Working principle

The air (blue) is drawn into the compressor through the inlet filter (1) where the air is
cleaned. Then passes through the throttle valve (2) with integrated blow off valve that
takes care of the load unload regulation.
In the first compression stage (3) the air pressure is raised to the intermediate pressure
after which the air is cooled down in the intercooler (4). After the intercooler the air
passes through a moisture separation system (5) before entering the high pressure stage
(6).
In the high pressure stage the pressure is brought to the final pressure. The air at the
outlet of the high pressure stage is split in two parts. One part goes via the pulsation
damper with integrated check valve (7) to the after-cooler (8) where it is cooled down and
moisture is separated and evacuated. A second part goes directly to the regeneration
area of the heat of compression MD dryer (9).
In the regeneration area of the dryer the hot air regenerates the adsorption drum after
which it passes through the regeneration cooler where it is cooled down and moisture is
separated and evacuated (10). The cold air coming from the regeneration section is then
mixed with the cold air from the after-cooler in the nozzle-ejector system before passing
through the drying section of the adsorption drum where the moisture is removed. Dry air
leaves the compressor through the outlet connection flanges (11).

The yellow flow is the oil path within the compressor, where the oil pump (12) sucks oil
from the oil sump and pumps it through the oil cooler (13) and the high efficiency filter
(14) giving cool clean oil to the bearings, the gears and the compressors element
jackets.

GA Pack: Compact compressor package
The GA Pack machine is a fully packaged compressor mounted on a sturdy industrial
grade steel oil containing base frame, which allows the unit to be placed on any level floor
capable of supporting its static weight. The assembled unit is also mounted on anti-
vibration dampers and in a sound attenuating enclosure to limit noise level.

GA Full Feature: Compact compressed air system package

The GA Full Feature consists in the total compressed air system, compressor and air
treatment equipment, integrated inside the compressor canopy, resulting in reduced
installation costs and optimum foot print (space requirement).
The GA 90+ - 160+ Full Feature series includes the latest technologies in refrigerant
dryers like the Atlas Copco saver cycle control reducing the dryer energy consumption in
light load conditions.

The dryer removes moisture from the compressed air by cooling it to near freezing point,
causing the moisture to condense. The condensate is then separated in the integrated
water separator and drained by the electronic water drains. After the water separator the
compressed air is dry. A dryer By Pass valve is included inside the compressor resulting
in 100 % availability of compressed air and low installation costs.

As an option the Full Feature compressor can include an integrated compressed air DD
filter, for enhanced compressed air quality and further reduced installation costs and foot
print.

The Heart Of the Compressor:

Designed for the optimum combination of maximized free air delivery for the lowest power
consumption; gives the main contribution for the compressor package maximum
efficiency.

The screw element bearings are subjected to a meticulous selection process and the
lubrication is done with the coolest oil through internally cast channels insuring low wear
and tear and consequently increased reliability and extended lifetime.

Drive Arrangement:
The GA 90+ - 160+ compressors are driven by efficiency 1 class, TEFC, IP 55 squirrel
cage induction motors designed to operate with 46C / 115F ambient temperature.

The motor power is transmitted to the compressor element via a flexible coupling and
high efficiency gears.

Cooling Fan arrangement:

