RESOLUTION NO. 16-03
IN RE: REVISION OF THE 1992 CONSTITUTION
OF THE LAW STUDENT GOVERNMENT

Promulgated on April 29, 2016
WHEREAS, Section 1, Article XIII of the Constitution of the Law Student
Government, hereinafter referred to as the Constitution, substantially provides
that an amendment or revision of the Constitution shall only be entertained, when
any proposal for such is made by any member of the San Beda Law Student
Government, hereinafter referred to as the student body, and shall be supported by
at least one-third (1/3) vote of all members of the student body;
WHEREAS, a proposal to revise the Constitution was submitted before the student
body.
WHEREAS, the San Beda Law Electoral Board (ELBO) enacted a set measures to
supervise the conduct of the election, as regards the requirement set forth by
Section 1, Article XIII of the Constitution.
WHEREAS, a total of 656 votes from the student body, excluding the votes of the
4th Year students, were validated by the ELBO. The exclusion of the votes of the
4th Year students in validating the number of votes to support the petition was
done not to withhold their right vested by the Constitution, but rather to ensure
that the substantive requirement set by Section 1, Article XIII of the Constitution,
in relation to a subsequent plebiscite to be conducted next academic year, is
nevertheless met.
WHEREAS, the total number of votes gathered were enough to meet the
necessary requirement set by Section 1, Article XIII of the Constitution.
WHEREAS, Section 2, Article XIII of the Constitution provides that any
amendment to the Constitution may be proposed for ratification by the Council of
Representatives, acting as a constituent body, upon the concurrence of at least
two-thirds (2/3) of all its members. In case of a revision, the Council of Class
Representatives shall convene a Constitutional Revision Committee upon a twothirds (2/3) votes of all the members thereof.
THEREFORE, the petition for revision of the Constitution of the Law Student
Government is hereby GRANTED. The Law Student Government is now

empowered to convene a Constitutional Revision Committee to


officially draft the revision, subject to a subsequent plebescite.

Let this resolution be posted in two conspicuous places within the school premises
and a copy thereof be furnished the Office of the Prefect of Student Affairs.
