I.
A. Enumerate 10 aggravating circumstances.
B. Mention five (5) persons who are exempt from criminal liability.

II.
A,B,C and D, armed with firearms, went to the house of X with the
intention to kill him. A pointed to B,C and D a room in the house where X usually
stayed. Thereupon, B,C and D fired their gun.
Nobody was killed or hunt because X was not at the house at that time. If
you were the prosecutor, with what offense would you charge A,B,C and D?
Reason out.

R, who is inside a passenger jeep, announced, Hold-up ito and cocked
his gun. One of the passengers was so intimidated that she jumped out of the
jeep. Her head struck the pavement causing her death. Would you hold R
criminally liable for the death of the passenger? Discuss.

A. Enumerate seven(7) mitigating circumstances
B. What are the seven (7) mode of extinguishing criminal liability
V.
S, 16 years old acing with discernment, conspired with B, who is blind in
one eye, and R who has served sentence for Homicide, to kill D.

They had a round of drinks and waited for night time, and proceed to the
house of A, located along the river bank. Ds nearest neighbor is two (2) km
away. S, B, and R were all armed with firearms.

After killing D, who was then sleeping in his room, S surrendered to his
schoo security guard, while B surrendered to his Barangay Chairman.

What are the mitigating and aggravating circumstances present and in


whose favour and against whom, would you consider them? Would you consider
band as an aggravating circumstance? Reason out your answer.

VI.
K, approached G, a gun owner, and borrowed his (Gs) gun telling him he
(K) is going to kill D.

K killed D with the gun lent by G. When K informed the authorities that G
was the owner of the gun, they hunted G down. Meanwhile G went to Mayor M
for help. Mayor M hid G in his farm.

Is the Mayor liable as accessory under the RPC? Why?

If not, can he be liable under another law? Discuss Fully.

VII.
Carlo attacked Juan with a knife without any provocation. Although hurt in
his left arm, Jun was able to wrestle possession of the knife from Cardo with
which he stabbed him dead.

May Juan squarely invoke self-defense? Explain.

VIII.
A attacked B without provocation, with a knife, hurting the latter. The attack
was seen by B-1, a brother and he (B-1) attacked A with a knife too, killing him.
Discuss if B-1 may claim defense of relative?

If B gave provocation that implied A to attack him (B), would your answer
be the same? Reason out?
