Volume 3A Technical Specifications General Items

1 GENERAL

1.1 General obligations

1.1.1 Definitions are given in the Conditions of Contract.


1.1.2 The Contractor is obliged to become familiar with the Romanian Law and all Regulations
of Central and Local Authorities as well as any other statutory rules and guidelines which
are in any way connected with the Works, and will be fully responsible for abiding by
such regulations, rules and guidelines in carrying out the Works.
1.1.3 The Contractor shall observe patent rights and be fully responsible for fulfilling all legal
requirements with respect to using patented devices or methods and will keep the
Engineer informed of his actions with copies of approvals and other relevant certificates.
1.1.4 The Contractor is responsible for carrying out the Work in accordance with the
Conditions of Contract, and for the quality of the materials and workmanship,
compliance with the Drawings, Specification, QAP, Contractor's method statement and
Engineer's instructions.
1.1.5 The Contractor is responsible for setting out the all principal points of survey in
accordance with the Drawings or any other written instruction from the Engineer.
1.1.6 The Contractor shall, at his own expense, correct any errors or mistakes, which he
made during the execution of the Works.
1.1.7 The checking of any setting out or line or level by the Engineer does not relieve the
Contractor of his responsibility for the accuracy thereof.
1.1.8 The Engineer's decisions with regard to the acceptance or rejection of materials or
workmanship shall be in accordance with the Contract, Drawings, Specifications,
standards, and guidelines. In arriving at his decision the Engineer shall take into
account the results of tests, observations arising during production and testing of
materials, past experience, research and any other matters which may influence his
decision.
1.1.9 Instructions from the Engineer shall be carried out within the time stipulated in the
Contract Data, if not the Works may be suspended. Any additional costs resulting from
such a suspension will be borne by the Contractor
1.2 Office for the Engineer including furniture and equipment

1.2.1 The Contractor shall construct at his own expense a Site office for the Engineer. The Site
office shall be provided in a suitable location acceptable to the Engineer close to the
Contractors compound and offices. Alternatively, rented office space in a suitable
location may be provided subject to the prior approval of the Engineer.
The office shall be made available for occupation within 12 weeks of the signature of the
Contract Agreement. The layout of the office shall be as specified in Appendix A1 hereto.
The office shall be provided with new furnishings, fittings and equipment as specified in
Appendix A1.
When the offices are no longer required by the Engineer but before the end of the
Defects Notification Period the Contractor shall dismantle and remove the offices and
restore the site to `its former condition.

1.2.2 Where temporary sewage disposal (e.g. a septic tank) has to be provided, the
Contractor shall be responsible for compliance with relevant regulations, installation,
regular emptying, and removal on completion.
1.2.3 The Contractor shall take out comprehensive insurance cover on the contents of the
Engineer's office to cover articles belonging to the Employer or the Engineer's staff.
Insurance shall remain valid to the removal of the office or issue of final Taking-Over
Certificate whichever is later.
1.2.4 Safety equipment and protective clothing for exclusive use by the Engineer and
Employer personnel shall be supplied by the Contractor in adequate numbers and sizes
as requested by the Engineer. The safety equipment supplied under the Contract shall
carry current inspection certificate which shall be kept up to date.
1.2.5 The Contractor shall provide for the exclusive use of the Engineer all instruments (which
shall be new or in proven good condition), appliances, protective clothing, rubber boots,
and labour required for checking the setting out of the Works, testing, inspection and for
any other attendance on the Engineer. A list of the basic equipment requirement is
included the Contract.
1.2.6 The Contractor shall supply new furniture and equipment as detailed in Appendix A1
hereto, of good quality and suitable for hard and prolonged use
1.2.7 The computer software shall be in the English language. Separate software packages
shall be provided for each computer complete with instruction manuals. The Contractor
shall supply diskettes, and printing and plotting paper.
1.2.8 When no longer required by the Engineer but before the end of the Defects Notification
Period the furniture and equipment shall become the property of the Local Beneficiary.
1.3 Site Laboratory

1.3.1 The Contractor shall arrange for all materials testing to be carried out in a licensed
laboratory convenient and acceptable to the Engineer.
1.3.2 If a suitable, licensed laboratory is not available in the vicinity of the Site the Contractor
shall establish at his own expense a Site laboratory for carrying out sampling and testing
close to his batching and mixing plants and close to the Engineers offices. The size and
layout of the laboratory shall be suitable to carry out all sampling and testing of materials
and workmanship as required by the Technical Specifications. It shall contain special
storage rooms for samples of materials etc., as approved by the Engineer.
1.3.3 The laboratory shall be set up in accordance with the Order MLPAT No. 31/N/I 995. The
Contractor shall provide the equipment and consumables necessary for carrying out the
sampling, testing and recording required by the Technical Specifications. The testing
equipment shall be new and maintained in a clean and serviceable state and shall be
checked and/or calibrated at required intervals or when instructed by the Engineer.
1.3.4 The Contractor shall staff the laboratory with a qualified engineer and technicians fully
experienced in the testing of materials. The sampling and testing shall be supported by
an adequate number of laboratory and field labourers.
1.3.5 The laboratory shall be maintained in a clean and tidy condition to the satisfaction of the
Engineer.
1.3.6 The laboratory shall be completed and ready for use within 12 weeks of the signature of
the Contract Agreement. If the contractor commences any selection or testing of
materials for submission to the Engineer for approval of the Permanent Works before the
end of the 12 week period, temporary testing facilities, or an external laboratory
acceptable to the Engineer, may be used.

1.3.7 The Contractor shall allow the Engineer to carry out his own tests for the Contract using
the equipment, consumables etc. or to have tests carried out by the Contractors staff.
1.3.8 The Contractor will be responsible for the maintenance of the laboratory and supply of all
spare parts, consumables and materials necessary for proper operation of the laboratory
and testing.

1.4 Laboratory Office for the Engineer

1.4.1 The Contractor shall arrange for the Engineer to have access to the laboratory or if he is
constructing the laboratory, he shall provide within the laboratory building specified in
Clause 1.3 above a lockable office for the exclusive use of the Engineer. The Engineers
laboratory office shall have a minimum floor area as specified in Appendix A1 hereto.
The office shall be provided with new furnishings, fittings and equipment as specified in
Appendix A1.
1.4.2 The office shall be completed and ready for occupation and use by the Engineer at the
same time as the Laboratory specified in Clause 1.3 above.
1.4.3 The Contractor will be responsible for the maintenance of the laboratory office and
supply of all spare parts, consumables and materials necessary for proper operation of
the of the Engineers lab office.

