MINUTES OF PROCEEDINGS: Jury Trial (Day 1)

8:22 a.m. The Court convenes outside the presence of the prospective jurors. The Court provides to
the parties a list of jurors which may be eligible for excusal. Mr. Tanasi renews his request that the
date of the subpoenas issued in this matter be extended.

8:43 a.m. The Court convenes in the presence of fifty-five (55) prospective jurors. The prospective
jurors are sworn and voir dire commences.

9:37 a.m. The prospective jurors are excused.

9:38 a.m. The court reconvenes in the absence of the prospective jurors. The Court and parties
discuss jurors whom may be excused for cause.

10:02 a.m. The Court stands at recess for a morning break.

10:21 a.m. The Court reconvenes outside the presence of the prospective jurors. The Court
admonishes the parties regarding questioning of the prospective jurors on voir dire. Ms. Creegan
requests that the government be able to reserve 10 minutes of its questioning time for when the
defendants finish their questioning of the prospective jurors. The Court approves the request.

10:31 a.m. The prospective jurors enter the courtroom. The Court excuses several jurors as stated on
the record. Voir dire resumes. Ms. Creegan asks questions of the prospective jurors on behalf of the
government.

11:00 a.m. Mr. Tanasi asks questions of the prospective jurors on behalf of Mr. Stewart.

11:17 a.m. Mr. Marchese asks questions of the prospective jurors on behalf of Mr. Parker.

11:33 a.m. Mr. Leventhal asks questions of the prospective jurors on behalf of Mr. Drexler.

11:46 a.m. Mr. Engel asks questions of the prospective jurors on behalf of himself.

11:58 a.m. The Court admonishes and excuses the prospective jurors for a lunch break.

11:59 a.m. The Court reconvenes outside the presence of the prospective jurors. The Court instructs
the parties as to the order of proceedings for the remainder of the day. The Court stands at recess for
a lunch break.

1:04 p.m. The Court reconvenes outside the presence of the prospective jurors.

1:09 p.m. The prospective jurors enter the courtroom. Mr. Perez asks questions of the prospective
jurors on behalf of Mr. Lovelien.

1:28 p.m. Mr. Jackson asks questions of the prospective jurors on behalf of Mr. Burleson.

1:38 p.m. Ms. Creegan asks follow-up questions of the prospective jurors on behalf of the
government.

1:44 p.m. The prospective jurors are excused. The Court calls prospective jurors 113 and 225 into
the courtroom for additional questioning one at a time.

1:57 p.m. The Court adjourns for an afternoon break.

2:05 p.m. The Court reconvenes outside the presence of the prospective jurors. The Court and parties
discuss cause challenges to the prospective jurors.

2:13 p.m. The prospective jurors enter the courtroom. The Court excuses several jurors as stated
on the record.

2:16 p.m. The prospective jurors are admonished and excused for the evening. The prospective
jurors are instructed to report to the jury office on February 7, 2017 by 3:00 p.m.

2:17 p.m. The Court reconvenes outside the presence of the prospective jurors. Mr. Tanasi requests
the list of names of prospective jurors whom will be appearing tomorrow. The Court will have the
courtroom deputy provide the list to the parties. Mr. Marchese informs the Court that the defendants
have not been classified by the Henderson Detention Center. The US Marshal states that the
defendants should be classified today. Mr. Leventhal inquires with the Court as to the status of the
remaining motions in limine, to which the Court responds that it will continue reviewing the motions
this evening. Mr. Tanasi inquires about the defendants discovery being accessible while the
defendants are located in Henderson. The US Marshal will look into the accessibility of discovery.
Mr. Marchese informs the Court that Mr. Engels investigator was treated as a personal visit by the
Henderson Detention center. The US Marshal believes this happened as a result of the defendants

not yet having been designated by the facility. Mr. Engel inquires about the computer access at the
Henderson Detention Center. The Court informs the defendant that this issued will be looked at.

2:33 p.m. Court adjourns.

Jury Trial continued to Tuesday, February 7, 2017 at 8:30 a.m. in Courtroom 7C before Chief Judge
Gloria M. Navarro.
