We are writing this letter of appeal regarding resolution no.

10 1617, promulgated last February 24, 2017, with the


subject: (pakisulat ang subject ng reso).

The resolution raised the violation of Falsification, rendering the disqualification of the two (2) candidates under the
Nationalist Youth and Progressive Democrats (NYPD). The following identified issues regarding the candidacy of the
candidates are as follows:

1. Written Grade Point Average of Vona Malvar which is 2.01 instead of 2.1;
2. Written Grade Point Average of Trisha Delarmente which is 1.972 instead of (GPA ni Trisha), excluding the
grade of a voluntarily dropped subject, which led to the computation of the former;

To warrant falsification as a ground for disqualification, such act alleged must be done with deliberate intent to falsify
information for gain or for deceit.

On the first issue regarding the candidacy of Vona Malvar, there was no deliberate intent to falsify or misinform the
office of the Electoral Board regarding the Grade Point Average of the candidate. It must be observed that the figures,
2.01 and 2.1 have a striking difference which a prudent man may commit mistake in writing or citing such figures.
Moreover, the 2.1 average of the candidate does not, in any way, disqualify her to run for the office, hence concluding
that there was no deliberate intent to defraud for there is no identified motive for the candidate to do such.

On the second issue regarding the candidacy of Trisha Delarmente, there was neither a deliberate intent nor to
defraud the office of the Electoral Board through stating a Grade Point Average, different from what was computed by
the Electoral Board. (Provision of the Student Handbook) states that

all subjects that have been officially dropped are excluded from the computation [of the Grade Point
Average]

It has been a practice that voluntarily dropped subjects were excluded in the computation of the GPA. The Omnibus
Election Code is silent regarding the specific guidelines of the GPA computation. Sec.5 par (b), Art IV of the Omnibus
Election Code only states:

b. Should have a GPA of not lower than 2.25 in the immediately preceding regular semester of the
election;

Since the Omnibus Election Code is silent regarding the guidelines of the proper computation of the GPA, the
candidate, in good faith, followed the guidelines of computation set forth by the Student Handbook.

Further, should the Electoral Board required the inclusion of the dropped subjects in the GPA computation, the
candidate and the NYPD shall oblige in providing the office their preferred computation of grade. Nonetheless, the
result will lead to the GPA of (State the GPA with DV), which still will not disqualify Ms. Trisha Delarmente from
running for the office.

It is in the best interest of the Nationalist Youth and Progressive Democrats, together with the Electoral Board, to
ensure a fair, clean, successful, and honest elections. All actions in lined with the elections were all done in good faith
by political party, as well as the candidates running under our banner. We are looking forward and praying for the
reassessment of the issues and your kind consideration. We are more than willing to discuss and hear further issues
