On 3-28-15 at approximately 0730 hours1 I was dispatched a call where two dogs were loose and one had
bitten a passerby. Sgt. Jenkins and I responded to _the call and located both dog?. Upon further investigation,
we discovered that ~he dog that bit was on bite quarantine for a previous bite to a passerby earlier in the
week. We made owner contact and seized the dog for shelter quarantine and dangerous dog hearing.
I am requesting this dog be deemed dangerous under SJMC 7.10.090 Dangerous dog for the following
reasons:

A.

Pursuant to Food and Agricultural Code Section 31621, as inay be amended, the hearing must be held
pro~ptly within no fewer than five (5) business days nor more than ten (10) business days after service of
notice upon the dog owner/guardian or person with a right to control the dog.

B.

At the hearing to determine whether the dog is potentially dangerous, dangerous or vicious, or maintained
in violation of the ~pecial dog permit, the dog oyvner/guardian or perspn with a right to control the dog and
the City may-be represented by counsel, may present evidence, and may cross-examine witnesses. Strict
rules of evidence do not.-apply. Any relevant evidence may be admitted if it is the sort of evidence on
which responsible persons are accustomed to rety in the conduct of serious affair~.

C.

Any witness appearing may present evidence.

D.

Once an Animal Services ~officer presents evidence to substantiate the dog's status as potentially
dangerous, dangerous or vicious, or maintained in violation of the special dog permit, the burden shifts to
the dog owner/guardian to rebut based on circumstances specified in Section 7.30.030.

E.

The decision of the Hearing Officer that the dog is potentially dangerous, dangerous or vicious, or
maintained in violation of the special dog permit must be supported by evidence on.the record and is final.

F.

The Hearing Of~cer must cause written notice of his or her decision to be mailed within fifteen (15)
- business days after the conclusion of the hearing to the dog owner/guardian or person with a right to control
the dog and to all persons who make a written request for a copy of the decision.

G.

Unless the preponderance of the e vidence rebuts the a.llegatio11. that tlte dog is potentially dangerous,
dangerous or vicious, or maintained in violation of the special dog permit, the Hearing Officer may
determine the dog to be potentially dangerous, dangerous or vicious, or maintained in violation ()f the
special dog permit, as alleged.

H.

If no evidence is entered at the hearing on behalf of either the dog owner/guardian or person with a right to
control the dog, then the Hearing Officer may determine that the dog is potentially dangerous, dangerous or
vicious, or maintained in violation of the special dog permit, as alleged.

I.

The.dog owner/guardian or person with a right to control the dog has five (5) business days upon service of
the HeariBg Officer's decision to appeal the rledsimt to the superior cou:tt pursuant to F ood and
Agricultural Code Section 31622, as may be amen<ted, or the decision will be deemed final if no appeal is
filed on or before the expiration of the appeal period. Service of the decision or appeal may be either
personally or by first-class mail, postage prepaid.

J.

Within thirty (30) days of service of the Hearing Officer's decision, both the dog owner/guardian and
person with a right to control a dog that is deemed potentially dangerous, dangerous, or vicious must
comply with all the provisions of the Hearing Officer's decision. Either the failure of the dog
owner/guardian or person with a right to control the dog to comply with all the provisions of the Hearing
Officer's decision will result in the surrender of the animal to the Administrator to be disposed. in
accordance with the law. The appeal of the Hearing Officer's decision to the superior court will suspend
the thirty (30) day period until a {esolution of the appeal by the court. The Administrator may grant either
the dog owner/guardian or persoii with a right to control the dog a fifteen (15) day extension for good cause
such as evidence of a good faith effort to comply and circumstances beyond the control of the dog
owner/guardian or person with. a right to control the dog.

Both dogs were loose again, and "Brutus" bit {V} Rajvanshy~ "Brutus}/ was th~n seized
for shelter quarantine and a dangerous dog hearing. (5} McDonald was cited for the
break of the quarantine.

3/21/15

Both dogs were running at large and "Brutus}/ bit a passerby. An ASO responded, and
from their investigation, the gate appeared to be forced open which was how th e
dogs escaped the yard. The officer then cited (5) McDonald for no license and animals
running at large, and put 11 Brutus" on home quarantine.