TERMS AND CONDITIONS OF SALES
SYARAT-SYARAT DAN KETENTUAN-KETENTUAN DALAM PENJUALAN
1. GENERAL. In these Terms and Conditions of Sale:
a) The Company shall mean PT. Atlas Copco Indonesia.
b) The Customer shall mean the addressee on the document or quotation.
c) Goods shall mean equipment and spare-parts (consumable part, non-consumable part and lubricant)
sold to the Customer.
d) Service Order shall mean after sales service and/or service conducted by the Technician.
e) Technician shall mean any appointed person by the Company and/or Atlas Copco Group.
f) The terms and conditions follow ORGALIME S2000 and ORGALIME M2000 as may be amended from
time to time.
g) Without prompt written objection thereto, the Customer shall be deemed to accept all the terms and
conditions set forth herein.
h) This contract is governed by the laws of the Republic of Indonesia. Any dispute pertaining to this
contract will be submitted to the district court of South Jakarta provided however that the Company has
the right to serve legal process in any other manner permitted by law to bring any action or proceeding
against the Customer or its property in any other court.
2. QUOTATIONS: Unless otherwise stated, the Company's tender or quotation will be valid for a period of 30
days from its issuance date, which the acceptance time of any order placed is subject to the Companys
written confirmation. The acceptance date shall be the date of the acceptance notice in writing on the tender
or quotation of the Customer is received by the Company.
3. PRICE. Unless otherwise stated, all prices are quoted in USD and not included any inland freight of more
than 50 km of the Companys warehouses, insurance or applicable domestic and foreign Tax Charges.
Contract price in IDR is including foreign exchange costs prevailing at the delivery date of the Companys
warehouses, and if the variation is occurred (either by rise or fall), then the contract price shall be adjusted to
such variations. Price for Industrial Tools is quoted in EUR. The Parties acknowledge that Indonesia has
passed laws which require that certain domestic transactions be denominated and settled in rupiah. The
Parties further acknowledge that the transactions contemplated by this agreement are intended to be
denominated and settled in US dollars or, as the case may be, EUR. The customer agree that, to the extent
these obligations (Rupiah Obligations) are at a later stage imposed on aspects of the transactions
contemplated by this agreement, the Parties will do the minimum necessary to ensure compliance with the
Rupiah Obligations, and ensure that the Company will be left in an economically equivalent position to what
they would have been in had the Rupiah Obligations not applied, including by converting any US dollar or, as
the case may be, EUR payments into rupiah at the prevailing mid-market rate published by Bank Indonesia
for the business day before the day of payment.
4. STORAGE FEE. Unless otherwise stated, The Company will charge storage fee to Customer in case the
goods still located in Company Premises after 7 (seven) days from notification of good arrival with/without
instruction from Customer. The storage fee will be calculated based on actual usage time, and the Company
will inform the Customer about the rate of storage fee before the seventh day from notification of goods
arrival passed.
5. TERMS OF PAYMENT. CASH BEFORE DELIVERY, The Company shall make the Goods available for the
Customer only upon the receipt by the Company of full payment of the purchase price, unless the Customer
has an approved credit term & credit limit by the Company for payment in installments. In the case of
payment in installments, invoice shall be issued to the Customer after the Goods has been received by the
freight company. The Company will charge interest of 2,5% per-month on any outstanding amounts which
has been due until the Company receives the outstanding amounts. On extended contract, progressive
payments will be required and such terms will be stated on the quotation. Payment in currency other than
quoted in invoice must refer to the Company's Book Rate.
6. DELIVERY AND PASSING OF TITLE. Availability of stock is as quoted subject to receipt of prior orders.
Every endeavor will be made to complete delivery within the period stated but no liability can be accepted in
regards thereto. Unless otherwise stated, the Company will not accept cancellation of an order due to late
delivery nor is it liable for consequential damages of any kind arising out of late delivery or non delivery. In
the case of full purchase price payment before delivery as confirmed as such by the Company, title to the
Goods shall pass to the Customer when the Goods have been received by the freight company.
In the case of payment in installments stated above, notwithstanding anything to contrary, title to each Goods shall at
all times remain in the Company; and the Customer, at its own cost, expenses and risks, shall protect and defend the
title of the Company. The Customer shall at its own cost, expenses and risks at all times keep the Goods free and
clear from all levies, liens, encumbrances and charges or judicial processes of every kind whatsoever, and shall give
the Company immediate notice thereof.
The Company is entitled to reclaim any Goods that have been delivered to the Customer, at any time, if the payment
has not been fully paid in accordance with the provision under Point 5 above.
7. The Company shall provide transportation only in the range of 50 km from the Companys Warehouses
(Carriage Paid To-CPT) or unless otherwise stated in a separate written agreement. The expense relating to the
transportation shall be borne by the Company. However, if the range exceeds 50 km of Companys Warehouses then
such excess shall be for the account of the Customer. Delivery may be made in one or more parcels and at different
times or by separate shipments or deliveries. Each parcel shall be form in a separate contract, be delivered,
accepted and paid for accordingly, notwithstanding late delivery or non delivery or non delivery of any other parcel.
8. START UP AND COMMISSIONING, unless otherwise stated, shall be inclusive in the contract price, only for
Goods having a value of more than USD. 5.000,00 per unit, applicable for one time visit and it shall be
conducted during companys normal working hours. However, any expense arising out of the transportation
and accommodation for a distance of more than 50 km from the Companys offices shall be for the account
of the Customer.
9. WARRANTY. Unless otherwise stated, the guarantee on all Goods manufactured by the Company shall
prevail for a period of 18 months from the delivery date of Companys factory warehouse or 12 months from
the successful date of start up and commissioning; whichever comes earlier, provided that the Customer
notifies the Company in writing of any asserted defect within such period. However, any Goods manufactured by
the Company which has a value of less than US$ 5.000,- per unit is guaranteed for a period of 9 months from
the delivery date of Companys factory warehouse or 6 months from the invoice date; whichever earlier.
Unless otherwise stated spare-parts installed through Service Order is guaranteed for 3 months since its installment.
The Customer is responsible for immediate report in writing on any problem occurred upon the Goods within 7
calendar days of its occurrence. Warranty does not cover consumable parts, transportation and accommodation cost
for technician, misuse of the Goods, and/or use of fake/non original spare parts and/or lubricant.
The Company's liability arising from, or in any way connected with this contract, or from the use or sale of
the Goods, shall be limited solely and exclusively at the Company's option to either the repair (at the Company's designated
facility) or replacement of the defective Goods, or return of the purchase price. Transportation of allegedly defective Goods to
and from the Company's designated facility shall be at the Customer's sole cost and expense, and the Customer shall bear all
risk of loss while such Goods are in transit. The Company's obligation to repair, replace, or return the purchase price of any
Goods asserted by the Customer to be defective in materials and workmanship shall be subject to the Company's inspection
and testing of the same upon its return to the designated the Company facility. Repairs or replacements necessitated by
neglect, misuse, or abuse, or otherwise not covered by this warranty, shall be carried out by the Company at its then standard
rates, charges and prices.
THE COMPANY MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, CONCERNING

