This EMN Glossary has been developed by the European Migration Network (EMN). The European
Commission and the National Contact Points, who collectively constitute the EMN, accept no
responsibility or liability whatsoever with regard to the use made of the information contained in
this glossary or of the content of the websites from which some terms are extracted.
1. Introduction
This is the first version of the EMN Glossary of terms relating to Asylum and Migration. The
purpose of this glossary is inter alia to improve comparability between EU Member States through
the use and common understanding of the terms and definitions contained herein. The glossary is
intended to serve as a useful reference document for EMN National Contact Points (EMN NCPs)
and their national network members, as well as for other practitioners in the field of asylum and
migration.
The glossary has been developed by the European Migration Network (EMN) within the context of
a Glossary and Thesaurus Working Group. It is the first stage of the development of this glossary,
since other terms will be introduced, refinements made to definitions, and updates published
accordingly. The glossary shall also be used in the development of an EMN Thesaurus, the purpose
of which is to facilitate structured searching of the documents contained within the EMNs
Information Exchange System.1
In the subsequent sections, an overview of the EMN is first given, followed by an outline of the
methodology used to develop the glossary. The glossary terms themselves are then given, consisting
of some 300 terms discussed and developed in a highly co-operative manner by the EMN NCPs
constituting the Glossary and Thesaurus Working Group.
The EMN would like to acknowledge the extensive efforts of the working group and its
appreciation for the permission given by other entities (ILO, IOM, OECD, UN, the EU Democracy
Observatory and the THESIM project) to the use of terms and definitions which they had developed
previously and which are duly referenced in the glossary.

approaches (politics, law, sociology) in which the terms are used. Because of the lack of universally
accepted definitions, different groups of interest and bodies (e.g. governments, police and border
authorities, governmental and non-governmental organisations) tend to use their own definitions,
according to their perspective. To further complicate matters, there are not only within the same
Member State different approaches followed, but also the usage of migration terms varies between
Member States.
In order to ensure a unique use of terms when indexing documents and to facilitate the formulating
of questions for the retrieval of documents in the EMNs Information Exchange System, a Glossary
and Thesaurus Working Group was created within the EMN. As existing definitions in the field of
migration and asylum are often vague, controversial or contradictory, and as there are, for many
terms, no universally accepted definitions, the Working Group established a hierarchy in the source
of definitions, the highest priority being for definitions given in the EU acquis on asylum and
immigration.6 The priority in definitions used was, therefore, according to those given (highest
priority first):
1. In EU Directives/Regulations/Decisions and then any definitions given in European Commission
Communications, particularly those with proposals for directives; then
2. By other EU entities, including the European Commissions Eurostat, FRONTEX, Fundamental
Rights Agency, National Contact Points on Integration, plus EUROJUST, EUROPOL; then
3. In European/International Conventions, Treaties and Protocols (e.g. on smuggling, trafficking,
Palermo, from the Council of Europe, International Criminal Court); then
4. By glossaries developed by the ILO, IOM, OECD, UNHCR; followed by
5. Other relevant (EU) projects/entities.
Given this hierarchy, the initial focus has been on legal definitions from the EU acquis, which in
turn gives more emphasis on asylum, refugees, (il)legal migration, and return. Further development
of the glossary will include other aspects of migration, particularly sociological, integration, and
economic related terms.

For some terms, preference was given in relating the term to either a person or to the process,
depending on which term was more commonly used. For example, Highly-Qualified Migrant is a
term which is more commonly used than Highly-Qualified Migration. Whilst trying to avoid too
much redundancy, in some cases, both types of terms are given in order to recognise the possible
use of them and to clearly indicate which is the source definition.
Where terms were sourced from other entities and taken from existing publications, permission was
sought to use their terms. In some cases, it was considered necessary to modify some definitions to
reflect better EU policy on asylum and migration, and this is indicated in the relevant entries.
The EMN Glossary and Thesaurus Working Group has met many times, each time typically for one
day, approximately every 6 to 8 weeks, over the course of four years, discussing in some detail and
in a highly co-operative manner the various terms. Members included primarily the European
Commission and EMN NCPs plus, in some cases, national experts who were part of an EMN NCPs
national network. Experts from the European Commission's Eurostat and Fundamental Rights
Agency also participated in some of the meetings.
Note that some of the terminology contained in the glossary may not have an exact correspondence
in all Member States, and the legal concept adopted at national level may not correspond totally or
partially to the concepts expressed in the glossary. However, one consideration in the discussion
and development of terms was for them to be of practical use at EU level, meaning that whilst the
definition of the term might not reflect exactly that at national level, nevertheless it was sufficient to
give at least the same broad meaning. In a similar vein, agreement on the preferred term to use (i.e.
the term which should be used instead of the synonym), was reached, even though the synonym to
the preferred term was more commonly used at national level for a Member State(s). For example,
Removal is the preferred term to use rather than its synonym Deportation. Where this occurred, an
explanatory note has been added to clarify in more detail the definition used and/or detailing more
the specificities within a particular Member State(s).
For some terms, definitions had to be derived from others, or new definitions established by the
Working Group.