On 3-28-15 at approximately 0730 hoursr I was dispatched a call where two dogs were loose and
one had bitten a passerby. Sgt. Jenkins and I responded tothe call and located both dogs1 which live
at 2516 Bentley Ridge Dr. in San Jose. Upon further investigation1 we discovered that the dog that bit
was on bite quarantine for a previous bite to a passerby earlier in the week. We made owner contact
and seized the dog for shelter quarantine and dangerous dog hearing.

. On. 3-28-15 at approximately 0730 hours, I was dispatched a call where two dogs were loose and
one had bitten a passerby. Sgt. Jenkins and I responded to the call and both dogs were confined at
the time of our arrival. Sgt. Jenkins made contact with suspect dog owner Ray McDonald and seized
the dog for shelter quarantine anq a dangerous dog hearing. I then made contact with the victim
and rtlis family at his home

took video and photos of the dogs loose and barking in his yard. (V) Rajvanshy had a large "L"
shapec! i aceration iM the webbing between ms thumb and forefinger of his 1eft hand, which was
bleeding profusely~ There was a trail of the blood leading from the sidewalk to the front door of the
address. Sgt Jenkins took photos of the injury and trail of blood, while I took (V) Rajvanshy's verbal _
statement and advised him to go to the doctor for treatment. Sgt. Jenkins and I cleared the scene at
app~irnatety 0045 tmurs.
On 4-0l-151 I returned to both addresses and collected written witness statement form both the (V)
Rajvanshy and (S) McDonald. .

(S) McDonald stated he did not know how the dogs were getting out.

ftARRA11VE CONDNUED.:
(S) McDonald filled out a witness statement form and signed it, but did not complete it. I then made
contact at the victim's address and got (V) Rajvanshy's statement.

(V) Rajvanshy stated he and his wife were out for their morning walk, when they ~alked towards (S)
~McDonald's

house. They were then charged by two large dogs, one black and one fawn. He stated
that the black dog began to circle both he and hiss wife, barking. He tried to shoo them away when the
fawn colored dog leap up and bit (V) Rajvanshy's left hand. He stated that he did not know what the
dog did after the incident, because he was going back inside his house, and no longer watching the
dog. After he was inside, he washed the wound and called the police to report the bite. His son-in-law
Alok Mittal, took video and photos of the dogs loose on their property and called San Jose Animal
Care Services to report the incident.

Once at the doctor, they cleaned the wound and wrapped it. He was also given"a tetanus shot and

antibiotics.

On March 28, 2015 at 0735 hours, San Jose Animal Services received a call from Reporting
Party, Alok Mittal, who stated two large dogs were running loose and one ofthem bit his
father. I arrived on scene at 0800 hours and made RP contact with 'Mittal. He-stated his father
was out for his morning walk when the neighbor's dogs, whom were at large, approached him
and one of the dogs bit. He stated the dogs have since been secured back to the home. He
pointed out the home, which is next door to his house, at 2516 Bentley Ridge Dr. At the
home, I saw an open gate with landscaping people cutting grass at the house.
SJACS dispatch advised that there was a dog on quarantine at the suspect house already, for
a bite that happened last week,(A 15-004692).

As fhe RP was faking me i11to bis horne.fo see the victinl, J noticed blood dropl~s along tbe
walkway to the front door. ~made v~ctim contact and verified a bite to his {eft hand. He had an
approximate 2 inch laceration where the left index finger meets the palm and a puncture on
the left hand knuckle. The victim state9 he was -walking past the neighbor's borne~~ when two
large dogs, 1 black and 1 brown, ran out of the property and charged him barking, and the
brown dog ran up and bit his hand. f took pictures of the wounds.
SJACS Officer pope arrived on scene and completed the bite report.
San Jose Police arri'(ed on scene and the sergeant called the dog owner, Ray McDonald, by
phone and asked him to .bring the brown dog out on leash, as per my request. McDonald
came out with the biter dog and load~d it onto my truc.k. I gave him a Dangerous Dog seizure
notice and explained the .D D process and requirements.
The dog was impounded for a 10 day shelter quarantine and .will stay at the shelter pending

the Dangerous Dog hearing.

