LEAVE AND LICENSE AGREEMENT

THIS AGREEMENT OF LEAVE AND LICENSE IS MADE AT PUNE ON THIS 1st April 2016

Hereinafter called as LICENSOR of the First Part And

Mr. Rohit Kumar


Age: 26, Occupation: Service(Amdocs Pvt. Ltd.)

Hereinafter called as the LICENSEE of the Second Part

WHEREAS the Licensee approached the Licensor and requested the Licensor to
allow the Licensee to make use and occupy the said flats by Leave and License for
a temporary period of 11 months (Eleven) commencing from 1 April 2016 and
ending on 31 March 2017. The Licensor agreed for Leave and License of the said
premises for the purpose of residence only.

AND WHEREAS the Licensor has maintained the said premises together with
fixtures and fittings therein and agreed to grant the Licensee occupation of the
said Flats for 11 (Eleven) months on the terms and conditions herein contained;

DESCRIPTION OF THE PROPERTY:

Flat No: 5, Alam House, House no. 626, Anandnagar,
Keshav Nagar, Mundhwa, Pune-411028.
NOW THEREFORE THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. The Licensor hereby grants to the Licensee and the Licensee hereby
accepts from the Licensor on Leave and License basis the said flat with
fittings and fixtures therein for 11 (Eleven) months only, commencing from
1st April 2016 and ending on 31st March 2017. This agreement shall only
mean to allow the Licensee to use and occupy the premises for residential
purpose only, under the control and supervision of the Licensor. The terms
and conditions are described hereinafter.

2. The Licensee shall pay to the Licensor a sum of Rs. 8000/- (Eight
Thousand only) per month as monthly license fees inclusive of society
maintenance charges. It is agreed that the Licensee shall pay the license
fees on or before 10th day of every English Calendar month in advance.

3. It is agreed by both the parties that the Licensor or his agents shall have the
right to visit and inspect the said flat at any time from sunrise to sunset,
with prior intimation.

4. It is hereby agreed by and between the parties hereto that the fittings.
Fixtures and articles belonging to the Licensor shall continue to remain in
the said flat. The Licensee hereby agrees that he shall take all care and
damage or loss will be made good by the Licensee at the cost of Licensee
either by rectifying the damage or by paying cash compensation as may be
determined by the Licensor.

5. The Licensee shall keep the interior of the said flat in good condition and
shall be responsible for the ordinary maintenance of doors, windows,
sanitary fittings, furniture, bathroom fittings. The Licensor shall be
responsible for the only heavy/major repairs to roof leakage or seepage
through walls.
6. All dues concerning M.S.E.B Electricity should be paid on due date without
delay by the Licensee. Original bills shall be handed over to the Licensor.
The yearly PMC tax for the said flat shall be paid by the Licensor.

7. The Licensee shall not assign, transfer or sub-let me said flat or any part of
the said flat.

8. The said Flat shall be used in a reasonable manner without being a


nuisance or annoyance to the Licensor or any other occupants in the
building, Society or the neighbors.

9. It is hereby agreed by and between the said parties that if the Licensee
commits default in payment of the aforesaid monthly compensation,
electricity charges.

10. and/or commits breach of any of the terms, covenants and conditions
contained in this Agreement, the Licensor shall be entitled to revoke the
License by giving a written notice of 7 days to the Licensee and the License
shall stand cancelled and terminated. The Licensee shall remove his
belongings from the said Flat and hand over peaceful and vacant
possession of the said Flat to the Licensor by giving the Licensor 30
(Thirty) days advance notice in writing in lieu of notice.

11. It is hereby agreed by the Licensee hereby that at all times the judicial
possession of the said Flat shall be of the Licensor and that the Licensee is
merely granted the permission to make use of and occupy the said Flat for a
period of 11 (Eleven) months only and the Licensee shall vacate and
peacefully hand over the Flat on the expiry of this Agreement to the
Licensor.
12. It is distinctly understood and agreed by and between the parties that no
right of tenancy is conferred by this Agreement to the Licensee and the
relationship of the landlord and tenant has not come into existence nor it is
intended to be brought into existence under this Agreement.

13. The Licensee has deposited a sum of Rs. 20,000/- (Rupees Twenty
Thousand Only) being amount of security deposit with the Licensor (which
shall bear no interest). The amount of security deposit shall be refunded to
the Licensee at the time of vacating and handing over peaceful, vacant
possession of the Flat to the Licensor after adjustment and deducting any
dues and for damage to the said Flat. The Licensor confirms having,
received the said deposit of Rs. 20,000/- (Rs. Twenty Thousand Only).

14. The License may be terminated by any party to this Agreement, i.e. the
Licensor or the Licensee by giving written notice of one calendar month in
advance to the other, and the Licensor shall be entitled to deduct the dues
towards License fees, electricity charges, any damages till the date of
vacation of the said Flat from the Licensee from the security deposit, if any,
will be paid to the Licensee by the Licensor.

15. The Licensee shall hand over vacant and peaceful possession of the said
Flat to the Licensor on the expiry of 11 (Eleven) months. If he does not do
so it shall be considered as trespasser in the said Flat.

16. This Agreement shall remain in force initially for a period of 11 (Eleven)
months and time is the essence of the contract. However, if both parties,
that is the Licensee and Licensor agree in writing a fresh Agreement with
the new terms and conditions may be re- entered by the parties.
17. The original copy of this Agreement will always remain with the Licensor
and a copy may be retained by the Licensee.
IN WITNESS WHEREOF THE PARTIES HERE TO HAVE SIGNED THIS AGREEMENT ON
THE DATE AFOREMENTIONED AND ALSO CONFIRM HAVING TAKEN AS AFORESAID OF
THE AGREEMENT.
