An Act to prohibit t h e supply of I n t o x i c a t i n g

Liquors to t h e Aboriginal Natives of N e w

HEREAS
t h e s u p p l y i n g of I n t o x i c a t i n g L i q u o r s t o t h e
A b o r i g i n a l N a t i v e s of N e w S o u t h W a l e s is p r o d u c t i v e of
serious mischief t o t h e said A b o r i g i n a l N a t i v e s a n d is t h e c a u s e of
n u m e r o u s c r i m e s a g a i n s t life a n d p r o p e r t y
A n d w h e r e a s i t is
e x p e d i e n t to p r o h i b i t t h e s u p p l y i n g of s u ch I n t o x i c a t i n g L i q u o r s a s
aforesaid
B e i t therefore e n a c t e d b y t h e Q u e e n ' s M o s t E x c e l l e n t
M a j e s t y b y a n d w i t h t h e advice a n d c o n s e n t of t h e L e g i s l a t i ve C o u n c i l
a n d L e g i s l a t i v e A s s e m b l y of N e w S o u t h W a l e s i n P a r l i a m e n t
assembled a n d b y t h e a u t h o r i t y of t h e s a m e as f o l l o w s :
1. I f a n y p e r s o n w h e t h e r licensed or u n l i c e n s e d shall sell
s u p p l y or give any L i q u o r f e r m e n t e d or s p i r i t u o u s or a n y m i x e d L i q u o r
p a r t l y f e r m e n t e d or p a r t l y s p i r i t u o u s t o a n y A b o r i g i n a l N a t i v e of N e w
S o u t h W a l e s h e shall for every s u c h offence forfeit a n d p a y a p e n a l t y
n o t exceedin g t e n p o u n d s A n d if such L i q u o r b e supplied by a n
u n l i c e n s e d p e r s o n such p e n a l t y shall b e over a n d above a n y p e n a l t y
t o w h i c h s u c h p e r s o n m a y be liable for selling L i q u o r w i t h o u t a license
P r o v i d e d t h a t n o t h i n g h e r e i n c o n t a i n e d shall p r e v e n t t h e s u p p l y of
a n y of t h e said L i q u o r s t o a n y A b o r i g i n a l for m e d i c i n a l p u r p o s e s only.
2. E v e r y p e n a l t y for a n y offence a g a i n s t t h i s A c t m a y b e
recovered before a n y t w o J u s t i c e s of t h e P e a c e i n a s u m m a r y w a y a n d
if t h e same be n o t p a i d w i t h i n t h e t i m e l i m i t e d b y s u c h J u s t i c e s i t
shall b e levied b y distress a n d sale of t h e offender's goods a n d o n
failure of distress shall be enforced i n m a n n e r provide d b y t h e A c t
e l e v e n t h a n d twelfth Victoria c h a p t e r f o r t y - t h r e e as a d o p t e d b y t h e
A c t of t h e G o v e r n o r a n d Legislativ e Council f o u r t e e n t h V i c t o r i a
n u m b e r forty-three a n d by any Acts amending t h e same.
3. T h i s A c t s h a l l b e styled a n d m a y b e cited as t h e " S u p p l y
of L i q u o r s t o A b o r i g i n e s P r e v e n t i o n A c t . "