03/28/15 07:49 I called rp to obtain dog description. No answer, went to voice mail, left message. We do currently have a
quarantine at the address of 2516 Bentley Ridge on a cane corso, if this is one of the dogs that is loose.
3/28/15 I arrived on scene and made RP contact. He stated his father was out for his morning walk when the neighbor's dogs,
who were at large, approached him and one of the dogs b it. He stated the dogs 'tlave since been secured back to the 'home. He
pointed out the home, which is ne)tt door to his house, at 2516 Bentley Ridge Dr. At the home, I saw an open gate with
landscaping people cutting grass at the house.
SJACS dispatch advised that there was a dog on quarantine at the suspect house alread1 for a bite that happened last
week,(AlS-004692).
As the RP was taking me into his home.to see the victim, I noticed blood droplets along the walkway to the front door. I made
victim contact and verified a bite to his left hand. He had an approximate 2 inch laceration where the left index finger meets the
palm arid a 1~..mcture on the left hailcl kn uckle. fie stated i 1e was walki~: :past ltle fleigllbor's flame, when two large dogs, 1
black and 1 brown, ran out of the properly and charged him barking and the brown dog ran up and bit his hand ..I took pictures
of the wounds. SJACS Officer pope arrived on scene and completed the bite report.

San Jose P91ice arrived on scene and the sergeant called the dog owner, Ray McDonald, by phone and asked him to bring the
brown dog out on leash, as per my request McDonald came out with the biter dog and loaded it onto my truck. I gave him a
Dangerous Dog seizure notice and explained the DO process and requirements.
The dog was impounded for a 10 day shelter quarantine and will stay at the shelter pending the Dangerous Dog hearing.
04/01/15 14:49- Made contact at both victim and suspect dog owner's address to dro off witness statement forms. Suspect
McDonald did not complete his. He stated it was ok to use a verbal statement.

Upon arrival I observed the dogs loose in front of the residence. There is a large automatic gate in the driveway that leads to a
courtyard. I made contact with the dog owner who confined the dogs. It appears that the gate was forced open from the
outside. The dog _owner believes someone may have been trying to get in. I educated the dog owner on Dangerous Dog
designations and civil liability. I completed an exposure report and placed the dog on a 'home quarant ine. I advised the dog
owner that I would follow up with him after speaking with the victim who is currently getting treated. I made contact with the
victim by phone. The victim stateed that she was walking past the address and saw that the dogs were comming from the open
gate. As she continued walking the dog came from behind and bit her on the thigh causing several minor punctures. I will be
followin up with the dog owner and will be issuing a citation.

I made contact with Evergreen animal hospital and confirmed that the dog is not current on its vaccination (EXP-10/30/14) The
dog will need to be released from quarantine in person on 03/31. I made contact with the dog owner and advised that I will be
issuing a citation for restraint on both dogs but will not persue a Dangerous Dog hearing as we have no priors and the
circumstances of the gate being forced open. The dog owner was cooperative and requested that I provide his contact info to
the victim to cover any medical expenses. I contacted the victim and provided her with the dog owner's first name and phone

the San Jose Municipal Code, the Hearing Officer conducted a public hearing on
April 30, 2015, notice of which was duly given, on whether the certain dog commonly
known as "Brutus," owned by Mr. Raymondo McDonald, 2516 Bentley Ridge Drive,
San Jose, is a dangerous dog; and

WHEREAS, at said hearing the Hearing Officer gave all interested persons present
a full opportunity to be heard and to present testimony and other evidence regarding
whether "Brutus" is a dangerous dog; and,

