DIRECTORS AND OTHERS CONCERNED SUBJECT REITERATING AND SUPPLEMENTING DILG MEMORANDUM CIRCULAR No. 2004-43 DATED 14 APRIL 2004 RELATIVE TO THE LUPONG TAGAPAMAYAPA INCENTIVES AWARDS GUIDELINES In furtherance of the objectives of the Lupong Tagapamayapa Incentives Awards, or LTIA, established pursuant to Executive Order No. 394 s. 1997 and to sustain the gains of the said awards, the guidelines relative thereto are herein reiterated and supplemented, as follows Awards Objectives : The Lupong Tagapamayapa Incentives Awards aims to: a. Strengthen the Katarungang Pambarangay (KP) as an indigenous conflict resolution structure at the grassroots; Institutionalize a system of granting economic benefits and other incentives to Lupong Tagapamayapa, herein referred to as lupons, which demonstrate exemplary performance; and Generate greater awareness among, and support from, the various sectors of Philippine Society on the KP as a potent vehicle toward social ordering and human development. National Awards Committee The National Awards Committee (NAC) shall be composed of the following: Chairperson - Secretary of the Interior and Local Government Vice Chairperson - Secretary of Justice Members. - Representative, Supreme Court National President, Liga ng mga Barangay Representative, National Peace and Order Council Two (2) Private Sector/ NGO Representatives MEMORANDUM CIRCULAR LTIA Guidelines up The NAC shall perform the following functions: Initiate and coordinate the necessary activities for the successful implementation of the LTIA; Set guidelines and criteria in the selection of winners; Secure funding and additional prizes from partner agencies and the private sector; Organize a National Board of Judges representing the government and the private sector to assist the committee in the selection of the awardees; Select from among the regional entries the national awardees; and Render a report, together with recommendations, if any, to the President, relative to the implementation of the Awards, The Bureau of Local Government Supervision, DILG, provides technical and secretariat services to the committee. Regional Awards Committee The Regional Awards Committee (RAC) shall be composed of the following Chairperson - Regional Director, DILG Vice Chairperson - Regional State Prosecutor, DOJ Members - Executive Judge, Regional Trial Court Representative, Regional Peace and Order Council President, Regional Chapter, LnB ‘Two (2) Region-based NGO Representatives The Committee shall perform the following functions: Initiate and coordinate the necessary activities toward the successful implementation of the LTIA in the region; Disseminate information on the Awards to generate awareness and support from the public and private sectors in the region; Select and submit to the NAC the best performing lupons in the region. May secure funding and counterpart prizes from the partner agencies and the private sector; and May plan and implement appropriate awarding ceremonies The DILG Regional Office provides technical and secretariat services to the committee, MEMORANDUM CIRCULAR LIA Guidelines 2[Pawe Provincial Awards Committee The Provincial Awards Committee (PAC) shall be composed of the following: Chairperson Provincial Director, DILG Vice Chairperson Provincial Prosecutor, DOJ Members Executive Judge, Regional Trial Court President, Provincial Chapter, LnB Representative, Provincial Peace and Order Council Representative, Province-based NGO The Committee shall perform the following functions: Initiate and coordinate the necessary activities toward the successful implementation of the LTIA in the province; Disseminate information on the Awards to generate awareness and ‘support from the public and private sectors within the province; Select and submit to the RAC the best performing lupons within the province; May generate counterpart funds from the partner agencies and the private sector; and May plan and implement appropriate awarding ceremonies. The DILG Provincial Office provides technical and secretariat services to the committee City Awards Committee The City Awards Committee (CAC) shall be composed of the following Chairperson - City Director, DILG Vice Chairperson - City Prosecutor, DOJ Members - Judge, Municipal Trial Court in Cities (MTCC) President, City Chapter, LnB. Representative, City Peace and Order Council Representative, City-based NGO MEMORANDUM CIRCULAR UTA Guidelines ‘The Committee shall perform the following functions: * Initiate and coordinate the necessary activities toward the successful implementation of the LTIA in the city. Disseminate information on the Awards to generate awareness and Support from the public and private sectors within the city; * Select and submit to the PAC the best performing lupon within the component city and to the RAC, in the case of Highly Urbanized