21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. REAPPROPRIATION - HENDERSON STATE UNIVERSITY. There is hereby
24 appropriated, to the Henderson State University, to be payable from the
25 General Improvement Fund or its successor fund or fund accounts, for the
26 Henderson State University, the following:
27 (A) Effective July 1, 2010, the balance of the appropriation provided in
28 Item (A) of Section 1 of Act 1394 of 2009, for equipment, personal services,
29 maintenance and operating expenses, and grants of the Rural Entrepreneurial
30 Initiative, in a sum not to exceed .............................$2,000,000.

32 (B) Effective July 1, 2010, the balance of the appropriation provided in
33 Item (A) of Section 3 of Act 508 of 2009, for campus renovations, in a sum
34 not to exceed ..................................................$3,100,000.

13 SECTION 2. REAPPROPRIATION - SOUTHERN ARKANSAS UNIVERSITY. There is hereby
14 appropriated, to the Southern Arkansas University, to be payable from the
15 General Improvement Fund or its successor fund or fund accounts, for the
16 Southern Arkansas University, the following:
17 (A) Effective July 1, 2010, the balance of the appropriation provided in
18 Item (A) of Section 4 of Act 508 of 2009, for construction of a University
19 Agriculture Center, in a sum not to exceed .....................$3,000,000.

21 (B) Effective July 1, 2010, the balance of the appropriation provided in
22 Item (B) of Section 4 of Act 508 of 2009, for deferred maintenance, in a sum
23 not to exceed ....................................................$630,000.

15 Section 8 of Act 1020 of 2009, for personal services, operating expenses, and

10 (K) Effective July 1, 2010, the balance of the appropriation provided in
11 Item (A) of Section 1 of Act 1431 of 2009, for a grant for expenses of the
12 Winthrop Rockefeller Institute including the Biannual Strategic Policy Forum;
13 conferences on Science, Technology, Engineering and Mathematics; Accelerate
14 Arkansas support and initiatives; conservation/sustainability and energy
15 workshops; strategic planning and development of conferencing capabilities
16 and locale amenities of the Institute in order to facilitate local, national,
17 and international conferences and meetings on policy matters including but
18 not limited to the above subject matter, in a sum not to exceed ..$650,000.

20 (L) Effective July 1, 2010, the balance of the appropriation provided in
21 Item (B) of Section 1 of Act 1431 of 2009, for a grant for expenses to
22 support a partnership between the Winthrop Rockefeller Institute and the
23 University of Arkansas Clinton School of Public Service for purposes
24 including but not limited to stipends for staff and students to be assigned
25 to the Institute for assessment and strategic planning; expense-sharing for
26 conferences and/or meetings arising from consultation and cooperation between
27 the Clinton School and the Institute; and to support other collaborative
28 initiatives between the Clinton School and the Institute, in a sum not to
29 exceed ...........................................................$150,000.

31 (M) Effective July 1, 2010, the balance of the appropriation provided in
32 Item (A) of Section 5 of Act 508 of 2009, for construction of a
33 nanotechnology research center for the U of A - Fayetteville, in a sum not to

18 TRUST. There is hereby appropriated, to the University of Arkansas at Little
19 Rock, to be payable from the Arkansas Natural and Cultural Resources Grant
20 and Trust Fund, for the University of Arkansas at Little Rock, the following:
21 (A) Effective July 1, 2010, the balance of the appropriation provided in
22 Item (01) of Section 30 of Act 1228 of 2009, for the acquisition, management,
23 stewardship or preservation of state owned lands, historic sites, buildings,
24 structures or objects, in a sum not to exceed .....................$14,037.

26 SECTION 13. REAPPROPRIATION - UNIVERSITY OF ARKANSAS FOR MEDICAL SCIENCES
27 - GENERAL IMPROVEMENT. There is hereby appropriated, to the University of
28 Arkansas for Medical Sciences, to be payable from the General Improvement
29 Fund or its successor fund or fund accounts, for the University of Arkansas
30 for Medical Sciences, the following:
31 (A) Effective July 1, 2010, the balance of the appropriation provided in
32 Item (A) of Section 1 of Act 1026 of 2009, for acquiring, constructing,
33 renovating, equipping, furnishing, personal services and operating expenses
34 of the Northwest Arkansas Satellite Campus, in a sum not to exceed

9 hereby appropriated, to the University of Central Arkansas, to be payable
10 from the General Improvement Fund or its successor fund or fund accounts, for
11 the University of Central Arkansas, the following:
12 (A) Effective July 1, 2010, the balance of the appropriation provided in
13 Item (A) of Section 1 of Act 1338 of 2009, for essential operations of the
14 university as determined by the Board of Trustees, general support for
15 education excellence through scholarships, equipment, technology, community
16 and economic development, and for payment of claims, in a sum not to exceed
17 ................................................................$4,000,000.