WHEREAS, at said hearing, the Hearing Officer received and considered the following
documents: 1) Request for Potentially Dangerous, Dangerous or Vicious Animal
Hearing, submitted by Animal Services Officer Stephanie Pope, dated April 1, 2015; 2)
Incident Report No. A 15-005085 and nine photographs submitted by Animal Services
Officer Stephanie Pope, dated April 1, 20,15; 3) Supplemental Incident Report No. A 15005985 submitted by Sergeant Jaysen Jenkins, dated March 28, 2015; 4) "Background
Report" and "Activity Information Card" reporting the prior occasion when "Brutus" came
to the attention of Animal Services on March 21, 2015; 5) Notice of Animal
Seizure/Impoundment, dated March 28, 2015; 6) "Animal Exposure Incident Reports"
Nos. A15-005085 and A15-004692, dated March 28, 2015 and March 21,2015,
respectively; 7) Witness Statement submitted by Witness Prem Rajvanshy, dated April
1. 2015; 8) The Hearing Officer heard and considered the oral testimony of Animal
Services Officer Stephanie Pope, Mr. Prem Rajvanshy, Mrs. Urmilla Rajvanshy, Ms.
Rita Karlsten, Witness Kathleen Budros, Mr. Raymondo McDonald; and

WHEREAS, said Hearing was conducted in all respects as required by the San Jose
Municipal Code; and

NOW, THEREFORE, the decision of the Hearing Officer is as follows:

A.
After ~onsidering the evidence

presented at the public hearing, the Hearing

Officer finds that the following are the relevant facts regarding whether
"Brutus" is a dangerous dog.

1.

San Jose Municipal Code Section 7.10.090 provides in relevant part


dangerous dog means any dog other than a Police Dog that has bitten
a person which resulted in an injury that is less than a severe injury.

2.

According to the testimony and report of Animal Services Officer


Stephanie Pope, on March 28, 2015, Officer Pope and Sergeant
Jaysen Jenkins were dispatched to the vicinity of 2516 Bentley Ridge
Drive because of a report of a dog bite. According to Officer Pope, at
some point, it was determined that the dog, "Brutus," a one year old
male Cane Corso, owned by Mr. Raymondo McDonald, was more
likely than not responsible for the dog bite that mor~ing and, further,
had been on quarantine because of a bite incident that occurred one
week earlier. Given the above, at the request of Animal Services, Mr.
McDonald surrendered "Brutus" and put his dog in the service vehicle.
"Brutus" was subsequently transported to Animal Services and
impounded.

3.

According to Officer Pope, the victir:ns were identified as Mr. Prem


Rajvanshy and Mrs. Urmilla Rajvanshy They were then coptacted. Mr.
and Mrs. Rajvanshy told Officer Poe, and stated during the hearing, on

the above date at approximately 6:30a.m., they started their routine


morning walk. As they began, according to Mr. Rajvanshy, two dogs,
one black in color and one brown in color, ran from across the home
across the street, ran to them and started running around them while
barking. Both Mr. and Mrs. Rajvanshy felt menaced by the dogs. At
some point, according to Mr. Rajvanshy's testimony, the brown dog,
named "Brutus,"" ... suddenly jumped up ... " and tried to bite his leg. Mr.
Rajvanshy put his hand behind his leg at which time it was bitten by
"Brutus." Mr. Rajvanshy stated he was wearing a glove at the time;
however, the dog's teeth penetrated the glove and bit his finger. Mr.
Rajvanshy stated the bite wound " ... started bleeding profusely ... " and
blood fell onto the sidewalk. Mr. Rajvanshy stated they went into the
home of his son in law, Mr. Alok Mittal, a doctor, where his wound was
washed thoroughly and continued to bleed. Mr. Rajvanshy stated he
was then taken to Palo Alto Medical Foundation where his hand was
placed in a solution. The wound was then bandaged and he was given
antibiotics.

Mr.

Rajvanshy stated soaking his hand in the solution was

painful and the medication caused nausea for ten days. Mr. Rajvanshy
reported the wound remains painful to this day.

4.