1.5 Vehicles for the Engineer

1.5.1 The Contractor shall provide to the Engineer new transport as detailed in the appropriate
items of the Bill of Quantities for the exclusive use of the Engineer and other persons
authorised by the Engineer at all times (including times outside the hours being worked
on the Contract and at weekends). These vehicles will be used for all purposes in
connection with this Contract.
1.5.2 The Engineers vehicles shall be licensed and comprehensively insured for use on the
public highway by any licensed driver authorised by the Engineer together with
authorised passengers and the carriage of goods and samples. The Contractor shall
provide fuel, oil and maintenance (including replacing defective parts, tyres, etc.
whenever required), arrange the annual legal technical checking in accordance with the
Romanian Law, (and obtain the appropriate certificate) and carry out servicing in
conformity with the vehicle manufacturers recommendations. The vehicles shall be
provided as soon as practicable after receipt of an appropriate instruction from the
Engineer and shall be fuelled, oiled and maintained as aforesaid until the Taking-Over
Certificate is issued, unless released earlier at the direction of the Engineer.
1.5.3 Each of the Engineers vehicles shall be fitted with a fire extinguisher, first aid kit, tow
rope, tool kit, wheel wrench, jack and handle, tyre pump, spade, torch, double skin steel
20 litre fuel can and orange rotating roof lamp with magnetic base. One battery charging
unit shall also be provided for the Engineers use.
1.5.4 The Contractor shall provide a similar replacement for any of the Engineers vehicles out
of service for more than twenty four hours.
1.5.5 The Contractor shall undertake any breakdown or accident recovery or transport of the
Engineers vehicles.
1.5.6 The Contractor shall himself fuel the Engineers vehicles without withdrawing their
availability to the Engineer or shall provide a sufficient supply of fuel on site.
1.5.7 The Contractor shall pay all costs, fees, charges etc. in providing and maintaining the
Engineers vehicles.
1.5.8 The vehicles shall be supplied within 12 weeks of the signature of the Contract or such
later time as instructed by the Engineer. If the Contractor fails to provide the vehicles in

the time specified then he shall provide temporary replacement vehicles of equivalent
Technical Specifications to the Engineer at his own expense. When no longer required
by the Engineer but no later than the end of the Defects Notification Period, the vehicles
shall be transferred to the Local Beneficiary.
1.5.9 The Contractor shall provide the Engineer, when required, with the services of one or
more drivers for the Engineers vehicles. These drivers shall also carry out general
duties as requested by the Engineer.

1.6 Communication Facilities for the Engineer

1.6.1 The Contractor shall provide the Engineer with a separate national telephone line at the
Engineers office complete with telephone/ fax set. The Contractor shall allow for all
purchasing, rental, servicing, and subscription costs etc. The Contractor shall also
provide one new mobile phone with GSM provider local contract to his choice.

1.6.2 The Contractor shall provide an internet connection for the Engineer office of minimum
128 kb capacity or better for the exclusive use of the Engineer

1.6.3 The charges for supply and use of the telephone, internet, fax facilities and mobile
phone shall be paid by the Contractor and will be reimbursed by the Employer.

1.7 Survey Equipment for the Engineer

1.7.1 The Contractor shall provide and maintain survey instruments for the sole use of the
Engineer. The Contractor shall procure recognized brands of equipment and shall obtain
the prior approval of the Engineer before placing an order for the equipment. A set of
survey instruments shall consist of the following:

- a new Total Station with sighting targets


- ranging rods
- automatic level
- metric level staff
- 30m steel tape
- 100m plastic tape
- laser measuring device
1.7.2 All necessary tools and equipment together with any consumables required shall be
provided to the Engineer as required (pegs, hammers, nails, torches sunshades etc.).
1.7.3 When no longer required by the Engineer and no later than the end of the Defects
Notification Period the survey equipment shall become the property of the Local
Beneficiary.
1.7.4 All survey and/ or measuring equipment supplied by the Contractor under the Contract
for the Engineers use shall be supplied with a current certificate of accuracy and an
operator's manual covering maintenance and testing of each item.

1.8 Quality Assurance and Control

1.8.1 The Contractor is responsible for the quality of the Works and shall submit for the
approval of the Engineer the details of his proposed system for carrying out his
obligations for controlling the quality of materials and standards of workmanship
required by the Contract. The Quality Assurance System will include the following

a) General items describing:


- Organisation of the Works including duration and methods of working
- Traffic management on the Site including all temporary traffic signs

- Health and safety regulations


- The qualifications and experience of each working gang
- The names of the people responsible for the quality of the Works
- The methods and procedures to be adopted in quality control
- The equipment to be used for control and testing (a description of the
Laboratory to be used)
- The method and system of collection of laboratory test results and presentation
to the Engineer,
b) Detailed items for each section of work Construction Method Statement
describing at least but not be limited to as relevant to the particular operation:
Method or technology applied,
Temporary works details
Personnel and labour resources to be used
Safety measures to be used including details on pedestrian, vehicular traffic and
emergency access
All plant and equipment to be used on the Site together with their specifications
The various type and numbers of transport together with methods for loading and
unloading
The method of storing material
The methods of maintaining and protecting loads during transportation
The methods and procedures for testing and inspecting material deliveries
The methods and procedures for testing and inspecting specific items of work
The action to be taken in the event of materials found to be not in accordance with
Technical Specification requirements.
1.8.2 Construction method statements shall be prepared for the principal elements of the
Works and shall be submitted to the Engineer for review at least 28 days prior to the
programmed activity commencement.
1.8.3 Construction method statements shall make due allowance for all requirements and
restrictions imposed by the Contract. Each method statement shall comprise a step by
step schedule of specific operations or activities with description, date, times and
duration of each step. The statements shall be supported by sketches, diagrams or
other supportive detail as necessary to enable a clear understanding of the method and
significance of each step of work or operation.
1.8.4 The Engineer shall make comments and/or objections concerning Method Statements
supplied by the Contractor within 14 days of their submission. These comments and/or
objections shall be considered as accepted by the Contractor should he not contradict
them in writing, either by registered letter or fax sent to the Engineer, within seven (7)
days of their receipt.
1.8.5 Before submitting Method Statements the Contractor shall consult with the Engineer. At
least seven (7) days notice shall be given of the requirement for such a consultation and,
if requested by the Engineer, the Contractor shall also supply drawings in the specified
number of copies, at least seven (7) days before the date of the consultation.
1.8.6 The Contractor shall amend, without delay, the documentation and drawings supplied by
him to the Engineer in respect of modifications carried out during the execution of the
Works.
1.8.7 The Contractor is responsible for controlling the Works and quality of the materials. The
Contractor shall ensure the correct system of control and provide laboratories, staff, and
all necessary equipment for the monitoring and testing of the Works. The aim of Quality
Control is to achieve the required standards

