1. Term: The term of this agreement shall be for 6 months commencing on the date set
forth above, unless canceled on 30 days written notice by either party. It shall be renewed
upon review of the Contract and re-signed and dated.

4. Ownership of/Authority Over Horse(s):


a. Boarder represents and warrants that they are the owner of record of Horse(s), are
of at least 18 years of age, or that they have express authority of the owner of
record to enter into this Contract and to house Horse(s) with Stable.
b. If Boarder is not the owner of record of Horse(s), Boarder nonetheless agrees to be
fully bound by the terms of this agreement, and liable for all sums hereunder:

5. Persons of Interest:
a. Boarder/Owner of Horse(s) certifies that they are not related to, business partners
or employed, or in any way dealing with anyone who is currently licensed or in
contract with the New York State Department of Agriculture and Markets through:
i. Domestic Animal Health Permit (Livestock/Horse Dealer)
ii. Dog Control Officer and/or Municipal Shelter
iii. Dog Breeder/Pet Dealer
iv. Cervid Farm Owner/Breeder (White-tail, Elk, Reindeer)
v. Poultry Market Owner/Employee
b. Should the Boarder/Owner of Horse(s) become involved with the NYS Department of
Agriculture and Markets through any of these forms, this contract shall become null
and the Horse(s) must be removed from the Stable property.

6. Boarding Fee:
a. Full Stall Board: $250 fee per horse is due on the 1 st day of each month. Payment
received after the 7th of the month will be subject to a $20 late fee, plus $2 in late

fees for each additional day thereafter on which Board plus accrued late fees remain
unpaid. There will be a $25 charge for returned checks/denied credit/debit cards.
Payments shall first be credited to accrued late fees and returned-check charges.
b. Pasture Board: $175 fee per horse is due on the 1 st day of each month. Payment
received after the 7th of the month will be subject to a $20 late fee, plus $2 in late
fees for each additional day thereafter on which Board plus accrued late fees remain
unpaid. There will be a $25 charge for returned checks/denied credit/debit cards.
Payments shall first be credited to accrued late fees and returned check charges.
c. Other Boarding Rates are listed in the Stable Price Schedule and must be agreed
upon by both parties.
7. Deposit:
A refundable deposit equivalent to half the board amount per horse is required at
the commencement of this Contract. Unpaid Board or Late fees, damages to Stable,
its facilities and equipment, veterinary charges, and any other unreimbursed
expense incurred by Stable for Boarders or Horses benefit (other than Boarding as
covered by this Contract) shall be deducted from the deposit. If Boarder choose to
remove Horse(s) prior to giving full and proper notice of cancellation, no deposit will
be refunded.

8. Requirements of Arrival of Horse(s):


a. Horse(s) must have the following requirements before unloading onto Stable
property:
i. Up to date NEGATIVE Coggins test if a NY Horse, the Coggins may be dated
this year or the year prior if an out-of-state horse, the Coggins must be
dated current this year.
ii. Current Rabies vaccination administered by a licensed veterinarian
iii. If Horse is out-of-state, must have a current 30-day Health Certificate

9. Stables Services:
a. Stable agrees to provide a covered stall/pasture space for Horse(s) which will be at
least once daily.
b. Horse(s) will be provided with turn-out time in congruence with Stable herd
schedule.
c. Horse(s) will be fed appropriate pellets and/or grain and/or square baled hay. Any
and all other supplements or feeds are the responsibility of Boarder. Feed and water
buckets will be provided by the Stable.
d. Stable will clean Horse(s) stall a minimum of once a day, as agreed upon on level of
Boarding, and pick the pasture once a week.
e. Stable shall have the rights to use reasonable and customary restraints and training
implements to move Horse(s) should they be necessary if, for example, horse
refuses to move or becomes a danger to itself or others. Further, if Horse(s)

becomes a danger to itself or others, Stable need not clean Horse(s) stall or provide
turn-out time.
f. Stable will blanket Horse(s) upon weather dependent.
g. Stable will schedule yearly Veterinary exams and every 6 week Farrier visits.
h. Stable will provide a location for Boarder to store tack/supplies for Horse(s),
provided Boarder keeps their supplies neat, put away and respects use of Stables
possessions.
i. Stable will provide each Boarder with three (3) scheduled hours of use of the Indoor
Arena, three (3) scheduled hours of use of the Outdoor Arena and three (3)
scheduled hours of use of the Round Pen per month.
j. Stable will provide fee schedule at end of Contract.