Ms. Rita Karlston was the victim of a dog bite inflicted by "Brutus"
seven days before, on March 21, 2015. As a result of above noted
incident, "Brutus" was quarantined as required by law, but 't'as
permitted to remain at home. Ms. Karlsten stated on the above date,

she and her friend and witness, Kathleen Budros, were starting their
routine walk on Bentley Ridge Drive when they saw two dogs run from
the home at 2516 Bentley Ridge Drive. One dog was brown in color,
"Brutus," and the other was black in color, "Tank.-" According to Ms.
Karlston, "Brutus" ran up behind her, jumped on her from the back,
caused her to fall onto the grass of the parkstrip and, at some point, bit
her on the back of. her thigh. Witness Budros positioned herself in
between Ms. Karlston and "Brutus" until Ms. Karlston was able to
stand. Ms. Karlston and Witness Budros then walked to a neighbor's
home for assistance. According to both, the neighbor took them into
the home where Ms. Karlston was able to assess, as she stated,
wounds consisting of three puncture wounds. Ms. Karlston cleansed
the wounds and, then, called Animal Services. The neighbor drove
them to their vehicle and, from there; Witness Budros drove Ms.
Karlston to Kaiser Hospital where she received treatment and
medication.

5.

When asked as to how his dogs were able to run at large, Mr.
McDonald stated, although there are two gates and they are secure,
he believed the gate to the street was intentionally opened by an
unknown person. Mr. McDonald came to that conclusion because, as
he represented, his home had been burglarized and believed one of
the persons responsible probably returned and opened the gates.

As to dog training, Mr. McDonald stated both dogs have had much
training by "Kelly K-9 Dog Training" and training occurred both in his
home and at the dog training facility. When asked what his dog trainer
said when told about the incidents at issue here, he was told his dogs
need more socialization to get used to people; his dogs, given their
breed are very protective. Mr. McDonald stated he intends to intensify
the dog training of both dogs.

6.

The costs of impounding and boarding "Brutus" from the date of


impound, March 28, 2015, to the date of this decision, May1, 2015, are
$624.00. The costs include an impound fee of $40.00. There were
boarding fees during the ten day quarantine period which totaled
$200.00 plus boarding fees for the remaining twenty-four (24) days at
$16.00 each day which totaled $384.00. The total costs, then, for
impounding and boarding "Brutus" from the date of impound, March
28, 2015, to the date of this decision, May 1, 2015, are $624.00.

B.

The Hearing Officer concludes and finds based upon an analysis of the above
facts that:

Mr. Raymondo McDonald is the owner of the dog commonly known as


"Brutus."

San Jose Municipal Code Section 7.10.090 provides in relevant part


dangerous dog means any dog other than a Police Dog that has bitten
a person which resulted in an injury that is less than a severe injury.

The evidence submitted in this matter, in particular, by the testimonies


of Victims Prem Rajvanshy, Urmila Rajvanshy and Rita Karlsten clearly
showed that "Brutus" bit and caused injuries to both Mr. Rajvanshy and
to Ms. Karlsten. In addition, it is concluded that Mrs. Rajvanshy was
menaced as "Brutus" and "Tank" circled and barked at both of them.
This entire matter was, of course, aggravated by the fact that when

,.i

"Brutus" bit Mr. Rajvanshy and menaced Mrs. Rajvanshy the dog was
under mandatory quarantine, having bitten Ms. Karlston one week
earlier.

According to Mr. McDonald, "Brutus" and "Tank" are litter mates. It is of


much concern that both dogs, at their young ages, are capable of
aggressive behavior to the extent the dogs, in particular, "Brutus," at
this point, are a threat to the public safety. In this matter, it will be
determined that "Brutus" is a dangerous dog, as define inthe municipal
code. As a consequence, "Brutus" will be subjected to be maintained
under significant requirements, one of which will be dog training. It is
concluded, given the facts of this case, dog training should be a
cornerstone of this decision and that Mr. McDonald should be much

involved in the training.

The costs of impounding and boarding "Brutus" from the date of


impound, March 28, 2015, to the date of this decision, May1, 2015, are
$624.00. The costs include an impound fee of $40.00. There were
boarding fees during the ten day quarantine period which totaled
$200.00 plus boarding fees for the remaining twenty-four (24) days at
$16.00 each day which totaled $384.00. The total costs, then, for
impoundirig and boarding "Brutus" from the date of impound, March
28, 201 ~~ to the date of this decision, May 1, 2015, are $624.00.

A.

The Hearing Officer further concludes and finds based upon an analysis of
the above facts, conclusions and findings that the dog, commonly known as
"Brutus," owned by Mr. Raymondo McDonald, is a dangerous dog.

B.

