Section 1. Appeals from specified agencies. Any provision of existing law or Rule of Court to the contrary
notwithstanding, parties aggrieved by a final ruling, award, order, decision, or judgment of the Court of Agrarian
RelationstheSecretaryofLaborunderSection7ofRepublicActNumberedSixhundredandtwo,alsoknownas
the "Minimum Wage Law" the Department of Labor under Section 23 of Republic Act Numbered Eight hundred
seventyfive, also known as the "Industrial Peace Act" the Land Registration Commission the Securities and
Exchange Commission the Social Security Commission the Civil Aeronautics Board, the Patent Office and the
AgriculturalInventionsBoard,mayappealtherefromtotheCourtofAppeals,withintheperiodandinthemanner
hereinprovided,whethertheappealinvolvesquestionsoffact,mixedquestionsoffactandlaw,orquestionsoflaw,
orallthreekindsofquestions.FromfinaljudgmentsordecisionsoftheCourtofAppeals,theaggrievedpartymay
appealbycertioraritotheSupremeCourtasprovidedinRule45oftheRulesofCourt.

Section2.AppealstoCourtofAppeals.AppealstotheCourtofAppealsshallbefiledwithinfifteen(15)daysfrom
notice of the ruling, award, order, decision of judgment or from the date of its last publication, if publication is
requiredbylawforitseffectivityorincaseamotionforreconsiderationisfiledwithinthatperiodoffifteen(15)days,
thenwithinten(10)daysfromnoticeorpublication,whenrequiredbylaw,oftheresolutiondenyingthemotionfor
reconsideration.Nomorethanonemotionforreconsiderationshallbeallowedanyparty.Ifnoappealisfiledwithin
theperiodsherefixed,theruling,award,order,decisionorjudgmentshallbecomefinalandmaybeexecutedas
providedbyexistinglaw.

Section3.Howappealstaken.AppealsshallbetakenbyfilinganoticeofappealwiththeCourtofAppealsandwith
the court, officer, board, award, order, decision or judgment appealed from, serving a copy thereof on all other
interestedparties.Thenoticeofappealshallstate,underoath,thematerialdatestoshowthatitwasfiledwithinthe
periodfixedinthisAct.

Section4.Docketingfeeanddepositsforcosts.Uponfilingofthenoticeofappeal,theappellantshallpaytothe
ClerkoftheCourtofAppealsthedocketingfeefixedinRule141,Section2(a)oftheRulesofCourtanddepositthe
sumoffiftypesos(P50.00)forcosts,orincasetheappellantbealaborer,employee,agriculturallessee,ortenant,
amotionsettingforthsaidfactunderoath,andprayingthathebeexemptedfrompaymentofdocketingfeeandthe
depositforcosts.Copyofthemotionshallbeservedonallinterestedparties.Shouldthecourtfindsaidmotionto
bewellfoundeditshallgrantthesamebutiftheCourtdeniesthemotion,theappellantshallpaythedocketingfee
andmakethedepositforcostswithinfifteen(15)daysfromnoticeofthedenial.Failuretopaythedocketingfeeand
makethedepositforcostswithintheperiodherefixedshallbeagroundtodismisstheappeal.

Section5.Effectofappeal.Appealshallnotstaytheaward,order,ruling,decisionorjudgmentunlesstheofficeror
body rendering the same or the court, on motion, after hearing, and on such terms as it may deem just, should
provideotherwise.Theproprietyofastaygrantedbytheofficerorbodyrenderingtheaward,order,rulingdecision
orjudgmentmayberaisedonlybymotioninthemaincase.

Section6.ElevationofRecord.Withinfive(5)daysfromthepaymentofthedocketfeeanddepositforcosts,the
ClerkoftheCourtofAppealsshallnotifytheclerkofcourt,commission,board,orofficeconcernedtoforwardthe
recordofthecase.Withinfive(5)daysfromreceiptofsuchnotice,thelattershallcomplybyforwardingthewhole
originalrecordofthecaseoracertifiedtruecopyofthewholerecordtotheCourtofAppeals.Failuretoelevatethe
recordwithintheperiodherefixedshallbedealtwithasforcontemptofCourt.

Section7.AppellateprocedureBriefs.UntiltheSupremeCourtshallprovideotherwisebyRuleofCourt,appeals
shall proceed as provided by Rules 46 to 55 of the Rules of Court, insofar as applicable, with the following
modifications

(a)Theappellant'sbriefshallbeservedandfiledwithinthirty(30)daysfromthedatethatheisnotifiedthat
therecordhasbeenreceivedbytheCourtofAppeals,withintheperiodabovefixed,andshallcontain,asan
appendix,theruling,order,award,decisionorjudgmentappealedfromtheappellee'sbriefshallbeserved
and filed within thirty (30) days from receipt of the appellant's brief and the appellant's reply brief, within
fifteen(15)daysfromreceiptoftheappellee'sbrief.

(b) The Court of Appeals may extend the periods above fixed only for good cause and the total extension
grantedanypartyshallnot,exceptinmeritoriouscases,begreaterthantheoriginalperiodabovefixed.

(c)Wheretheappellanthasbeenexemptedfrompayingthedocketfeeormakingthedepositforcosts,or
when the appellee is an employee, laborer or tenant, he shall be allowed to file his briefs in typewritten or
mimeographedform.

Section8.Repealingclause.SectiontwelveofRepublicActNumberedOnethousandtwohundredandsixtyseven
as amended Section seven of Republic Act Numbered Six hundred two, as amended Section twentythree of
RepublicActNumberedEighthundredandseventyfiveSectionthirtysixofCommonwealthActNumberedEighty
three,asamendedSectionfiveofRepublicActNumberedOnethousandonehundredandsixtyone,asamended,
SectionfourofRepublicActNumberedOnethousandonehundredfiftyoneSectionsfortyeightandfortynineof
RepublicActNumberedSevenhundredandseventysixSectionssixtythree,sixtyfourandsixtyfiveofRepublic
ActNumberedOnehundredandsixtyfive,asamendedSectiontwoofRepublicActNumberedOnethousandtwo
hundred and eightyseven, Section thirtythree of Republic Act Numbered One hundred sixtysix, and all other
portions of said Acts, and all other laws, rules and regulations, or Rules of Court, or parts thereof, that are
inconsistentwiththeprovisionsofthisAct,areherebyamended,repealedormodifiedtoconformherewith.

Section9.Effectivity.ThisActshalltakeeffectuponitsapproval.
