CHAPTERI
Preliminary
l. Short title, extentand commencement.4l)
This Act may
be calledthe Jammuand KashmirRightto Information
Act. 2009.
(2) It extendsto the whole of the State.
(3) It shall come into forceat once,

2. Definitions-ln this Act, unless the context otherwise


requires,- ,
(a) "Act" meansthe Jammuand KashmirRightto Information
Act, 2009 ;

CHAPTER II
Right to Information and Obligations of Fublic
Authorities
3. Right to information -Subject to the provisions of,the Act,
every personresiding in the Stateshall have the right to information.

Obligations of public authorities.-(l ) Every public authority

(a) maintain all its recordsduly cataloguedand indexed in a


mannerand the form which facilitatesthe right to information
under the Act and ensurethat all recordsthat are appropriate
to be computerizedare,within a reasonabletime and subject
to availability of resources,computerizedand connected
through a network all over the Stateon different systemsso
that accessto such records is facilitated ;
(b) publish within one hundred and twenty days f'om the
commencementof the Act.-

held by it or under its control or usedby its employees
for dischargingits functions;
(vi) a statementof the categoriesof documentsthat are held
by it or under its control ;
(vii) the particutars of any arrangementthat exists for

implementationthereof ;
(viii) a statementof the boards,councils, committeesand

(ix) a directory of its officers and employees;
(x) the monthly remunerationreceived by each of its
officers and employees, including the system of
compensationas provided in its regulations;
(xi) the budget allocated to each of its agency,indicating
the particularsof all plans,proposedexpendituresand
reports on disbursementsmade ;
(xii) the manner of execution of subsidy programmes,
including the amountsallocatedand the details of
beneficiariesof such Programmes;

(xiii) particulars of recipients of concessions'permits or
authorizationsgrantedbY it ;
(xiv) detailsin respectof the inforrnation,availableto or held
by it, reducedin an electronicform ;
(xv) the particulars of facilities available to citizens for
obtaininginformation.includingthe workinghoursof a
library or readingroom' if maintainedfor public use ;
(xvi) the names, designationsand other particulars of the
Public InformationOfficers ;
(xvii) such other information as may be prescribed ; and
thereafterupdatethese publicationsevery year ;
(c) publishall relevantfactswhile formulatingimportantpolicies
or announcingthe decisionsrvhich affect public ;
(d) provide reasons for its administrative or quasi-judicial
decisionsto affected Persons.
(2) It shall be a constantendeavourof every publicrauthorityto
take steps in accordancewith the requirementsof clause (b) of subsection(f ; to provide as much informationsuo motu to the public at
regular intervalsthrough variousmeansof communications,including
iniernet,so that the public have minimum resori to the use of the Act
to obtain information.
(3)Forthepurposesofsub-section(l),everyinformationsha||
be diiseminatedwidely and in such form and mannerwhich is easily
to the Public.

Explanatior .'-For the purposes of sub-sections (3) and (4),

Officers in all administrativeunits or offices under it as may be

(2) Without prejudiceto the pro';.ions of sub-section

9. Grounds for iejection to occess in certain cases.-Without
prejudiceto the provisionsof section8, a Public Information Officer
may reject a requestfor information where such a requestfoi providing
accesswould involve an infringementof copyright subsistingin a person
other than the State.

undersection6, if the third party hasbeengiven an opportunityto make
representationunder sub-section(2), make a decisionas to whetheror
not to disclosethe information or record or part thereof and give in
writing the notice of his decisionto the third party.
(4) A notice given undersub-section(3) shall includea statement
that the third party to whom the notice is given is entitled to prefer an
appealunder section l6 againstthe decision.
CHAPTER III
The State Information Commission
The
12. Constitution of State Information Commission-(l)
Governmentshall,by notificationin the GovernmentGazette,constitute
a body to be known as the Jammu and Kashmir State Information
Commission to exercise the powers conferred on, and to perform the
functions assisnedto. it under the Act.

(2) The State Information Commissionshall consist of(a) the State'ChiefInformationCommissioner; and'
(b) two State Information Commissioners.

(3) The State Chief Information Commissionerand the State


InformationCommissionersshall be appointedby the Governoron the
recommendationof a committeeconsistingof(a) the Chief Minister, who shall be the Chairpersonof the
committee ;
(b) the Leader of Oppositionin the LegislativeAssembly ; and
(c) a CabinetMinister to be norrrir'rrte(l
h\ the Chief Minister.
Explanation.'-For the purposesof remoral ot doubts, it is hereby
declaredthat where the Leader of Opposition in the
LegislativeAssemblyhasnot beenrecognizedas such,
the Leaderof the single largestgroup in oppositionof
the Governmentin the LegislativeAssemblyshall be
deemedto be the Leader of Opposition.
(a) The generalsuperintendence,

affairsof the StateInformationCommissionshall vest in the StateChief
Information Commissioner who shall be assisted by the State
InformationCommissionersand may exerciseall such powers and do

directions by any other authority under the Act.
(5) The State Chief Information Commissionerand the State
InformationCommissionersshall be personsof eminencein public life

Information Commissionershall not be a Member of Parliamentor

of the StateInformationCommission

13. Term of ffice and conditionsof semice.--{l) The State
Chief InformationCommissioner
shall hold office for a term of five