provide a direct translation, then instead a translation was provided which better reflected the
definition given. Another aspect, for some Member States, was that there could be more than one
translation, depending on whether reference was being made to national law or the EU acquis. In
these cases, both translations have been provided, with an indication as to the context (national or
EU) in which they are used.
When there were differences in the terms used for Member States having the same nominal
language (e.g. Austria and Germany; France and Belgium; Netherlands and Belgium), both
translations are provided with their respective Member State acronym to distinguish this difference.
For example, the term Subsidiary Protection Status is translated as Status des Subsidir
Schutzberechtigten in Austria (AT), whereas in Germany (DE) it is Subsidirer Schutzstatus.
Otherwise, the acronym used is for both Member States having the same national language (e.g.
AT/DE). For the reasons outlined previously, when relevant, male translations of terms were used
by default.
For some terms, the definition is considered obvious or a definition in the broadest sense of the
word may be used. For example, agriculture, construction, child care, city, civil war,
(environmental) disaster, economic sector, education and language, elderly. A good reference for
such terms is the ILO Thesaurus.7 Other (legal) terms in a broader context (e.g. for Burden of Proof,
Policy, Social Exclusion) may also be obtained from, for example, the Oxford English Dictionary8
and the Oxford Dictionary of Law.9

Defined as work that deprives a child of their childhood, ILO International Programme on
their potential and their dignity, and that is harmful to the Elimination of Child Labour
physical and mental development. It refers to work that: (IPEC)
- is mentally, physically, socially or morally dangerous and
harmful

Principles
Within the context of EU integration policy, these are a set JHA Council Conclusions of 19
of (11) simple, non-binding but thoughtful guidelines of November 2004
basic principles intended to assist Member States in (Doc. 14615/05)
formulating their integration policies. They also serve to:
a) give Member States a means by which they can judge
and
assess
their
own
efforts;
b) enable Member States to set priorities and further
develop
their
own
measurable
goals;
c) serve as a basis for Member States to explore how EU,
national, regional, and local authorities can interact in the
development and implementation of integration policies;
d) determine how these policies can best engage other
actors involved in integration (for example, social partners,
NGOs, women's and migrants' organisations, businesses,
and
other
private
institutions);
e) be complementary and in full synergy with existing
legislative frameworks, including the international
instruments on Human Rights, Community instruments
containing integration provisions, EU objectives on gender
equality and non-discrimination and other EU policies;
f) assist in structuring the regular dialogue between
governments and all other relevant institutions and
stakeholders
at
the
EU-level;
e) act as a basis for and assist the EU to explore how
existing EU-instruments related to integration can be
developed
further;
and
f) assist the Council to reflect upon and, over time, agree on
EU-level mechanisms and policies needed to support
national and local-level integration policy efforts,
particularly through EU-wide learning and knowledgesharing.

The "Partnership Agreement between the members of the Cotonou Partnership Agreement
African, Caribbean and Pacific Group of States of the one
part and the European Community and its Member States of
the other part" was signed on 23 June 2000 in Cotonou,
Bnin hence the name " ACP-EC Partnership Agreement"
or "Cotonou Agreement". The Cotonou Agreement is a
global agreement, introducing important changes and
ambitious objectives while preserving the 'acquis' of 25
years

ACP-EC
cooperation.
Article 13 of this Agreement, states that "The issue of
migration shall be the subject of in-depth dialogue in the
framework of the ACP-EU Partnership."