1. UMUM. Dalam Syarat untuk Penjualan :
a) Perusahaan berarti PT. Atlas Copco Indonesia.
b) Pelanggan berarti yang pihak yang menjadi alamat tujuan sebagaimana dimuat dalam dokumen atau
surat penawaran harga.
c) Barang berarti peralatan dan suku cadang (unit habis terpakai, unit tidak habis terpakai dan pelumas)
yang dijual kepada Pelanggan.
d) Permintaan Jasa berarti layanan purna jual dan/atau layanan jasa yang dilaksanakan oleh Teknisi.
e) Teknisi berarti orang yang ditunjuk oleh Perusahaan dan/atau Atlas Copco Grup.
f) Syarat-syarat dan ketentuan-ketentuan mengikuti ORGALIME S2000 dan ORGALIME M2000
sebagaimana dapat diubah dari waktu ke waktu.
g) Tanpa adanya keberatan secara tertulis terhadap dokumen ini, maka Pelanggan dianggap telah
menyetujui seluruh syarat dan ketentuan yang tercantum di dalam dokumen ini.
h) Perjanjian ini diatur berdasarkan hukum Republik Indonesia. Setiap sengketa yang berkenaan dengan
perjanjian ini akan diselesaikan melalui pengadilan negeri Jakarta Selatan namun dengan ketentuan
bahwa Perusahaan berhak mengajukan proses hukum dengan cara lainnya yang diizinkan berdasarkan
undang-undang untuk mengajukan segala tindakan atau proses hukum terhadap Pelanggan atau
kekayaannya pada pengadilan lain.
2. PENAWARAN HARGA. Kecuali ditetapkan lain, maka tender atau penawaran harga dari Perusahaan berlaku
untuk jangka waktu 30 hari terhitung sejak tanggal dikeluarkannya penawaran harga, dimana waktu
persetujuan atas setiap pesanan yang ditempatkan adalah tergantung dari konfirmasi tertulis dari Perusahaan.
Tanggal persetujuan adalah tanggal dimana pemberitahuan persetujuan secara tertulis atas tender atau
penawaran harga dari Pelanggan diterima oleh Perusahaan.
3. HARGA. Kecuali ditetapkan lain, maka semua harga adalah dalam mata uang Dolar Amerika Serikat dan tidak
termasuk biaya angkutan dalam negeri apapun yang melebihi jarak 50 km dari gudang Perusahaan,
pertanggungan asuransi atau ketentuan Perpajakan lokal maupun luar negeri yang berlaku untuk transaksi ini.
Harga kontrak dalam mata uang Rupiah adalah termasuk biaya valuta asing yang berlaku pada tanggal
pengiriman dari gudang Perusahaan, dan apabila terdapat perubahan (baik kenaikan atau penurunan), maka
harga kontrak akan disesuaikan dengan perubahan dimaksud. Harga produk Industrial Tools akan dikutip
dalam mata uang Euro. Para Pihak mengakui bahwa Indonesia telah membuat undang-undang yang
mewajibkan agar transaksi-transaksi domestic tertentu ditetapkan besarannya dan dibayarkan dalam Rupiah.
Para Pihak selanjutnya mengakui bahwa transaksi-transaksi dalam perjanjian ini dimaksudkan untuk
ditetapkan besarannya dan dibayarkan dalam dolar Amerika Serikat atau, sesuai keadaan, Euro. Pelanggan
sepakat bahwa, sepanjang kewajiban tersebut (Kewajiban Rupiah) pada tahap selanjutnya dibebankan pada
aspek-aspek transaksi dimaksud dalam perjanjian ini, Para Pihak akan melakukan secara minimum sebatas
yang diperlukan guna memastikan pemenuhan dengan Kewajiban Rupiah, dan akan memastikan bahwa
Perusahaan akan berada dalam posisi yang setara secara ekonomi yang akan dicapai apabila Kewajiban
Rupiah tidak diberlakukan, termasuk dengan mengkonversi pembayaran-pembayaran dolar Amerika Serikat
atau, sesuai keadaan, Euro ke dalam rupiah dengan menggunakan nilai tengah pasar yang berlaku yang
