointment by the President. Thereafter, persons appointed to succeed such members
shall hold office for a term of four (4) years and until their successors shall have been appointed and qualified.
Permanent vacancy in the Board shall be filled by appointment by the President with the recommendation of the
Minister of Education, Culture and Sports and such appointee shall hold office for the unexpired term only.
In the absence or inability of the Minister of Education, Culture and Sports, the Deputy Minister of Education, Culture
and Sports or when these positions are vacant, the President of the College shall act as chairman.
The members of the Board of Trustees shall serve without compensation, but shall be entitled to reimbursement for
actual and necessary expenses incurred in attendance upon meetings of the Board and upon other official business
authorized by resolution of the Board, subject to existing budget laws on honoraria and allowances.
SEC. 5. The Board of Trustees shall have the following powers and duties in addition to its general powers of
administration:
(a) To receive and appropriate for the ends specified by law such sums as may be provided for by law for the support
of the College;
(b) To confer the usual honorary degrees upon persons in recognition of learning, statesmanship, or eminence;
(c) To appoint, upon recommendation of the President of the College, the registrar, the dean of the college, the heads
of the various branches of the College, professors, instructors, lecturers, and other employees of the College and to
fix their compensation subject to P.D. No. 985 and other pertinent budget and compensation laws, prescribe the hours
of service, duties and the conditions of work as it may deem proper, to grant to them, in its discretion, leaves of
absence in accordance with the rules that it may promulgate, and to remove them for cause after proper investigation
and hearing pursuant to Civil Service laws governing disciplinary action;
(d) To approve the curricula and rules of discipline drawn up by the Academic Council as hereinafter provided;
(e) To provide fellowship and scholarship for deserving faculty members and students of the College;
(f) To prescribe rules for its own government, and to enact for the government of the College such rules and
regulations, not contrary to law, as may be necessary; and
(g) To receive in trust legacies, gifts, and donations of real and personal property of all kinds and to administer the
same for the benefit of the College, or of a department thereof, or for aid to any student or students in accordance
with the directions and instructions of the donor, and, in default thereof, in such manner as the Board of Trustees may
in its discretion determine.
SEC. 6. A quorum of the Board of Trustees shall consist of all the members holding office at the time the meeting of
the Board is called. All processes for or against the Board of Trustees shall be served on the President or Secretary
thereof.
SEC. 7. On or before the 15th day of the month following the opening of regular classes each year, the Board of
Trustees shall file with the Office of the President, through the Minister of Education, Culture and Sports a detailed
report setting forth the progress, condition and needs of the College.
SEC. 8. The head of the College shall be known as the President of the College. He shall be appointed for a term of
six (6) years by the President of the Philippines upon recommendation of the Minister of Education, Culture and
Sports upon consultation with the members of the Board: Provided, That the President of the College may be
reappointed after his term shall have expired upon same recommendations aforestated.
The powers and duties of the President of the College shall be those pertaining to the office of the president of a state
college.
SEC. 9. There shall be a vice-president of the College to be appointed by the President upon recommendation of the
Minister of Education, Culture and Sports. He shall be vested with all the powers and duties of the President upon
assumption of such function in the absence or incapacity of the latter for any cause, and shall also perform such other
duties as the Board of Trustees may from time to time assign to him.
SEC. 10. There shall be an Administrative Council consisting of the President of the College as chairman, the vicepresident, deans, and heads of branches of the College as members. It shall have the duty and authority to
implement policies governing the administration, management, and development planning of the College. All
formulated plans and programs for the College shall be subject to the approval of the Board.
SEC. 11. There shall be an Academic Council consisting of the President of the College as chairman and the faculty
of the College who teach collegiate courses as members. The Academic Council shall have the power and duty to
prescribe the curricula and rules of discipline, subject to the approval of the Board of Trustees. It shall fix the
requirements for admission to the College, as well as for graduation, and the conferral of titles and degrees. The
Council shall likewise have the power to recommend students or others to be recipients of titles or degrees. Through
the President or his duly authorized representative, it shall have disciplinary power over the students of the College
within the limits prescribed by the rules of discipline approved by the Board of Trustees.
SEC. 12. The body of instructors and professors of the College shall constitute the faculty thereof.
In the appointment of professors and instructors of the College, no religious test shall be applied, nor shall religious
opinions or affiliations of the faculty of the College be made a matter of examination or inquiry: Provided, That no
member of the faculty shall inculcate sectarian tenets in any of his/her teachings, nor attempt either directly or
indirectly under the penalty of dismissal by the Board of Trustees, to influence students and attendants at the College
for or against any particular church or religious sect.
SEC. 13. There shall be a secretary of the College who shall be appointed by the Board of Trustees. He shall be the
registrar of the College, and the secretary of the Board of Trustees. He shall keep the records of the College, and
shall exercise such powers, and perform such duties as may be designated by the Board of Trustees.
SEC. 14. The Treasurer of the Philippines shall be ex officio treasurer of the College. All accounts and expenses
thereof shall be audited by the Commission on Audit, or its duly authorized representative.
SEC. 15. All personnel, assets, records, and appropriations of the Nueva Vizcaya School of Arts and Trades, and the
Paniki Barangay High School are hereby transferred to the College.
SEC. 16. Heads of bureaus and offices of the national government operating in Nueva Vizcaya as well as heads of
departments in the provincial government of said province are hereby authorized to loan or transfer, upon request of
the President of the College, such apparatuses, equipment, and supplies as may be needed by the College, and to
detail employees for duty therein when in the judgment of the head of the bureau or department or office, such
employee/s can be spared therefor without serious detriment to the public service. Employees so detailed shall
perform such duties as may be required under such detail and the time so employed shall be counted and considered
as part of their regular official service.
SEC. 17. The Minister of Education, Culture and Sports shall take such steps as are necessary for the immediate
implementation of this Act. For this purpose, he is authorized to create a technical committee within one (1) month
after the Board of Trustees shall have been duly constituted, to advise the Board toward the proper adjustment of the
College so constituted to the new status of a state college, as well as to guide them in the making of program for the
development and expansion of the College.
SEC. 18. The existing appropriations for the Nueva Vizcaya School of Arts and Trades and the Paniki Barangay High
School in the Municipality of Bagabag are hereby transferred to the Nueva Vizcaya State Polytechnic College, to be
disbursed in accordance with the provisions of this Act. Thereafter, the necessary sum for the operation and
maintenance of the new state college shall be provided for in subsequent General Appropriations Acts, until which
time the operation of the institution as a college shall be deferred, provided that its new name shall take effect upon
approval of this Act.
SEC. 19. All laws or parts thereof which are inconsistent with this Act are repealed or modified accordingly.
SEC. 20. This Act shall take effect upon its approval.

be provided for in subsequent General Appropriations Acts until which time the operation of the institution as a college
shall be deferred, provided that its new name shall take effect upon approval of this Act.
SEC. 4. This Act shall take effect upon its approval.

SEC. 4. No student shall be denied admission to the State College by reason of sex, ethnic consideration, or religious
belief or affiliation.
SEC. 5. The head of the State College shall be known as the President of the Northern Iloilo Polytechnic State
College. His salary shall be fixed by the Board of Trustees comparable to that being received by the president of
similar institutions of like standing, subject to Presidential Decree No. 985 and other pertinent budget and
compensation laws. He shall be appointed by the President of the Philippines. The incumbent Superintendent of
Western Visayas College of Fisheries shall be the first President of the State College, subject to civil service law, rules
and regulations.
The power and duties of the President of the State College, in addition to those specifically provided for in this Act.
shall be those usually pertaining to the office of the president of a college.
SEC. 6. The governing body of the State College shall be the Board of Trustees of the Northern Iloilo Polytechnic
State College. It shall be composed of the Minister of Education, Culture and Sports as chairman, the President of the
State College as the vice-chairman, with the following as members: Director, Ministry of Education, Culture and
Sports, Region VI, Director, National Economic and Development Authority, an assemblyman for the Province of Iloilo,
the Governor of the Province of Iloilo, and one bona fide resident of Iloilo with management and technical expertise
who shall be appointed by the President of the Philippines.
When the Minister of Education, Culture and Sports is unable to perform his duties as chairman of the board due to
illness, absence or other causes, or in case of vacancy in the office, the Deputy Minister of Education, Culture and
Sports shall temporarily perform the functions of the chairman of the said board. When both the Minister and the
Deputy Minister of Education, Culture and Sports are unable to exercise the powers of the Chairman of the Board of
Trustees, the members of the board shall elect from among themselves a temporary chairman who shall act as
chairman thereof.
SEC. 7. The members of the Board of Trustees shall serve without compensation but they shall be reimbursed for
actual and necessary expenses incurred either in attendance upon meetings of the board or upon other official
business authorized by resolution thereof, subject to existing budget laws on honoraria and allowances.
SEC. 8. In addition to its general powers of administration, the Board of Trustees shall have the following powers and
duties:
(a) To receive and appropriate for the purposes specified by law such sums as may be provided for the support of the
State College;
(b) To confer degrees upon successful candidates for graduation of the State College. It may also confer the usual
honorary degrees upon persons in recognition of learning, statesmanship or eminence in science, agriculture,
forestry, industry or public service related to such fields;
(c) To authorize the President of the State College to award proficiency certificates or diploma to students who have
completed non-degree courses;
(d) Subject to Civil Service Law, rules and regulations, to appoint, upon recommendation of the President of the State
College, the deans of the different schools of the State College, the registrar, the heads of departments, professors,
instructors, lecturers and other employees of the State College; to fix, in accordance with the rates established by the
Compensation and Position Classification Administration, their compensation; to prescribe hours of service, duties
and the conditions of works1 as it may deem proper; to grant to them in its discretion, leaves of absence under such
regulations as it may promulgate, any provisions of law to the contrary notwithstanding, and to remove them for cause
upon investigation and hearing- pursuant to Civil Service Law governing disciplinary action;
(e) To approve the curricula and rules of discipline drawn up by the State College Council as hereinafter provided;
(f) To provide fellowship and scholarship for deserving faculty members and students;
(g) To prescribe rules for its own government and for this purpose, to enact such regulations not contrary to law as
may be necessary;
(h) To receive in trust legacies, gifts and donations of real and personal property of all kinds and to administer the
same for the benefit of the State College or of a department thereof, or for aid to any student in accordance with the
directions and instructions of the donor, and in default thereof, in such manner as the Board of Trustees may in its
discretion determine;
(i) To provide vocational training to adult citizens and out-of-school youths; and
(j) To name after prominent Filipinos or heroes any building, annex, ground, or branch of the State College.
