CONTRACT OF LEASE
KNOW ALL MEN BY THERE PRESENTS:
This AGREEMENT, made and executed by and between:
I, GIRLIE R. DUAS, of legal age, Filipino/s and resident/s of # 356 Pantal Dist., Dagupan City,
Pangasinan, Philippines, hereinafter referred to as the LESSORS/S and ELIFE C. CATAMBING,
Philippines, hereinafter referred to as the LESSEE/S;

WITNESSETH
WHEREAS, the LESSOR/S is the owner/s administrator/s of a residential / apartment building
identified as Commercial Building; Located at Tapuac, Dagupan City, Pangasinan;
WHEREAS, the LESSEE/S offered to lease the aforesaid building and the LESSOR/S accepted
the offer, subject to the following terms and conditions, to wit:
1. That the period of lease shall be Three (3) years beginning on January 31, 2016 and
expiring on January 31, 2016 renewable for another period at the option of the LESSOR/S
which shall be covered by another written contract of lease;
2. That the monthly rental shall be FOUR THOUSAND PESOS (P 4,000,00) payable in
advance by the LESSEE/S at the residence of the LESSOR/S on or before the 1st of every
month, without the necessity of demand from the LESSOR/S. In case of failure of the
LESSEE/S to pay the said rental n the date herein specified, the LESSEE/S shall pay a
penalty charge of TEN PERCENT(10%) per month for such default;
3. The LESSEE/S shall make a deposit of TWO MONTHS equivalent to EIGHT THOUSAND
PESOS (P 8,000.00), Philippines Currency as the condition before occupying the leased
property and said amount shall remain subsisting during the entire period of lease and shall
only be withdrawn at the termination of this contract of lease provided that the LESSEE/S is
cleared of all financial accountabilities including utility charged such as water, electric,
telephone, etc, as well as damages arising from breach or violation of any terms and
conditions set forth herein committed by the LESSEE/S for which the LESSOR/S has
suffered by any damages;
4. That the LESSEE/S shall use the leased property exclusively for residential / business
purposes only and is strictly prohibited from using it for any other purposes;
5. That the LESSEE/S shall not directly or indirectly sublease, assign, transfer, convey or in
any manner encumber my rights over the eased property or any portion thereof under any
circumstances whatsoever and any contract entered into by the LESSEE/S with third
person/s in violation of this agreements shall be null and void;
6. That the occupancy of the leased property shall be limited to the following persons only, to
wit; ______________________;
7. That the LESSEE/S shall pay for the utility charges such as Telephone, Electric, Water and
other public service which the LESSEE/S may use in the leased property during the period
of lease;
8. That the LESSEE/S shall allow the LESSOR/S to enter the leased property / premises from
the time to time within reasonable hours of the day for purposes of conducting an inspection
regarding sanitation, safety, are and other proper maintenance of the leased property and

premises.
9. That the LESSEE/S shall not undertake any improvements, alterations or change the
electrical, water and plumbing installation within the leased property / premises without prior
consent of the LESSOR/S;
10. That the LESSEE/S agrees to abide strictly with all reasonable regulations which may be
given by the LESSOR/S to the LESSEE/S from time to time to protect the latters interest;
11. That any damage or injury to the leased property / premises due to the fault of the
LESSEE/S,__________________ agents, employees/s, servant/s of third person/s who
may gained access to the leased property / premises shall be promptly repaired of restored
at the sole expenses of the LESSEE/S;
12. That the LESSEE/S hereby acknowledged having received the leased property in a good
and habitable condition and shall keep / maintain the same under such condition except
those depreciation arising from the ordinary wear and tear. The LESSEE/S further agree to
take care of the leased property with due diligence of a good father of a family;
13. That all repairs made within the leased property / premises that arise from the daily use of
the facilities therein shall be for the account of the LESSEE/S without the right of
reimbursement, including those improvements made with prior consent of the termination of
the Lease Contract except those improvements agreed upon to be exempted from accruing
to the LESSORS/S;
14. That effective upon breach or violation of any of the terms and conditions of this contract or
in case of default of the LESSEE/S to pay one(1) month/s rental, this contract shall be
considered cancelled / rescinded and the period of lease is automatically terminated even if
the period of lease has not yet expired and the LESSEE/S shall peacefully and voluntarily
vacate the leased property / premises. The LESSEE/S further grants the LESSOR/S or his
representative or assign, full power and authority to take procession and enjoy the leased
property without the necessity of formal notice or demand to vacate said property served
upon the LESSEE/S as well as padlocked the same if the LESSEE/S refuses to vacate the
leased property.
15. That failure on the part of the LESSOR/S to insist upon the strict compliance of any of the
terms and conditions set forth herein, shall not be deemed consideration waiver of any right
or remedy that the LESSOR/S have under unless expressly made in writing and signed by
the LESSOR/S;
16. That the LESSOR/S hereby reserved the right to increase the agreed rental in case of
extension or renewal of this contract;
17. If the leased property shall be vacated or deserted by reason of cancellation, termination or
expiration of the contract of lease and the leased property was locked or not surrendered to
the LESSOR/S, the LESSOR/S shall have the right to enter the said leased property as an
agent of the LESSEE/S by forced and the LESSEE/S hereby expressly waived his right to
file any civil or criminal action against the LESSOR/S;
18. That after the lease period has been terminated for any reason whatsoever and the
LESSEE/S is allowed to continue to occupy the leased property with express of implied
consent of the LESSOR/S, the extension of the lease shall be understood to run on a month

to month basis only and under the same terms and conditions of this contract and may be
terminated by either party by means of a written notice served upon the other party for at
least fifteen (15) days prior to the date of termination of the lease of said property;
19. That this contract of lease supercedes all other lease contracts or agreements, oral or
previously entered into by the herein contracting parties involving said leased property and
shall remain in full force and effect unless otherwise modified or amended by another written
agreements duly signed by said parties;
20. That in case of failure of the LESSEE/S to comply with any of the terms and conditions of
this contract, the LESSOR/S or his / her authorized representative is hereby authorized in
take possession of the leased property / premises without the necessity of resorting to any
court action, provided that the LESSEE/S be advised in writing for at least fifteen (15) days
or in his absence the Notice to be posted at the main entrance of the leased property
regarding termination of the lease period and this shall served as a sufficient compliance of
the Notice to the LESSEE/S; (Viray vs. Intermediate Appellate Court, G.R. No 81015, J July
4, 1991);
21. That the failure of the LESSEE/S to pay the advance monthly rentals during the 1 st five (5)
days
of
the
month
period,
the
LESSEE/S
agreed
to
pay
___________________________________ (P ________), as penalty charge for every day
of delay in the payment of said rental;
22. That in case of any court action arising from this contract, the parties hereby agree that the
Venue shall be at the proper court situated in Dagupan City, Philippines, and the guilty party
shall be liable to pay Attorneys damages and litigation expenses.