dikeluarkan oleh Bank Indonesia untuk hari kerja sebelum tanggal pembayaran.
4. BIAYA PENYIMPANAN. Kecuali ditetapkan lain, Perusahaan akan menagihkan biaya penyimpanan kepada
Pelanggan dalam hal Barang tetap berada di Tempat Perusahaan setelah 7 (tujuh) hari sejak tanggal
pemberitahuan kedatangan barang, dengan/tanpa instruksi dari pihak Pelanggan. Biaya Penyimpanan akan
dihitung berdasarkan waktu penggunaan aktual, dan Perusahaan akan menginformasikan kepada Pelanggan
tentang besaran tariff biaya penyimpanan sebelum hari ketujuh sejak tanggal pemberitahuan kedatangan
barang terlewati.
5. SYARAT PEMBAYARAN. TUNAI SEBELUM PENGIRIMAN, Perusahaan akan menyediakan Barang bagi
Pelanggan hanya setelah diterimanya oleh Perusahaan pembayaran penuh atas harga pembelian, kecuali bagi
Pelanggan yang memiliki fasilitas kredit dan batas kredit yang telah disetujui Perusahaan untuk pembayaran
dengan angsuran. Dalam hal pembayaran dengan angsuran, tagihan akan dikeluarkan kepada Pelanggan
setelah Barang telah diterima oleh perusahaan pengangkutan. Perusahaan akan membebankan bunga
sebesar 2,5% per bulan atas setiap jumlah yang masih terutang dan yang telah jatuh tempo sampai
Perusahaan menerima jumlah-jumlah terutang dimaksud. Atas kontrak yang diperpanjang, pembayaran-
pembayaran secara progresif akan diberlakukan dan syarat-syarat demikian akan dicantumkan dalam
penawaran harga. Pembayaran yang dilakukan di luar mata uang yang tercantum pada tagihan wajib mengacu
pada Kurs Buku Perusahaan.
6. PENGIRIMAN DAN PENGALIHAN HAK. Ketersediaan pasokan Barang adalah sebagaimana ditawarkan dan
tunduk pada pesanan-pesanan yang telah diterima sebelumnya. Setiap usaha akan dilakukan untuk
menyelesaikan pengiriman dalam jangka waktu yang ditetapkan tetapi tidak dapat diberikan jaminan untuk hal
itu. Kecuali ditetapkan lain, maka Perusahaan tidak akan menerima pembatalan pesanan apapun yang
disebabkan oleh pengiriman yang terlambat dan juga tidak bertanggung jawab atas kerusakan dalam bentuk
apapun yang timbul dari adanya keterlambatan pengiriman ataupun ketiadaan pengiriman. Dalam hal harga
pembelian telah dilunasi sepenuhnya sebelum penyerahan sebagaimana dikonfirmasi secara tertulis oleh
Perusahaan,, kepemilikan atas Barang akan beralih kepada Pelanggan pada saat Barang telah diterima oleh
perusahaan pengangkutan.
Dalam hal pembayaran secara angsuran, dengan mengesampingkan hal-hal yang bertentangan, hak milik atas setiap
Barang akan setiap saat tetap dimiliki oleh Perusahaan; dan Pelanggan, dengan biaya, pengeluaran dan risikonya
sendiri, harus melindungi dan mempertahankan hak milik Perusahaan tersebut. Pelanggan dengan biaya, pengeluaran
dan risikonya sendiri setiap saat harus mempertahankan Barang sehingga bebas dan bersih dari semua pungutan, hak
gadai, pembebanan dan biaya atau proses yudisial dengan jenis apapun, dan harus memberikan Perusahaan
pemberitahuan segera atas hal-hal tersebut.
Perusahaan berhak untuk menarik kembali setiap Barang yang telah dikirimkan kepada Pelanggan, pada setiap waktu,
apabila pembayaran belum dilakukan secara penuh sesuai dengan ketentuan Poin 5 di atas.
7. Perusahaan menyediakan transportasi hanya dalam jarak 50 km dari Gudang-gudang Perusahaan (Carriage
Paid To-CPT) atau kecuali dinyatakan lain dalam kesepakatan tertulis yang terpisah. Biaya yang terkait dengan
