HaskoningDHV had been appointed to carry out the design

VC stated that there has been increased pressure on the progression


of the Finningley Development
VC stated that the progress of Finningley Development is reliant on
the approval of the application for rezoning from agricultural to
municipal township under Act 70 of 1970.
VC stated that the application has been submitted to the Department
of Agriculture and approval of the application by this department is
still outstanding.
RM stated that the original scope of work consisted of a water
demand determination for the Midnite Cafe supply zone, which
included additional demands for the recently developed Amahlongwa
rural infill project. The existing infrastructure and storage capacity
was found to be insufficient and an upgrade to the rising main, pump
station and reservoir capacity was required.
LB stated that during the detailed design stage, it was discovered
that the existing pipeline servitudes and the reservoir site were never

completely registered and expropriated and is not owned by EWS.


Upon commencing with the land acquisition phase for the
registration/expropriation of the pipeline servitudes and reservoir site,
the proposed Finningley Development was discovered.
The requirements of the Finningley Development resulted in a
change in the design and scope of work of the original contract
appointed to RHDHV.
RM stated that a water demand investigation had been carried out
and that the combined ultimate for both the EWS supply zones and
the Finningley Development to be supplied from the Midnite Caf
reservoir is approximately 16 M/day.
In order to provide 48 hours storage, a 32 M capacity reservoir is
required.
LB stated that a section of the existing gravity pipeline and the
Amahlongwa take-off are to be relocated as no formalised servitudes
are registered over these routes and the existing pipelines interfere
with the proposed land-use (new small-craft airport and racetrack)
within the Finningley Development zone.
LB stated The requirements of the Finningley Development also
results in financial implications increasing the total cost of the project
from approximately R60 mil to approximately R160 mil.
LB stated that the additional required funding has not yet been
approved by council, however the section 116 report for the approval
of the additional required funding and the extension of RHDHVs
appointment has been drafted.
NJ stated that progress on the Midnite Cafe contract should be
halted until the required funding has been approved by council.
LB stated the concern of the current contract with RHDHV which
expires on the 12th of May 2017.
LB raised the concern that the existing reservoir and existing
pipelines are on land owned by Finningley Development (JCGroup)
and not EWS.
LB stated that the existing pipelines are also within the area to be
developed by Finningley and are required to be relocated.
SM stated that Finningley (JCGroup) have offered to donate the
land required by EWS.
VC confirmed this statement.
VC proposed a new process for the approval of the required funding
and extension of the RHDHV appointment through The Municipal
Finance Management Act (MFMA) (Act 56 of 2003).
VC proposed that the required Midnite Cafe funding be included into
Finningleys total amount to be signed off by/through MFMA.
VC stated that Finningley Development (JCGroup) would nominate
RHDHV as the consultant for the Midnite Cafe scope of work.
VC stated that the proposed process would mitigate the delay of the
SCM process, allowing construction of the Midnite Cafe infrastructure
to commence earlier, shortening the overall project programme.

VC stated that a shortened Midnite Cafe programme is in the best
interests of Finningley Development as Finningley Development
requires water for the building and construction supply.
LB stated that Dave Larkin (EWS) has recently submitted a similar
application using the MFMA process for Tongaat Hullets
Development (THD); however approval of the application has not yet
been granted.
LB to discuss the MFMA process with Dave Larkin
LB to discuss the new process of funding and appointment through
the MFMA with Simon Scruton (EWS)
SM stated that should the proposed MFMA process be agreed upon
by all parties, a Memorandum Of Understanding (MOU) between
EWS and Finningley Development (JCGroup) is required and would
need to be approved by EXCO.
SM stated that EXCO hold their first meeting at the end of January
2017.
SM stated that the MOU is to include that Finningley Development
(JCGroup) will nominate RHDHV as the appointed consultant to
carry out the design and construction monitoring of the Midnite Cafe
project.
SM stated that the current EWS appointment/contract with RHDHV
will only be terminated once the MOU has been signed and approved
by EXCO.
SM requested that RM co-ordinate a follow up meeting on Tuesday
the 13th of December.
SM stated that Lekha is required to attend the meeting to be coordinated on the 13th of December.
