AFFIDAVIT OF ARRESTING OFFICER

I, SP03 OTIK P. ADIK, of legal age, Filipino, married and a member of
Philippine National Police, presently assigned at Divisoria Police Station,
Zamboannga City, do hereby depose and state:

1. That I am one of the police officers who conducted a checkpoint

operation along MCLL Highway, Divisoria, dated January 17, 2016;

2. That said operation is randomly conducted per advise by the

commanding officer of Police station 6;

3. That on or about 5:50 p.m of the same date, we received

message thru radio from the Compac stationed at the Integrated Bus
Terminal (IBT), requesting for the apprehension of a certain tricycle
colour _____ bearing plate no. HA 123, for an alleged robbery;

4. That the driver together with his companions (later known to be

Rap Rap S. Diutay and Kuyanash L. Delacros) took an unconscionable
amount as payment for their tricycle trip from their passengers;

5. That a that few minutes upon learning of the said request, we

cited the above described vehicle approaching the checkpoint;

6. That we signaled the driver of the said tricycle to stop for

inspection (later known to be Harjado I. Buenbrazo);

7. That we later learned through radio that there is a Complaint that

a certain tricycle driver with his companions robbed two female
passengers;

8. That one of the passenger of the tricycle (later known to be Rap

Rap S. Diutay) tried to jump out upon hearing said information;
 9. That it prompted the undersigned to immediately effect arrest of
the said persons.

10. Seized and recovered in the possession of Rap Rap Diutay and
in control of the arrested person were the following, to wit:

a. one (1) two hundred peso bill;

b. four (4) one hundred peso bills;
c. three (3) fifty peso bills; and
d. Other personal effects.

11. That suspects together with the seized and recovered

evidence was brought to Divisoria Police Station for booking
and proper disposition. Likewise, the arrested person was
apprised of their rights as provided for under the Constitution
of the Philippines; and

12. I executed this affidavit to attest the truthfulness of the

foregoing facts and to support the filing of Criminal Case
against HARJADO I. BUENBRAZO, RAP RAP S. DIUTAY and
KUYANASH I. DELACROS for commission of Highway Robbery
under P.D. 523.

IN WITNESS WHEREOF, I hereunto affixed my signature this 18th day