1.8.8 Samples will be taken randomly. It is recommended that a statistical method of


representative sampling be used, based on the probability that any part of the Works
may be chosen for testing.
1.8.9 Before acceptance of the Quality Assurance System the Contractor shall carry out trial
tests in order to demonstrate their suitability.
1.8.10 The Contractor shall carry out sampling and testing at such times as are necessary to
ensure that the Works are being carried out in accordance with the requirements of the
Drawings and Specifications.
1.8.11 The Contractor shall carry out sampling and testing at such times as are necessary to
ensure that the Works are being carried out in accordance with the requirements of the
Drawings and Technical Specifications.
1.8.12 The minimum requirements for the type and frequency of testing are described in the
Specifications, standards, and guidelines. In the event that these have not been
described, the Engineer shall determine what requirements are necessary in order to
ensure that the Works are constructed in accordance with the Contract.
1.8.13 The Contractor shall provide certificates confirming that all sampling and testing
equipment is fit for its purpose, has been calibrated correctly, and meets the
requirements of the testing procedures.
1.8.14 The Engineer shall be allowed access to all the Contractor's laboratories for the purpose
of inspection.
1.8.15 The Engineer will inform the Contractor in writing of any faults concerning the laboratory,
its equipment, its technicians or methods of testing. If the Engineer is of the opinion that
these faults may affect the accuracy of the testing, he may refuse the incorporation into
the Works of the material being tested until the testing procedures are corrected and
acceptability of the materials is established.
1.8.16 All costs concerning testing shall be borne by the Contractor
1.9 Miscellaneous Services for the Engineer

1.9.1 The Contractor shall supply all necessary stationary for the Engineers staff in all the
offices, e.g. A3 and A4 paper, printer cartridges, toners for the photocopier, notebooks,
pads of writing paper, file holders, lever-arch files, ball pens, pencils, erasers, staplers
and staples, punches, clips, adhesive tape, marking pens and such other sundry items
as may be reasonably required by the Engineer.

1.9.2 The Contractor shall provide the Engineer with an automatic, compact digital camera.

1.9.3 The Contractor shall, from time to time, make available laboratory handymen
experienced in assisting the Engineer with routine tasks in the Laboratory.

1.10 EU Promotion Plan

1.10.1 The Contractor shall implement the following actions:

Erection of the Project Identification Signs

Provide for each location two single faced signs (one in Romanian language and one in
English) to be fixed in concrete at locations to be agreed with the Engineer.

The signs shall be installed by the Contractor prior to commencement of the Permanent
Works. The signboards shall be installed on concrete foundations and shall be 3m high
and 2m wide; they shall be mounted on steel posts so that the lower end of the sign

board be at 1 m above ground level. The sign boards shall preferably be in aluminium.
Details of the design shall be prepared by the Engineer.

The boards shall read as the model attached hereto

With regards to the billboard bearing the emblem and the reference of the EU the
background shall be blue with the standard European stars of EU emblem standing
along and shall take up at least 25% of the total area of the billboard. No other colours
than "Pantone Reflex Blue" and "Pantone Yellow" can be used for the EU emblem.

Provision of Audio-Video films

To be recorded on tape and of a duration of approximately half hour. The Contractor


shall provide the film, camera, and the operating team. One original and two copies of
the film shall be handed over to the MDP. The timing of the shooting shall be determined
by the Engineer but one recording should be made every year, preferably during the
summer season.

Commemorative plaques

Commemorative plaques shall be installed at locations to be agreed with the Engineer. If


the materials used for marking the commemorative plaque do not permit the use of
colour, the EU emblem should be preferably reproduced in black and neutral but visible
tone.

1.11 Site Tidiness

1.12.1 The Contractor shall be responsible for the proper tidiness of the Site and Works and
remove rubbish and waste promptly from the Site. All materials, plant and equipment
shall also be stored or positioned in a tidy manner.

1.12 Entry on to the Site

1.13.1 Prior to the commencement of operations, the Engineer shall supply to the Contractor
the names and addresses of relevant owners and occupiers. The Contractor shall notify
the Engineer in writing 56 days in advance of his intention to start work within each area
of ownership or occupation.
1.13.2 The Contractor shall keep records of the dates of his entry on to and departure from all
property and lands of each owner and occupier, together with the dates of the erection
and removal of all enclosures, and shall furnish copies of these records when required
by the Engineer. He shall keep, and furnish, copies of similar records in respect of roads,
footpaths and thoroughfares.
1.13.3 The Contractor shall not enter or use any part of the Site for any purpose not connected
with the Works.
1.13.4 Where the Contractor requires any facilities or temporary occupation of land (such as
changes to site boundaries or access routes) he shall make his own arrangements with
the land owners/occupiers or local authority as appropriate.
1.13.5 Any special conditions concerning entry to the Site are given elsewhere in the Contract

1.13 Possession and Use of the Site

1.13.1 The Contractor shall request possession of the Site from the Engineer when required
and in accordance with his programme of Works. The Employer shall grant possession
in accordance with Sub-Clause 2.1 of the Conditions of Contract.
1.13.2 When the Contractor is given possession of the Site he shall be given authority to carry
out the Works instructed by the Engineer under the Contract.
1.13.3 The Contractor shall not enter the Site for additional investigations or to execute the
Works until he has been granted possession. If the Contractor requires entering the Site
prior to being granted possession for other reasons and the Engineer agrees, he shall
demonstrate that he has the necessary insurances and has arranged appropriate safety
measures.
1.13.4 During possession of the Site, or portion of the Site, the Contractor shall be responsible
for providing lighting, protection and other measures to make the temporary works,
material storage, excavations, partially finished works, etc. safe for the public and road
use.
1.13.5 The Local Beneficiary and the Employer will arrange for the above and shall make
the Site available to the Contractor upon request.

1.14 Contractors Site Compound Accommodation and other Facilities

1.14.1 The Contractor shall find his own site or sites for setting up one or more compounds in
which to locate his offices, workshops, stores, plant etc. The sites shall be close to the
Engineers office and the Site laboratory.
1.14.2 On completion of the relevant section of the Works the Contractor shall remove all his
offices, workshops, stores, plant, fencing, hard standing etc., clean up the site and carry
out other works to return the site to its original condition.

1.14.3 The Contractor shall also locate his own areas for collection and disposal of waste and
unwanted materials, complying with local regulations and procedures for transport and
disposal.
1.14.4 The Contractor shall obtain all necessary approvals of local authorities and others for its
site compound at its own cost.