Notice is hereby given that, pursuant to Section 7.30.920 of Title 7 of the San
Jose Municipal Code :

1.

A dangerous dog is subject to a Special Dog Permit tags requirements


under Section 7.30.540; and

2.

A dangerous dog shall be muzzled and leashed as specified under

place or upon any private place, or property or common

A dangerous dog is subject to the confinement requirements of Section


7.30.940; and

4.

A dangerous dog must be spayed or neutered; and

5.

A dangerous dog must have a microchip implant for identification


purposes; and

6.

A dangerous dog is subject to the warning sign requirements of


Section 7.30.960 SJMC; and

7.

A dangerous dog is subject to the transportation requirements of


Section 7.30.970 SJMC; and

8.

A dangerous dog is subject to the insurance requirements of Section


7.30.980 SJMC; and

9.

The dog owner/guardian or person with the right to control&,the dog

class and attend the dog obedience class with the dogs that exhibited
the behavior specified in Section 7.10.090 SJMC; and

Mr. Raymondo McDonald shall pay a Fine in the amount of $300.00


and said Fine plus any Penalties and/or Interest that may accrue shall
be paid on or before July 15, 2015 and said payment is to be made
payable to Field Services, San Jose Animal Care and Services and

Your dog "Brutus" was the subject of a potentially dangerous, dangerous, or vicious dog hearing
conducted by the City of San Jose on April 30, 2015. In the decision dated May 1, 2015 the Hearing
Officer has deemed your dog to be a Dangerous Dog.
If you wish to keep your dog within the City of San Jose, please read this letter carefully and follow the
requirements set forth below. In order to keep your dog within the City of San Jose, you must comply
with the City of San Jose Municipal Codes, Chapter 7.30, Part 5 Special Dog Permit Procedures and Part 9
Requirements for Maintaining a Potentially Dangerous, Dangerous, or Vicious Dog.
THE FIRST STEPS ARE AS FOLLOWS:

1.

License your dog with the City of San Jose.

2.

The Special Dog Permit Application is enclosed. Complete and return the Special Dog Permit
Application within ten (10} days of the date of this letter*. Submit ONE application PER DOG .
Be sure to fill out the form accurately and completely. Inaccurate or incomplete applications
will not be accepted.

3. Submit the $114.00 application-processing fee, which includes one inspection.


4.

Mail completed application and personal check or money order made payable to:

5.

Comply with the requirements for confinement as set forth in the City of San Jose Municipal
Codes, Section 7.30.'940. A summary of which is provided for your convenience only.

You have thirty {30) days from the date of this letter to complete the permit process and be in

Either the failure of the dog owner/guardian or person with the right to control the dog to
comply with all the provisions of the Hearing Officer's decision will result in the surrender of the
animal to the Administrator to be disposed of in accordance with the law.

8.

If San Jose Animal Services has impounded/seized your dog, you have ten (10) business days
from the day you receive your decision to apply for a Special Dog permit. Once your Special Dog
Permit application has been received and processed, you have twenty (20) days to pay for all
fees "-and be in compliance with City of San Jose Municipal Code Chapter 7.30 part 5.
*NOTE:

If your application has not been received within ten {10} days, and/or
you fail to gain compliance your dog will be deemed abandoned and
become property of City San Jose, Animal Care and Services.
9.

You have the right to appeal the Hearing Officer's decision with the Santa Clara County Superior
Court at 191 N. First Street, San Jose, CA 95113 or (408) 882-2100 between the hours of 8:00am
and 4:00pm within five {5) days of receiving this decision pursuant to section 31622 of the
California Food and Agricultural Code, or this decision will be deemed as final after five {5) days.

