It is Proposed to hold an inquiry against Sri M. Vinaya Kumar, AE/Mech. in accordance
with the procedure laid down in APSEB Employees Discipline & Appeal Regulations as
adopted by APGENCO.

2) The substance of the imputations of misconduct or misbehaviour in respect of


which the inquiry is proposed to be held is set out in the enclosed statement of Article
of charge (Annexure-I). A list of documents by which, and a list of witnesses by whom,
the Article of charge is proposed to be sustained are also enclosed (Annexures II and
III).

3) Sri M. Vinaya Kumar, AE/Mech. is directed to submit his explanation written


statement of defense within 10 working days from the date of receipt of this charge
memo.

4) Sri M. Vinaya Kumar, AE/Mech. is also informed that Enquiry will be held only in
case the Article of Charge is not admitted. He should, therefore, specifically admit or
deny the article of charge in his reply.

5) Sri M. Vinaya Kumar, AE/Mech. is further informed that if he does not submit his
written statement of defence on or before the date specified above, further action will be
processed based on the material available.

6) The receipt of the Memorandum should be acknowledged at the earliest.

Statement of Article of Charge framed against Sri M. Vinaya Kumar, AE/Mech.,

Article:

That the said Sri M. Vinaya Kumar, while functioning as AE/Mech.,, under the control of
the Chief Engineer/O&M/KTPP, was absent to duty for more than one (1) year since
15.09.2012 onwards without proper sanction of leave from the Competent Authority.

The APGENCO Employees are expected to perform their duties with devotion, Integrity
and Impartiality and further they are expected to maintain discipline.

Further as per the Regulation 15 (4) of APSEB Leave Regulations, as adopted by


APGENCO, Leave for longer duration of more than a month shall be availed by the
Board employees with prior sanction of the competent authority. Any absence without
prior sanction shall be treated as unauthorized absence. If the period of unauthorized
absence of a Board Employee exceeds one month, the period shall be treated as DIES-
NON and the employee shall also be liable for disciplinary action.

Thus, he has failed to maintain the set discipline of regular attendance and perform his
duties with devotion, resulting in dislocation of the office work and causing great
inconvenience and also failed to maintain absolute integrity, expected of him, which
constitutes misconduct as per Regulation 4(xxiv) (a) of APSEB Employees (Revised)
Conduct Regulations read with APSEB Employees Discipline & Appeal Regulations as
adopted by APGENCO Limited.

Statement of Imputations of misconduct or misbehaviour in support of the


Article of charge framed against Sri M. Vinay Kumar, AE/Mech., O/o
CE/O&M/KTPP.

The gist of the letter No. F.26/D.687/2013 dt.14.08.2013 of CE/O&M/KTPP


addressed to the Chief General Manager (Adm)/APGENCO/VS/Hyd, is set out
below:

Sri M. Vinay Kumar, AE/Mech., has joined in Turbine Maintenance


Division at KTPP on 15.09.2012 and proceeded on Casual Leave for 02
days on 17.09.2012 and 18.09.2012. On expiry of leave, he neither
reported nor extended leave.

In memo dated 07.11.2012, the SE/O&M-I/KTPP issued instructions to


the AE to report within three days otherwise suitable
disciplinary/departmental action deemed fit will be initiated based on the
records available.

But the AE has not turned up to resume duty.

The CE/O&M/KTPP has surrendered the services of the AE.

07.11.2012 issued to Sri M. Vinay Kumar, AE/Mech.,

Sri M. Vinay Kumar, AE/Mech., has joined in Turbine Maintenance


Division at KTPP on 15.09.2012 and proceeded on Casual Leave for 02
days on 17.09.2012 and 18.09.2012. On expiry of leave, he neither
reported nor extended leave.

The AE was instructed to report for duty immediately with in three days
otherwise suitable disciplinary/departmental action deemed fit will be
initiated based on the records available.

But the AE has not turned up to resume duty.

The SE/O&M-I/KTPP has surrendered the services of the AE to the


control of CE/O&M/KTPP.

dt. 06.11.2013 issued to Sri M. Vinay Kumar, AE/Mech.,

In the Memo dated 06.11.2013 cited above, explanation was called for from
Sri M. Vinay Kumar, AE/Mech., informing that, his absence is more than one year w.e.f.
15.09.2012 which constitute misconduct as per Reg. 4 (xxiv) (a) and (xxvii) of APSEB
Employees Revised Conduct Regulations as adopted by APGENCO and he is also liable
for the Major punishment of Removal from service in terms of G.O.O. No.
24/JS(Per)/208, dt. 23.04.2008 as his unauthorized absence from duty for a
continuous period exceeded one year period.

The gist of the explanation dt.20.11.2013 of Sri M. Vinay Kumar, AE/Mech., (U/A)
addressed to the Chief General Manager (Adm)/ APGENCO/ VS/Hyd, is set out
below:

That, he had applied for casual leave from 17.09.2012 to 18.09.2012 due
to ill health.

Thereafter due to ill health of chronic pulmonary esnophelia and


breathlessness, he was taken to super Speciality Hospital for follow up
treatment.

He has submitted leave application for extension of leave.

He was in receipt of the memo dated 06.11.2013 but, he is unable to join duty as
he has not yet recovered and it may take six more moths to recover from illness,

He has requested to grant EOL on Medical grounds with effect from 17.09.2012
to 20.05.2014.