SEC. 9. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time the
meeting of the board is called. All processes against the Board of Trustees shall be served on the president or
secretary thereof.
SEC. 10. On or before the fifteenth day of June of each year, the Board of Trustees shall submit to the President of
the Philippines a detailed report, setting forth the progress, condition, and needs of the State College.
SEC. 11. There shall be a State College Council consisting of the President of the State College and all members of
the faculty of the State College. The council shall have the power to prescribe the curricula and rules of discipline,
subject to the approval of the Board of Trustees. It shall fix the requirements for admission to the State College, as
well as for graduation and the conferring of degrees subject to review by the Board of Trustees. The council alone
shall have the power to recommend students or others to be recipients of degrees. Through the President of the State
College or a duly authorized committee, the council shall have disciplinary power over the students within the limits
prescribed by the rules of discipline.
SEC. 12. The body of instructors and professors of the State College shall constitute the faculty of the State College,
with the President of the State College as the presiding officer.
No member of the faculty of the State College shall attempt directly or indirectly, under penalty of dismissal by the
Board of Trustees, to influence students or attendants at the State College towards any ideology, political or
otherwise, which preaches the overthrow of the government through violence or subversion.
SEC. 13. There shall be a secretary of the State College who shall be appointed by the Board of Trustees upon
recommendation of the President of the State College. He shall be the secretary of the board and also of the State
College, and shall keep such records of the State College as may be determined by the Board of Trustees.
SEC. 14. The President of the State College may, upon prior consultation with the superintendent of schools of the
province, designate any secondary school in the division concerned as training or laboratory school of the State
College.
SEC. 15. The Treasurer of the Philippines shall be ex officio treasurer of the State College. All accounts and expenses
therefor shall be audited by the Commission on Audit and all disbursements shall be made in accordance with
auditing rules and regulations.
SEC. 16. Heads of bureaus and offices of the national government are hereby authorized to loan, or transfer, upon
request of the President of the State College, such apparatus, equipment or supplies as may be needed by the State
College and to detail employees for duty therein, when in the judgment of the head of the bureau or office, such
apparatus, equipment, supplies or the services of such employees can be spared without serious detriment to the
public service. Employees so detailed shall perform such duty as is required under such detail, and the time so
employed shall be counted as part of their regular official service.
SEC. 17. The requirements provided in this Act as may prove adverse to the present faculty and employees of the
Western Visayas College of Fisheries and the Estancia High School who may be absorbed by the State College shall
not apply to them. But future appointees to the said State College shall be subject to all the requirements provided in
this Act.
SEC. 18. All parcels of land, buildings, equipment and facilities owned by the Western Visayas College of Fisheries
and the Estancia High School, as well as all obligations and appropriations thereof, shall be transferred to the
Northern Iloilo Polytechnic State College.
SEC. 19. All existing appropriations for the Western Visayas College of Fisheries and the Estancia High School are
hereby transferred to the Northern Iloilo Polytechnic State College, to be disbursed in accordance with, fee provisions
of this Act. The necessary sum for the operation and maintenance of the new state college shall be provided for in
subsequent General Appropriations Acts, until which time the operations of the institution as a state college are
deferred, provided that its new name shall take effect upon approval of this Act.
SEC. 20. The Board of Trustees in the fulfillment of the objectives of the Northern Iloilo Polytechnic State College is
empowered to establish satellite schools and/or extension schools and to integrate and make part of the State College
other national and vocational schools of the Province of Iloilo and nearby provinces: Provided, That these schools will
continue to offer their present curricular offerings that the Board of Trustees may in its discretion authorize.
SEC. 21. This Act shall take effect upon its approval.

SEC. 2. The operation of said school for the current fiscal year shall continue to be funded out of local funds and from
its share of national aid to local schools. The requirements for succeeding fiscal years shall be provided in the
forthcoming General Appropriations Acts.

in fisheries, trades and technology, arts and sciences, as well as short-term technical or vocational courses, as the
Board of Trustees may deem necessary, and shall promote researches in the exploitation and conservation of the
natural resources in the province.
SEC. 3. No student shall be denied admission to the Colleges by reason of age, sex, ethnic consideration, religious
belief, or political affiliation.
SEC. 4. The head of the Colleges shall be known as the President of the Camarines Sur Polytechnic Colleges. He
shall be appointed by the President of the Philippines upon recommendation of the Board of Trustees which shall fix
his compensation, subject to Presidential Decree No. 985 and other pertinent budget and compensation laws, and
term of office.
The powers and duties of the President of the Colleges, in addition to those specifically provided for in this Act, shall
be those usually pertaining to the office of the president of a college.
SEC. 5. The governing body of the Colleges shall be the Board of Trustees of the Camarines Sur Polytechnic
Colleges. It shall be composed of the Minister of Education, Culture and Sports as the chairman, the Provincial
Governor of Camarines Sur, the President of the Colleges, the Bicol River Basin Development Project Program
Director and three (3) other residents of the Province of Camarines Sur as members who shall be appointed by the
President of the Philippines, one in the field of fisheries, one in trades and technology, one in arts and letters, and one
in sciences. Of the three members first appointed by the President, one is to serve two years; one to serve three
years; and one for four years. Thereafter, persons appointed to succeed such members shall hold office for a term of
four years and until their successors shall have been appointed and qualified. In case of permanent vacancy, the
position shall be filled by appointment of the President of the Philippines.
Such appointee shall hold office for the unexpired term only.
The Minister of Education, Culture and Sports and the Governor of the Province of Camarines Sur may designate
their respective representatives in the Board who shall have all the powers and privileges pertaining to their offices. In
the absence of the Minister of Education, Culture and Sports who is the chairman of the Board, the members of the
Board present may elect the temporary chairman to preside over the meeting.
SEC. 6. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time a
meeting is called. All processes against the Board of Trustees shall be served on the President or Secretary thereof.
SEC. 7. The members of the Board of Trustees shall be entitled to an allowance of not less than two hundred pesos
per meeting actually attended: Provided, That they shall be reimbursed for actual and necessary expenses incurred in
attendance of meetings and other official business authorized by resolution of the Board, subject to existing budget
laws on honoraria and allowances.
SEC. 8. The Board of Trustees, in addition to its general powers of administration and the exercise of all the powers of
corporation as provided in Section Thirty-six of Batas Pambansa Blg. 68, otherwise known as the Corporation Code
of the Philippines, shall have the following powers and duties:
(a) To receive and appropriate for the purpose specified by law such sums as may be provided for the support of the
Colleges;
(b) To confer degrees upon successful candidates for graduation, it may also confer honorary degrees upon persons
in recognition of learning, statesmanship or eminence in any of the fields of specialization of the Colleges, or in
recognition of public service: Provided, That such degrees shall not be conferred in consideration of or to reciprocate
some personal favor;
(c) To authorize the President of the Colleges to award proficiency certificates or diplomas to students who have
completed non-degree courses;
(d) To organize academic units and courses as may be necessary to meet the economic and social needs of the
Province of Camarines Sur;
(e) To appoint, on recommendation of the President of the Colleges, academic and administrative officials, faculty and
employees of the Colleges, to fix their compensations, subject to Presidential Decree No. 985 and other pertinent
budget and compensation laws, hours of service, and to perform such other duties and conditions as it may deem
proper; to grant to them, in its discretion, leaves of absence under such regulations as it may promulgate; any
provisions of existing laws to the contrary notwithstanding; and to remove them for cause after an investigation and
hearing;
(f) To approve the curricula and rules of discipline drawn by the College Council as hereinafter provided;
(g) To provide fellowship for qualified faculty members; and to provide scholarship for deserving students;
(h) To prescribe rules for its own governance and to enact for the government of the Colleges such rules and
regulations, not contrary to law, as may be necessary to carry out the purposes and functions of the Colleges;
(i) To receive in trust legacies, gifts, and donations of real and personal property of all kinds, to administer the same
for the benefit of the Colleges, or of any department thereof, or for aid to any student or students, in accordance with
the directions and instructions of the donor, and in default thereof, in such manner as the Board of Trustees may in its
discretion determine. All such donations shall be exempt from all taxes and be considered as deductible items from
the income tax of the donor;
(j) To authorize the Colleges to undertake construction and/or repair of its buildings, machinery and equipment and
other facilities, any provisions of law or executive order to the contrary notwithstanding;
(k) To provide vocational training to adult citizens and out-of-school youths; and
(l) To acquire sites or campuses and to provide facilities and improvements as may be necessary.
SEC. 9. On or before the fifteenth day of the second month after the opening of regular classes each year, the Board
of Trustees shall file with the Office of the President of the Philippines and of the Provincial Governor of Camarines
Sur, a detailed report setting forth the progress, condition and needs of the Colleges.
SEC. 10. There shall be a College Council consisting of the President of the Colleges and all members of the faculty
with the rank of professor. The Council shall have the power to prescribe the curricula and rules1 of discipline, subject
to the approval of the Board of Trustees. It shall fix the requirements for admission to the Colleges, as well as for
graduation and conferring of degrees subject to review by the Board of Trustees. The Council alone shall have the
power to recommend students or others to be recipients of degrees or certificates. The Council, through its duly
authorized committee, or the President of the Colleges shall have disciplinary power over the students within the limits
prescribed by the rules of discipline.
SEC. 11. The body of instructors and professors of the Colleges shall constitute the faculty of the Colleges.
