All of which is contrary to the form of the statutes in such cases made and provided by I.C. 35-44.1-3+1(a)(3) and I.C, 35-44.1-3-1(b)(3), and against the peace and dignity of the State of Indiana. JAMES WOODROW MORRISON ) Senay DOB gay 977 eee Captain Timothy A. Spencer, under the pains and penalties of perjury, says that: Lam a police officer with the City of Mishawaka and have been so employed for 27 years. I currently hold the rank of Captain, and am in charge of the Trattie Division of the Mishawaka Police Department, Since 2005, I have also been assigned as the Coordinator for the St. Joseph County Fatal Crash Team (FACT), The FACT Team, made up of officers from Mishawaka, South Bend, Walkerton and the County Police, investigates all fatal erashes when there is a surviving driver, as well as all crashes jolving serious bodily injury when there is either law enforcement involvement or alcohol or drugs may have been involved. The FACT team was tasked with investigating a fatal crash that occurred on February 21, 2017. I make the following statements after speaking to investigating officers, witnesses, assessing the scene and reviewing law enforcement Mobile Video Recorder (MVR) systems recordings. On February 21, 2017, Deputy Matthew Walls with the Berrien County Sherriff's Department was working in uniform and a marked squad car. He observed a gold in color Chevy Trailblazer that he recognized from a stolen vehicle report near a flea market in Berrien County, Michigan, about 1 ¥ miles north of the Michigan-Indiana state line on US 31. Deputy Walls ran the vehicle's plate and confirmed that it had been reported stolen and was still active (the original theft had been reported on February 17, 2017) Based upon this information, Deputy Walls attempted to stop the vehicle by activating his overhead lights in the area of Bertrand Road and US 31. The driver of the Chevy, later identified as JAMES WOODROW MORRISON, did not stop. Officer Walls then activated his siren. Instead of stopping, JAMES WOODROW MORRISON continued to travel south on 31 into St. Joseph County, Indiana (31 turns into SR 933 when it crosses into Indiana from Michigan). JAMES WOODROW MORRISON accelerated, driving at a high rate of speed and weaving in and out of traffic. A review of the MVR indicated that Officer Walls” police vehicle reached speeds over 100 mph, as JAMES WOODROW MORRISON continued to pull away from him, The Chevy drove down SR 933 (in St. Joseph County, Indiana) and approached Darden Road, which is equipped with a traffic control device. The light was red for the north-south traffic. Instead of stopping, JAMES WOODROW MORRISON disregarded ared light, striking a pick-up truck heading east on Darden. The collision also resulted in four other vehicles being struck by either the Chevy, the pick-up or debris. The driver of the pick-up truck, Andre Northern, was pronounced dead at the scene. An autopsy was performed, and the cause of death was blunt force trauma as a result of the collision. ‘Medical personnel were dispatched and found four (4) occupants of the vehicle, including JAMES WOODROW MORRISON. There were three other occupants of the Chevy, Samantha Johnson (Johnson), Tyler Weems (Weems), and Melinda Gillespie Gillespie) were all transported to Memorial Hospital. Passenger Samantha Johnson sustained multiple fractures, including pelvis, ribs, wrist, fibula, tibia, and humorous. Passenger Melinda Gillespie suffered rib and facial fractures and a splenic laceration. Passenger Tyler Weems sustained a substantial concussion to the point that he was placed ona ventilator by medical staff for his protection. Medical treated JAMES WOODROW MORRISON. During the course of their treatment, JAMES WOODROW MORRISON admitted to using heroin earlier that day. Medical personnel also noted that his arms contained fresh track marks (indicating heroin usage). A blood draw from JAMES WOODROW MORRISON indicated the presence of opiates (heroin). ‘The entire pursuit was captured by the Berrien County in-car camera system (and radio traffic) and has been reviewed by investigators. It is clear from the video that JAMES WOODROW MORRISON ran the red light at Darden immediately before he crashed into Mr. Northern. While the pursuit was initiated in Michigan, a significant portion of the pursuit, as well as the crash that resulted, happened in St. Joseph County, Indiana. affirm, under the penalties for perjury, that the foregoing representations are true as they have been related to me. The defendant also has multiple criminal convictions in Michigan including as well as several prior warrants for failure to appear.