Cities Category, the best performing lupon within the highly urbanized city; * May secure funding and counterpart prizes from the partner agencies and the private sector; and * May plan and implement appropriate awarding ceremonies The DILG City Office provides technical and secretariat services to the committee. Municipal Awards Committee The Municipal Awards Committee (MAC) shall be composed of the following Chairperson - Municipal Local Government Operations Officer (MLGOO) _ Vice Chairperson - Provincial Prosecutor, DOJ Members - Judge, Municipal Trial Court) Municipal Circuit Trial Court (MTC/MCTC) President, Municipal Chapter, LnB. Representative, Municipal Peace and Order Council Representative, Municipal-based NGO The Committee shall perform the following functions * Initiate and coordinate the necessary activities toward the successful implementation of the LTIA in the municipality, Disseminate information on the Awards to generate awareness and Support from the public and private sectors within the municipality, Select and submit to the PAC the best performing lupon within the municipality; * May secure funding and counterpart prizes from the partner agencies and the private sector; and * May plan and implement appropriate awarding ceremonies The DILG Municipal Office provides technical and secretariat services to the committee. MEMORANDUM CIRCULAR LITA Guidelines 4[Pay Awards Categories There are four (4) categories of the LTIA, as follows: + Outstanding Lupong Tagapamayapa in Highly Urbanized Cities; Outstanding Lupong Tagapamayapa in Component and Independent Component Cities; Outstanding Lupong Tagapamayapa in 1°-3"° Class Municipalities; Outstanding Lupong Tagapamayapa in 4""-6" Class Municipalities Awards Guidelines 1. Allthe lupons nationwide are covered by the annual Awards; 2. Allthe lupons are evaluated on the basis of three (3) Major Criteria a. Efficiency in Operations b. Effectiveness in Securing KP Objectives ©. Creativity and Resourcefulness of the Lupong Tagapamaya 3. Under the Criterion, Efficiency in Operations, the following shall be taken into consideration: a. Observance of settlement procedures and deadlines, proper recording of complaints and serving of summons to parties b. Conduct of monthly meetings exclusively on KP matters ©. Systematic maintenance of records of all complaints filed and actions taken, minutes of meetings, transmittal reports and records on the execution of settlements or awards, d. Timely submission of reports to concemed agencies in accordance with the KP Monitoring Guidelines (monthly to DILG and quarterly to other agencies/offices). 4. Under the Criterion, Effectiveness in Securing the Objectives of the KP Program, all concerned are to be guided by the following: a. At least 90% of cases settled against the total number of cases filed b. No repudiated nor recurred case after settlement ©. Atleast 80% compliance with the terms of settlement or award. 5. Under the Criterion, Creativity and Resourcefulness, lupons are able to : a. Introduce innovative mediation methods / techniques that are outside those Provided in the KP law without diminishing or altering the concept of the KP. b. Establish active coordination with concemed agencies i.e., DSWD, PNP, DAR, DEPEd, DO4J, the courts, in terms of: updating knowledge on KP Laws to avoid misinterpretation thereof; ii. seeking advice to enhance conciliation/mediation skills; and MEMORANDUM CIRCULAR LTIA Guidelines lil referring to concerned agencies, cases that require actions from the appropriate agency ©. Conduct sustained advocacy efforts in the promotion of the KP through the lupons, to include mentoring other lupons. 4. Initiate and conduct KP trainings with funding support from either the barangay, municipality, city, province or other agencies within the reporting period. e Attended KP trainings upon invitation of sponsoring agencies within the assessment period, Designate an area or facilty within the barangay hall or a separate structure exclusively for the KP activities 9. Mobilize budgetary support from city or municipal government, national government agencies, NGOs; and community participation in KP activities. In the determination of the official entries in all the awards categories, concerned awards committees shall be guided by the Overall Performance Rating (OPR) and its Adjectival Equivalent as follows: OPR Adjectival Rating 95 - 99 + Outstanding or Excellent 90 - 94 - Very Satisfactory 85 - 89 - Satisfactory 80 - 84 - Fair 75-79 > Poor Below 75, - Very Poor 7. Only the highest ranked lupon with the Overall Performance Ratings (OPR) of not lower than 90 points is qualified to compete at the national level final assessment and selection. In case of a tie, the concerned awards committee shall further validate the assessment results to determine the official entry or awardee for each category. 