    ThisisanapplicationwherebyapplicantVivekVishwananth

    Kumar is seeking permission for return of passport for the purpose of


    passportapplicationforhisnewbornchildrenuntilsuchtimeasrequired
    bythepassportauthorities.

    Heard Adv. Lokesh Jain for the applicant and SPP Adv.

    GharatfortheState.SPPAdvGharatforthestatestatedthatonprevious
    occasions this Hon'ble Court was pleased to grant permission to the
    applicant to travel abroad. He returned and abided by the conditions

    imposedbythisHon'bleCourt.Hence,SPPgavenoobjectiontoreturnthe
    passport.

    Applicant, in pursuance to bail condition was ordered to

    surrenderhispassportwithI.O.Alreadypermissionisgrantedtoapplicant
    totravelabroad.Theapplicanthasnotsoughtpermissiontotravelabroad,
    buthewantshispassportforapplyingforthepassportforhisnewlyborn
    children. I do not find that any prejudice would be caused to the
    investigating agency if, applicant is returned his passport for the said
    purpose.Theinvestigatingagency,meanwhile,canissuelookoutnotice
    againsttheapplicanttoavoidtheanypossibilityofapplicantfleeaway.As
    such,Iproceedtopassfollowingorder.
    ORDER
    Applicationisallowed.
    Investigating agency is directed to handover /return the
    passporttotheapplicant.
    Applicant is directedto again surrender his passport with
    I.O.in24hoursafterthecompletionofthepassportformalities forhis
    children.
    Applicantisalsodirectednottousethepassporttotravel
    abroadwithoutthepermissionofthisdesignatedCourt.
