I, Nicholas Boyd, of the New York State Police, by this information makes written
accusation as follows: That on or about and between October 10, 2016 and October 13,
2016 in the Town of Palmyra, Wayne County, New York, the above defendant did
Commit the offense of overdriving, torturing and injuring animals; failure to provide
Proper sustenance, a misdemeanor in violation of §353 of the Agriculture and Markets
Law of the State of New York (69 counts), in that they did, at the aforesaid time and

‘mutilates or kills an animal, whether wild or tame, and whether belonging to himself or to another, or
eprives any animal of necessary sustenance, food or drink, or neglects oF refuses to furnish it such

‘The facts upon which this information is based are as follows:
‘That the defendant on the aforementioned date, while at 1212 Johnson Road in the Town of
Palmyra, Wayne County, New York, did deprive 69 domesticated rats of necessary sustenance or
food or water and furthered an act of cruelty by failing to provide a healthy, clean, sanitary and
humane living environment for 69 domesticated rats, all contrary to the provisions of the statute
in such case made and provided.
‘The foregoing factual allegations are based upon;

(X) the verbal admission of the defendant,
(X) signed statements of Robert Howard and Steven Venturino
attached hereto and made a part thereof

‘My name is Stephen Venturino and | live at 96 South Union St in Rochester NY, Phone - 315-705-3840, DOB 09/26/1960
‘and | am here on my own free will speaking with Trooper Boyd of the New York State Police.
On 10/11/16 1 was at my rental property at 1212 Johnson St in the Town of Palmyra, | asked if | could put a new fumace
filter in the furnace. When | asked this ! was told by @ male that | could not come inside the house, his name is Ken Kahler.
While | was at the door | could smell an awful stench, it smelled like dirty animals. | asked what it was and he replied that
there was no animals in the house.
The next day on 10/12/16, | was doing routine preparation for winter on the house, | was outside cleaning the gutters when |
Could see multiple cages of rats inside an upstairs bedroom. | immediately called the Police to report animal cruelty. | could
