Management Competencies / Fall 2012

The Swindler

Dreier presided over the Lawrence High School student council,

and graduated "most likely to succeed"
Graduated from Yale University in 1972 with a Bachelor of Arts
Earned a Juris Doctor from Harvard Law School in 1975
Named to list of top 20 lawyers in U.S. by New York Magazine
several years running

Questions:
Stepping back from the obvious, what caused an intelligent man to
find himself in such a situation?
Do you think Dreier has more regrets about doing what he did or
about getting caught?
Dreier was sentenced to 145 years in prison. Do you think that
sentence is just? Why or why not?
Do you think you ever could be in a situation like Mr. Dreier? Why
or why not?

Bullard Houses

Should be no agreement unless

1. Absentias representative lies about Absentias
planned use of the property; or
2. Absentias representative violates Absentias
instructions not to disclose the planned use of the
property, and the representative of Downtown finds
that use acceptable to the Downtown shareholders;
or
3. Downtowns representative loses sight of the sellers
fundamental interest in insuring that their ancestral
home is used for "tasteful" purposes by a reputable
purchaser

Management Competencies / Fall 2012

12

Bullard Houses
Questions for Downtown Representative
What will you tell the Downtown shareholders
when they ask you?
Who did you sell our ancestral home to?
What are they going to do with it?

Did the Downtown representatives disclose to

Absentia the amounts of the competing offers? Why
or why not?
How should you decide whether or not you want
to disclose information to the other side?

Management Competencies / Fall 2012

13

Bullard Houses
Questions for Absentia Representative
How did the Absentia deal with questions about
the principals identity and the planned use of the
property?
Were the Absentia representatives adequately
prepared to answer questions regarding identity
and use; what had you planned to say, did you have
follow-up answers, etc.?
How should you decide whether or not you want
to disclose information to the other side?

14

Ethical Decision-Making
Bullard Houses

Is omitting information lying? Why or why not?

Why are people unethical?
Do you think we tend to have more blind
spots (believe ourselves to be more ethical
than is the case) when making decisions?
What are some ways to make decisions more
ethically?
The book argues that involving others can
increase the ethicality of decisions? Do you
agree and, if so, how so?