The faculty shall be exempt as such from any civil service examinations or regulations as a requisite to appointment.
SEC. 12. No member of the faculty of the Colleges shall attempt directly or indirectly, under penalty of dismissal by
the Board of Trustees, to influence students or any person in the Colleges towards any ideology, political or otherwise,
which preaches the overthrow of the government through violence or subversion.
SEC. 13. There shall be a secretary of the Colleges who shall be appointed by the Board of Trustees upon
recommendation of the President of the Colleges. He shall also be the secretary of the Board and shall keep such
records of the Colleges as may be determined by the Board of Trustees.

Employees so detailed shall perform such duties as required under such detail and the time so employed shall be
counted as part of their regular official service.
SEC. 16. The Province of Camarines Sur shall provide the site or funds for the purchase of such site: Provided, That
the sum of five hundred thousand pesos (P500,000. 00) shall be appropriated by the Province of Camarines Sur for
the establishment, operation and maintenance of the Colleges. Thereafter, funds for the maintenance and operation
of the Colleges shall be included in the annual appropriations of the Province of Camarines Sur.

SEC. 18. Provisions of law notwithstanding, the Province of Camarines Sur is hereby authorized to levy such taxes as
may be necessary to raise the funds needed for the purpose aforementioned, subject to the approval by the Minister
of Finance.
SEC. 19. All laws, decrees, executive orders contrary to or inconsistent with the provisions of this Act are hereby
repealed or amended accordingly.

AN ACT CONVERTING THE SAN JOSE NATIONAL HIGH SCHOOL IN THE MUNICIPALITY
OF SAN JOSE, PROVINCE OF OCCIDENTAL MINDORO, INTO OCCIDENTAL MINDORO
NATIONAL COLLEGE, PROVIDING A CHARTER FOR THIS PURPOSE AND FUNDS
THEREFOR.
Be it enacted by the Batasang Pambansa in session assembled:
SECTION 1. The present San Jose National High School located in the Municipality of San Jose, Province of
Occidental Mindoro, is hereby converted into Occidental Mindoro National College, hereinafter referred to in this Act
as the College.
SEC. 2. The College, in addition to technical and vocational education, shall provide and offer baccalaureate courses
leading to the degrees of Bachelor of Science in Education, Bachelor of Science in Elementary Education, Bachelor
of Arts, Bachelor of Science in Commerce, Bachelor of Science in Agriculture, Bachelor of Science in Fishery, and
Bachelor of Science in Forestry.
SEC. 3. No student, provided he/she qualifies in the NCEE test and passes the College Admission Test shall be
denied admission to the College by reason of sex, ethnic consideration or religious beliefs.
SEC. 4. The College shall be headed by a Superintendent to be appointed by the President of the Philippines upon
recommendation by the Minister of Education, Culture and Sports. His salary and other emoluments shall be fixed by
the Board of Trustees, subject to P.D. No. 985 and other pertinent budget and compensation laws.
The powers and duties of the Superintendent of the College, in addition to those specifically provided in this Act, shall
be those usually pertaining to the office of the president of a state college.
SEC. 5. The governing body of the College shall be the Board of Trustees, to be composed of the Minister of
Education, Culture and Sports or his duly authorized representative as chairman, the Regional Director of the
National Economic and Development Authority, the Superintendent of the College, and four (4) other distinguished
citizens of the Province of Occidental Mindoro, who shall be appointed by the President, as members. Of the four (4)
appointed members, one shall be an authority in agriculture, one in trade and technology, one in general education,
and one in commerce and industry. Of the four members first appointed by the President of the Philippines, one shall
serve for one (1) year, one to serve for two (2) years, one to serve for three (3) years, and one to serve for four (4)
years. Thereafter, persons appointed to succeed such members shall hold office for a term of four (4) years and until
their successors shall have been appointed and qualified. In case of a permanent vacancy, the position shall be filled
by the President of the Philippines. Such appointee shall hold office for the unexpired term only.
SEC. 6. A quorum of the Board of Trustees shall consist of a majority of all the members holding office at the time a
meeting is called. All processes for the members of the Board of Trustees shall be served on the Superintendent of
the College or Secretary thereof.
SEC. 7. The members of the Board of Trustees shall serve without compensation but shall be entitled to an allowance
of two hundred pesos (P200.00) per meeting actually attended, but not exceeding six hundred pesos a month and to
reimbursement of actual and necessary expenses on other official business as may be authorized by the Board,
subject to existing budget laws on honoraria and allowances.
SEC. 8. The Board of Trustees shall have the following powers and duties:
(a) To receive and appropriate for the purposes specified by law such sum as may be provided for the support of the
College;
(b) To confer degrees upon successful candidates for graduation of the College, honorary degrees upon persons in
recognition of learning, statesmanship and public service;
(c) To prescribe, develop and update a College Admission Test for all applicants for enrollment;
(d) Subject to Civil Service Law, rules and regulations, to confirm appointments made by the Superintendent of the
College to the registrar, deans of the different schools or colleges, heads of departments, professors, instructors,
lecturers and other employees of the College;
(e) To remove, dismiss or suspend, demote and impose any other penalty and all other disciplinary actions upon
erring teachers and employees for cause after the proper investigation and hearing pursuant to the provision of the
Civil Service Law;
(f) To prescribe, develop and approve the different curricula of the College upon approval by the Ministry of Education,
and Culture and Sports;
(g) To prescribe and modify rules of conduct and discipline for the teachers and employees of the College in
accordance with the Civil Service Law, rules and regulations ;
(h) To prescribe rules for its government or such rules and regulations not contrary to law and as may be deemed
necessary to carry out the purpose and function of the college.
SEC. 9. There shall be a secretary of the College who shall be appointed by the Superintendent of the College,
subject however to a confirmation of the Board of Trustees. He shall also be the Secretary of the Board of Trustees
and shall keep the record of the College and perform duties as may be determined by the Board.
SEC. 10. Heads of bureaus and offices of the national government are hereby authorized to loan or transfer upon
request of the Superintendent of the College, such apparatus, equipment or supplies that may be needed by the
College and to detail employees for duty therein when in the judgment of the head of the bureau or office concerned,
such apparatus, equipment, supplies or the services of such employees can be spared without serious detriment to
their offices.
SEC. 11. All parcels of land, buildings, equipment and facilities owned by the San Jose National High School as well
as all obligations are hereby transferred to and assumed by the Occidental Mindoro National College.
SEC. 12. All existing appropriations for the San Jose National High School are hereby transferred to the Occidental
Mindoro National College, to be disbursed in accordance [with the provisions of this Act. The necessary sum for the
operation and maintenance of the new college shall be provided for in subsequent General Appropriations Acts, until
which time the operations of the institution as a college shall be deferred, provided that its new name shall take effect
upon approval of this Act.
SEC. 13. The Minister of Education, Culture and Sports is hereby directed to take such steps as are necessary for
immediate implementation of this Act.
SEC. 14. All laws, decrees, executive orders or regulations contrary to or inconsistent herewith are hereby repealed or
amended accordingly.

"SEC. 93. Contribution to Assurance Fund.Upon the entry of a certificate of title in the name of the registered
owner, and also upon the original registration on the certificate of title of a building or other improvements on the land
covered by said certificate, there shall be paid to the Register of Deeds one-fourth of one percent of the assessed
value of the real estate on the basis of the last assessment for taxation purposes, as contribution to the Assurance
Fund. Where the land involved has not yet been assessed for taxation, its value for purposes of this Decree shall be
determined by the sworn declaration of two disinterested persons to the effect that the value fixed by them is to their
knowledge, a fair valuation.
"Nothing in this Section shall in any way preclude the court from increasing the valuation of the property should it
appear during the hearing that the value stated is too small."
"SEC. 95. Action for compensation from funds.A person who, without negligence on his part, sustains loss or
damage, or is deprived of land or any estate or interest therein in consequence of the bringing of the land under the
operation of the Torrens system or arising after original registration of land, through fraud or in consequence of any
error, omission, mistake or misdescription in any certificate of title, and who by the provisions of this Decree is barred
or otherwise precluded under the provision of any law from bringing an action for the recovery of such land or estate
or interest therein, may bring an action in any court of competent jurisdiction for the recovery of damage to be paid out
of the Assurance Fund."

Representative of the Rizal Provincial Government, and the ranking officers of the KKK regional office in Region IV;
Member; and
Two prominent citizens who have distinguished themselves in the professions or fields of specialization of the Rizal
College of Agriculture and Technology, one representing the alumni of the state college, the other chosen from
prominent citizens in the municipality of Tanay or the Province of Rizal, to be appointed by the President of the
Philippines upon the joint recommendation of the Minister of Education, Culture and Sports, and the Minister of
Human Settlements, as Members.
The first group of appointive trustees shall serve for two (2) years and for (4) years, respectively. Thereafter, the
appointee shall hold office for a term of four years. In case of vacancy, the person appointed to fill the vacancy shall
hold office for the unexpired term only.
In the absence of the Minister of Education, Culture and Sports, the Minister shall authorize a representative,
preferably the Deputy Minister of Education, Culture and Sports and at least a director, to sit in the meetings of the
Board: Provided, however, That during the meetings the president shall preside as Vice-Chairman of the Board.
SEC. 4. The governing board shall exercise policy-making functions in accordance with the general policies, plans,
and programs on national and regional development as may be issued by the chairman of the governing board; shall
see to it that the general educational policies, plans and programs as formulated and promulgated are adopted and
observed by the state college.