10. Horses Physical Condition/Special Care:


a. Except as specified in this section, to Boarders knowledge, Horse(s) is/are currently
sound, disease-free, and in good condition, and not in need of any special care.

a. Horse(s) described above will be fed according to dietary needs. Owner shall
describe what the Horse(s) are currently being fed, how much and what/if
supplements are needed:

13. Hours of Visitation/Access to Horse(s): Boarder, Stable veterinarian, farrier,


Horses trainer, and designated guests shall have access to Stable and Horse(s) on the
following schedule: Monday Friday 8am to 8pm, Saturday 8am to 9pm, and
Sunday upon pre-scheduled/agreed upon times.

All visits to the Stable and Horse(s) shall be scheduled ahead to ensure the
safety of the Boarder and Horse(s).

NOTE: Stable reserves the right to photograph all boarded horses and use the
photos in publicity ads, online and other forms of media.

14. Veterinary Care:


a. Boarder agrees and understands that it is the Boarders responsibility to provide
Horse(s) with proper veterinary care and veterinary services. Boarder understands
that if Boarders horse is or appears sick or injured, Stable will first try to contact
Boarder. If Boarder is unavailable, or Horse(s) has an emergency, Boarder gives
Stable permission to call Boarders veterinarian, identified as Dr.

Boarders veterinarian is unavailable, Boarder authorizes Stable to call its
veterinarian, and that Boarder will be fully responsible for all veterinarian charges
so incurred.
b. Boarder also agrees that Boarder will keep Horse(s) current on all customary
worming and vaccinations, including but not limited to Rabies, West Nile, Lyme,
Eastern Equine Encephalitis, Western Equine Encephalitis, Tetanus, Influenza,
Rhinopneumonitis and any and all other worming or vaccinations as may be
prevailing or customary in Stables locale.
c. Boarder also agrees with testing for Equine Infectious Anemia every two years as
required to the New York State regulations. If horse is to be transported across NYS
lines, Boarder shall pay for a yearly Equine Infectious Anemia testing and 30-day
Health Certificate.
d. Stable will provide a yearly visit for vaccinations and Equine Infectious Anemia
testing by their chosen veterinarian: Dr. Bruce Kaplan. If Boarder decides to
exempt themselves from this visit, they shall have a veterinarian of their choosing
to perform the required vaccinations and testing. If Boarders Horse(s) require the
vaccinations, Boarder authorizes Stable to call its veterinarian and Boarder shall be
fully responsible for all veterinary fees incurred.
e. Boarder authorizes the Stable to treat Boarders Horse(s) per Boarders or
Veterinarians instructions, including medicines prescribed by Veterinarian and
herbals or supplements prescribed and/or authorized by Boarder.

a. Boarder understands and agrees that it is Boarders responsibility to provide
Horse(s) proper hoof care and farrier services.

Visitation. If Boarders Farrier is unavailable and Boarders Horse(s) is in need of

Boarder will be fully responsible for all farrier charges incurred.

17. Prohibited Activities:


a. Neither Boarder nor their guests or agents shall feed, turn-out, walk, work, ride,
saddle, injure, whip, harass or otherwise use or interact with any other horse at
Stable without permission of Stable or that horses owner.

18. Authorized Users:


a. Stable has discretion when and under what circumstances to allow Boarders
designated Users to have access to Horse(s) and Stables facilities.

19. Safety and Release from Liability:


a. BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS,
INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR
PROPERTY DAMAGE, ARISING OUT OF YOU or YOUR CHILDS PRESENCE AND/OR
PARTICIPATION IN EQUINE ACTIVITIES AT STABLE, INCLUDING INJURY, DEATH OR
PROPERTY DAMAGE ARISING OUT OF THE NEGLIEGENCE OF STABLE.
READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE
INDICATES YOUR UNDERSTANDING OR AND AGREEMENT TO ITS TERMS.

b. Helmets and Safety Gear:

i. I understand that it is the recommendation of Stable to wear a riding
helmet and utilize other safety gear appropriate to my level of
experience while on a horse. I accept full responsibility for accident
or injury to myself, family members or my guests if I or they choose
not to use a riding helmet or other appropriate safety gear. Children
under the age of 18 are NOT exempt from wearing a riding helmet
while riding a horse in the Stable per NY State Law. Vehicle and
Traffic Law, S2007. It is recommended that all children under the age
of 13 to being wearing a helmet while handling a horse on the
ground.
INITIAL:
c. Horses are Inherently Dangerous:
i. I also understand that engaging in equine activities is an inherently
dangerous activity and that, by doing so, I expose myself to dangers
both known and unknown. Horses are large, unpredictable animals
which may be dangerous no matter how much training they have, no
matter the level of experience I have, and no matter the situation. I
agree and understand that Stable can not control the horses it
boards, and that I shall release and hold harmless Stable from any
injury arising out of or related to equine activities at Stables
facilities.

