CLU3M SUMMATIVE: MOCK TRIAL


Due Date: Presentations begin THURSDAY, DECEMBER 1ST, 2016 and will continue until no later than
THURSDAY, DECEMBER 22, 2016:
Tuesday, December 20, 2016: R. v. Tisi
Wednesday, December 21, 2016: R v. Wai
Thursday, December 22, 2016: R. v. Jones
Process: In groups of 4+ (groups will be assigned by the teacher) you will prepare and present an assigned
case in a mock trial. This trial will last the duration of one period: 75 minutes. Each group is required to
hand-in a written report detailed below.
You will have THREE full-period preparation days in-class. Any other work must be completed outside of
class time. Each preparation class will begin with a short note to aid you with your trial.
Your group of 4+ people will be divided into 2 distinct groups:
1. The Crown (attorney and witness(es))
2. The Defence (attorney and witness(es))
Attendance: When not presenting your group must be present to act as the jury in the other trials.
Attendance is mandatory, please do not be late during the mock trials!
WRITTEN REPORT
o Cover Page
o Table of Contents
o Group member names on each section they contributed to
OPTION 1: Crown (remember that the victim may be a witness)
1. Opening statement- written by Crown attorney and help from witness(es)
2. Direct examinations for each Crown witness (list of questions - written by Crown attorney with
help from defence witness(es)
3. Witness responses to all questions asked-written by witness(es) i.e. script
4. List of questions to ask the defence witness(es) one for each witness- written by Crown with help
from witness(es)
5. Closing statement- written by Crown attorney
6. Exhibits presented in court (they will be included in your case or you may create these)
OPTION 2: Defence (remember that the accused may be a witness)
1. Opening statement- written by Defence attorney and help from witness(es)
2. Direct examination for each Defence witness (list of questions to be asked)- written by Defence
attorney and help from witness(es) & court clerk
3. Witness responses to all questions asked-written by witness(es) i.e. script

4. List of Questions (one for each witness) to ask the Crown Witnesses- written by defence attorney
with help from witness(es)
5. Closing statement- written by Defence attorney
6. Exhibits presented in court (they will be included in your case or you may create these)
o ALL GROUP MEMBERS: Reflections:
o Each group member should complete a 1-2 paragraph reflection on their role, the issues they
encountered while preparing and the insights gained through the process.
o Appendix:
o original case documents
Presentation (Trial): Each group member is expected to speak for approx 10 minutes over the course of the
trial in the (various) role(s) they play. The jury will then deliberate after the charge from the Judge and
render their verdict.
