My story about Aleynikov covered post-employment topics of trade secrets ,
confidentiality , Non-disclosure in Theme 4 .It addressed issues of proprietorship ,
guidelines under NSPA , EEA Act, trade secret theft tangible reproduction and transportation of stolen property across state lines. In this story the main protagonist was convicted for trade secret theft & transporting stolen property across state lines & sentenced to imprisonment & fine for copying source code proprietary to his organisation and putting them into another server in a different country & later copying them into his own system on the day he left his current organisation to join another rival organisation in 2009. All his lawyers efforts to trial him under civil court & reduction of sentence period on ground that he had no intention of hurting anyone went in vain as his case was compared with other such cases. But later on in May 2015 he was acquitted of all crimes and released on bail as his deeds were found in no violations of guidelines under NSPA or EEA and no evidence of tangible reproduction was found. So basically this story has dealt with concepts when a person can be tried under trade secret theft & which information & which employees can be trialed under transfer of confidential information and in which situation In my preceding story the offender had made tangible reproduction of copied codes , and in my succeeding story the protagonist had stolen tangible document( Goods under NSPA Act) so they were found guilty and given no pre sentence period bail. The instructor asked me difference between the previous story and why was Aleynikov given bail and was convinced with my answers & touch points of the story. The class was satisfied with the concepts of NSPA , EEA act & tangible reproduction of confidential information.
