Va tnsoe WHEREAS, the intent of this ordinance is to establish a Master Fee Schedule which shall achieve the following objectives: j a) to provide easier access to and a better understanding by the public of all fees charged by the City of Oakland; Cid #9353 Ge Ket Bid #9387 heck b) to provide equity in distributing the cost burden for City services on the beneficiary and the taxpayer to a maximum degree consistent with sound fiscal and management principles; Aprende Ly c) to provide for fees which will reflect the cost, when deemed appropriate by the Oakland City Council, of services provided by the personnel, facilities, or equipment of the City of Oakland; and F-3.7e W237 Aomental 4y a) to provide for annual revision of fees. The Council of the City of Oakland does ordain as follow: SECTION 1. This schedule shall be known and cited as the Master Fee Schedule. SECTION 2. The Master Fee Schedule shall contain only Oakland City Council approved fees for, but not limited to, fees for permits, services, parking, and other such legal instruments which grant permission or authority to do a specific activity or to exercise a certain privilege. SECTION 3. Upon recommendation of the City Manager, the Oakland City Council by an ordinance of the Council shall exclusively exercise the authority to amend the fees contained in the Master Fee Schedule. SECTION 4. If any portion of the Master Fee Schedule is held to be in violation of the laws or the Constitution of the State of California or the Constitution of the United States, such decision shall not affect the validity of any other portion of the Master Fee Schedule. Ie SECTION 5. The amount of any fee listed in the Master Fee Schedule shall be deemed a debt to the City of Oakland. Any person failing to pay a fee shall be liable to an action in the name of the City of Oakland in any court of competent jurisdiction for the amount of the fee and the penalty imposed on such nonpayment. SECTION 6. The applicant for an original or renewal permit shall make a deposit sufficient to pay for the cost of investigating said application. The City of Oakland may thereafter require a further deposit or deposits as are reasonably necessary to continue such investigations. Any excess of the funds deposited by the applicant after the investigation is completed shall be returned to said applicant, and in all cases a statement of the cost of such investigations shall be rendered to each applicant. No permit shall be issued until the costs of investigations have been paid in full by the applicant. SECTION 7. ‘The Master Fee Schedule shall be as set forth in Exhibit "A", attached hereto and made a part hereof. SECTION 8. The Master Fee Schedule shall take effect July 1, 1976.