1.14.5 The Contractor shall provide erect, service and maintain all necessary buildings as
offices, housing or plant/yard/stores for himself, his staff and his employees.
1.14.6 The Contractor shall arrange the supply of electricity, fresh water, telephone,
compressed air and other services as are necessary to his Site establishment and shall
provide, maintain and remove on completion all pipes, cables and fittings which carry
such services to his operations. The Contractor shall provide an adequate supply of safe
drinking water on the Site. All electrical installations forming part of the Temporary Works
shall comply with the current National Regulations.
1.14.7 The Contractor shall make all necessary arrangements for the purchase or rental of
land, for his offices, housing, plant yard, stores, and with the supply of electricity and
water and sewage and waste disposal (including the construction of septic tanks).
1.14.8 All buildings shall comply with the appropriate local or National regulations and the
Contractor shall provide the appropriate Authority with sufficient details of the
establishment so that approval of that Authority can be obtained by the Contractor prior
to construction. The Contractor shall also construct and maintain adequate roads or
paths to all buildings.
1.14.9 All huts, buildings, fixtures and fittings provided under this Clause shall be removed and
the site reinstated at the end of the Contract

1.15 Documents to be submitted to the Engineer

1.15.1 Prior to commencement of the Works the Contractor shall supply a Works Programme to
the Engineer for approval.
1.15.2 The Works Programme to be provided under the Conditions of Contract shall be
submitted in the form of a Time Location Chart clearly indicating the phasing of all
work. Plant and labour resource teams shall be listed for all operations.
1.15.3 The programme shall be updated following any major variations or extension of time
given, and when any critical operation has fallen behind its planned programme by more
than 10 per cent, and in any case at 91 day intervals.
1.15.4 On a regular base, the Contractor shall supply the following documents to the Engineer:
Cash Flow (monthly);
List of Labour and Plant (monthly).
The submission will show cash flow up to the end of the Contract. The Contractor shall
also submit to the Engineer at the end of each calendar month, or at such other times as
may be agreed, detailed schedules and reports on plant and labour on Site, divided into
categories, and show separately the Contractors and each sub-contractors labour and
plant. As far as the plant is concerned, the condition of each item shall be indicated in
the schedules.
1.15.5 The Contractor shall prepare and submit for the Engineers approval all bar-bending
schedules and all drawings of temporary work, in conjunction with the quality assurance
system described in Clause 1.8
1.15.6 The Contractor is also responsible for the preparation and timely submission of the
shop/ construction/ As-built drawings as detailed in Clause 1.32.

1.16 Survey of Highways, Properties, Lands and Crops

1.16.1 Where appropriate, the Engineer shall arrange for surveys to be carried out, in
conjunction with the Contractor and the Highway Authority, owners or occupiers, of the
condition of highways, drainage structures, properties, lands and crops which may be
affected by the Works.

1.17 Levels and Reference Points

1.17.1 The Contractor shall supply to the Engineer details of the value and location of the
temporary datum and reference points which he proposes to use.

1.17.2 The Contractor shall satisfy himself that the existing ground levels and the levels and
locations of structures as indicated in the Contract are correct. Should the Contractor
wish to dispute any levels he shall submit to the Engineer a schedule of the position of
the levels considered to be in error and a set of revised levels.

1.18 Temporary Fencing/ Security of Site

1.18.1 The Contractor shall be responsible for ensuring that the Site is adequately fenced. The
Contractor shall do this work prior to starting work on the relevant portion of the Site. The
Contractor shall regularly inspect and maintain all such fencing, any defects being made
good without delay.
1.18.2 Access shall be provided in temporary/Site fencing as necessary for the use of the
occupiers of adjacent lands. Temporary site fencing shall remain in position until either it
is replaced by permanent fencing or the Works are sufficiently completed to enable that
portion of the Site to be brought into use.
1.18.3 The type and height of temporary fencing shall be to the Engineer's satisfaction where
not stated elsewhere in the Contract.
1.18.4 Where required by the Contract the Contractor shall be responsible for making the Site
secure with lockable access gates and security lighting to suit local conditions.

1.19 Interference with Land Interests

1.19.1 The Contractor shall confine his constructional operations within the Site, or such other
areas of land as may be negotiated, and shall instruct his employees, and those of his
sub-contractors, not to trespass.
1.19.2 Subject to any unavoidable disturbance that may be necessitated by the execution of the
Contract, the Contractor shall not interfere with any sporting, fishing or other rights that
may be enjoyed on or near the site.
1.19.3 Before exercising any right negotiated by him in connection with way leaves or
accommodation outside the site, the Contractor shall notify the Engineer in writing of
such arrangements.
1.19.4 Normally on site living accommodation will not be permitted but where it is unavoidable,
this will be detailed in the Contract.

1.20 Interference with Access to Properties and Apparatus

1.20.1 Before interfering with access to any property, the Contractor shall provide alternative
arrangements. The Contractor shall notify the Engineer and the relevant occupiers in
writing 14 days in advance of any such interference and shall confirm to the Engineer
that alternative arrangements have been agreed.
1.20.2 The Contractor shall take particular account the access and service requirements of
those with special needs. Special needs are defined as those needs related to health

and mobility of individuals affected and individuals concerned with the health of others.
1.20.3 The Contractor shall not unreasonably obstruct access to any manhole or other surface
cover outside normal working hours.
1.20.4 The Contractor shall give strict and specific instructions to all his employees that no
valves or other fittings, not forming part of the Contract, are to be operated, adjusted or
interfered with in any way without the specific agreement of the Engineer.

1.21 Procedure for Complaints and Claims for Damage

1.21.1 The Contractor shall notify the Engineer in writing immediately following any damage or
injury arising out of the execution of the Works.

1.21.2 Details of all claims or warnings of intended claims which the Contractor may receive
from third parties shall be notified without delay to the Engineer, who shall likewise pass
to the Contractor any such claims or warnings which may be submitted directly to the
Engineer or Employer.

1.21.3 The Contractor shall deal promptly with any complaints, claims, damage or injury by
owners or occupiers.

1.22 Protection against Damage

1.22.1 The Contractor shall take all necessary precautions to avoid causing any unwarranted
damage to roads, lands, properties, trees and other features during the currency of the
Contract.
1.22.2 Where any portion of the Works is close to, across, or under any existing apparatus of
Utility Companies, the Highway Authority or other parties, the Contractor shall
temporarily support and work round, under or adjacent to all apparatus in a manner
designed to avoid damage, leakage or danger, and to ensure uninterrupted operation.
1.22.3 Should any leakages or damage be discovered, the Contractor shall at once notify the
Engineer and the Utility Company, Highway Authority or owner concerned, as
appropriate, and the Contractor shall afford every facility for the immediate repair or
replacement of the apparatus affected.
1.22.4 The Contractor shall fully reinstate at his expense and to the Engineers satisfaction any
damage caused by any of his operations.
1.22.5 Damage includes all actions that would lead to environmental damage such as tipping of
waste, fuel or oil and destruction by plant and equipment.
1.22.6 The Contractor shall protect all underground and above ground existing structures from
damage, whether or not they lie within the limits of the easements obtained by the
Employer. Where such existing walls, fences, gates, sheds, buildings, or any other
structures must be removed in order to carry out the construction properly, they shall be
restored to their original condition to the satisfaction of the property owner, occupier and
Engineer. The Engineer shall be notified of any damage made to structures and repairs
or replacements shall be made before backfilling takes place. The Contractor shall
remove and replace such small miscellaneous structures as fences, mailboxes, and
signposts without additional compensation from the Employer. These structures shall be
replaced in a condition as good as their original condition.
1.22.7 If existing structures are encountered which will prevent the construction of the Works as
designed, the Contractor shall notify the Engineer of his proposed changes and make
such reasonable modifications as are necessary to the satisfaction of the Engineer.

