Air Quality Monitoring Permit

This shall serve as an Air Quality Monitoring Permit (Permit) between THE REGENTS OF THE
UNIVERSITY OF CALIFORNIA on behalf of its UC Berkeley Department of Civil Engineering
(University") and:

In coordination with the Environmental Defense Fund and West Oakland Environmental Indicators
Project (project funders), University will conduct a 100x100 Study, a West Oakland
Community Air Quality Research Project (Study) which will consist of a local network of 100
soot air pollution monitors installed on neighborhood properties in West Oakland.

The purpose of the Study is to monitor local air quality for a period of 100 days between February 1,
2017 and September 30, 2017 in order to improve air quality testing in Bay Area communities and
provide data on the impact of air pollution on community members who live/work next to major
roadways.

As a condition of HOSTs participation in this Study, the following terms shall apply:

1. HOST agrees to allow University researchers to access its Property for the sole purpose of
installing, maintaining and removing a soot air pollution monitor (Monitor) either on
HOSTs front yard or front porch. HOST can choose its preferred installation location, or the
location will be chosen by University researchers. The Monitor is smaller than a shoebox and
may include a solar panel and/or the Monitor may be plugged into an outdoor electrical outlet
if one is available.

2. During the Study period, Universitys installation and maintenance visits will be subject to
occur without notice during daytime hours any day of the week. Specific installation dates
and monitoring periods will be determined by the researchers. HOST will be notified of these
dates prior to installation via communications from the West Oakland Environmental
Indicators Project.

3. HOST shall indemnify, defend and hold harmless University, its officers, agents, employees,
and project funders from and against any claims, damages, costs, expenses (including an
amount equal to reasonable attorneys' fees), losses, liabilities, or obligations arising out of this
Permit including, without limitation, claims, damages, costs, expenses, or liabilities for loss
of or damage to any property, or for death or injury to any person or persons, but only in
proportion to and to the extent that such claims, damages, costs, expenses, or liabilities arise
from the negligence or willful acts or omissions of HOST, its officers, agents, employees or
project funders.

4. University shall indemnify, defend and hold harmless HOST, its officers, agents, and
employees from and against any claims, damages, costs, expenses (including an amount
equal to reasonable attorneys' fees), losses, liabilities, or obligations arising out of this
Permit including, without limitation, claims, damages, costs, expenses, or liabilities for loss
of or damage to any property, or for death or injury to any person or persons, but only in
proportion to and to the extent that such claims, damages, costs, expenses, or liabilities
arise from the negligence or willful acts or omissions of University, its officers, agents or
employees.
