Q1 : Please state your name, address and other personal circumstances.

A1 : I am NINA K. AWAN of legal age, single, Filipino, and presently

residing at Tibanga, Iligan City.

Q2 : Do you know the respondent in this case?

A2 : Yes. I personally know the respondent JAF AMEROL.

Q3 : What action are you filing against JAF AMEROL?

A3 : I am filing a case for ESTAFA against the respondent JAF AMEROL.

Q4 : Why are you filing a case for ESTAFA against JAF AMEROL? Will
you narrate to us the incident of how and when it happened?

A4 : Yes Sir. Sometime in November 25, 2016, I had an agreement with

JAF AMEROL regarding the sale of a piece of jewelry particularly 16
Karat Chinese Gold Chocker 22.2 grams worth Eighty Five Thousand
Nine Hundred which I own.

Q5 : Can you explain further what the agreement is all about?

A5 : Yes Sir. The agreement is that I will give him the piece of jewelry on
the condition that she will sell the same and return or deliver to me
the amount or the proceeds of the sale for the said jewelries.

Q6 : What happened next?

A6 : Trusting and confident that he will perform her part of the agreement
and remit to me the proceeds of the sale, I parted with my jewelry.

Q7 : Did he return the full amount?

A7 : No Sir. As of the present, the respondent JAF AMEROL still has a

remaining balance of THIRTY THREE THOUSAND NINE HUNDRED
PESOS (33,900.00) still to be remitted.

Q8 : What happened after that?

A8 : I immediately tried to contact JAF AMEROL in order to find out why

he stopped remitting the remaining balance.

Q9 : Did you able to contact him?

A9 : Yes Sir. The time I reached him, she promised me that he will deliver
to me the remaining balance. Since I personally know him and we are
acquainted, I still gave him the chance to comply with the obligations.

Q10 : Did he finally able to pay you after that?

A10 : No Sir. The respondent JAF AMEROL failed and continues to fail up
to this day in delivering to me the remaining balance.

Q11 : What did you do after that?

A11 : In fear and upon realizing that respondent JAF AMEROL is not going
to comply with what he had committed, I went to my legal counsel to
seek advice on the matter. My counsel, upon finding out about what
happened, immediately sent a formal demand letter through
registered mail with return card on Anduljalil, Guro, Sanguila, Ibrahim,
Macaraya & Partners, 1/F B&B Bldg. Roxas Avenue, Mahayahay,
Iligan City. A copy of the letter dated January 12, 2017 is attached
and marked as Annex A hereof.

Q12 : What happened after that?

A12 : As of date, he has unjustifiably ignored all these demands for delivery
of the said amount. This has all in effect, prejudiced me and my
family. Hence, the circumstances left me with no other alternative but
to file a criminal action against JAF AMEROL.

I am answering the questions asked, fully conscious that we do so

under oath that I may face criminal liability for false testimony or perjury.
