Dear homeowner;

We are inviting you to our meeting to reinstate the HOA in our community. The Orchard
Townhomes is a Planned Unit Development or PUD for short.
In our community we abide by: Common Interest Communities which are not required
to incorporate in Utah, but many choose to do so. We were trying to work with you but for lack of
cooperation, we feel obligated to have the HOA registered in the state of Utah.
During the close of your townhome purchase you signed an agreement, acknowledging
that you were purchasing a home within a covenanted community and that you would abide to
the CC&Rs of the community or Association. At the time of closing, a copy of our CC&Rs should
have been provided from the county records office when you signed all the buying documents
with your lender.
Our HOA governing documents are in the form of a Declaration of Covenants,
Conditions, and Restrictions (CC&Rs), Rule and Regulations, and Bylaws. Ours, (Orchard
Townhomes) was filed in Utah County by David Gren (original owner of the Townhomes) in
December 2005. Our CC&Rs have not changed since its inception.
Incorporation provides additional legal guidance respecting community governance,
provides additional legal protections to the associations' governing boards, and facilitates
contracting with some entities, particularly some lenders.
In most associations, the budget is established by the Board, and presented at the
annual meeting.
In Utah, you must have at least three directors on your board. If you do not name initial
directors in your articles of incorporation, you must provide their names to the state no later than
the filing of your first annual report.
When you purchased your Orchard townhome, you acknowledged that it resides
within a planned, covenanted community. Your membership to the HOA is mandatory.
The meeting will be held on 393 West 800 North, Lindon Utah 84042 on Tuesday,
December 23rd at 7:00 pm. The meeting will be no more than one hour long.
