INTRODUCTION
On December 30, 1999, the State of New Jersey and the United States of
America agreed upon the terms of a Consent Decree in Civil No. 99-5970 (MLC)
(Consent Decree). Pursuant to Consent Decree 114, the State published
nineteen semiannual public reports of aggregated data on motor vehicle stops
made by the New Jersey State Police. The State published the first semiannual
public report of aggregate data on June 27, 2000 (First Data Report) and then
nineteenth semiannual public report of aggregate data on August 12, 2009
(Nineteenth Data Report). The First Data Report contained information in Motor
Vehicle Tables and a Misconduct Investigation Table for the four-month period
January 1, 2000 through April 30, 2000. The subsequent data reports contained
this information for the six-month periods, ending with the Nineteenth Data
Report that contained this information for the period November 1, 2008 through
April 30, 2009.1
In August 2009, the State and the Department of Justice agreed to file a
joint motion to terminate the 1999 Consent Decree with the United States District
Court. The motion was granted and the an order terminating the Consent Decree
was entered by the Court on September 21, 2009. Legislation codifying many of
the reforms implemented under the Consent Decree (N.J.S.A. 52:17B-222 et seq.)
created an Office of Law Enforcement Professional Standards (OLEPS) within the
Office of the Attorney General, which shall prepare semiannual public reports on
New Jersey State Police traffic enforcement activities and procedures.
Data are reported in the First OLEPS Data Report using the format of the
Eighth Data Report that structured all subsequent public reports prepared
pursuant the Consent Decree. In the Motor Vehicle Tables, the following data for
motor vehicle stops are reported by race or ethnicity of driver:

11. Drug Dog Employed -- Reports the number of motor vehicle stops
during which a drug detecting canine was summoned to the motor
vehicle.
C. Dispositions (Summons/Warnings):
1. Summons moving;
2. Summons nonmoving;
3. Warnings moving;
4. Warnings non-moving;
5. Summons moving and warnings moving;
6. Summons non-moving and warnings non-moving;
7. Summons and/or warnings/moving and/or non-moving; and,
8. Other.
The Motor Vehicle Tables contain data for each troop and station within the
Division of State Police.2 On these tables, the race or ethnicity of the motorist is
listed horizontally and the motor vehicle enforcement action or procedure is listed
vertically. More specifically, the vertical axis of the Motor Vehicle Tables lists
Stops, Law Enforcement Procedures (Post-Stop Interaction) and Dispositions.
The Stops and Dispositions information was obtained through the Computer
Aided Dispatch (CAD) system. In the Sixteenth Data Report, the CAD data for
two stations (Atlantic City Expressway and Atlantic City Airport) incorporated data
from NJSPs new CAD system for the period from July 16, 2007, the new systems
implementation date in those stations, through October 31, 2007, the end of the
sixteenth reporting period. On January 23, 2008, the remaining stations in Troop
A were brought on-line for the new CAD system, followed by all of Troop C on April
14, 2008. Troops D and E were brought online on May 15, 2008, after the
beginning of the eighteenth reporting period. The new CAD was implemented in
Troop B on June 18, 2008. The data presented in the Eighteenth Data Report

As noted in the Eleventh Data Report, effective January 8, 2005, the Community Partnerships
Troop (Troop CP) was created within the Field Operations Section. Data for the troop are displayed
separately, as of the Eleventh Data Report (Exhibit F). However, no separate arrest data are
available as all arrest reports are filed exclusively with the respective community jurisdictions. In
previous reports, the data for the Initiative were included with those for Other Units. Effective
May 13, 2006, during the Fourteenth Data Report time period, the Community Partnerships Troop
was dissolved. The Operations South Unit became the Metro South Unit in Troop A and the
Operations North Unit became the Metro North Unit in Troop B. The stop data are aggregated
either in the Community Partnership Troop, or in Troops A and B, accordingly. In October 2005,
Troop E Holmdel Station moved to a new station and is now known as Sayreville/Holmdel
substation; the data reported are comparable to those previously published for Holmdel Station.
On April 12, 2008, Allenwood Station was dissolved. Data presented in the Seventeenth Report
for Allenwood Station reflected the reporting period through April 11, 2008.