SEC. 5. The Board of Trustees shall have the following specific powers and duties in addition to the general powers
as provided in the Corporation Code of the Philippines;
(a) To promulgate for the government of the state college such rules and regulations not contrary to law as may be
necessary to carry out the purpose and functions of state institution;
(b) To receive and appropriate to the ends specified by law such sums as may be provided for the support of the state
college;
(c) To receive in trust legacies, gifts and donations of real and personal property of all kinds, to administer the same
for the benefit of the state college or for aid to any student in accordance with the directions and instructions of the
donor, and in default thereof, in such manner as the governing board may in its discretion determine. Such donations
shall be exempt from all taxes and shall be considered as deductible items from me taxable income of the donors;
(d) To approve the curricula and rules of discipline drawn by the Administrative and Academic Councils as hereinafter
provided;
(e) To confer degrees upon successful candidates for graduation, to award honorary degrees upon persons
recognition of learning, public service, statesmanship or eminence in any field of specialization or expertise of the
state college, and authorize the President of the state college to award certificates for completion of non-degree
programs;
(f) To confirm appointments of vice-presidents, secretary, deans, directors, registrars, heads of departments,
professors, instructors and other officials and employees of the college made by the President; to fix compensation
subject to Presidential Decree No. 985 and Pertinent budget and compensation laws, hours of service, and such
other duties and conditions as the governing board may promulgate, in accordance with the provisions of existing
laws; to remove them for cause after investigation and hearing;
(g) To establish chairs in the state college and to provide fellowships for qualified faculty members and scholarships to
deserving students;
(h) To authorize the construction or repair of its buildings, machineries, equipment and other facilities, and the
purchase of necessary supplies, materials and equipment for the purpose shall come from authorized appropriations
of the college.
SEC. 6. A quorum of the governing board shall consist of a majority of all members holding office at the time of the
meeting: Provided, however, That among those present are the Minister of Education, Culture and Sports, or his duly
authorized representative who is the Chairman of the Board, the Minister of Human Settlement, or his duly authorized
representative and the President of the College, who acts as the presiding officer in the absence of the Minister of
Education, Culture and Sports. All processes against the college shall be served on the President of the state college
or his duly authorized representative.
SEC. 7. The members of the governing board shall not receive compensation but shall be reimbursed for actual and
necessary expenses incurred in their attendance of meetings or other official functions authorized by the Board,
subject to existing budget laws on honoraria and allowances.
SEC. 8. The head of the college shall be known as the President of the Rizal College of Agriculture and Technology,
who shall be appointed by the President of the Philippines upon recommendation of the Minister of Education, Culture
and Sports after consultation has been made with the Board of Trustees. He shall serve for a term of six (6) years. In
case of vacancy, by reason of death, absence, or resignation, the Minister of Education, Culture and Sports shall have
the authority to designate an officer-in-charge of the college pending the appointment of the President.
The powers and duties of the President of the College, m addition to those enumerated in the succeeding section,
shall be those normally pertaining to the office of the president of a college.
SEC. 9. Specifically, the President of the state college shall have the following powers and duties, in addition to those
normally appertaining to the office of the president of the college.
(a) He shall be the chief executive officer of the college. As such, progressive and dynamic, intellectual and
administrative leadership in the College is expected of him and vested in him;
(b) He shall be the head of the college faculties and any branch unit thereof;
(c) He shall have the general supervision over all academic as well as business or financial operations of the state
college;
(d) He shall promulgate and enforce general policies Meeting any unit of the school, and take such actions which in
his judgment are necessary for the protection of property and general interest of the school, students and personnel
and for the operation of the college as a whole, and shall inform the Board on all matters relating to the operation and
welfare of the state college;
(e) He shall appoint qualified persons to fill all vacancies and new positions subject to the approval of the Board and
make such other arrangements to meet emergencies occurring between meetings of the Board so that the work of the
college shall not suffer, subject to appropriate civil service rules and regulations.
(f) He shall institute disciplinary action against any member of the college personnel, faculty as well as any member of
the college whose actions adversely affect the general interest of the school;
(g) He shall decide appeals in controversies between ranking officials of the state college, his decisions being final
and conclusive;
(h) He shall grant or deny sabbatical, maternity, vacation and sick leaves and leaves of absence with or without pay
and/or extension of such leaves as well as extension of fellowships or any form of scholarship for a period not
exceeding one academic year if the budget permits and for some reason may deem satisfactory;
(j) He shall grant permission to reveal confidential matters or information affecting the college or any unit thereof, as
well as any action taken by the Board of Trustees;
(k) He shall grant permission for the use of buildings and premises of the college for academic, professional and
scientific conventions, seminars for students and related activities, and to fix the fee therefor;
(l) He is authorized to join in the execution of all contracts, deeds, and instruments for the proper conduct of the
business of the college and to assign the same in behalf of the college;
(m) He shall prepare an annual report on the work of the past year and needs of the current year including a budget
with estimates of income and expenditures; and
(n) He shall have such powers as may be specifically authorized by the Board of Trustees; he may delegate in writing
any of his specific functions to any office of the college.
SEC. 10. There shall be an Administrative Council of the College consisting of the President of the College as
chairman; and the vice-presidents, deans, directors and other officials of equal rank as members, whose duty shall be
to implement policies governing the administration, management and development planning of the college as
approved by the governing Board.
SEC. 11. There shall be an Academic Council of the college with the President as the chairman and all professors
and members of the instructional staff as members.
The Academic Council shall have the power to prescribe curricula and rules of discipline of the college subject to the
approval of the Board of Trustees. It shall fix the requirements for admission to the college as well as for graduation
and conferring of degrees, subject to the review of the Board of Trustees. The Council shall likewise have the power to
recommend students to be recipients of degrees. Through the President of the college or his duly-authorized
representative, the Council shall have disciplinary power over the students of the school within the limits prescribed by
the rules of discipline as approved by the Board of Trustees.
SEC. 12. No religious test shall be applied nor shall religious opinion or affiliation be a matter of inquiry in the
appointment of faculty members of the school: Provided, however, That no member of the faculty shall teach for or
against any particular church or religious sect.
SEC. 13. No student shall be denied admission to the college by reason of sex, nationality, religious or political
affiliation.
SEC. 14. It shall be the concern of the school to disperse ns programs primarily to the municipalities of the Province
of Rizal as may be determined by the Board of Trusts and all areas it can effectively cover.
SEC. 15. All parcels of land, buildings, equipment and facilities college personnel and records owned by the Rizal
National Agricultural School, including their obligations and appropriations shall be transferred to the Rizal College of
Agriculture and Technology: Provided, however, That college shall continue to receive the corresponding shares from
the education fund of the provincial government concerned, as are now enjoyed by the Rizal National Agricultural
School in accordance with existing laws and/or decrees.
SEC. 16. It shall be a continuing policy of the college to accept affiliation and/or integration within its operation of any
existing state college whose programs can contribute largely and effectively to the attainment of its
objectives:Provided, however, That the case of integration, the Minister of Education, Culture and Sports is authorized
to determine and approve the specific existing national schools that are to be integrated as part of the Rizal College of
Agriculture and Technology. In this particular case, it is understood that all funds, properties, and other assets as well
as obligations of the integrated school be transferred to the school pursuant to the preceding section of this Act.
SEC. 17. The Treasurer of the Republic of the Philippines shall be the ex officio treasurer of the college. All accounts
and expenses of the college shall be audited by the Commission on Audit or its duly authorized representative.
SEC. 18. On or before the fifteenth day of the second month after the opening of regular classes each year, the
governing board shall file with the Office of the President of the Philippines through the Minister of Education, Culture
and Sports, a detailed report setting forth the progress, conditions and needs of the school.
SEC. 19. Pursuant to Section fifteen of Presidential Decree Numbered Fourteen hundred and thirty-seven, the Rizal
College of Agriculture and Technology shall be deemed attached to the Ministry of Education, Culture and Sports for
purposes of policy and program coordination.
SEC. 20. All existing appropriations for the Rizal National Agricultural School are hereby transferred to the Rizal
College of Agriculture and Technology, to be disbursed in accordance with the provisions of this Act. The necessary
sum for the operation and maintenance of the college shall be provided for in subsequent General Appropriations
Acts, until which time the operation of the institution as a college shall be deferred, provided that its new name shall
take effect upon approval of this Act.
SEC. 21. The incumbent administrator of the Rizal National Agricultural School shall continue to serve as President of
the Rizal College of Agriculture and Technology until a permanent president has been appointed by the President of
the Philippines and has qualified for the position: Provided, That in the event that the incumbent president shall not
qualify as President of the Rizal College of Agriculture and Technology, he shall be entitled to full retirement
benefits: Provided, further, That he has Served the government for at least twenty (20) years:Provided, finally, That in
case the number of years served is less than twenty (20) years, lie shall be entitled to a gratuity of one month salary
for every year of service pursuant to Presidential Decree Numbered Fourteen hundred and thirty-seven.
SEC. 22. All laws, rules and regulations which are inconsistent with the provisions of this Act are hereby repealed,
amended or modified accordingly.
SEC. 23. This Act shall take effect upon its approval.

its share of national aid to local schools. The requirements for succeeding fiscal years shall be provided in the
forthcoming General Appropriations Acts.
SEC. 3. This Act shall take effect upon its approval.
Approved, June 24, 1983.
(a) Four-year business education course leading to the degree of Bachelor of Science in Business Education as well
as the masteral degree thereof;
(b) Four-year industrial arts course leading to the degree of Bachelor of Science in Industrial Arts as well as the
masteral degree thereof;
(c) Four-year technical fishery course leading to the degree of Bachelor of Science in Fisheries;
(d) Two-year business education course leading to the title of Associate in Business Education; and
SECTION 1. There shall be established, under the direct supervision of the Office of the Minister, Ministry of Health, a
ten-bed municipal hospital in the Municipality of Culaba, Sub-province of Biliran, Province of Leyte, to be known as
the Culaba Community Hospital.
SEC. 2. The amount necessary for the construction and operation of the hospital not to exceed seven hundred fifty
thousand pesos shall be funded out of the appropriations authorized by Batas Pambansa Blg. 230 for the Ministry of
Health intended for new or expanded hospitals. Thereafter, such sum as may be necessary for its operation and
maintenance shall be included in the annual General Appropriations Act.
SEC. 3. This Act shall take effect upon its approval.
Approved, June 24, 1983.
Management shall order the suspension of all transactions on this account until such time that said requirements are
complied with.