1.23 Protection of Agricultural Land

1.23.1 The Contractor shall submit details to the Engineer of all herbicides and pesticides
proposed for approval.

1.23.2 Specific requirements to prevent the spread of animal and plant diseases (if any) are
given in the Contract.

1.24 Works affecting Watercourses

1.24.1 The Contractor shall notify the Engineer in writing 14 days in advance of his intention to
start any part of the Works affecting a watercourse (whether running with water or not),
canal, lake, reservoir, borehole or aquifer.

1.24.2 The Contractor shall be responsible for maintaining watercourses within the Site in
effective working condition at all times.
1.24.3 The Contractor shall take all practicable measures to prevent the deposition of silt or
other material in, and the pollution of, or damage to, any existing watercourse, canal,
lake, reservoir, borehole or aquifer, arising from his operations and acts of vandalism.
1.24.4 The Contractor shall obtain approval for all temporary discharges, crossings or
diversions to watercourses. National legal requirements (if any) and those specific to the
Project and are detailed in the Contract.
1.24.5 Generally all liquid/fuel storage tanks shall be located in a sealed protective retaining
bund capable of holding at least 110% of the tank volume with a freeboard of 200mm.
Filling/discharge pipe work shall be positioned to contain spillage in the bund and all
valves shall be lockable.

1.25 Dealing with Water

1.25.1 The Contractor shall bear all risks associated with water, whether from the main river,
local water courses, irrigation channels, underground springs, rainfall or any other
sources or cause. The Contractor shall take measures, carry out any operation and
provide and use all necessary plant, appliances, pumps, and the like for dealing with
flowing or standing water within the Site. The Contractor shall be responsible for
pumping all water from excavations.

1.26 Hygiene

1.26.1 Before any person is engaged on work involving possible contact with potable water, he
shall be notified of the need for personal hygiene and the dangers of contamination,
shall complete a medical questionnaire provided by the Employer and, where there is a
need, shall be tested to indicate that he is not a carrier of any waterborne disease. The
Contractor shall notify the Engineer of any person who has been certified by a doctor as
suffering from an illness associated with looseness of the bowels and no such person
shall be employed on such work until the Employer's medical adviser is satisfied that it is
safe for him to be employed.
1.26.2 Where there is a doubt concerning a person's suitability to be employed on the Works,
that person will be required to complete a medical examination certifying that he is clear
of illness associated with any waterborne disease.
1.26.3 Where the Works are intended for the purpose of supplying potable water to the public,
every precaution must be taken to avoid contamination of the Works. For this reason,
any workman fouling any site or its vicinity shall be removed from the Works and shall
not thereafter be employed upon the Works without the permission of the Engineer.
1.26.4 The Contractor shall provide sufficient chemical-type toilets at each working location, of

suitable type, and maintain the facility in a sanitary condition at all times. Chemical-type
toilets shall be of adequate construction so that no unsanitary contamination of the area
can result from their use. Upon completion of that part of the Works, sanitary facilities
shall be removed and the areas restored to their original condition.

1.27 Utilities Relocation and Protection

1.27.1 The Contractor shall be responsible for identifying the location and nature of all services
on the Site, liaising with utilities and other organisations or bodies whose services may
be affected by the Works and obtaining the necessary permits and approvals for design
and construction of the Works. The necessary approval periods shall be allowed for in
the Contractors scheduling programme.

1.27.2 Notwithstanding any approvals, before excavation commences the Contractor shall
ascertain the accurate location of existing services using safe methods of pipe location,
cable detection or hand digging of trial holes as appropriate. If any underground service
is encountered unexpectedly the Contractor shall notify the Engineer and owner of the
service without delay. Notwithstanding any services information supplied to the
Contractor the responsibility to locate all services and prevent any damage to existing
services shall rest with the Contractor.
1.27.3 The Contractor shall be responsible for all works as may be required in the inter-relation
with existing utilities and services, such as the realignment, adjustment, disconnection,
relaying and reconnection, for all and any delay occasioned thereby and making
payment to the relevant statutory bodies for utility services.
1.27.4 The Contractor shall ensure that all utility service providers, including the Employer,
whose equipment already traverses the Site can gain access to that equipment to
inspect, repair and renew the same without restriction.
1.27.5 The Contractor shall record the position of all located existing services on the general
arrangement drawings a copy of which shall be made available by the Contractor to the
Engineer. If any service is found to exist but is not as indicated in the Contract then the
Contractor shall at once give written notification to the Engineer. No warranty is given as
to the accuracy or completeness of the information on existing services included in the
Contract.
1.27.6 It shall be the Contractor's responsibility to ensure proper backfilling, appropriate to the
section of the site, of any excavation made in the work area by any Utility Company,
made necessary by the Contractor's operations.
1.27.7 The Contractor shall possess sufficient serviceable pipe/cable detectors for locating
buried pipes and cables and appropriate staff competent in their use. Each detector shall
be operated in accordance with the manufacturer's instructions.
1.27.8 Paint used for temporary marking of services shall be non-permanent and shall either
weather away naturally or be capable of being washed away using water and a stiff
brush.
1.27.9 The Contractor shall comply with any relevant local or National Utility regulations
indicated in the Contract.

1.28 Traffic Management

1.28.1 Throughout the execution of the Works and the remedying of any defects therein, the
Contractor shall:
have full regard for the safety of all persons on the Site and shall keep the Site (so
far as the same is under his control) as well as the Works (so far as the same are not

completed or occupied by the Employer) in an appropriate state to avoid any danger


