LEASE AGREEMENT

KNOW ALL MEN BY THIS PRESENTS:


This Lease Agreement is made and executed by: FIL-CREST TECHNICAL AND DEVELOPMENT CO.
under Mr. Alnie D. Emano, General Manager, and with office located at Jericho St. Reyes Village Subd.
Bugo, CAGAYAN DE ORO CITY, herein after called the LESSOR/ADMINISTRATOR.
-and ROTOR MACHINERY WORKS CORP. managed by Ms Evangeline P. Rotor with postal address
Katipunan, Hinaplanon, Iligan City Herein after called the LESSEE all of legal age, all Filipinos.
WITNESSETH:
Whereas, the LESSORS are the owner/administrator of shop space located at Jericho St. Reyes Subd. Phase
2, Bugo, Cagayan de Oro City the subject matter of this Lease Agreement hereby lease unto the LESSEE
under the following terms and conditions:
1. RENTAL-DEPOSIT. The following shall be paid at the signing of the lease contract:
1.1One (1) month advance rental PHP4,000.00
1.2 Two (2) months deposit PHP8,000.00
THE DEPOSIT SHALL NOT BE APPLIED FOR RENT. The deposit shall be refunded only
after the termination of the lease under the following conditions: 1. After a period of one (1) month;
2. After the shop is evaluated for damages and costs of repairs; & 3. Receipt of electric and water
bills covering the last month of the lease.
1.3 Rental payments shall be made at the end of the month.
2. PERIOD OF LEASE. The term of the lease is for a period of 2 months from

3. USES OF LEASED PREMISES.
3.1 The LESSEE/LESSEES hereby expressly agrees and warrants that the leased premises shall be
used by him or her exclusively for commercial purposes for the immediate personnels.
3.2 The LESSOR agrees to let the LESSEE/LESSEES to use the following LESSORS equipment below:
3.2.1 1 set BENCH TABLE
3.2.2 1 set Drill Press
3.2.3 1 set Bench Grinder
3.3 The LESSOR shall use the office located at the back of LESSORS office for personnel
accommodation.
4. NOTICE OF TERMINATION. The LESSEE shall inform the Lessor in writing TWO (2) months in
advance of his intention to renew/ terminate this Lease Agreement. Failure to notify the LESSORS
within the period specified will subject the LESSEE to penalty of P 1,000.00 and failure of the
LESSEE to complete the two months lease agreement will subject the LESSEE to a penalty of ONE
THOUSAND PESOS (P1,000.00) .A cleaning fee of FIVE HUNDRED PESOS (P 500.00) will be charge
from the LESSEE upon vacating the as well. The shop is considered completely vacated only upon
the return of the complete set of keys to the LESSOR. All standing Bills must be settled at the end of
the lease agreement.
5. POLITENESS, KINDNESS AND FRIENDLINESS TO OTHER LESSEES. Exercise politeness,
kindness and friendliness to all residents to promote peace and harmony in the premises.
6. CAR PARKING AND REPAIRS. Vehicle Parking inside the shop is not allowed. Visitors parking
space shall be located outside the premises.
7. COMPLIANCE WITH RULES AND REGULATIONS. The LESSEE shall comply with all laws,
ordinances, regulations, and orders promulgated by proper government authorities arising from the
use, occupation and sanitation of the leased premises. Non-compliance therewith shall be at the
exclusive risk and expense of the LESSEE.
8. INSPECTION OF PREMISES. The LESSOR or her duly authorized representative shall have the
right to inspect the leased premises at any reasonable hour of the day.
9. REPORTING OF DEFECTS AND MALFUNCTIONS. The LESSEE shall promptly report to the
LESSOR any building/facility defect such as leaks (faucet, toilet, electrical and etc. Otherwise, the
LESSEE shall be responsible for all unreported damage/malfunction of building and facilities and
corresponding cost of repair and increase utility bills.
10.USE OF BUILDING, NOISE, ETC. The household members of the LESSEE should exercise utmost
care in the use of the building and facilities at all times. Avoid loud talking and domestic quarrels.
Do not vent anger on shop facilities. Tone down radio, TV, House parties should not be noisy and
rowdy and should end at night.
11. ALTERATION AND REPAIR; AUTHORIZED REPAIRMAN. The LESSEE hereby expressly
acknowledges that the leased premises is in good condition and agrees to keep the same such good
condition. The LESSEE may undertake at his exclusive expense, all repairs, improvements such as
may be required to maintain the same in good state with PRIOR WRITTEN CONSENT AND APPROVAL
OF THE LESSOR. All improvements or alteration of whatsoever nature shall, upon completion
thereof from integral parts of the leased premises and shall not be removed there from but shall
belong to and become the exclusive property of the LESSORS. Repairmen must be properly