transportasi akan ditanggung oleh Perusahaan. Akan tetapi, apabila jaraknya melebihi 50 km dari Gudang-
gudang Perusahaan, maka kelebihan jarak tersebut menjadi tanggungan Pelanggan. Pengiriman dapat
dilakukan melalui satu atau beberapa kiriman dan pada waktu yang berbeda atau dengan beberapa
pengapalan atau pengiriman yang terpisah. Setiap kiriman dilakukan dalam bentuk kontrak yang terpisah, yang
dikirim, diterima dan dibayar sesuai dengan itu, meskipun ada keterlambatan pengiriman atau tidak ada
pengiriman atau tidak ada pengiriman atas kiriman selanjutnya
8. PEMASANGAN DAN PENYALAAN BARANG UNTUK PERTAMA KALI, kecuali ditetapkan lain, adalah
termasuk di dalam harga kontrak, namun hanya untuk setiap Barang yang memiliki nilai lebih dari USD5.000,-
per unit, berlaku untuk satu kali kunjungan dan akan dilakukan di dalam jam kerja normal Perusahaan. Akan
tetapi, setiap biaya yang timbul dari transportasi dan akomodasi untuk jarak yang lebih dari 50 km dari kantor-
kantor Perusahaan wajib ditanggung oleh Pelanggan.
9. GARANSI. Kecuali ditetapkan lain, Garansi atas seluruh Barang yang diproduksi oleh Perusahaan berlaku
untuk jangka waktu 18 bulan sejak tanggal pengiriman dari gudang pabrik Perusahaan atau 12 bulan sejak
tanggal keberhasilan pemasangan dan penyalaan Barang untuk pertama kali; yang mana yang terlebih dahulu,
dengan ketentuan bahwa Pelanggan memberitahu Perusahaan secara tertulis dalam jangka waktu tersebut
tentang cacat dimaksud. Akan tetapi, setiap Barang yang diproduksi oleh Perusahaan, yang memiliki harga
kurang dari USD5.000,- per unit akan digaransi selama 9 bulan sejak tanggal pengiriman dari gudang pabrik
Perusahaan atau 6 bulan sejak tanggal tagihan, yang mana yang terlebih dahulu.
Kecuali dinyatakan lain, suku cadang yang dipasang melalui Permintaan Jasa digaransi selama 3 bulan sejak
terpasang. Pelanggan bertanggung jawab untuk secepatnya melaporkan secara tertulis atas masalah yang terjadi atas
Barang dalam 7 hari kalendar sejak terjadinya masalah. Garansi tidak mencakup unit yang habis terpakai, biaya
transportasi dan akomodasi bagi teknisi, kesalahan penggunaan Barang dan/atau penggunaan suku cadang dan/atau
pelumas palsu/tidak orisinal.
Kewajiban Perusahaan yang timbul dari, atau dengan cara apapun terkait dengan kontrak ini, atau akibat penggunaan
atau penjualan Barang, akan semata-mata dan secara eksklusif terbatas pada pilihan Perusahaan apakah akan melakukan
perbaikan (pada fasilitas yang ditentukan oleh Perusahaan), atau penggantian Barang yang cacat, atau pengembalian harga
pembelian. Pengangkutan Barang yang diduga cacat ke dan dari fasilitas yang ditentukan oleh Perusahaan merupakan biaya
dan pengeluaran sepenuhnya dari Pelanggan, dan Pelanggan akan menanggung semua risiko kehilangan ketika peralatan
tersebut sedang dalam transit. Kewajiban Perusahaan untuk memperbaiki, mengganti, atau mengembalikan harga pembelian
Barang yang dinilai cacat oleh Pelanggan atas bahan dan cara pembuatan akan tergantung pada pemeriksaan dan pengujian
Perusahaan atas Barang tersebut sewaktu dikembalikan ke fasilitas Perusahaan yang ditentukan. Perbaikan atau penggantian
yang diperlukan karena kelalaian, kesalahan penggunaan atau penyalahgunaan, atau yang lainnya, yang tidak ditanggung

