MOTION FOR EXECUTION

COMES NOW THE PLAINTIFF, through the undersigned counsel most

respectfully states that:

Plaintiff is a Filipino citizen, of legal age, with business address at ____, while
defendant is a Filipino citizen, of legal age, and a resident of ____, where he may be
served with summons and other court processes;

Plaintiff filed a complaint before the Barangay against the defendant for
collection of sum of money;

On February 14, 2005, the parties entered into an Amicable Settlement at the
Barangay. A copy of the settlement, duly approved by ____, Punong Barangay of
Dominican Mirador Barangay, is herein attached as Annex A;

Of the settlement, the amount of P____ which was due on ____ remains unpaid.
Likewise the interest of ___ % a month, which was due at the end of April, 2004,
remains unpaid, amounting to P ____ as of December, 2004;

Efforts to enforce the settlement on the Barangay level failed, as evidenced b y

the herein attached Certification to file action in court issued by the Barangay on
December, 2004;

WHEREFORE, it is respectfully prayed of this Honorable Court that a Writ of

Execution of an Amicable Settlement entered before a Barangay be issued at the
soonest possible time;

filed or is pending in the Supreme Court, the Court of Appeals, or any other tribunal

wherein the original pleading and sworn certification contemplated herein have been
