Last September 20,2016 the Committee on Health and Sanitation had a Committee
meeting to take up the endorsement for appropriate action to Hon. Leo Carmelo l.
Locsin Jr., Vice Mayor ,quorum was declared with all members present, the herein
request of Dr, Jose Arnil C. Corong to amend certain provisions or sections of the
Ordinance No. 7 or the so called Anti- Rabies Ordinance of 1996 of Ormoc City, the
said existing ordinance have been operational for 20 years since its effectivity, thus the
proposed amendments from the City Veterinary office is a way to enhance the for a
more comprehensive Anti-Rabies Ordinance. Rabies is a human infection that occurs
after a transdermal bite or scratch by an infected animal, like dogs and cats. It can be
transmitted when infectious material, usually saliva, comes into direct contact with a
victims fresh skin lesions. Rabies may also occur, though in very rare cases, through
inhalation of virus-containing spray or through organ transplants. Rabies is considered
to be a neglected disease, which is 100% fatal though 100% preventable. It is not
among the leading causes of mortality and morbidity in the country but it is regarded as
a significant public health problem because (1) it is one of the most acutely fatal
infection and (2) it is responsible for the death of 200-300 Filipinos annually.

The Committee went through the proposed amendments, Dr. Corong discussed to the
Committee that it shall be important to include in the said ordinance a section which
provides responsibilities of the Pet Owners, Barangay LGU and concerned government
agencies, since the existing ordinance did not contain any provision for their
responsibilities. The said amendment is in pursuant to the the National Law which is
REPUBLIC ACT NO. 9482 Anti-Rabies Act of 2007
Section 5 of the said law provides Responsibilities of Pet owners, Section 6 provides
responsibilities of Government Agencies and Section 7 provides Responsibilities of the
LGUs.In connection thereto, SP Member Penserga manifested to include in the
ordinance a committee called BANTAY RABIS SA BARANGAY (or so called BRB) this
is a committee organized at the barangay level responsible in the implementation of the
local/barangay anti-rabies ordinance and monitoring of the compliance of its constituent.

Dr. Corong then discussed on the next proposed amendment that the Liga ng mga
Barangay President, DepEd Ormoc Division Representative, DILG City Director or
Representative, an NGO (Veterinary Clinic/Hospitals Association of Ormoc) shall be
included as members on the existing Anti- Rabies Committee, since they play a vital
role in the implementation of the ordinance. The City Veterinary Office also provided an
amendment on Section 10 Public Pound/ City Pound that the dog catchers team shall
not be held liable in instances such as during the course of catching operations, the
stray dogs were accidentally hit by running motor vehicle while the dog is in flight
reaction or suddenly run towards the direction of busy highway and accidentally hit by
running vehicle that resulted to instant death of the animal; or in other instances that the
dog suddenly die for unknown reason or due to shock reaction while in the process of
catching and transporting them to dog pound. On Section 10 Public Pound/ City Pound ,
on impounding fee that Dog owners who shall redeem their impounded dog shall be
charged an impounding fee of P1000.00 instead of 100 plus additional daily charge of
P10.00.

The Committee then next tackled on the adoption of penalties stipulated in Section 11
RA 9482 which will be incorporated as amendments on the Anti Rabies ordinance of the
City , the members discussed on the fine to be imposed on the violators of the
provisions and agreed on the amount of fine to be impose, these includes the following
: 1. Pet owners who fail or refuse to have their dog registered and immunized against
rabies shall be punished by a fine of Two Thousand Pesos (P 2,000.00), 2. Pet owners
who refuse to have their dog vaccinated against rabies shall be liable to pay for the
vaccination of both the dog and the individuals bitten by their dog, 3. Pet owners who
refuse to have their dog put under observation after said dog has bitten an individual
shall be meted a fine of Five Thousand Pesos (P 5,000.00) , 4. Pet owners who refuse
to have their dog put under observation and do not shoulders the medical expenses of
the person bitten by their dog shall be meted a fine of Five Thousand Pesos (P
5,000.00) ,5. Pet owners who refuse to shoulder the medical expenses of the person
injured due to motor/vehicle accident caused by their stray dog shall be meted a fine of
Five Thousand Pesos (P 5,000.00) 6. Pet owners who refuse to put leash on their dogs
when they are brought outside the house shall be meted a fine of Five Hundred Pesos
(P 500.00) for each incident, 7. An impounded dog shall be released to its owner upon
payment of a fine of not less than Five Hundred Pesos (P 500.00) but not more than
One Thousand Pesos (P 1,000.00), 8. Any person found guilty of trading dog for meat
shall be fined not less than Five Thousand Pesos (P 5,000.00) per dog and subjected to
imprisonment for one (1) to four (4) years, 9. Any person found guilty of using
electrocution as a method of euthanasia shall be fined not less than Five Thousand
Pesos (P 5,000.00) per act and subject to imprisonment for one to four years, 10. If the
violation is committed by an alien, he or she shall be immediately deported after service
of sentence without any further proceedings.

FINDINGS AND CONCLUSIONS:

1. It was decided that the proposed amendment on the ordinance on

RESPONSIBILITIES OF PET OWNER, THE LOCAL GOVERNMENT UNIT OF
RESPECTIVE BARANGAYS AND CONCERNED NATIONAL GOVERNMENT
AGENCIES shall be carried and incorporated in the Anti-Rabies Ordinance

2. That the proposed amendment on penalties and amount of fine agreed by the
members shall be incorporated to the Anti-Rabies Ordinance

The Committee, after careful and thorough review of the draft ordinance submitted,
concluded that the proposed amendments of the ordinance contribute relevance to the
Anti Rabies Ordinance which minimize the risk to residents , public health and for
comprehensive Rabies control of the City of Ormoc.

RECOMMENDATION :

It was recommended to present the amended ordinance for its approval to the plenary .