SEC. 4. Trust Receipts.Receipts from non-tax sources authorized by law for specific purposes which are collected/
received by a government office or agency acting as a trustee, agent or administrator, or which have been received as
guaranty for the fulfillment of an obligation, and all other collections classified by law or regulations as trust receipts
shall be treated as a trust liability of the agency concerned and deposited in an authorized government depository
bank or in the National Treasury, as the case may be, subject to the conditions prescribed under the Special
Provisions of the agency concerned and to the rules and regulations as determined by the Permanent Committee
created under Section 51 of P.D. No. 1177: Provided, That deposits in authorized government depository banks shall
be withdrawable on the joint signatures of the authorized representatives of the agency and the Commission on Audit
without the need of Special Budget or the issuance of a Cash Disbursement Ceiling: Provided, further, That if the
amount is deposited in a savings account, the interest shall accrue to the General Fund which shall be remitted to the
National Treasury at the end of each quarter.
SEC. 5. Seminar and Conference Fees.Ministries, bureaus, offices or agencies which conduct training programs
approved jointly by the Office of Budget and Management and the Civil Service Commission are authorized to collect
seminar and conference fees from government and private agency participants, the rates of which shall be
determined in accordance with Letter of Instructions No. 565. The proceeds derived from such seminars or
conferences may be deposited in an authorized government depository bank as a trust liability and shall be made
available for expenditure without the need for a Cash Disbursement Ceiling, to defray the costs incurred for handouts,
meals and other incidental expenses, including speakers' honoraria at rates prescribed pursuant to P.D. No. 985, but
not for entertainment or representation expenses, withdrawable on the joint signatures of the authorized
representatives of the agency concerned and the Commission on Audit: Provided, That if the income is deposited in a
savings or time deposit account, the interest thereof shall accrue to the General Fund and shall be remitted to the
National Treasury at the end of each quarter: Provided, further, That no appropriations authorized in this Act shall be
used to support or augment expenses of seminars or conferences for which fees are collected: and Provided, finally,
That any income remaining in the bank account at the end of the fiscal year shall be withdrawn and deposited with the
National Treasury as income of the General Fund. The Office of Budget and Management and the Commission on
Audit shall promulgate the necessary rules and regulations to implement this provision.
Ministries, bureaus, offices or agencies concerned shall submit to the Office of Budget and Management a monthly
report of collections and deposits and quarterly report of expenditures and financial status of its training operations,
and in case of failure to submit said requirements, the Office of Budget and Management shall order the suspension
of all withdrawals from the funds deposited until such time that said requirements are complied with.
SEC. 6. Sale of Products.Ministries, bureaus, offices or agencies are authorized to sell products of agricultural,
industrial or other projects, including official publications, and the proceeds derived therefrom shall be deposited with
the National Treasury and accrue to the General Fund, pursuant to Section 50 of P.D. No. 1177, unless otherwise
provided by law or authorized by Special Provision in this Act.
SEC. 7. Donations.Ministries, bureaus, offices, or agencies are authorized to accept donations, contributions,
grants bequests or gifts, in cash or in kind from foreign governments, international agencies, private entities or
individuals for purposes relevant to their functions. Cash proceeds shall be deposited with the National Treasury as a
Special Account in the General Fund and shall be used or expended only in accordance with the wishes of, and
purposes specified by the benefactor or donor, subject to Section 40 of P.D. No. 1177. Contributions or gifts in kind
intended for specified beneficiaries, but which are perishable in nature and would require storage or distribution
expenditures of more than forty per cent of their current market value may be sold at public auction and the proceeds
derived therefrom shall be deposited in like manner as if they were in cash, and shall be used or expended for the
same purpose, subject to the conditions imposed by the donor and Section 40 of P.D. No. 1177. All such receipts,
including equipment and other fixed assets shall be recorded in the books of the government and shall be subject to
pertinent accounting and auditing rules and regulations.
The agency concerned shall submit to the Office of Budget and Management and to the Commission on Audit
quarterly/monthly report of the proceeds from such donations, contributions, grants, bequests or gifts, in cash or in
kind, including a quarterly report of expenditures or disbursements thereof.
SEC. 8. Performance Bonds and Deposits.Performance bonds and deposits filed or posted by private persons or
entities with agencies of the government shall be deposited with an authorized government depository bank as trust
liabilities and under the name of the agency concerned. Upon faithful performance of the undertaking or termination
of the obligation for which the bond or deposit was required, any amount due shall be returned to the filing party and
the office or agency concerned, withdrawable on the joint signatures of the authorized representatives of the agency
and the Commission on Audit without the need for Cash Disbursement Ceiling:Provided, That any interest accruing
on deposit account and any forfeited amounts shall be recorded as income of the General Fund and shall be remitted
to the National Treasury at the end of each quarter. This provision shall apply to bonds posted in cash, such as
bidder's bond, guaranty bonds, bail bonds, judicial deposits for the benefit of clients, cash under litigation deposited in
court or quasi-judicial bodies and other refundable and judicial bends, and all bonds and deposits required by law,
rules and regulations to be posted to ensure the faithful performance of an activity or undertaking.
Authorized Expenditures
SEC. 9. Reorganization of the Executive Branch.The President may adjust, realign or modify key budgetary
inclusions and appropriations authorized in this Act as may be necessary to implement the reorganization of
ministries and agencies of the government as approved by law or pursuant to Presidential Decree No. 1416 granting
continuing authority to the President of the Philippines to reorganize the administrative structure of the National
Government: Provided, That the total amount as realigned does not exceed the grand total of all the appropriations of
the ministries concerned.
SEC. 10. Use of Savings.Ministries, bureaus, offices and agencies are hereby authorized, subject to LOImp. No. 29
and P.D. No. 1177, to use savings realized from appropriations actually released for the settlement of the following
obligations and activities incurred during the current year:
a.
Payment of hazard duty pay and of retirement gratuity or separation pay of employees who are entitled
thereto under existing law or are laid off as a result of the elimination, of their positions under authorized
procedures;
b.
Payment of the share of the National Government in the salaries of officials and employees in newly created
and/or reclassified local government units where no appropriation has been provided in this Act or where the
authorized appropriation is not sufficient to cover the salaries of the said officials and employees;
c.
Provision for social and economic opportunities and such other activities intended for the welfare of the
cultural minorities as may be undertaken by the Presidential Assistant on National Minorities;
d.
Organization, activation, training and operation of military units for the purpose of implementing agency
development projects in areas adversely affected by peace and order problems, including salaries and allowances
of all military personnel assigned thereto;
e.
Payment of obligations of the National Government or any of its ministries or agencies arising from perfected
and valid contracts, or international agreements;
f.
Purchase or repair of equipment and furniture, including motor vehicles, to replace those lost or destroyed
through, theft or robbery, accident, fire, typhoon and other natural calamities, and to replace unserviceable and
condemned items;
g.
Expansion of essential facilities and services, including the opening of additional classes in elementary,
secondary and vocational schools, as may be approved by the President;
h.
Funding of foreign exchange and peso requirements of foreign-assisted projects; and
i.
Augmentation of operational expenses.
SEC. 11. Key Budgetary Inclusions.The Key Budgetary Inclusions (KBI) of ministries, bureaus, offices or agencies
shall be released and used only for the indicated purposes and conditions, except as may be otherwise approved by
the President, pursuant to P.D. No. 1177: Provided, That the amounts herein appropriated and funded from loan
proceeds or donations shall be released only to the extent of actual loan availments or receipts, as the case may be,
and shall not be used for any purpose other than that specified in the loan agreement or in the deed of donation.
SEC. 12. Expenditure Components.No change or modification shall be made in the expenditure items referred to in
the General Appropriations Act and other appropriations laws except by the act of the Batasang Pambansa or of the
President, as the case may be, upon recommendation of the Office of Budget and Management.
SEC. 13. Cash Advances for Foreign-Assisted Projects. Any provision of law to the contrary notwithstanding, cash
advances may be authorized to meet the expenditure requirements of foreign-assisted projects in cases where the
approved project/loan agreement provides specifically for a reimbursement mechanism for expenses incurred, subject
to the approval of the Office of Budget and Management and to applicable accounting and auditing regulations.
SEC. 14. Foreign Purchases and Other Importations. Purchases under foreign military sales agreements, heavy
equipment imports for infrastructure projects and other importations of agencies which are financed by foreign
borrowings or by Central Bank consolidated borrowing programs shall be subject to the requirement of certification of
availability of appropriations released for the purpose, to the requirements of LOI No. 880 and to applicable laws,
rules and regulations.
SEC. 15. Foreign Exchange Requirements.Except as otherwise provided in this Act, the appropriations for
ministries, bureaus, offices or agencies allotted for maintenance and other operating expenses may be used for
foreign exchange requirements of duly approved activities, including payment of dues to international organizations,
subject to the prior approval of the Office of Budget and Management.
SEC. 16. Condition on the Use of Regular Budgetary Allocations for Importations.Funds appropriated for ministries,
bureaus, offices or agencies, state universities and colleges and government-owned and controlled corporations may
be used to finance the importation of any commodity or service, including payments for equipment, supplies and
consultancy fees only upon prior approval of a Special Budget for the purpose under Section 40 of P.D. No. 1177.
SEC. 17. Release and Disbursement of Funds for Foreign Mission.The maintenance and other operating expenses
of foreign missions and attaches shall be released and/or disbursed only in accordance with a Special Budget
specifically intended for foreign posts and approved under Section 40 of P.D. No. 1177.
For this purpose, no personnel of any ministry, bureau, office or agency who is not included in said Special Budget
shall be assigned or attached to foreign missions except upon prior approval of the Office of Budget and
Management.
SEC. 18. Legal Assistance.With the approval of the President and upon recommendation of the Minister of Justice
and the Presidential Commission on Reorganization, the funds herein appropriated for legal assistance activities,
including those in the Ministry of Justice, Ministry of Labor and Employment, Ministry of Agrarian Reform, Ministry of
Agriculture, and other agencies may be realigned so as to ensure a fully integrated legal assistance program.
