REGULATION ORDINANCE NO. 2016-256


AN OlUUNANCE ESTABLISHING GUIDELINES FOR AND
ALLOWING THE REGISTRATION OF BIRTHS OF PEOPLE
BORN IN ILOILO CITY WHO ARE NOT BORN IN HOSPITALS
OR MATERNITY CLINICS AND WHOSE BIRTHS ARE NOT
ATTENDED BY A LICENSED PHYSICIAN OR MIDWIFE

WHEREAS, there is an increasing number of births in Iloilo City that are not
egiste:red by reason that such deliveries were not made in hf>s.pitals or maternity clinies,
nd that such births were or are not attended to by a licensed physician or midwife;

WHEREAS,. the United Nations Convention on the Right of the C~ provides


that "the child shall be registered immediately after birth and shall have the right from
birth to a name, the right to a nationality'';

WHEREAS, the fulfillment of the right to have one's birth registered is a


prerequisite to the fulfillment of the other rights enshrined in the Constitution such as
the right to education, the right to health care and the right of suffrage, among others;

WHEREAS, the registration of such births must not only be alrowed but should
be encouraged through the passage of suitable legislation for such purpose.

NOW, THEREFORE, be it ordain-ed by tile Sangga.niang Panhmgsotl of th-e City


of Iloilo, in session assembled, that births occurring within the territorial jurisdiction of
Iloilo City, that area not made in hospitals or maternity clinics and without the
assistance of a licensed physician OF midwife shall be allewed Fegisttation b-y the Local
Civil Registrar, subject to compliance of the following requirements, to wit:

Section r. - r. NSO/PSA negative resrrlt - dated not later trran on-e {r} year from
the date of application for the registration;

2. Marnage Certificate of Parents. In the absence of the paFent's marriage


certificate, ANY ONE of the following may be presented:

a. Certifieate of Live Birth of otder sibfurg, or


b. Cer:fificate of Live Birth of younger sibling, provided that
the Date of Marriage of parents as indicate in the said
Certificate of Live Birth of the ymmger sibling should be
earlier than the date of birth of the applicant for late
:registration~
c. Information from the child's School Records indicating
his/her birth dated and place, or
cL Any valid documents (insurances,. etc~) which can show the
child's place and date of birth.

4. Personal appearance of both parents (for illegitimate child) before the


authorized personnel of the City Civil Registry Office.

Section 2c - These. :reqniFements. lik-ewise. apply to late. :registration of births that


were attended by licensed physician or midwives but were not made in hospitals or
maternity clinics, when the signature of such licensed physicians or midwives in the
birth registration forms cannot be obtained,. and also in pending and future applications
for late registration of such births that occurred prior to the effective date of this
ordinance.

Section 3 - The Barangay Secretary of the barangay where such births occurred
h ll be responsible for the preparation of the Birth Certificate Form.

Section 4. - Should the civil registrar find any cause to suspend the veracity of the
ormatfon given by the informant of the applicants, he shall nevertheless allow the
processing of the registration of such birth but shall further require the following
documents:

a) Two (2) valid identification cards and profiled picture of the informant
ta ~ta:ken hefore the Office of the-City Civil Registry Office-.
b) Profile picture and thumbprint/footprint of the child to be registered
to be taken at the Office of the City Civil Registry Office.

Section 5. - The suspicious registration application allowed by the Civil Registrar

Section 6. - Any person found to be providing false information in relation to the


present ordinance and convicted by final judgment by a court of competent jurisdiction
sha:U be punishable- by law with thret; (3J ta six ( 6)' momhs' imprisonment a:t th'e
discretion of the court.

Section 7 - This ordinance shall take effect after puhlieation for ten (10} days in a
newspaper of general circulation in the City of Iloilo.

SectiOTI 8. - Let a copy of this ordinance be published in a newspaper of general


circulation in the City of Iloilo for information dissemination and guidance and be
furnished to all office concerned.