to all persons whether or not they are authorised to be on the Site; and
provide and maintain, at his own cost, all lights, barriers and warning signs, when
and where necessary or when required by the Engineer for the protection of the
Works or for the safety and convenience of the public or others.
1.28.2 The Contractor shall not commence any work that affects the public roads until all traffic
safety measures necessitated by the work are fully operational.
The Traffic Management Plan shall indicate, but not limited to, what measures will be
implemented to manage the traffic while works are underway. Such a system shall
describe, in the form of a sketch accompanied by narrative details, the sequence of
signs, deviations, lighting, fence, etc, to be applied to each section of the road with
different cross profile characteristics (2,3,4 lanes) so that road users traffic be protected.
1.28.3 The traffic signs, road markings, lamps, barriers and traffic control signals shall be in
accordance with the requirements current at the date of the execution of the work.
1.28.4 The Contractor shall keep clean and readable at all times all traffic signs, road markings,
lamps, barriers and traffic control signals and he shall position, re-position, cover or
remove them as necessitated by the progress of the Works.
1.28.5 Roads, accesses, rights of way, etc. which are being used by construction traffic shall at
all times be kept clean of all dirt, mud and material dropped from vehicles or from tyres
arising from such use. The Contractor shall provide, maintain and use suitable
equipment for this purpose.
1.28.6 In carrying out the Works the Contractor shall ensure that all road drains, ditches and
channels are kept clear of any spoil, mud, slurry, or other materials likely to impede the
free flow of water.
1.28.7 Where work is carried out on, or adjacent to a highway open to traffic, the Contractor
shall ensure that vehicles and mobile plant under his control operating frequently or
regularly on or adjacent to that highway in the execution of the Works shall be painted in
a conspicuous colour.
1.28.8 The Contractor shall provide, and suitably sign, points of entry to and exit from the Site,
for vehicles and plant engaged on the Works. The Contractor shall ensure that when any
vehicle or item of plant is reversing within the Site on or adjacent to a highway open to
traffic, it does so only under the supervision of a person designated for the purpose of
regulating traffic within the Site who shall be readily distinguishable from the remainder
of the work force.
1.28.9 Where work is carried out on or adjacent to a highway open to traffic, the Contractor
shall ensure that the work force and the site supervisory staff at all times wear high
visibility warning clothing.
1.28.10 The Contractor shall comply with statutory load restrictions in transporting material and
equipment to and from the Works. He will obtain all necessary permissions and
approvals from the Authorities for moving abnormal loads and keep the Engineer
informed at all times. Vehicles or loads causing excessive axle loads shall not be
permitted on newly completed construction within the Site and the Contractor shall be
responsible for repairing any work so damaged in accordance with the Engineer's
instructions

1.29 Emergency Arrangements

1.29.1 The Contractor shall maintain arrangements whereby he can quickly call out labour
outside normal working hours to carry out any work needed for an emergency
associated with the Works. The Engineer shall be provided at all times with a list of

addresses and telephone numbers of the Contractor's staff who are currently
responsible for organising emergency work.

1.29.2 The Contractor shall acquaint himself and his employees with any relevant local
arrangements that are in existence for dealing with emergencies.

1.30 Hazardous Substances

1.30.1 No hazardous substances shall be brought on to the Site or used for any purpose unless
the Contractor has previously obtained the written approval of the Engineer and has
obtained the necessary permits.

1.30.2 The Contractor shall obtain the Engineer's approval in writing prior to storing and
locations of any hazardous substance on the Site.

1.30.3 The Contractor shall comply with Specific local or National codes and laws, for example,
those concerning storage of fuel and flammable substances and explosives.

1.31 Existing Structures and Underground Services

1.31.1 Where, in the course of construction of the Works, any existing foundations, walls,
sewers, drains, pipes, wires, cables, and other structures, places and things are
exposed, or otherwise are affected by the execution of the Contract, they shall be
properly maintained, adequately supported and protected. Expedients to the approval of
the Engineer shall be adopted, which will prevent inconvenience, interruption and which
will ensure safety and continuity of use, of the above.

1.32 Shop-Drawings, Construction Drawings and As-Built Drawings

1.32.1 These drawings shall be prepared by the Contractor in accordance with current
Romanian legislation and construction regulations.
1.32.2 The Contractor shall submit these drawings, with all necessary supporting calculations/
equipment details, etc., in order to obtain approval for these drawings from the Engineer
and all relevant authorities prior to commencement of construction works.
1.32.3 Where there are specific Romanian design standards, loadings and codes, they must be
complied with e.g. earthquake resistance, wind speeds, climate etc.
1.32.4 The Contractor shall prepare all necessary construction drawings and shop-drawings
necessary for the construction of the Works and shall submit them to the Engineer at
least 28 days prior to the planned commencement of any work. The Engineer shall
review such drawings and shall provide his written approval or comments within 14 days
of receipt of them. In the event that the Engineer withholds approval his written
comments shall be sufficiently detailed as to allow the Contractor to institute any
necessary changes to the drawings. In such case the Contractor shall address the
Engineers written comments and re-submit drawings to the Engineer.
1.32.5 The Contractor shall keep records as the works proceed to enable him to mark up a set
of as-built drawings during construction. The records shall include detailed drawings of
all roads, buildings, structures, culverts and major drainage channels to include line and
level. The as-built drawings shall be made available for inspection from time to time to
the Engineer. On completion of the Works and not more than 90 days after the issue of
the Taking-Over Certificate the Contractor shall furnish two sets of as-built drawings to
the Engineer covering the complete construction of the Works. The as-built drawings
shall be accompanied by all relevant records compiled during the construction of the
Works and shall comply with Romanian regulations regarding construction or working

drawings.

1.33 Fire Prevention and Protection

1.33.1 The Contractor shall perform all work in a fire-safe manner. He shall supply and maintain
on the site adequate fire-fighting equipment. The Contractor shall comply with all current
applicable fire regulations.

1.33.2 Inflammable materials shall be stored in accordance with fire regulations and away from
third party persons.

1.33.3 The Contractor will be responsible for any losses as a result of fire started during the
execution of the Works or by any of his employees.

1.34 Access by Officials and Visitors

1.34.1 Authorised government and municipal officials shall at all times have access to the work
wherever it is in preparation or progress, and the Contractor shall provide proper
facilities for such access and for inspection.

1.34.2 Where the Site has conditions requiring access by archaeologists, environmental or
conservation officials, this will be detailed in the Contract.

1.34.3 Where visitor access is required to the site offices, particular care shall be taken to
ensure that this access is safe and adequately signposted.

1.35 Public and Labour Safety and Convenience

1.35.1 The Contractor shall mark all open trenches and other obstructions by approved signs,
fences, barricades, and lights for the safety of the public.

1.35.2 During the execution of the Works, the Contractor shall at all times comply with all legal
safety requirements. He shall pay particular attention to the health and safety of his
employees and ensure adequate working and sanitary conditions.

1.35.3 During the execution of the Works, the Contractor shall at all times comply with all legal
safety requirements. He shall pay particular attention to the health and safety of his
employees and ensure adequate working and sanitary conditions.
1.35.4 The Contractor is to provide all necessary safety equipment and clothing for the
protection and safety of his employees.

1.35.5 The cost of complying with safety regulations is deemed to be included in the Contract
Price.

1.36 Street Clean-Up during Construction

1.36.1 The Contractor shall clean all spilled dirt, gravel, or other foreign material caused by the
construction operations from all streets and roads at the conclusion of each day's
operation. Cleaning shall include washing with water, power brushing, and use of
manual labour as necessary to achieve the standard comparable with adjacent streets
unaffected by the works.