SEC. 19. Purchase of Computer Equipment.The appropriations authorized in this Act for the purchase of computer
equipment shall be released only with the approval of the President upon recommendation of the National Computer
Center and the Office of Budget and Management.
SEC. 20. Purchase of Motor Transport Equipment.No appropriations authorized in this Act shall be used directly or
indirectly for the purchase of motor transport equipment unless otherwise directly authorized by the President or as
approved by the Executive Committee upon recommendation of the Office of Budget and Management as provided by
Letter of Instructions No. 1220 and Letter of Implementation No. 29.
SEC. 21. Purchase of Supplies, Materials and Equipment Spare Parts.The stock on hand of supplies, materials and
equipment spare parts, to be acquired thru ordinary purchase out of appropriations herein provided, shall at no time
exceed normal three-month requirements, subject to pertinent rules and regulations issued by competent
authority: Provided, That heads of ministries, bureaus, offices or agencies or other instrumentalities of the government
may approve the build-up of stocks on hand of critical supplies and materials as defined or specified by the Office of
Budget and Management in anticipation of cost increases, of requirements of a national emergency, or of an
impending shortage in the items concerned; specifying maximum quantities of individual items, but in no case shall
these stocks exceed more than one year's need, unless otherwise approved by the President, upon the joint
recommendation of the Minister concerned and the Chairman of the Commission on Audit.
SEC. 22. Emergency Purchases.Unless otherwise provided in this Act, ministries, bureaus, offices or agencies of
the National Government are authorized to make emergency purchases of supplies, materials and spare parts of
motor transport equipment that are urgently needed for the repair of ambulances, motor vehicles, vessel and aircrafts
or to meet an emergency which may involve the loss of, or danger to, life and/or property, or are to be used in
connection with a project or activity which cannot be delayed without causing detriment to the public service, in a
monthly amount not exceeding four per centum of the annual agency expenditure program for supplies and materials
out of the appropriations allotted for maintenance and other operating expenses of the agency concerned, except as
may be authorized by the President, upon the joint recommendation of the Office of Budget and Management and the
Commission on Audit.
SEC. 23. Repair of Buildings.Ministries, bureaus, offices or agencies, including public schools, courts of justice and
hospitals may use their appropriations allotted for maintenance and other operating expenses for minor repairs of
their offices and buildings which are government-owned.
SEC. 24. Cultural and Athletic Activities.An amount not exceeding P15,000 per annum out of the appropriations
each ministry, bureau, office or agency, and P5,000 for each regional office of each regionalized ministry, bureau,
office or agency, may be used for cultural and athletic activities, including purchase of uniforms at not more than P250
for each participant, and for supplies and necessary expenses for said activities. The amounts fixed in this section
constitute the allowable maximum to be expended by any bureau, office or agency for its cultural and athletic
activities, except as otherwise approved by the President: Provided, That these amounts may be pooled by the
Minister concerned into one fund, programmed and controlled to best serve the needs of all the offices, bureaus and
agencies therein.
SEC. 25. Extraordinary and Miscellaneous Expenses.Appropriations herein authorized may be used for
extraordinary expenses not exceeding: (a) P30,000 for each Minister or equivalent; (b) P10,000 for each Deputy
Minister or equivalent; (c) P4,000 for each Assistant Minister/ Secretary or head of bureau or organization of equal
rank to a bureau and for each Ministry Regional Director; and (d) P2,000 for each Bureau Regional Director. In
addition, official entertainment and other miscellaneous expenses not exceeding P6,000 per annum shall be
authorized for each of the following offices:
1.
Office of the Minister;
2.
Office of the Deputy Minister;
3.
Office of the Assistant Minister/Secretary;
4.
Bureau or Organizations of Equal Rank to a Bureau;
5.
Office of the Ministry Regional Director; and
6.
Office of the Bureau Regional Director.
These expenditures shall be payable on a reimbursement basis upon presentation of receipts and chargeable to
appropriations allotted for maintenance and other operating expenses of the corresponding office.
For purposes of this Section, extraordinary and miscellaneous expenses shall include, but not limited to, expenses
incurred for or during meetings, seminars and conferences, official entertainment, public relation, educational, athletic
and cultural activities, contributions to civic or charitable institutions, membership fees in government associations,
subscription to professional technical journals and informative magazines, library books and materials, office
equipment and supplies and other similar expenses that are not supported by the regular budget allocation: Provided,
That no portion of the amounts authorized herein shall be used for the creation of positions, nor for salaries, wages,
allowances, intelligence and confidential expenses.
SEC. 26. Release of Intelligence and Confidential Funds. Intelligence and confidential funds provided for in the
budgets of ministries, bureaus, offices or other agencies of the National Government, including amounts from savings
authorized by special provisions to be used for intelligence and counter-intelligence activities, shall be released only
on a project basis upon approval of the President.
SEC. 27. Information Outlay.The appropriations pertaining to information activities of the various ministries,
bureaus, offices or agencies shall be released upon presentation of an appropriate program of activities prepared in
coordination with the Office of Media Affairs, copies whereof shall be furnished the Members of the Batasang
Pambansa: Provided, That each ministry, bureau, office or agency shall include in its program of information
dissemination, the adequate and timely reproduction of relevant laws and other administrative issuances for
distribution to its lowest field organizational units, including those units over which it exercises supervision:Provided,
further, That assistance of the Office of Media Affairs in printing such documents shall be made to achieve
economical, efficient and effective dissemination thereof.
SEC. 28. Loans Outlay.The amounts authorized for loans outlay in the budgets of ministries, bureaus, offices and
other agencies, including accumulated balances and receivables, shall be remitted to government financial institutions
to be constituted and administered as a trust fund under such terms and conditions as may be agreed upon by the
head of the agency and the government financial institution concerned.
The rules and regulations governing the use of the trust fund shall be formulated by the Office of Budget and
Management.
Contracts
SEC. 29. Funding of Contracts.Notwithstanding the availability of deferred payment terms, ministries, bureaus,
offices or agencies concerned, before entering into a contract involving the expenditure of public funds, including
contracts for services or consultancy, contracts of lease, equipment rental, construction of partitions or improvements
in leased buildings, or contracts involving an increase in the approved contract price shall secure a certification of
availability of funds for the purpose from the agency Chief Accountant, subject to applicable rules and regulations as
may be issued by the Office of Budget and Management and to Sections 46 and 64, P.D. No. 1177: Provided, That
the certification of availability of funds sufficient to cover the cost of the contracted activities shall be contained in and
made part of the contract duly signed by the Chief Accountant of the contracting agency, as provided for by LOI No.
968.
SEC. 30. Loan Agreements.Ministries, bureaus, offices, or agencies may enter into foreign or domestic loan
agreements, whether in cash or in kind: Provided, That such loan agreements shall be in accordance with the
provisions of R.A. No. 245, as amended, LOI No. 880 and LOI No. 1307. Report of such agreement shall be furnished
the Members of the Batasang Pambansa.
Foreign borrowings shall not be incurred except for purposes and under conditions authorized under LOI No. 1307
and R.A. No. 4860, as amended.
SEC. 31. Contracts for Security and Janitorial Services. Ministries, bureaus, offices or agencies are authorized to
contract for security and janitorial services with private firms after public bidding of which the cost thereof may be paid
from savings in the appropriations of the ministry, bureau, office or agency concerned: Provided, That the execution of
the contract for security and janitorial services shall not operate to automatically abolish or render vacant any existing
occupied security or janitorial position in the contracting office or agency: Provided, further, That when said security or
janitorial position shall subsequently become vacant, said position shall be considered automatically abolished.
SEC. 32. Future Payment of Contractual Obligations. Ministries, bureaus, offices or agencies, before entering into
contracts for delivery of goods or services against future payment, shall first secure a certification of the availability of
the full contracted amount for such goods or services out of the agency's appropriations. No contracts shall be
entered into nor work shall be undertaken without such certification of fund availability.
SEC. 33. Lease-Purchase Agreements.Ministries, bureaus, offices or agencies may enter into agreements for
lease-purchase of equipment subject to public bidding and to the approval of the Office of Budget and Management,
and other pertinent accounting and auditing regulations. Details of the payment shall be indicated in the leasepurchase agreement and accompanied with certification of availability of equipment outlay authorized for the agency
in this Act to cover the full contract cost: Provided, That lease-purchase agreements may be entered into only for
specialized equipment with high unit costs and not for such equipment as typewriters, adding machines, automobiles
the purchase price of which is at least P50,000.00: and Provided, further, That all lease-purchase agreements of
equipment with a total value in excess of P200,000.00 shall be subject to the approval of the President.
PERSONAL SERVICES BENEFITS
SEC. 34. Funding of Personnel Benefits.The personnel benefits costs of government officials and employees shall
be charged against the respective funds from which their compensation and/or salaries are paid.
All authorized supplementary/additional compensation, fringe benefits and other personal services costs of officials
and employees whose salaries are drawn from special accounts or special funds, such as salary increases and
adjustments, merit increases, incentive/service fees, vacation and sick leaves, retirement and life insurance
premiums, compensation insurance premiums, health insurance (Medicare) premiums, Pag-I.B.I.G. contributions,
hospitalization and medical benefits, scholarship and educational benefits, training and seminar expenses, all kinds of
allowances, whether commutable or reimbursable, in cash or in kind, and other personnel benefits and privileges
authorized by law, including the payment of retirement gratuities, separation pay and terminal leave benefits shall be
charged against the corresponding fund from which their basic salaries are drawn and in no case shall such
personnel benefits costs be charged against the General Fund of the National Government.
Officials and employees on detail with other offices, including the representatives and support personnel of auditing
units assigned to serve other offices or agencies, shall be paid their salaries, emoluments, allowances and the
foregoing supplemental compensation, fringe benefits and other personal services costs from the appropriations of
their parent agencies and in no case shall such be charged against the appropriations of the agencies where they are
assigned or detailed, except when authorized by law.