03/28/15 07:49 I called rp to obtain dog description. No answer, went to voice mail, left message. We do
currently have a quarantine at the address of 2516 Bentley Ridge on a cane corso, if this is one of the dogs that
is loose. dr7204
3/28/15 I arrived on scene and made RP contact. He stated his father was out for his morning walk when the
neighbor's dogs, who were at large, approached him and one of the dogs bit. He stated the dogs have since
been secured back to the home. He pointed out the home, which is next door to his house, at 2516 Bentley
Ridge Dr. At the home, I saw an open gate with landscaping people cutting grass at the house.
SJACS dispatch advised that there was a dog on quarantine at the suspect house already, for a bite that
happened last week,(A15-004692).
As the RP was taking me into his home to see the victim, I noticed blood droplets along the walkway to the front
door. I made victim contact and verified a bite to his left hand. He had an approximate 2 inch laceration where
the left index finger meets the palm and a puncture on the left hand knuckle. He stated he was walking past the
neighbor's home, when two large dogs, 1 black and 1 brown, ran out of the property and charged him barking
and the brown dog ran up and bit his hand. I took pictures of the wounds. SJACS Officer pope arrived on scene
and completed the bite report.
San Jose Police arrived on scene and the sergeant called the dog owner, Ray McDonald, by phone and asked him
to bring the brown dog out on leash, as per my request. McDonald came out with the biter dog and loaded it
onto my truck. I gave him a Dangerous Dog seizure notice and explained the DD process and requirements.
The dog was impounded for a 10 day shelter quarantine and will stay at the shelter pending the Dangerous Dog
hearing. -JJ06

forms. Suspect McDonald did not complete his. He stated it was ok to use a verbal statement. SP37

I spoke with dog owner Ray McDonald and he stated he is leaving for Chicago on Sunday (5/10/15). He will be
in on Sunday to reclaim. He was advised that he will need the permit to get the dog out. He agreed to the
payment of all fees and the permit but he does not want his dog neutered. I confimred with 5500 that no neuter
is necessary as long as he is leaving San Jose with the dog on Sunday and will not be back.
His new address in Chicago is: 26025 North Middleton Pkwy Chicago, Ill 60608
I made cpntact with Inspector Allen Holcomb with Chicago Animal Services and advised him of the relocation
into his jurisdiction. He requested a copy of the designation and a photo of the dog.
Please see the application and permit on 5520's desk.
Owner was advised he needs to have the leash, muzzle and harness, along with thetransport container on
reclaim day.
I confirmed his insurance- First American Insurance Policy# 10336041701
No need for home confinement requirements because he is not living in San Jose anymore.
He has been advised to seek training but he will not be here for us to verify.
He must pay all boarding and permit fees. He has until 7/15 to pay ad min fee.
Dog must have current rabies but we can waive the licensing fee sine he is moving out of state.
Dog must have muzzle, harness and leash on before going out and he must be put into the transport container.
Please get the {light information, since he should be going straight to the airport from SJACS. He stated he
needed to change his flight to a later time on Sunday, to give him time to reclaim his dog.

05/27/15 12:06- Since Mcdonald had been arrested in Santa Clara, we were unsure that his dogs were still
living in california. PO records stated current information on McDonald was sealed, and could only provide the
bentley ridge address. Went out to house to confirm the dogs were not ~t the home. House is empty, and
several packages at the door are listed to another individual. Will call Cali Canine and confirm the dogs are in

9/3/16 I made OC and I confirmed the dog "Brutus" is gone. Mcdonald stated he shipped the dog to Florida to a
friend. He stated his friend has since given the dog away to another person. I advised him that he needs to
provide the address of the new owners, and giving the dog away while designated is against the requirements.
He stated he would try to get the address and call me with it.-JJ06

9/7/16 Mr. Mcdonald called and said he spoke to his friend but he did not know the address or any other
information on the new owners. I advised him he would be cited for the violation.
I spoke with 5500 who stated since there is no new owner information, to cite Mcdonald and close the

Upon arrival I observed the dogs loose in front of the residence. There is a large automatic gate in the driveway
that leads to a courtyard. I made contact with the dog owner who confined the dogs. It appears that, the gate
was forced open from the outside. The dog owner believes someone may have been trying to g~t in. I educated
the dog owner on Dangerous Dog designations and civil liability. I completed an exposure report and placed the
dog on a home quarantine. I advised the dog owner that I would follow up with him after speaking with the
victim who is currently getting treated. I made contact with the victim by phone. The victim stateed that she
was walking past the address and saw that the dogs were comming from the open gate. As she continued
walking the dog came from behind and bit her on the thigh causing several minor punctures. I will be following
up with the dog owner and will be issuing a citation.

