It is Proposed to hold an inquiry against Sri M. Vinaya Kumar, AE/Mech. in accordance
with the procedure laid down in APSEB Employees Discipline & Appeal Regulations as
adopted by APGENCO.
4) Sri M. Vinaya Kumar, AE/Mech. is also informed that Enquiry will be held only in
case the Article of Charge is not admitted. He should, therefore, specifically admit or
deny the article of charge in his reply.
5) Sri M. Vinaya Kumar, AE/Mech. is further informed that if he does not submit his
written statement of defence on or before the date specified above, further action will be
processed based on the material available.

Article:
That the said Sri M. Vinaya Kumar, while functioning as AE/Mech.,, under the control of
the Chief Engineer/O&M/KTPP, was absent to duty for more than one (1) year since
15.09.2012 onwards without proper sanction of leave from the Competent Authority.
The APGENCO Employees are expected to perform their duties with devotion, Integrity
and Impartiality and further they are expected to maintain discipline.
Thus, he has failed to maintain the set discipline of regular attendance and perform his
duties with devotion, resulting in dislocation of the office work and causing great
inconvenience and also failed to maintain absolute integrity, expected of him, which
constitutes misconduct as per Regulation 4(xxiv) (a) of APSEB Employees (Revised)
Conduct Regulations read with APSEB Employees Discipline & Appeal Regulations as
adopted by APGENCO Limited.

The AE was instructed to report for duty immediately with in three days
otherwise suitable disciplinary/departmental action deemed fit will be
initiated based on the records available.
In the Memo dated 06.11.2013 cited above, explanation was called for from
Sri M. Vinay Kumar, AE/Mech., informing that, his absence is more than one year w.e.f.
15.09.2012 which constitute misconduct as per Reg. 4 (xxiv) (a) and (xxvii) of APSEB
Employees Revised Conduct Regulations as adopted by APGENCO and he is also liable
for the Major punishment of Removal from service in terms of G.O.O. No.
24/JS(Per)/208, dt. 23.04.2008 as his unauthorized absence from duty for a
continuous period exceeded one year period.
The gist of the explanation dt.20.11.2013 of Sri M. Vinay Kumar, AE/Mech., (U/A)
addressed to the Chief General Manager (Adm)/ APGENCO/ VS/Hyd, is set out
below:
That, he had applied for casual leave from 17.09.2012 to 18.09.2012 due
to ill health.
He was in receipt of the memo dated 06.11.2013 but, he is unable to join duty as
he has not yet recovered and it may take six more moths to recover from illness,
He has requested to grant EOL on Medical grounds with effect from 17.09.2012
to 20.05.2014.