1.36.2 The Contractor shall take all reasonable steps to prevent vehicles entering and leaving
the Site depositing mud or other debris on the surface of adjacent roads or footways,
and shall remove expeditiously any materials so deposited.

1.36.3 The Contractor shall not without the agreement of the Engineer obstruct more than a
100 metre length of any part of the highway at any one time.

1.37 Access for Emergency Services

1.37.1 The Contractor shall notify the Fire and Police Services before closing any street or
portion thereof and no closing shall be made without the Engineer's approval. The Fire
and Police Services shall be notified when the streets are again passable for emergency
vehicles. The method adopted for construction of the Works shall minimise interference
with Fire and Police Service access and at no time prevent such access.

1.37.2 The Contractor shall leave his night contact telephone number with the local Police office
whenever construction operations are in progress.

1.38 Tipping Facilities and Waste Materials

1.38.1 No tipping facilities are to be provided by the Employer (unless otherwise indicated in the
Contract) and he shall make all arrangements and bear all costs for the disposal of all
surplus excavated material. Unauthorised tipping shall not be permitted.

1.38.2 The removal of waste material from the site must comply with local and National
regulations in respect of carrying and disposal.

1.39 Testing

1.39.1 If the Contractor provides his own testing facilities, the equipment, staff and method of
operation shall be acceptable to the Engineer, and up to 25% of all tests conducted by
the Contractor shall simultaneously be carried out, on samples of the same material, by
an approved independent testing laboratory.

1.39.2 If the results of such independent tests show the Contractor's results to be incorrect, the
Engineer shall instruct the Contractor to repeat the tests or rely on his own test results
for the purpose of assessing the quality of materials and workmanship

1.39.3 The Engineer shall have access to the Contractor's laboratory or the independent
laboratory at all reasonable times.

1.39.2 The Contractor submits all test results without delay. Test results from independent
laboratories shall be copied and sent directly to the Engineer by the laboratory.

1.39.5 The Contractor shall submit copies of the test reports as soon as possible and no later
than in the times specified in the Quality Assurance System prepared according to the
requirements specified under Clause 1.8.

1.40 Works Off-Site

1.40.1 When major components of the Works are manufactured off-Site, the Contractor shall
make arrangements to provide an adequate and secure office at or adjacent to the place
of, and during the period of, manufacture and testing.

1.40.2 The Contractor shall give written notice to the Engineer of the workshops and places
where work is being, or is about to be, carried out from which materials of manufactured
articles are about to be or are being supplied. He shall also give such notice and keep
the Engineer advised of the times when such materials will be ready to be inspected, so
that such inspection may take place without delaying the delivery of the materials to the
site. Such notices shall be given at such times as will permit the inspection of the whole
of the work at all stages of the processes of manufacture and not simply when the goods
are completed ready for delivery.

1.40.3 At least four weeks prior to the placing of any orders for major components of the Works
the Contractor shall forward to the Engineer for approval full and detailed particulars and
samples when requested of the materials/ components that he intends to procure for the
Works. All these items shall comply with the Technical Specifications and shall bear
necessary approvals for use in Romania.

1.41 Other Contractors

1.41.1 The Contractor is advised that other contractors employed by the Employer and
employees of the Employer may be working on and around the Site. The Contractor
shall grant access to the Site to any such persons. The Contractor shall liaise with the
Employer and shall plan and execute the Works for mutual convenience and ensure
satisfactory progress of the project.

1.41.2 The Contractor shall not interfere in any way with any works, whether the property of the
Employer or of a third party and whether or not the position of such works is indicated to
the Contractor, by the Engineer, except where such interference is specifically described
as part of the Works either in the Contract or by the Engineers instruction. The
Contractor shall respect and shall ensure that his employees and his subcontractors
respect the construction and finish of works and articles supplied or installed by others
and will be held responsible for any loss or damage thereto if caused by him.

1.42 Safeguarding the Environment

1.42.1 The Contractor shall execute all works and take any measures for environmental
protection and impact mitigation in accordance with the laws in force in Romania. He
shall obtain all the necessary updated information concerning the Organisation for
Environmental Protection in Romania and obtain all the necessary authorisations and
carry out complementary studies whenever necessary. He shall obtain environmental
approvals for all temporary works.
1.42.2 During the works, including site mobilisation and the maintenance period, the Contractor
and his sub-contractors, in compliance with the norms and regulations in force, shall
implement the following mitigation measures:
Reduction of Equipment and Plant noise when working in urban areas and in
proximity to occupied buildings.
Control of vibration from plant and equipment in urban areas and in proximity to
buildings and other structures.
Optimum location for crushers, bitumen plants, batching plants and other similar
plants, in order to minimise their adverse impact on the natural and human
environments.
Enforcement of an adequate traffic management plan to minimise the disturbance
caused by the site traffic and to safeguard the public and the Contractors labour.
Protection of rivers, lakes, lands in crop and any areas surrounding the Site, against
any pollution, which may originate either from the permanent road works or from other
activities related to the Contractors organisation.
Control of the method of storage of materials, with strict observance of the standards
and Technical Specifications regarding the most sensitive items such as fuel,
bitumen, lubricants, cement, explosive, etc.
Protection and accurate reinstatement at the end of the works of borrow pits,
quarries, services and diversion roads and any other temporary or preparatory work.

Provision and installation of specific equipment and the relevant monitoring of noise,
gas, dust, liquids and other pollutants derived from Site activities.
Reduction of the emission of pollutants when they reach maximum admissible levels,
in accordance with the Romanian current legislation and norms.
Biodegradable materials shall be carefully buried in locations approved by the
Engineer and the local environmental Agency in order to prevent any pollution of
underground water.
Any other action which might be necessary in accordance with the Engineers
instructions and, as required by the current Romanian legislation. (Law No. 137,
dated 30.12.1995 refers particularly).
1.42.3 The Contractor shall, at the request of the Engineer, carry out whatever environmental
measurements are required to demonstrate that the requirements of this Clause are
being respected. The tests shall be carried out at the locations and times required by the
Engineer, and the Contractor shall carry out such tests at his own expense with
instruments supplied by him.

1.43 Contractors Equipment

1.43.1 Details of all Contractors equipment to be used by the Contractor in the execution of the
Works shall be submitted to the Engineer prior to its use.

1.43.2 If in the Engineer's opinion circumstances arise where it is reasonable that the use of the
Contractors equipment should be suspended either temporarily or permanently, the
Contractor shall change the method of performing the work affected. In particular, this
will apply where it is impossible or unsafe to excavate except by hand methods, due to
the proximity of, and danger to, existing roads, structures, or services.

1.43.3 The Contractor shall be deemed to have no cause for claims against the Employer on
account of having to carry out the work by another method, nor shall he be deemed to
have cause for claim if any order issued by the Engineer results in the Contractors
equipment having to stand idle for a period of any duration whatsoever or having to be
removed..