Means any of the following acts when committed as part of Article 7 of the Rome Statute of
a widespread or systematic attack directed against any
the International Criminal Court
civilian population, with knowledge of the attack:
(a) Murder;
(b) Extermination;

Note:
The term 'ethnic cleansing' has frequently been employed to
refer to the events in Bosnia and Herzegovina. General
Assembly resolution 47/121 referred in its Preamble to 'the
abhorrent policy of 'ethnic cleansing', which is a form of
genocide', as being carried on in Bosnia and Herzegovina.
... It [i.e. ethnic cleansing] can only be a form of genocide
within the meaning of the [Genocide] Convention, if it
corresponds to or falls within one of the categories of acts
prohibited by Article II of the Convention. Neither the
intent, as a matter of policy, to render an area ethnically
homogeneous, nor the operations that may be carried out
to implement such policy, can as such be designated as
genocide: the intent that characterizes genocide is to
destroy, in whole or in part a particular group, and
deportation or displacement of the members of a group,
even if effected by force, is not necessarily equivalent to
destruction of that group, nor is such destruction an
automatic consequence of the displacement. This is not to
say that acts described as 'ethnic cleansing' may never
constitute genocide, if they are such as to be characterized
as, for example, 'deliberately inflicting on the group
conditions of life calculated to bring about its physical
destruction in whole or in part', contrary to Article II,
paragraph (c), of the Convention, provided such action is
carried out with the necessary specific intent (dolus
specialis), that is to say with a view to the destruction of the
group, as distinct from its removal from the region. As the

Group on Asylum and
Migration
The High-Level Working Group on Asylum and Migration European Commission (DG
(HLWG) works under the auspices of the European Council JLS)
and was set up to prepare action plans for the countries of
origin and transit of asylum applicants and migrants. The
action plans carry out an assessment of the political,
economic and human rights situation in countries of origin
and provide a joint analysis of the causes and consequences

mentions various forms of exploitative labour (namely

forced labour or services, slavery or practices similar to
slavery, servitude."), but it is very difficult to draw a line
between 'real' exploitation on the one hand and poor wages,
poor working conditions, social pressures, discrimination

Means a third-country national or stateless person below the Council Directive 2001/55/EC
age of eighteen, who arrives on the territory of the Member
States unaccompanied by an adult responsible for them
whether by law or custom, and for as long as they are not

who are left unaccompanied after they have entered the
territory of the Member States.

A practice by which all persons forming part of a large- UNHCR Master Glossary of
scale influx are regarded as refugees on a prima facie basis. Terms
Group determination ensures that protection and assistance
needs are met without prior individual status determination. UNHCR Resettlement
Handbook, paragraph 3.5
Refugee status must normally be determined on an
individual basis, but situations often arise in which large
populations have been displaced under circumstances
indicating that most members of the population could be
considered individually as refugees. In such situations, the
need to provide protection and assistance is often extremely
urgent and it may not be possible for purely practical
reasons to carry out an individual determination of refugee
status for each member of that population. Recourse is
therefore made to so-called group determination of refugee
status, whereby each member of the population in question
is regarded prima facie (in the absence of evidence to the
contrary) as a refugee. In other words, the presumption is
that individual members of the population concerned would
be considered as refugees in need of protection

Use of term should be avoided, and it is NOT a synonym IOM Glossary on Migration
relating to Return. Depending on the Member State, this
term has different meanings/connotations (see Note
below).
For the purpose of completeness, however, the following
IOM definition is used:
Refers to the personal right of a refugee or a prisoner of war
to return to his/her country of nationality under specific
conditions laid down in various international instruments
(Geneva Conventions, 1949 and Protocols, 1977, the
Regulations Respecting the Laws and Customs of War on
Land, Annexed to the Fourth Hague Convention, 1907, the
human rights instruments as well as in customary
international law). The option of repatriation is bestowed
upon the individual personally and not upon the detaining
power. Repatriation also entails the obligation of the
detaining power to release eligible persons (soldiers and
civilians) and the duty of the country of origin to receive its
own nationals. Repatriation as a term also applies to
diplomatic envoys and international officials in time of
international crisis.
Note:
In PL, RO, NL this refers specifically to repatriating their
nationals back to PL, RO, NL respectively. In ES, IE, IT,
UK, it is often used in context of returning third country
nationals to their Country of Origin. In LV, the term refers
specifically to the persons of Latvian or Liiv origin to
resettle permanent residence in Latvia. In PT, the term has
no legal concept being used more as a sociological term. It
is commonly used to refer to Portuguese citizens that return
to Portugal, including being forced to return.
