R ecognized as leading the legal industry standard in Italy, the TopLegal Awards were
presented to over 700 guests last November at the East End Studios in Milan, inclu-
ding partners from more than 100 Italian law firms. The record number of participants
at the tenth TopLegal Awards was boosted by the presence of company counsel repre-
senting leading Italian corporates and financial institutions. As in recent years, all the
winners were selected by a joint team composed of TopLegals team of journalists and
researchers assisted by a 24-strong external panel of in-house legal and tax specialists

The Highlights
Among the headline individual winners, Stefano Simontacchi of BonelliErede won the
top prize for Professional of the Year. Simontacchi had been honoured in 2015 as Man-
aging Partner of the Year, the prize claimed this year by Federico Sutti of Dentons. Lin-
klaters partner Claudia Parzani was named Female Lawyer of the Year.
Among the major team wins, Legance finished top as Law Firm of the Year. Four law
firms, including BonelliErede, Clifford Chance, DLA Piper and Gianni Origoni Grippo
Cappelli received recognitions in two separate categories.
In the main transactional categories, BonelliErede overcame stiff competition to win
the prize for Corporate/M&A, while the Chiomenti team scored a victory in the Capital
Markets category. Clifford Chance beat rivals to emerge as winner for Banking and Fi-
nance.
Among the other major law firm winners, niche firms figured prominently in a
strong year for Italian boutiques. Rubini won the category for Dispute Resolution and
Arbitration while Ludovici Piccone, a spin-off which only launched in 2015, won the
team award for tax. Cintioli emerged as team winner for Public Law.
The Italian Desk of the Year award was introduced in 2014 to recognize Italian legal
teams who advise on significant transactions without a presence in Italy. This year, two
accolades were given for the unique contribution made by independent and interna-
tional firms to advising Italian clients abroad. Iberian giant Garrigues was recognized
as the leading international firm while Dutch practice Van Campen Liem won in the
independent firm category.

Co-managing partner since 2013, Simontacchi has been a driving force behind the firms
organizational and strategic overhaul in recents years. As chairman of the firms interna-
tional development committee and the Africa committee, Simontacchi also oversaw the
project for international expansion in Africa in 2016 and figured among the promoters of
the so-called African Act, a package of legislative measures designed to increase trade and
development between Italy and Africa that was endorsed by former Italian Prime Minister
Matteo Renzi.

enues. The workload over the last 12 months included advising Ryanair on its negotia-
tions with the Ministry of Transport, leading to the suspension of the Municipal tax on

Individual: FRANCESCO SCIAUDONE (Grimaldi)
Sciaudone was acknowledged for his substantive contribution to Italian and European
law. He drafted new procurement guidelines in collaboration with the Italian National
Anti-Corruption Authority (ANAC) and advised the European Commission on formu-
lating regional policy.

The firm secured a significant antitrust precedent within the European Union for Shisei-
do involving a multi-year global licensing agreement.

Banking and Finance

Novarese was acknowledged for his role in advising the banks on Pirelli Groups 7
billion debt refinancing. The refinancing represented a key step for Pirelli as the group

Individual: PATRIZIO MESSINA (Orrick Herrington & Sutcliffe)
A key figure among capital markets specialists, Messina advised on setting up new
measures designed to backstop the Italian banking system. In particular, he contributed
to converting into law the Decree on a state guarantee scheme to facilitate the securiti-
zation and sale of non-performing loans.

Among its strong performances on both the debt and equity side, the practice advised
troubled bank Veneto Banca on its complex reorganization process and capital increase,
as well as a rescue plan involving Italian private equity fund Atlante.

Corporate M&A
Individual: CARLO PAVESI (Gatti Pavesi Bianchi)
Advised Banco Popolare on its ground-breaking merger with Banca Popolare di Mi-
lano. The deal was part of the Italian governments policy to consolidate and strengthen
the fragmented Italian banking sector by allowing mutual banks to become joint-stock
companies.

Team: BONELLIEREDE
The corporate practice helped to set up Atlante, the 4.25bn rescue fund created to
recapitalize some Italian banks, as well as revive the non-performing loans market in
Italy. The firms work was judged to have a highly strategic value for the Italian financial
system.

Dinoia secured the full acquittal of Massimo Di Marco, the former CEO of Milano Ser-
ravalle, an Italian transport company which owns concessions to roads around the city
of Milan. Di Marco was involved in a headline bribery and corruption case that also
involved a former president of the Lombardy province.

Commercial Criminal: Environmental

Individual: GIORGIO PERRONI (Perroni)
Acknowledged for his representation of executives from the Pirelli group involved in
criminal cases brought by the companys employees in relation to alleged health and
saftey liabilities.

Commercial Criminal: Financial

Individual: ENRICO DE CASTIGLIONE (Moro Visconti de Castiglione Guaineri)
Secured the definitive acquittal of a CEO in relation to alleged international money
laundering involving a well-known Luxembourg-based financial company.

Commercial Criminal: Tax

Individual: FABIO CAGNOLA (Cagnola)
Defended Irish-based Apple executive Michael OSullivan in a case brought by Italian
prosecutors following a probe which alleged that Apple had failed to pay 879m in taxes
in the country. The six-month jail sentence for the executive was later converted into the
payment of a 45,000 settlement. The case was the first of its kind to be brought against
Apple employees in Europe relating to unpaid taxes.

Won a major victory for Telecom Italia in one of the most significant commercial in-
ternational arbitrations at the ICC which rejected a request to fine the Italian telecoms
company 15bn.

Team: RUBINI
Advised Snam Rete Gas, an Italian natural gas infrastructure company, in relation to a
dispute with an energy company that uses the Snam network to transport its natural
gas. The provisions obtained by the team at the Court of Milan are the first that ac-
knowledge the lawfulness of the Network Code.

Employment: Industrial Relations

Individual: Paola Tradati (Gianni Origoni)
Advised AIG Europe on the reorganization of its Italian subsidiary including the trade
union procedures relating to collective agreements in a rare case involving the Italian
insurance sector.

Team: TRIFIR
Advised Italian furniture company Natuzzi on its restructuring which included a soli-
darity agreement for over 1,900 employees, temporary layoff benefit schemes for over
300 employees and a collective redundancy procedure to close down one of the compa-
nys manufacturing facilities.

Represented Italian chocolate and confectionery manufacturer Ferrero in relation to an
appeal against a lawful dismissal for misconduct made by a former company executive.

Team: LEXELLENT
Won a landmark European case for Ryanair which was accused of not paying 9.4m in
social security contributions to Italys inland revenue for over 200 staff based in Berga-
mo. The court ruled that an EU law allowed the low-cost airline to put staff on the books
in Ireland where tax rates are lower.

Individual: GUALTIERO DRAGOTTI (Dla Piper)
Acknowledged for his work in patent litigation, Dragotti advised on trademark protec-
tion issues and multi-jurisdictional patent litigation for client Alpinestars, an Italian
manufacturer of protective gear for motorcycle and motor racing.

Intellectual Property: Copyright and Trademarks

Team: BIRD & BIRD
The team obtained a positive verdict for the Consortium for the Protection of Prosciut-
to San Daniel in a case involving infringement geographical indication and protected
designation of origin relating to a high-quality ham from the northeast of Italy.

paying highways worldwide in relation to an inter-ministerial decree designed to reor-