1.44 Clearance of Site on Completion

1.44.1 A Performance Certificate will not be issued before the Contractor has removed all his
machinery, equipment, plant, waste material from the Site and the Site reinstated to the
satisfaction of the Engineer.

1.45 Construction Permits

1.45.1 The Contractor shall obtain all permits necessary for the construction, occupation and
use of the Works. The Engineer will assist the Contractor in obtaining the necessary
permits.
1.45.2 The Contractor shall assist the Engineer and the Employer in obtaining permits that only
the Employer may obtain.
1.45.3 The Contractor shall allow a realistic timescale for dealing with the third parties
responsible, for permits etc., in his planning and programming of the work.
1.45.4 The Contractor shall comply with all conditions stipulated in any permits granted by third
parties, including conditions stipulated in those permits obtained by the Employer.

1.46 Working Hours

1.46.1 Working hour restrictions may apply to the Site including the delivery of materials and
equipment. Details are given in the Contract.

1.47 Temporary Works

1.47.1 The Contractor shall design, arrange, provide and remove at his own cost all temporary
works needed to carry out the Permanent Works. The temporary works shall include the
provision of road diversions where considered necessary. All temporary works shall be
approved by the Engineer, but this shall not relieve the Contractor of his responsibility for
their design and adequacy. The Contractor shall obtain all the necessary approvals from
the relevant authorities, service (utility owners), local municipalities and other third
parties for his design of the temporary works where required.
1.47.2 The Contractor shall be responsible for obtaining all approvals and permits for
organising all necessary land hire for any temporary works such as access roads,
diversion roads, borrow pits, site compounds, material and equipment storage areas,
laboratory facilities and so on. He shall restore the areas affected by these temporary
works either to their original condition or to a condition agreeable to the Engineer, or
stipulated in approvals.
1.47.3 The Contractor shall design and construct any form of temporary road diversion and rail
or river crossing and shall be responsible for obtaining approvals and clearances from all
land owners and other relevant organisations affected by these temporary works.
1.47.4 The temporary road diversions shall be designed and constructed using materials and
workmanship that prevent settlement, rutting or distortion of the running surface.
1.47.5 The design of the diversion shall be submitted, to the Engineer for approval. The
Contractor shall submit details of his scheme to the landowners, river authority etc.
1.47.6 When submitting the design of the diversion to the Engineer, the Contractor shall also
submit his proposals for traffic management and safety whilst the diversion is in use and
shall obtain approval of such from local authorities.
1.47.7 On completion of the relevant section of the Works for which temporary works have
been provided, the Contractor shall remove such roads, structures and the like and
reinstate the ground on which they had been constructed to its original or to a similar
condition to the satisfaction of the Engineer.

1.48 Documents required for Taking Over by Employer

1.48.1 Works shall be taken over by the Employer and Local Beneficiary after they have been
completed in accordance with the Contract. For the purpose of the Taking over
procedure the Contractor shall prepare and submit to the Engineer, the Construction
Book and as-built drawings as required under Romanian Law. These documents will
form the annex to the Taking over Certificate.
1.48.2 Failure of the Contractor to submit these documents may be considered by the
Engineer as the justifiable reason to reject Contractor notice for the issue of the Taking
over Certificate.
1.48.3 The Engineer shall have the right to review the documents supplied by the Contractor
and to order any amendments or substantiations he may consider necessary.

1.49 Provisional sums

1.49.1 Provisional sums specified in the Contract shall only be used, in whole or in part, at the
discretion and on the instruction of the Engineer.

1.549.2 Where a provisional sum is provided in the Bill of Quantities to cover the cost price of
certain goods, services or materials to be supplied under the Contract, the amount to be
paid therefore to the Contractor shall be the actual price payable by him, for providing
these goods, services or materials, together with any charge included by the Contractor
in his pricing to allow for labour, profit, carriage, establishment and for other charges
related to such goods, services or materials

1.49.3 The Contractor shall produce all invoices, vouchers and receipts in respect of payments
made by him in connection with Provisional Sums items when he requires payment for
these items.
1.50 Munitions survey and disposal

1.50.1 Clearance of munitions will mean for the purpose of this Specification either clearing of
explosive remnants of war (ERW) or unexploded ordnance (UXO) or any other
Explosives, Propellants and Pyrotechnics materials including Small Arms Ammunition

1.50.2 During construction there will be a potential for munitions to be encountered. Therefore
the Contractor shall prepare Munitions Survey and Disposal Plan for the total Works.
The plan shall be prepared and executed by a specialist professional experienced in
work in this area. The plan is subjected to the Engineers approval. The plan shall
address the following:

a)
Assessment of extent of ordnance survey and disposal to be undertaken in
accordance with the Technical Specifications
b) Detailed procedures for identifying, securing, disposing of unexploded ordnance,
implementation of Quality Control procedures
c) Submission of reports to the Engineer including proposed reporting format, for the
following:
Report on each Construction Area searched, cleared and audited within 14 days
of completion of this work;
Six (6) monthly reports of all search, clearing, disposal, Quality Control and
auditing.
1.50.3 For each Construction area searched and cleared the Contractor will issue Certificate
confirming clearing of the area in the format agreed with Engineer.

1.50.4 The Contractors Munitions Survey and Disposal Plan will be the part of the overall
Quality Assurance System

1.50.5 The Contractor scope of actions within this Specification requirements shall be limited to
the munitions clearance up to the 1m depth under the soil surface, which can be
performed using standard hand held detectors.

1.51 Archaeological assistance

1.51.1 Archaeological construction monitoring is generally conducted to monitor ground-


disturbing activities taking place near known archaeological sites or where substantial
amount of earthworks is to be performed. Construction monitoring is performed to limit
the impacts to archaeological sites during earthworks operations that are located within
proximity to known archaeological sites. This activity is required by the Governmental
Ordinance OG no. 43/Jan-2000, paragraph 6b.

1.51.2 Notwithstanding the presence of the Archaeological Authority personnel or not if any of
the Contractors personnel or other person identifies any material suspected to be of
archaeological significance during construction, the works that could impact on the

material shall be suspended immediately, and the Engineer as well as the


Archaeological Authority shall be notified immediately.

1.51.3 The Contractor shall be responsible for safeguarding against possible looting or
disturbance, of the material suspected to be of archaeological significance till the
decision on the further proceeding is given either by the Authority concerned or the
Engineer.

1.51.4 The Contractor shall include in his Work Programme activities related to the
archaeological monitoring as well as shall include in his Quality Assurance System
appropriate Method Statement for the purpose of the archaeological monitoring. This
should cover suspension of part or all of the works for inspection and photography of
trenches, shoring, and hand excavation by contractor's staff under archaeological
supervision, emergency excavation of up to seven (7) days' duration in the event of
inadvertent findings.
