REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This Real Estate Mortgage is executed by and between:

Alejandro C. Perez of legal age, Filipino, single and with address at

143 Park Avenue, Pasay City, hereinafter known as the

MORTGAGOR;

-and-

Fund Line Lending Corporation, a private lending company with

principal address at 15th Floor, Solaris One Building, Legazpi Village,

Makati City, hereinafter represented by its General Manager, Mr.

Imman Robin T. Santos, hereinafter known as the MORTGAGEE;

WITNESSETH:

WHEREAS, the Mortgagor is indebted unto the Mortgagee in

the sum of THREE HUNDRED THOUSAND PESOS (P300,000.00)

Philippine currency, receipt of which is acknowledged by the

Mortgagor upon the signing of this instrument, payable within a period

of FIVE (5) years with interest thereon at the rate of TWENTY FOUR

PERCENT (24%) per annum;

WHEREAS, to secure the above-mentioned loan, the

MORTGAGOR hereby mortgages the property described herein,


together with all its improvements, under the terms and conditions

stated hereunder

WHEREFORE, IN VIEW OF THE FOREGOING, the parties

agree as follows:

1. For and in consideration of the above-mentioned loan, the

MORTGAGOR hereby conveys and delivers by way of mortgage

unto the said MORTGAGEE and the latters heirs and assigns, the

following property together with all the improvements thereon,

covered by Transfer Certificate of Title No. 3214 of the Registry of

Deeds of Calamba City and specifically described as follows:

A parcel of land (Lot 10, Block of the subd. Plan Psd-52319,

being a portion of plan Pcn-2136, LRC (GLRO) Rec. No. 6890),

situated in the Dist. of Mayapa, Calamba City, bounded on the

SW, along line 1-2 by Lot 40, Blk. 5; on NE., along line 2-3 by

Lot 6, Blk. 6; on the SE along line 3-4 by Road Lot 17; and on

the SW., along line 4-1 by Lot 7, Blk. 6 all of the subd.

Plan. Beginning at the point marked 1on plan, being N. 45

deg.29W., 2480.26 m. from BLLM No. 7, Calamba City; thence

S. 58 deg. 21 min., E., 9.93 m. to point 2; thence N. 32

deg .04min., W., 20.04 m. to point 3; thence N. 58 deg 23 min.,

10.09 to point 4; thence S. 31 deg. 37 min., E., 20.03 m. to the

point (over) of beginning; containing an area of ONE

HUNDRED TWENTY SQUARE METERS AND SIXTY

DECIMETERS (120.60) all points referred to are indicated on

the plan and are marked on the ground by B.L. Cyl conc. Mons.
14x60 cm; bearings true; date of original survey, December

1910 to June 1911, and that of the subd. Survey, May 2 to

November 29, 1957. Date approved - August 19, 1963.

2. In the event, the above-mentioned loan is duly paid by the

MORTGAGOR in accordance with terms and conditions of such

loan which he executed with the MORTGAGEE, this Mortgage

shall be discharged and rendered of no force and effect, otherwise,

it shall subsist and be subject to foreclosure in the manner and

form provided by law.

3. In case of suit, the parties agree that all actions arising from this

agreement shall be filed only in the courts of Pasay City.

4. All expenses that will be incurred by either party for the

enforcement of his rights under this contract shall be borne by the

party at fault.

IN WITNESS WHEREOF, the parties set their hands this 1st day of

February 2017 at Makati City, Philippines.
