5.

Domestic Violence: RA 9262

Problem:
Ang bana ni Marina nagtrabaho sa usa ka dako nga kompanya ug nagdawat ug
dakong sweldo. Wala siya mosugot nga motrabaho si Marina kay gusto niya nga mag-atiman
ra siya sa ilang balay ug 2 ka anak. Wala siyay kaugalingong kwarta.

Pagsugod pa lang sa ilang kaminyuon, dili na maayo ang pagtagad sa iyang bana
kaniya. Pirme lang siyang tawgon ug bugok. Sa dihang namabdos siya, ug nanambok
tawagon siya ug baboy sa iyang bana. Dihay usa ka higayon nga suko kaayo iyang bana,
gilamparo siya, na andam na siya nga birahon iyang buhok ug guroyon ug ilamba sa
bongbong ug uban pang pagdagmal. Tungod sa kaulaw ug kahadlok, si Marina walay kaisog
nga motug-an sa iyang pamilya ug mga police.

Dihay usa ka higayon nga ning sukol siya sa iyang bana, iyang gi kamras ang nawong.
Si Marina ni angkon nga naka uyab siya sa sulod sa 2 ka bulan nga wala nahibalo iyang
bana.

Ang pang insulto ug pagpang dagmal nagpadayon. Wala na siya kabalo ug unsa ang
angayan niyang buhaton. Gisulayan niya pakig storya ang iyang bana ug usahay mahapsay
ang ilang pagpuyo. Pero sa matag higayon nga adunay mahitabo, dapatan na usab siya.

These may be some of the factors why Marinas husband commits domestic violence
against her:
Firstly, the traditional belief that men are leaders and providers, while women are seen
as nurturers and supporters. This perception leads to men gaining more power over women.
In the example, the husband does not want Maria to work to take care of the house
and the children - add the fact that only the husband is earning for the family. As Marina does
not contribute anything valuable to the table and that she depends on him for the needs of
the family, the husband might have felt that he has the right to control Maria.
Another, the mentality that violence and mistreatment are the ways to vent anger.
Studies show that abusers resort to physical violence because they have solved their
problems in the past with violence or that they have effectively exerted control and power over
others through violence or no one has stopped them from being violent in the past. In the
example, the way the husband treats Marina felt like violence is the norm.
Also, an immediate cause that can set off a bout of domestic abuse is provocation by
the abused. In the example, Maria admitted a short-lived extramarital affair. However, even if
a woman has behaved appallingly, she does not deserve to be beaten. Violence is not an
acceptable way to solve conflict in a relationship
Lastly, society may also contribute to domestic violence by not taking it seriously
enough and by treating it as expected, normal, or deserved. People may have the attitude
that the abuse is the fault of the victim, or that the abuse is a normal part of marriage or
domestic partnerships. In the example, Marina is afraid to talk to her family or report to the
police because of shame and fear.

2. Unsa may angayan buhaton sa ilang sitwasyon? Ngano?

In such a situation, Marias husband has violated R.A. 9262. Under this law, a husband
may be found guilty if he cause physical harm or cause humiliation including repeated verbal
abuse towards his wife. He may also violate this law if he prevents her wife from engaging in
any legitimate profession, occupation, business or activity.
Marias husband clearly committed acts which are punished under RA 9262 by not
allowing Maria to work, calling Maria bugok (dumb) and baboy (fat) when Maria got
pregnant. Lastly, by pulling Marias hair and pushing her towards the wall, thereby causing
physical harm on the part of Maria. These acts is what R.A 9262 seeks to prevent.
The best thing to do in this desperate situation is for Maria to file a petition for the
issuance of a Protection Order, the purpose of which is to prevent further acts of violence
against Maria. She may choose what kind of Protection Order to file: either a Barangay
Protection Order which shall be issued by their Baranggay and valid for 15 days, or a
Temporary Protection Order which is issued by a court having jurisdiction over the address of
Maria, and is valid for 30 days. Also, if Maria so choses, she may file a Permanent Protection
Order, which is issued by a court having jurisdiction over the address of Maria, and is valid
until revoked by the court upon application of the person in whose favour the order was
issued.
It is noteworthy that one of the reliefs provided under Protection Order is legal support.
In this instance, Marina and her child can claim a share in her husbands salary as support.
In applying for the issuance of a Protection Order, Maria may seek the aid of a police
officer, or she can directly file such petition by herself.
