RETAINERSHIP AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:

The Law Office of Cyril C. Oropesa, , with principal office address # 437
Market Site Sirangan, Sorsogon City, Province of Sorsogon, Philippines,
hereinafter referred to as the LAW OFFICE, hereby agrees, commits and
undertakes to extend to the CLIENT[S] the professional legal services
specified hereunder under the terms and conditions set forth herein.

TERMS
Litigation:
The LAW OFFICE shall provide legal
services/assistance to Defendant GAUDICIO
NOGALES for the purpose of defending Civil
Case No. 2010 -8180, for DAMAGES WITH
PRAYER FOR PRELIMINARY ATTACHMENT
filed EDEN JAYONA before the Regional Trial
Court of Sorsogon, Branch 53.
Inclusions:
Appellate proceedings, either by ordinary
appeal, petition for review or special civil
action for certiorari only if the client becomes
an appellant-defendant.
Exclusions:
For any other cases to be referred to and
handled by the LAW OFFICE for the client, a
separate retainer agreement shall be signed
and executed.
For admission of the case, including
initial assessment of the issues
involved, appearances in court, and
preparations and writing of all kinds of
pleadings.

Php30,000.00
Appearance Fee:
Only the time consumed for
appearances in court by an attorney
from the LAW OFFICE shall be billed,
including postponements not made at
the instance of the counsel for the
defendant.
Php2,000.00
Success Fee:
S Share of the Law Office in the money
claims, damages and claims recovered.
An additional amount of Two Hundred
Thousand [Php200,000.00] from the
gross amount of the claim of the
defendant from the actual amount
adjudged to the latter shall be paid,
upon the rendition of a favorable
judgment, by the Regional Trial Court
[RTC], Court of Appeals [CA] or the
Hon. Supreme Court [SC]. For this
purpose, a judgment shall be deemed
"favorable" if it results in the avoidance
of liability on his part through
DISMISSAL of the civil case, or when
the defendant is awarded positive
reliefs on his counter-claim. Such
amount shall be automatically paid,
without recourse, upon dismissal of the
instant case and/or or when the
defendant is awarded positive reliefs on
his counter-claim, whichever comes
first.