d. I am Responsible for my own Conduct and That of my Horse:


i. I understand that I will ride and handle my horse, and will conduct
myself, at my own risk while I am on Stables property.

e. RELEASE AND WAIVER OF LIABILITY, AND ASSUMPTION OF RISK:
i. I take full responsibility for myself and for any guest that I may bring
onto the property and will not hold stable, its owners, agents, or
employees responsible for accident or injury to myself, my guests, or
my agents.

f. Death or Injury to Horse:
i. Stable, its owners, trainers, agents or employees will not be held
responsible for injury or death of Horse absent active negligence on
their part.

g. HOLD HARMLESS, DEFEND AND INDEMNIFY:

i. Boarder agrees to defend, indemnify, save and hold harmless Stable
and its principals, agents, and affiliates from and against any loss,
liability, damage, attorneys fees, or costs that they may incur
arising out of in any way connected with Boarders use of Stable,
presence at Stables facilities, Horses conduct, Boarders use or
access to Horse, or Boarders or their agents actions, breaches,
failures, or omissions in performing or futhering this Contract or any
related contract, obligation or conduct, or as they may relate to or
arise out of the subject matter of this Contract.
INITIAL:
h. Costs, Attorneys Fees, and Expenses:
i. In any legal actions brought in connection with this Contract, arising
out of this Contract, or arising out of any activity of Horse, Boarder,
or their guests or agents, the prevailing party will be entitled to
prompt payment of expenses from the other party following final
adjudication in favor of the prevailing party. For the purpose of this
Section, expenses will include the following costs actually incurred
by the prevailing party: attorneys fees, retainers, court costs,
transcript costs, fees of experts, witness fees, travel expenses,
duplicating or copying costs, printing and binding costs, telephone
charges, postage, delivery service fees, and all other disbursements.
INITIAL:
i. Stable Reserves Right to Refuse Board:
i. We reserve the right to deny boarding and services to any horse for
any reason including but not limited to: animals poor health or
unsoundness, dangerous propensities, habits, vices which this
Stable is not equipped to handle. Boarders refusal to obey Stables
rules or to cooperate with this Stable on reasonable requests
relative to the management, welfare and safety of the animal and
people on premises; and also in the event of discontinuation of the
business of boarding horses. After all fees have been paid in full and
the animal has vacated the stall this Agreement is concluded. Should
the Boarder wish to return a new boarding agreement must be
signed.

20. Stables Remedies:

a. If Boarder breaches this Contract, if Horse becomes sick, disabled, injured, or a
danger to itself or others, or if Stables ceases to be able to provide services to
Boarder and Horse, hereunder, Stable reserves the right to require owners
immediate removal of Horse, and to find alternative boarding for Horse if Boarder
fails to do so. Boarder agrees they will be fully responsible for all alternative
boarding charges so incurred.
b. If Boarder neglects to pay board for a total of 3 months totaling $750 and all prior
late fees ($240) then per NY Lien Law Article 8, Section 183 & Article 9, Section 201
Stable reserves the right to hold Horse(s) until the Boarder settles all debts.
i. If Boarder neglects to pay all debts, then Stable has the right to hold public
auction to settle all debts.
ii. Stable will send a notice in due diligence to Boarder at the above address via
certified mail.
iii. Boarder will have one month to satisfy all debts prior to sale of Horse(s) and
Boarder will be responsible in removing the Horse(s).

21. Amendments and Modifications:


a. The parties may amend this Contract only by a written agreement executed by all
parties.

22. Notice:
a. Notice to Stable:
i. All notices must be in writing and delivered to Stable at the following address,
in a manner which provides proof of delivery:

i. All notices must be in writing and delivered to Boarder at Boarders address
listed above in this agreement, in a manner which provides proof of delivery.

23. Assignment of Transfer:


a. No party may assign or transfer this Contract without the prior written consent of
the other parties.

24. Entire Contract:


a. This Contract contains the entire agreement among the parties. Any modifications
or additions must be in writing and signed by all parties to the Contract. No oral
modifications will be considered part of the Contract unless reduced to writing and
signed by all parties.

25. Comprehension:
a. Each party hereby affirms and acknowledges that they have been given the
opportunity to obtain independent legal review by an attorney of their choosing,

that they have read this entire Contract, that it is in plain language, and that they
fully understand and appreciate the meaning of each of its terms.

26. Governing Law and Venue:


a. This agreement shall be governed by the laws of New York. Venue for resolution of
disputes shall be proper in Cattaraugus County, New York.
