Sub: Complaint for Extortion Demand and Harassment from Govt.

Sir,
I am a senior citizen aged about 71 years and I am a peaceful resident living in the area of
PATEL GARDEN- KAKROLA. I would like to put forward my recent grievance to the
concerned legal authority regarding undue harassment from some public officials.
I would like to inform you that I am residing in a old house which is in need of urgent repair
work as a measure of protection against earthquakes, floods and other natural calamities.
Therefore I had decided to start some work of plastering and repairing of the walls. Being a
dutiful citizen I am aware of minor disturbance which may be caused due to such work being
carried out in the said area. As a result, I have made sure that there must not be any obstruction
of easement of others nor any debris be lying on the road causing any hindrance to anyone.
On the day of 23rd November, 2016, the local Sub-Divisional Magistrate (SDM) along with his
officials came to my place of residence and all of the sudden, without due notice, began
threatening my contractor and his laborers working at the site. When I came forward to inquire,
he turned towards me and threatened me that he will serve notice to me under certain provisions
of law and get me arrested by police authorities. I fervently pleaded him to explain why he was
insisting on taking punitive actions against me and whether there was anything illegal in the
work which was being done or if it was causing any problem to anyone in the vicinity.
On hearing me speak, he shouted at me and began threatening me again that he will make sure
that I am booked under Section 133 of The Code of Criminal Procedure 1973 i.e. (Conditional
order for removal of nuisance), and surely I will be arrested under the charge. I was extremely
disheartened by the words of the govt. official as I was wondering why I was subjected to such a
charge since there was no visible complaint against me by anyone. When I completed my
statement, he thundered at me and said he is powerful enough to arrange for some fake
complaints which will be filed against me. Since I was not in a position to argue with a public
official like SDM, I pleaded again with folded hands to have some mercy on me.
He later advised me to speak to his driver. Furthermore, the SDM confirmed to me that he will
do what he can about resolving the issue and will take regard of my age and the urgency of the
repair work to be done, on the condition that, I obey his orders. Instead of helping me sort out the
issue, he, without the slightest hesitation, demanded a huge bribe of Rupees Four Lacs. He
categorically stated that the money was for allowing me to do my renovation work peacefully

and if I refuse to pay the sum, I would be subjected to some very heavy penalties alongwith
frequent visits to the court for appearing in cases to be filed against me. This is a perfect example
of blatant misuse of authority and position by a public official under various laws dealing with
corruption by government officials and I strongly object to it.
The very next day, the officer visited me again and wanted to know, if I had considered his
proposal. I requested him directly that since I am not doing anything illegal; I would not pay
anything to him. He again angrily shouted on me and threatened me with dire consequences by
embroiling me in a false case of illegal bore well which was not existent at the first place. I have
repeatedly asking if I am doing anything illegal but he had no answers to my questions.
I hereby asking your good office to intimate me and serve notice, if I am doing anything illegal
as I will stop it there and then itself. But as per my understanding, getting renovation work of my
own house is not outside the limits of law, nor I am creating any nuisance for anyone. I feel
ashamed to have written all this to you because of my inherent fear of harm to me. I have not
made a complaint to anyone till date. As a senior citizen, I hereby request you to protect me and
my property from such errant officials, which instead of serving the public have decided to
misuse their office, and take prompt appropriate action.