19 (B) Effective July 1, 2010, the balance of the appropriation provided in
20 Item (A) of Section 11 of Act 508 of 2009, for construction of Science

36 SECTION 18. REAPPROPRIATION - UNIVERSITY OF ARKANSAS - FORT SMITH. There
1 Item (A) of Section 1 of Act 1244 of 2009, for grants and aid for the
2 operational costs of the Arkansas Association of Two-Year Colleges Workforce
3 Training Consortium to provide services to two-year colleges statewide, in a
4 sum not to exceed ................................................$600,000.

6 (B) Effective July 1, 2010, the balance of the appropriation provided in
7 Item (A) of Section 34 of Act 508 of 2009, for allocation by the Director of
8 the Arkansas Department of Higher Education, to two-year colleges for
9 economic development incentive grants, in a sum not to exceed ..$3,000,000.

11 SECTION 20. REAPPROPRIATION - DEPARTMENT OF HIGHER EDUCATION - TRUST.
12 There is hereby appropriated, to the Department of Higher Education, to be
13 payable from the Higher Education Projects Development Fund, for the
14 Department of Higher Education, the following:
15 (A) Effective July 1, 2010, the balance of the appropriation provided in
16 Item (A) of Section 44 of Act 299 of 2009, for the development of projects at
17 State Institutions of Higher Education and the payment of project costs and
18 expenses of the issuance of bonds of the Arkansas College Savings General
19 Obligation Bonds Program, in a sum not to exceed ...............$3,432,175.

21 SECTION 21. REAPPROPRIATION - GRANTS FOR SCHOLARSHIPS. There is hereby
22 appropriated, to the Department of Higher Education, to be payable from the
23 General Improvement Fund or its successor fund or fund accounts, the
24 following:
25 (A) Effective July 1, 2010, the balance of the appropriation provided for
26 grants for scholarships for Historically Black Colleges and Universities and
27 for personal services and operating expenses as determined by the Department
28 of Higher Education for outreach programs to promote awareness of the
29 scholarships for Historically Black Colleges and Universities, the sum of...

32 SECTION 22. APPROPRIATION - GRANTS FOR SCHOLARSHIPS. There is hereby
33 appropriated, to the Department of Higher Education, to be payable from the
34 General Improvement Fund or its successor fund or fund accounts, for grants
35 for scholarships for Historically Black Colleges and Universities and for
36 personal services and operating expenses as determined by the Department of

2 SECTION 26. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor
3 obligations otherwise incurred in relation to the project or projects
4 described herein in excess of the State Treasury funds actually available
5 therefor as provided by law. Provided, however, that institutions and
6 agencies listed herein shall have the authority to accept and use grants and
7 donations including Federal funds, and to use its unobligated cash income or
8 funds, or both available to it, for the purpose of supplementing the State
9 Treasury funds for financing the entire costs of the project or projects
10 enumerated herein. Provided further, that the appropriations and funds
11 otherwise provided by the General Assembly for Maintenance and General
12 Operations of the agency or institutions receiving appropriation herein shall
13 not be used for any of the purposes as appropriated in this act.
14 (B) The restrictions of any applicable provisions of the State Purchasing
15 Law, the General Accounting and Budgetary Procedures Law, the Revenue
16 Stabilization Law and any other applicable fiscal control laws of this State
17 and regulations promulgated by the Department of Finance and Administration,
18 as authorized by law, shall be strictly complied with in disbursement of any
19 funds provided by this act unless specifically provided otherwise by law.

21 SECTION 27. LEGISLATIVE INTENT. It is the intent of the General Assembly
22 that any funds disbursed under the authority of the appropriations contained
23 in this act shall be in compliance with the stated reasons for which this act
24 was adopted, as evidenced by the Agency Requests, Executive Recommendations
25 and Legislative Recommendations contained in the budget manuals prepared by
26 the Department of Finance and Administration, letters, or summarized oral
27 testimony in the official minutes of the Arkansas Legislative Council or
28 Joint Budget Committee which relate to its passage and adoption.

30 SECTION 28. EMERGENCY CLAUSE. It is found and determined by the General
31 Assembly, that the Constitution of the State of Arkansas prohibits the
32 appropriation of funds for a longer period than one (1) fiscal year; that the
33 effectiveness of this Act on July 1, 2010 is essential to the operation of
34 the agency for which the appropriations in this Act are provided, with the
35 exception that Sections 22, 23, 24 and 25 in this Act shall be in full force
36 and effect from and after the date of its passage and approval, and that in