were thus aggregated from both the old and new CAD systems. The data
presented in the Nineteenth Data Report were the first to be reported only from
the new CAD system.
The data reflect the race or ethnicity of the motorist as observed by the
Trooper for motor vehicle stops initiated by the Trooper.3 The information
regarding summonses and warnings reflects whether a summons or warning was
issued, but not the number of summonses or warnings issued. Under the CAD
reporting system, if an arrest occurs and a summons is issued in connection with
the motor vehicle stop, then only the arrest would be reflected; if no summons or
warning is issued with the arrest, the disposition would be displayed here as
other. The vertical axis of the Motor Vehicle Tables also lists Law Enforcement
Procedures (Post-Stop Interaction). This information was obtained through input
of data recorded on the Motor Vehicle Stop Report.4 State Police procedures
require Troopers to complete these reports whenever a law enforcement procedure
occurs during a motor vehicle stop. The data here reflect law enforcement
procedures in any stop, including those not initiated as such by the Trooper, such
as motorist aid or accident incidents. The number of total interactions is
reflected, not of incidents with a law enforcement procedure of a certain type.5
The vertical axis of the Motor Vehicle Tables also lists total criminal arrests
and patrol-related arrests as compiled utilizing Uniform Crime Report (UCR)
methodology. The arrest data come from arrest-report computer files. Patrol-

Trooper initiating the stop, the stop is not included for CAD elements. The total number of
Trooper-initiated motor vehicle stops for the current report was 86,872; 86,572 stops are reported
here. For the remaining 300 stops (0.3% of the total), race and ethnicity or some other information
was not available. Prior to the Seventeenth Data Report, data reports routinely excluded about one
percent of stops for which the race or ethnicity of the driver was not available. In the Seventeenth
and Eighteenth Data Reports, the high proportion of excluded stops because of incomplete race
and ethnicity were attributable to stations acclimating to the new CAD system. With full
implementation of the new CAD reflected in this Nineteenth Data Report, the percentage of
excluded stops has returned to pre-Seventeenth Data Report levels. Data on race and ethnicity
reported for law enforcement procedures are also the Troopers observation as recorded in Motor
Vehicle Stop Reports and in arrest reports. Law enforcement procedure data are unaffected by the
implementation of the new CAD system.

On January 1, 2008, NJSP implemented enhanced data entry for Motor Vehicle Stop Report
data in its Record Management System. Data reported in the Seventeenth Data Report aggregate
information entered in both the old and the new protocols. Beginning with the Eighteenth Data
Report, all post-stop interaction data are reported from the new protocol.

related arrests are, in turn, more specifically listed as arrests for drugs, weapons,
and other patrol-related arrests. The vertical axis also lists arrests for driving
under the influence, listed as DUI. These arrests are all those recorded for the
respective unit during the time period, regardless of why the stop was initiated.

Insufficient Evidence
The information in this First OLEPS Data Report was generated through use
of the CAD reporting systems and the Motor Vehicle Stop Report database. In the
case of consent search data, the information was further refined by a review of the
underlying consent search reports and supplemental reports themselves. The
number of requests seeking consent to search a motor vehicle made by state
troopers for the two months comprising this reporting period is 245 requests,
substantially greater than the 186 consent requests reported for the previous six-
month reporting period. The number of consent searches undertaken by state
troopers during this reporting period was also greater than in the previous period:
231 searches here versus 146 searches previously. The increase in the number
of requests for consent to search a motor vehicle and the number of consent

searches actually conducted by state troopers may be due in part to a decision of
the New Jersey Supreme Court.
The State accepts and adheres to the principles underlying the Consent
Decree, and commits substantial resources and effort, by members of the
Department of Law and Public Safety and the New Jersey State Police. The State
remains committed to continuing the progress in producing these data in the
spirit of the Consent Decree as codified now in N.J.S.A. 52:17B-235.