THE GOODS AND THEIR DOCUMENTATION, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE ARE SPECIFICALLY DISCLAIMED IN CONTRACT AND IN TORT LAW.
The Customer shall be solely and exclusively liable for any warranties or representations concerning the Goods beyond those
stated in this Point 9.
THE COMPANY AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT,
OR CONSEQUENTIAL DAMAGES WHETHER FORESEEABLE OR NOT, EVEN IF THE COMPANY HAS BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING OR ARISING FROM, OR IN ANY WAY
CONNECTED WITH, THIS CONTRACT OR THE USE OR SALE OF THE GOODS, AND IT IS AGREED AND
UNDERSTOOD THAT NEITHER THE COMPANY NOR ITS SUPPLIERS SHALL HAVE ANY DUTY TO INDEMNIFY THE
CUSTOMER OR THE CUSTOMER'S CUSTOMERS FOR ANY LOSS OR DAMAGE TO PERSONS OR PROPERTY
ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS CONTRACT OR ANY PRODUCT.
The Company makes no representations or warranties of any kind concerning the market for the
Goods or the Customer's potential earnings through resale or use of the Goods.
10. DAMAGE IN DELIVERY. The Customer shall be responsible for any risks, loss and/or damage to the Goods
since the Goods has been received by the freight company. The Company will not insure any delivery unless
instructed in writing to do so by the Customer. All insurance charges shall be invoiced to and paid by the
Customer.
11. INSPECTION, REPORT FOR DEFECTIVE DELIVERY AND DEFECTIVE GOODS. The Customer is
responsible for immediate examination of the Goods upon delivery and any deficiency or damage thereof
must be reported to the Company in writing within 7 calendar days of its receipt. No report for such damages
or deficiency will be entertained unless made within the stated period. Company shall process and conduct
inspection on every report. In the event that the damage and/or deficiency are caused by defective delivery,
Company will assist the Customer to report it to the freight company.
12. RETURN OF GOODS. When Goods is returned to the Company for a reason acceptable to the Company,
prior arrangements for their acceptance must have been made with the Company. Unless such prior
acceptance and arrangements have been made, the Company shall not under any circumstances accept the
responsibility of any liability of such returned Goods. If refund is required for the returned Goods, the
Customer must advise the Company of the date, delivery point, and document numbers relating to the
original delivery and should obtain proof of delivery to the Company. If the Good is returned by the Customer
for reasons other than defective delivery, defective Goods or warranty, unless other arrangements are made,
the allowable refund will not exceed 80% of the net invoiced value of the Goods at the delivery date. Except
in the instance of the defective delivery, defective Goods or warranty as verified by the Company to be as
such, the Customer shall be responsible for all expenses relating to the freight and carriage to the
Company's Warehouses.
13. ORDER CANCELLATION. Order Cancellation can only be conducted and accepted based on the occurrence
of Force Majeure acceptable to the Company. Cancellation for any other reason will impose the Customer
the obligation to bear all of the costs incurred in execution of this order up to the date of cancellation, and
claim made by the Company under Point 13 herein shall be final and binding.
14. QUALITY AND TECHNICAL INFORMATION. Unless otherwise specified in the Company's quotations or
order confirmation, all Goods shall be in the standard design and manufacture, and according to the quoted
standards, carefully inspected and where applicable, submitted to its standards tests at the Companys works
before dispatch. Drawings, illustrations and specifications remain the property of the Company and shall not
be communicated by the Customer to a third party without the Company's previous written permission.
Drawings and illustration in connection with the Company's quotations or contained in its price list are not
binding as to dimensions, specifications or details, unless expressly stated in writing.
15. WORK ON CUSTOMER'S PREMISES. Except where otherwise arranged, should work of any kind be
carried out by the Company on the Customer's premises or any other appointed premises or property of the