I made contact with Evergreen animal hospital and confirmed that the dog is not current on its vaccination (EXP
10/30/14) The dog will need to be released from quarantine in person on 03/31. I made contact with the dog
:)Wner and advised that I will be issuing a citation for restraint on both dogs but will not persue a Dangerous
Dog hearing as we have no priors and the circumstances of the gate being forced open. The dog owner was
:ooperative and requested that I provide his contact info to the Victim to cover any medical expenses. I

United Veterinary Specialty & Emergency states that dog was very aggressive and went after several people at

Myself and ASO Kinsman #27 responded and made contact with Ray McDonald at the Bergerac address which
he now resides with his two dogs. He advised that he moved with Brutus to Chicago after he was designated,
then later had Brutus transfered to Florida where he then recently had Brutus sent here to his address he said -a
few weeks ago. He advisaed April took Brutus to EAC Dell due to a ear infection and injuries sustained from his
two dogs fighting. He put us on the phone with April, who advised she was with Brutus the entire time. and
advised no bite happened. We left a WSF with McDonald to have April cpmplete for our investigation.

Myself and 5517 responded to Ray McDonald's residence. McDonald answered the door and I asked about the
injuries to "Brutus". He stated that "Brutus" and his other dog got in to a fightt and "Brutus" was taken in to
EAC to remove drain tubes. Apryl Goncalces
had brought "Brutus" in on a leash and McDonald
was not present. I asked if he was aware of a bite and he said no. I told him that it was reported that "Brutus"
bit a vet tech at EAC. He said that his dog is very sensitive to his ears due to the injury and that the hospital
should know that. He called Apryl and handed me the phone. I had a hard time hearing her, but she said that
she had "Brutus" .on a leash and a vet tech came out. She never observed a bite and then questioned why they
would send someone else out to work on "Brutus" if he did bite someone. I asked if I could leave a Witness
Statement with Mr. McDonald for her to fill out and she agreed. I asked for her phone number and she gave
. 5517 issued McDonald a Witness Statement for her. I asked McDonald if this was his residency
or temporary housing and he said it was his residency. I advised him that he has "Brutus" back in San Jose
without being in compliance with a Dangerous Dog permit. He said that he would take care all of the
requirements right away. I told him that due to the bite and the designation, we would need to impound the
dog. He said that we would have to come back with a warrant to take his dog since he felt there was no bite
and i~ was unfair to the dog. I spoke to 5500 and concluded that we would verify the bite since the fax was
from EAC and not the hospital. 5500 said that he needed to get in compliance now with the DD requirements. I
went back to McDonald and told him that we would be looking in to the bite and in the mean time he needed to
get in to compliance. I also mentioned that if there was a bite that was verified we would be seizing the dog. I
asked if he thought that was fair since we are trying to work with him and he agreed. 5517 provided McDonald
with DD requirements and set up going out tomorrow morning to deliver application. We cleared the call and

He said that on Wednesday the 27th a female (who he referred to as Mrs. McDonald- and was never 'corrected)
brought "Brutus" in for drain tube removal. Aguilar was about two feet away and talking to Apryl. The dog
suddenly lunged and pulled her to the ground on her knees. "Brutus" then went after Aguilar and bit him on his
right upper arm. He said that he had a sweater and had pulled his arrn away and "Brutus" let go. Apryl was
able to get up and pulled "Brutus" back. Aguilar was told that Apryl mentioned to the receptionist that "Brutus"
has never done that before. 5517 and I were shown the injury. There was a significant amount of bruising
about the size of a grapefruit and a pea size puncture as well as a small puncture on the other side of his arm.
He declined to go to the hospital and treated it himself. We asked if he could fill out a Witness Statement for
us, which he did and returned. MK27

Noticed this activity has been outstanding so I entered a new sequence for dog owner contact in hopes of
gaining updated compliance for his dangerous dog. 0 was previously issued permit DD.0219 on 5/10/15 which
technically expires 5/10/16. However, this permit was assigned to his last known residence on Bentley Ridge,
and his status has been invalid since allegedly moving out of SJ jurisdiction. Reference activity A15-005085.