SEC. 35. Transportation and Representation Allowances.The following officials and those of equivalent rank as may
be determined by the Office of Budget and Management are hereby granted monthly commutable transportation and
representation allowances payable from the programmed appropriations provided for their respective offices, not
exceeding the rates indicated below, which shall apply to each type of allowance:
a.
At P1,000 for Ministers;
b.
At P750 for Career Executive Service Rank I officials,
c.
At P650 for Career Executive Service Rank II Officials;
d.
At P550 for Career Executive Service Rank III Officials;
e.
At P475 for Career Executive Service Rank IV Officials;
f.
At P400 for Career Executive Service Rank V Officials ; and
g.
At P325 for Chiefs of Divisions, identified as such in the Personal Services Itemization.
The transportation allowance herein authorized shall not be granted to officials who are as-signed a government
vehicle or use government motor transportation, except as may be approved by the President. Unless otherwise
provided by law, no amount appropriated in this Act shall be used to pay for representation and/or transportation
allowances, whether commutable or reimbursable which exceed the rates authorized under this Section. Previous
administrative authorizations not consistent with the rates and conditions herein specified shall no longer be valid and
payment shall not be allowed.
Allowances of those officials who are receiving salaries from special accounts or special funds shall be charged
against the corresponding fund from which their salaries are charged. Officials on detail with other offices, including
officials of the Commission on Audit assigned to serve other offices or agencies, shall be paid the allowance herein
authorized from the appropriations of their parent agencies.
SEC. 36. Official Vehicles and Transport.Government motor transportation may be used by the following officials,
and those who may be specifically authorized by the President with costs chargeable to the appropriations authorized
for their respective offices:
a.
The President of the Philippines;
b.
The Prime Minister;
c.
The Speaker of the Batasang Pambansa;
d.
The Chief Justice of the Supreme Court;
e.
f.
g.
h.
i.
rate of quarters allowance or rental, as the case may be shall be determined by the Office of Budget and
Management.
SEC. 43. Compensation of Contractual Personnel.Heads of ministries, bureaus, offices or agencies, when
authorized in their respective appropriations as provided under this Act, may hire consultants, experts and other
contractual personnel to perform specific vital activities or services which cannot be provided by the regular staff of
the agency, limited to such period when their services are reasonably required and to activities that shall have a
definite expected output. Such contractual personnel may be paid compensation inclusive of fees, honoraria, per
diems and allowances not exceeding 120% of the minimum salary of an equivalent position in the National
Classification and Compensation Plan, except as may be authorized by the Office of Budget and Management in the
following instances: (a) when the consultant or expert is an acknowledged authority in his field of specialization, and
(b) where the consultant or expert is hired to perform a specific activity or service that requires technical skill and
expertise which local labor force cannot provide, or if such expertise is available, the supply is limited: Provided, That
in no case shall such compensation exceed the salary of his immediate superior, except as may be otherwise
approved jointly by the Civil Service Commission and the Office of Budget and Management:Provided, further, That
no amount appropriated in this Act shall be used for payment of retirement gratuity under Section 12 (c) of C.A. No.
186, as inserted by E.A. No. 1616, as amended, nor for leave benefits pertaining to services rendered under
contractual employment, nor use the compensation received for the same period as basis for computation of leave
benefits, except where specifically provided by law.
For purposes of this Section, appointments to positions funded from lump-sum appropriations for personal services
for the payment of consultants, technical, professional and expert services, confidential assistants or other similar
positions, or from capital outlays, feasibility studies fund, subsidies, donations, special projects fund, either funded by
the General Fund and/or supported by domestic or foreign loans, and other similar funds which may be used for
personal services, are considered contractual in nature. Appointments which are funded from special lump-sum
appropriations, subsidies and contributions from other agencies, shall likewise be considered as contractual in nature,
and subject to the above restrictions and limitations, except as may be determined by the Office of Budget and
Management.
SEC. 44. Restriction on the Use of Appropriations for Retirement Gratuity and Terminal Leave.Unless otherwise
authorized by law, no amount appropriated in this Act shall be used for payment of retirement gratuity under the
provisions of SEC. 12 (c) of C.A. No. 186, as inserted by R.A. No. 1616, as amended, and terminal leave benefits of
retiring officials and employees which include in the computation thereof additional compensation received for: (a)
overtime services rendered beyond regular office or school hours; (b) per diems for attendance in board or committee
meetings or conferences or for travel outside official stations; (c) mid-year, Christmas, thirteenth month and other
bonuses; (d) allowances for cost of living, subsistence, quarters, housing, laundry, clothing/uniform, family, education,
hazardous, occupation, overseas duty, post/station, medical/dental/hospitalization, representation, transportation,
extraordinary and miscellaneous, amelioration, inflation, incentive and such other similar allowances; (e) fees on per
capita basis as members/examiners of professional regulation and other examination boards; (f) honoraria as
resource speaker or lecturer in conferences or seminars or as instructors in classrooms for excess teaching loads
granted over basic pay rendered at night or on Saturdays, holidays and summer vacation; (g) fees for consultancy or
similar services rendered to committees, boards, offices or agencies; and (h) service fees for extra services and other
similar compensation paid for rendition of additional services.
SEC. 45. Unauthorized Pre-Retirement Promotions and Salary Increase.No portion of the appropriations provided
in this Act shall be used for automatic promotions or for salary increases and adjustments granted to retiring officials
and employees, which are not authorized by law and duly formalized in the form of a National Compensation Circular.
SEC. 46. Personal Liability of Officials for Payment of Unauthorized Personal Services Cost.No official or employee
of any ministry, bureau, office, agency, commission, board, state university or college, of the National Government,
including those of government-owned or controlled corporations shall be granted and/or paid any unauthorized
compensation, either basic, additional or supplementary, or fringe benefits and allowances of any kind, including
payment of retirement benefits and terminal leaves computed in violation of the General Provisions in this Act or other
existing laws, which are chargeable against the appropriations authorized in this Act or under other appropriation laws
or from other income of the Government.
The payment of any unauthorized compensation, allowance, fringe benefits or personal services costs made in
violation of this Section or of the General Provisions in this Act is null and void and is the personal liability of the head
of the office or agency who authorized such payment, the Resident Auditor, other officials and employees who
participated or took part therein, and the person who received such payments, who shall be jointly and severally liable
for the refund of the full amount so paid and received, in addition to any disciplinary action that may be instituted
against such erring officials under the provisions of Sections 49 and 87 of P.D. No. 1177 and to any criminal action
under the Revised Penal Code and other penal laws.
Local Government Units
SEC. 47. Sharing of National Revenues.The computation of appropriations herein authorized for local government
revenue sharing established under P.D. Nos. 144 and 436 (as amended) shall be based on revenues excluding
income recorded but charged to the General Fund Adjustments and Customs Duties Fund provided in this Act
assessed on otherwise tax-exempt government agencies and corporations. Compliance with the sharing formula as
provided by law shall be determined taking into account all kinds allocated and released for local government units,
except for the budgetary aid fund herein appropriated pursuant to Item No. 7 of P.D. No. 144.
Administrative Procedures
SEC. 48. Release of Funds for Training Programs. Ministries, bureaus, offices or agencies shall formulate and
review their training programs in light of the need to train personnel in skills and attitudes. Such training programs
shall be submitted to the Training Coordination Committee created under LOI No. 754, which shall review and
evaluate the training activities. No appropriation for training shall be released without such review and evaluation.
SEC. 49. Direct Release of Funds to Regional Offices. Funds allotted for regional offices but included in the budgets
of their central offices or which are specifically allocated for the different regions shall be released directly to said
regional offices when dictated by the need and urgency of regional activities, pursuant to SEC. 38(e) of P.D. No. 1177.
Imposition of any retention or deduction as reserves shall not be allowed except as may be authorized by the Office of
Budget and Management. For this purpose, the Office of Budget and Management shall identify by region the
expenditure programs of agencies in the national government budget and shall release funds intended for them in
accordance with the approved regional distribution of expenditures, specifying the region of destination.
SEC. 50. Prohibition Against Deduction/Retention of Allotment.Fund releases from appropriations provided in this
Act for any project or activity shall be transmitted intact or in full to the office or agency concerned and no retention or
deductions as reserves or overhead shall be made, except as authorized by law or upon direction of the President.
The Commission on Audit shall ensure compliance with this provision to the extent that sub-allotments by ministries
and/or central agencies to their subordinate offices are in conformity with allocations in budgetary Advice of
Allotments issued by the Office of Budget and Management.
SEC. 51. Release of Appropriations to Local Government Units.Funds appropriated herein for local government
units shall be released only after the approval of their respective budgets pursuant to the provisions of P.D. No. 1375,
except as may be authorized jointly by the Ministry of Local Government and the Office of Budget and Management.
SEC. 52. Administration of the Releases of Funds Allotted for Operating Expenses and Equity Investments in
Government Corporations.Funds herein appropriated for operating expense contributions and equity investments in
government-owned or controlled corporations and other public corporate bodies shall be under the administration of
the Office of Budget and Management. Said funds shall be directly released to the recipient corporation through the
Bureau of the Treasury on the basis of a Work and Financial Plan prepared and submitted by the Corporation
concerned, subject to SEC. 40 of P.D. No. 1177 and Letter of Implementation No. 29.
SEC. 53. Corporate Equity Investments.The appropriations herein authorized for equity investments may be used
by the National Treasurer for the payment of loans relent to corporations, including the obligations incurred by the said
corporations for the reimbursement of advances made by the National Treasury on obligations guaranteed by the
Government of the Republic of the Philippines, subject to the approval of the President upon recommendation of the
Office of Budget and Management.
SEC. 54. Submission of Financial Statement.All government-owned or controlled corporation shall submit to the
Office of Budget and Management and to the Members of the Batasan their respective financial statements, including
plans, programs, targets and other reports as may be required from time to time. The annual reports shall be done
and submitted as herein provided on or before March 31, of the succeeding year.