9. The decision of the awards committees in all levels is final and executory. 10.All entries shall be done in the proper format, copy of the Nomination Form attached. The Executive Summary of Accomplishments with relevant enclosures or attachments shall be prepared and packaged in bound folder. 11.The submission of incomplete documents or non-compliance with the Prescribed Standard Documentation Report Requirements, and the late Submission of the Regional Entries to the National Secretariat (BLGS) shall be @ ground for automatic disqualification of the contestant lupon or imposition of reduction in points. 12.The concerned RAC shall submit the Official Entry in only ONE (1) copy to Feach the BLGS not later than 5:00 P.M. of the last working day of the scheduled month for submission. MEMORANDUM CIRCULAR LTIA Guidelines 6[Pare 13.A National Awardee for three (3) consecutive years in the same awards calegory or a five-time national awardee in the same category, shall be a recipient of a Hall of Fame award. Assessment and Selection Procedures 1. The LTIA FORM 01 is the Basic Performance Evaluation Form. The Form is to be accomplished by the individual member of the concerned awards committee in the evaluation of contestant lupons in all categories 2. Thereafter, the concerned awards committee prepares the Consolidated Performance Evaluation Form, LTIA FORM 02 to arrive at the OPR of the Contestant lupons of each municipality or city. 3. The concerned awards committee then prepares appropriate Comparative Evaluation Form, (LTIA FORMS 03-[C/M]) in the case of the CACs and MACs to determine the highest ranked lupon in a city or municipality; (LTIA FORMS 03-{P]) in the case of the PACs to determine the highest ranked cityimunicipal- based lupons within the province; and LTIA FORMS 03-{R] in the case of the RAC to determine the highest ranked lupon, by category within the region. In case of a tie, the concerned awards committee shall further validate the assessment results to determine the highest ranked lupon for each category by using the Performance Validation Form LTIA FORM 04. 5. The concerned awards committee submits to the next higher level committee, the highest ranked lupon or awardee for each category using the Official Entry Form (LTIA FORM 05) together with the appropriate LTIA Form 03 Awards and Prizes 1. Each National Awardee lupon through the Lupon Chairman shall be conferred with a Presidential Trophy and cash prize to be utiized for KP programs and projects. Each Runner-Up Awardee lupon through its chairman shall be conferred with a Plaque of Recognition and cash prize to be utilized for KP programs and projects. 3. A Hall of Fame Awardee, through its chairman, shall be conferred with a Presidential Trophy and a cash prize to be utilized for KP programs and projects, Standard Official Entry and Documentation Report Requirements A. Official Entry Requirements (to be prepared by the RAC) Transmittal Letter to the NAC indicating therein the Regional Entries in each Category and the assessment methodology MEMORANDUM CIRCULAR LITA Guidelines m1 Attachments: 1. Form 03-{R] duly accomplished by the Regional Awards Committee indicating therein the Performance Evaluation Results of all the highest ranked lupons in every province, by category 2. Forms 03-C/M duly accomplished by all the City/Municipal Awards Committees indicating therein all the lupons in their coverage areas and their corresponding OPR and rank. Bs Documentation Report Requirements (to be prepared by thie Finalist or the Regional Entry Lupon with the assistance of the DILG LTIA Program Officer) 1. Brief Profile of the LT (1-2 pages only) 2. Performance Highlights, by criterion (written in English) 3. Attachments: * Summary of Cases and Related Information, i.e., date filed; name of complainants and respondents; specific nature of cases; date of summon; date of hearing; actions taken i.e, mediated, conciliated, arbitrated; dismissed; Issued CFA and summary report on the execution of settlement or award classified as to payment of money, delivery or restitution of property, and execution of a conveyance of land, or delivery of deeds or other documents or performance of any other specific act; * Transmittal of KP Reports to DILG and Courts (certified photocopy); * Minutes of Meetings of the Lupong Tagapamayapa (certified Photocopy and translated in English or Pilipino, if prepared in local dialect); * Pictures on KP Undertakings with captions i.e. date and Activity Highlights (original copy) Approval and Promulgation of the LTIA Guidelines By virtue of the approval of the Guidelines embodied in DILG Memorandum Circular No. 2004-43, the same is hereby promulgated pursuant to Executive Order No. 394 s. 1997 Let copies of this Memorandum Circular be disseminated to all concerned.