compensated for the installation of particular requirement or the repair damage caused by the
LESSEE.
When damages or defect is caused by negligence or ignorance of LESSEE all cost of repair shall be
charge to the LESSEE. If the cause is structural or building facility cost is charged to LESSOR.
12.ELECTRICAL AND PLUMBING ALTERATIONS. The LESSEE shall not make alterations or change in
the electrical or plumbing installations within the leased premises without the prior written consent
of the LESSOR.
13.CYLINDER CONTAINING FLAMMABLE GAS. The LESSEE shall place the cylinders in safe and
allowable distance from the inhabited area which may expose the leased premises to fire or
increase the fire hazard of the building. The LESSEE shall be provided at least 2 cylinders of fire
extinguisher for the shop in case of fire emergency.
14.INSECT, PESTS, ELECTRIC AND WATER SUPPLY FAILURE. The LESSORS shall not be liable for
the presence of bugs, vermin, and ants or insect, if any, in the leased premises. The LESSORS shall
not be liable for the failure of water supply and/or electric current and other utilities in the
premises.
15.CLEANLINESS, GARBAGE, PETS, ETC. The LESSEE shall keep the premises clean and shall
minimize wear and tear thereof. Keep the driveway clear of obstructions and garbage. KEEP THE
FRONT STEEL GATE CLOSED AT ALL TIMES. Do not leave bags of kitchen garbage within
the shop premises esp. along the driveway and road.
Do not hire outsider to throw your garbage/ basura bags.
16.CURFEW AND SECURITY. Only office hours time from 7:00am to 8:00pm shall be operated inside
the premises . Working during Sunday and Special holidays shall be with prior written consent of
the LESSOR. All LESSEES personnel shall submit their bio-data to the LESSOR for security record.
LESSEE personnel shall wear proper uniform for easy identification. The LESSEE shall be provided
security for his/her company. The LESSOR will not be held responsible for injury, death, damage and
losses of LESSES property and personnels.
17.PREMATURE TERMINATION OF LEASE AGREEMENT. If the LESSEE shall at any time fail or
neglect to perform or comply with any of the conditions, agreements or restriction stipulated of if
the LESSEE shall become bankrupt or insolvent, then in any such above cases this Lease
Agreement shall become automatically terminated and cancelled and said premises shall be
vacated peacefully by the LESSEE, and it shall be lawful for the LESSORS or any authorized
representative without any formal notice or demand, to enter into and upon said leased premises,
or any part thereof without prejudice on the part of the LESSORS to exercise any or all rights from
the Lease Agreement and those given by law and upon such cancellation of the agreement the
LESSEE hereby automatically grants to the LESSORS the legal rights to enter and to take possession
of the leased premises as through the term of this Lease Agreement has expired.
18.EXPIRATION OF LEASE AGREEMENT. The LESSEE at the expiration of the term of the lease or
cancellation of this lease as herein provided will promptly deliver the said premises to the LESSORS
in good condition in all respects, reasonable wear and tear, expected, devoid of all occupants,
furniture, articles and effects of any kind.
19.NOTICE OF VACATION, PENALTY. Deposit in the leased premises of a note to vacate the premises
shall constitute due and sufficient note to the LESSEE as provided by law. In case of failure to
vacate the premises the LESSEE shall pay rent plus 50% penalty.
If said premises is be not surrendered at the end of the term, the LESSEE shall be responsible to the
LESSORS for all damages which the LESSORS shall suffer by reason thereof and will indemnify the
LESSORS against all claims made by any succeeding tenant, is so far as such delay is occasioned by
failure of the LESSEE to surrender the premises.
20.ENFORCEMENT OF AGREEMENT TERMS. The failure of the LESSORS to insist upon a strict
enforcement of any of the terms, conditions and covenants hereof shall not be deemed a
relinquishment or waiver of any subsequent breach or default of the terms and conditions herein
contained, which shall not be deemed to have been made unless expressed in writing and signed
by the parties hereto.
21.CONFLICT RESOLUTION. Conflict between LESSEE and LESSOR are reported to the Barangay for
mediation. When conflicts are not resolved in the Barangay, the Barangay Officials gives the
LESSORS clearance to file court action.