SEC. 55. Unauthorized Organizational Units.Unless otherwise created by law or directed by the President, no
organizational unit in any ministry, bureau, office or agency shall be authorized in the respective organizational
structures and be funded from appropriations provided by this Act, without authority from the Presidential Commission
on Reorganization and the Office of Budget and Management. Organizational units created by administrative
authorizations shall be considered as ad hoc arrangements that shall be staffed by contractual personnel or staff
members on detail.
SEC. 56. Implementation of Construction Projects. Construction projects funded from capital outlays authorized in
this Act under the various ministries, bureaus, offices or agencies of the National Government, including the
construction of buildings for state universities, colleges, schools, hospitals, sanitaria, health centers and health
stations, roads and bridges, shall be implemented only in accordance with the appropriate standards and
specifications for the planning, survey, design and construction of the projects as prescribed by the Ministry of Public
Works and Highways or the Ministry of Transportation and Communications, through either of said ministries as the
case may be. In addition, land use and zoning guidelines shall be prescribed by the Ministry of Human Settlements.
In the prosecution of the construction projects, Sections 2, 3, 4, 5, 6, 7, 9 and 10 of Batas Pambansa Blg. 50 entitled
"An Act Appropriating Funds for Public Works and Highways Projects and for Other Purposes", and other legislations
on public works shall be strictly complied with whenever applicable.
Concluding Provisions
SEC. 57. Separability Clause.If for any reason any section or provision of this Act is declared unconstitutional or
invalid, other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect.
SEC. 58. Effectivity.The provisions of this Act shall take effect on January one, nineteen hundred and eighty-four
unless otherwise provided herein.

1. The Members of the Batasang Pambansa shall be elected by the different provinces with their component cities, by
highly urbanized cities, and by the districts of Metropolitan Manila, instead of by the various regions. Each province,
highly urbanized city and district of Metropolitan Manila shall be entitled to at least one Member. The total number of
Members of each province and city shall at least be the same as under the 1935 Constitution.
2. The Members of the Batasang Pambansa to be elected by the different provinces with their component cities,
highly urbanized cities, and the districts of Metropolitan Manila shall be apportioned, unless otherwise provided by
law, as follows:

Any province that may hereafter be created or any component city that may hereafter be declared by or pursuant to
law as a highly urbanized city, shall be entitled in the immediately following election to at least one Member or such
number of Members as it may be entitled to on the basis of the number of its inhabitants and on the same uniform
and progressive ratio used in the, last preceding apportionment. The number of Members apportioned to the province
out of which the new province was created or where the new highly urbanized city is geographically located shall be
correspondingly adjusted by the Commission on Elections but such adjustment shall not be made within one hundred
twenty days before the election.
4. The residence requirement in the political subdivision in which a Member of the Batasang Pambansa will be
elected is reduced from one year to six months immediately preceding the day of the election.
QUESTION NO. 2
Do you vote for the approval of amendments to the Constitution as proposed by the Batasang Pambansa in
Resolution Numbered 110 which, in substance, provide for a different mode of presidential succession with the
following salient features:
1. Abolition of the Executive Committee and Creation of the Office of the Vice-President
(1) The Executive Committee provided in Section 3, Article IX of the Constitution is abolished.
(2) The Office of the Vice-President is created. The Vice-President shall have the same qualifications and term of
office and may be removed from office in the same manner as the President. He may be appointed as a member of
the Cabinet and he may be nominated and elected as Prime Minister. He shall be elected with and in the same
manner as the President. A vote for the President shall also be a vote for the Vice-President running under the same
ticket of a political party, unless otherwise provided by law. The age qualification for President and Vice-President is
reduced to 40 years old.
(1) In case a vacancy in the Office of President occurs before the presidential election of 1987, the Speaker of the
Batasang Pambansa shall act as President until a President and a Vice-President or either of them shall have been
elected and shall have qualified.
(2) The Batasang Pambansa shall, at ten o'clock in the morning of the third day after the vacancy occurs, convene in
accordance with its Rules without need of a call and within seven days enact a law calling for a special election for
President and Vice-President to be held not earlier than forty-five days and not later than sixty days from the time of
such call. The convening of the Batasang Pambansa cannot be suspended nor the special election postponed. No
special election shall be called if the vacancy occurs within seventy days before the date of the presidential election of
1987.
(3) The tenure of office of the President and Viee-President elected in the special election shall commence at noon of
the tenth day following their proclamation, and shall end at noon on the thirtieth day of June of the sixth year
thereafter.
(1) The Acting President may not declare martial law or suspend the privilege of the writ of habeas corpus without the
prior consent of at least a majority of all the Members of the Batasang Pambansa.
(2) He may not issue any decree, order or letter of instruction while the lawmaking power of the President is in force.
(3) He shall be deemed automatically on leave and the Speaker Pro-Tempore shall act as Speaker. While acting as
President, the Speaker may not be removed.
(4) He shall not lie eligible for election in the immediately succeeding election for President and Vice-President.
(5) Appointments extended by the Acting President shall remain effective unless revoked by the newly elected
President within ninety days from his assumption of office.
(1) If at the time fixed for the beginning of his term, the President-elect shall have died, the Vice-President elect shall
become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if
the President shall have failed to qualify, then the Vice-President shall act as President until a President shall have
qualified.
(2) In case of permanent disability, death, removal from office or resignation of the President, the Vice-President shall
become the President to serve the unexpired term.
5. Statutory succession
(1) The Batasang Pambansa shall by law provide who shall act as President or the manner in which one who is to act
shall be selected if neither a President-elect nor a Vice-President-elect shall have been chosen nor shall have
qualified, or both shall have died at the time fixed for the beginning of their term.
(2) The Batasang Pambansa shall by law provide for the death, permanent disability or resignation of the Speaker at
the time the vacancy in the Office of the President occurs or subsequently thereafter, declaring who shall serve as
President until the President and the Vice-President shall have been elected and qualified, subject to the same
restrictions of powers and disqualifications as the Speaker when acting as President.
QUESTION NO. 3
Do you vote for the approval of amendments to the Constitution as proposed by the Batasang Pambansa in
Resolution Numbered 105 which, in substance, provide that grant shall be an additional mode for the acquisition of
lands belonging to the public domain and that the agrarian reform program may include the grant or distribution of
alienable lands of the public domain to qualified tenants, farmers and other landless citizens.
SEC. 4. In case of any resolution that may hereafter be approved proposing further amendment or amendments to
the Constitution, the Commission on Elections is empowered to formulate the appropriate question or questions
based on the resolution concerned for inclusion in the same ballot as the other questions to be submitted in the
plebiscite herein called.
SEC. 5. There shall be a Citizen's Election Committee in every voting center to be composed of three public school
teachers one of whom shall be designated as the chairman. In case the number of public school teachers is
insufficient, the Commission on Elections may appoint private school teachers. The members of the committee shall
each receive a compensation of fifty pesos per day of service which shall be paid not later than thirty days following
the day of the plebiscite.
SEC. 6. The Citizens' Election Committees shall prepare and sign four copies of the returns of the plebiscite in their
respective voting centers on a form to be prescribed by the Commission on Elections. The fourth copy shall be
deposited in the ballot box for valid ballots, and three copies shall be delivered to the election registrar concerned who
shall retain one copy, immediately deliver the original to the provincial election supervisor and forward the other to the
Commission on Elections. In cities, the election registrar shall deliver the original to the city board of canvassers and
forward the other to the Commission on Elections. Certified copies of the plebiscite returns may be issued by the
election committees upon request of interested parties and such certified copies shall he evidence of the results of
the plebiscite in the voting centers concerned.
SEC. 7. (1) There shall be a provincial board of canvassers in each province to be composed of the provincial election
supervisor or a representative of the Commission, as chairman, and-the provincial fiscal and the division
superintendent of schools, as members: Provided, That in case there are two or more division superintendents of
schools in a province, the Commission shall appoint as member the more senior superintendent who is not a native of
the province.
(2) There shall be a city board of canvassers in each city to be composed of the city election registrar or a
representative of the Commission on Elections who should be a lawyer, as chairman, and the city fiscal and the city
superintendent of schools, as members.
SEC. 8. Upon the completion of the canvass, the provincial or city board of canvassers as the case may be shall
prepare a certificate of canvass in duplicate. The original shall be delivered to the Commission on Elections in Manila
by the fastest possible means and the duplicate shall be filed in the Office of the Provincial Election Supervisor.
Certified copies of the certificate of canvass may be issued by the board of canvassers upon request of interested
parties and such certificates shall be evidence of the results of the canvass in the province or city concerned.
SEC. 9. The Commission on Elections, sitting en banc shall, not later than twenty days from the date of the plebiscite,
canvass and proclaim the result of the plebiscite using the certificates submitted to it, duly authenticated and certified
by the board of canvassers of each province or city.
SEC. 10. The President shall issue a proclamation upon submission to him by the Commission on Elections of the
results of the plebiscite, declaring the amendments ratified in the plebiscite as in full force and effect as part of the
Constitution of the Philippines.
SEC. 11. On such date as the Commission on Elections may fix, which shall not be later than January 17, 1984, the
Commission on Elections shall order a new registration of voters in any voting center, motu proprio or upon verified
petition of any election registrar, political party or voter after due notice and hearing, in areas where there is need
therefor to cleanse the list of voters of illegal or irregular registrants. Not later than five days before the date fixed for
the plebiscite, the complete list of voters shall be posted in every voting center. Failure to comply with this requirement
shall be considered serious election offense and shall be penalized as such.
SEC. 12. The expenses for the plebiscite shall be charged to the appropriations of the Commission on Elections
authorized for the purpose in the General Appropriations Acts of 1983 and 1984. In case of deficiency, the
appropriations herein provided may be augmented from funds authorized under said General Appropriations Acts
under the Special Activities Fund.
SEC. 13. The plebiscite shall be conducted and supervised by the Commission on Elections and shall be governed by
the pertinent provisions of the 1978 Election Code and other applicable laws. The Commission on Elections shall
promulgate the rules and regulations necessary to carry out the provisions of this Act.
SEC. 14. This Act shall take effect upon its approval.