Customer, the Company shall not be liable for any loss or damage caused to any third party or to his
employee arising from any cause whatsoever connected in any way of such work, except to fulfill obligation
under Point 16 herein.
16. SAFETY, HEALTH AND ENVIRONMENT (SHE). While Company activities are performed in the Customer
area, the Company has the obligation to maintain cleanliness, to prevent any and all damages, accidents and
environmental incidents, to report immediately of any and all labor accidents that occur at the Customers
site. The Company shall be subject to safety, health and environment policies and procedures based on
government regulation and Customer policy. The Company disclaims any familiarity with or responsibility by the
Company for the safety regulations and other standards for the Products in the area where the Goods will be
installed. Customer assumes full responsibility for compliance with any such regulations and standards, including,
without limitation, any necessary or desirable modifications to the Products or the designs therefor.
17. BUSINESS CODE OF PRACTICE. The Company has high standards of business and personal ethics; we
adhere to our internal policies, and obviously follow all applicable laws and regulations in the countries where
it operates. The Company is committed to honesty in every situation and refrains from having interests which
conflict with the interests of the Atlas Copco Group.
18. FORCE MAJEURE. The Company will not be responsible in any manner for any loss, damage or delay
arising out of the occurrence of Force Majeure except in the case stated in Point 13.
19. DEFAULT. Time is of the essence of the transaction herein with respect to performance by the Customer of
its obligations herein, including without limitation, the full and timely payment of any portion of the purchase
price in the case of payment in installments referred to in Point 5 above. Should in such case the Customer
default in the payment of any sum to be paid hereunder or misrepresent or conceal any material fact relating
to the transaction herein of fail to perform any of its obligations herein, and such default continues for ten
days, or if the Goods is being used beyond its capacity or in any manner improperly cared far or abused, or
should the Customer be the subject of any proceeding under any bankruptcy laws or become insolvent or
attempt to sell, transfer, encumber, sublet or part with possession of any Goods, or if the Company deems
itself insecure, the Company shall have the right in any case at the Customers expense to take, without
judicial intervention and with or, at the Companys sole option, without prior notice to the Customer, to enter
the land and building where the Goods is placed/kept and move and repossess the Goods, whereupon
accrued unpaid sale price shall become immediately due and payable, the Customers right to use the Goods
shall cease forthwith and the Company may sell or rent the Goods to any third party upon such terms as the
Company shall determine. The Customer shall remain fully liable for any other payment due under the
transaction herein. In the event of the repossession, the Customer shall be liable to the Company for all costs
and damage incurred by the Company in securing repossession of the Goods including attorneys fees,
whereby in such repossession, the equipment is in a well maintained and functioning condition by the
Customer. A well maintained and functioning condition means in a condition like its condition when the
Customer originally received the equipment, only with ordinary wear and tear (purely at the Companys
discretion) caused by reasonable use and free and clear from any and all collateral rights or other rights of
any persons whatsoever whether or not arising from such removal and transfer.

MENGENAI BARANG DAN DOKUMENTASINYA, DAN BAHWA GARANSI YANG TERSIRAT ATAS KELAYAKAN JUAL
DAN KELAYAKAN PENGGUNAAN UNTUK TUJUAN TERTENTU DENGAN INI SECARA KHUSUS DITOLAK SECARA
KONTRAKTUAL DAN BERDASARKAN UNDANG-UNDANG GANTI RUGI. Pelanggan semata-mata dan secara eksklusif
bertanggung jawb atas garansi atau pernyataan mengenai Barang di luar yang dinyatakan dalam Poin 9 ini.
PERUSAHAAN DAN PEMASOKNYA TIDAK BERTANGGUNG JAWAB ATAS GANTI RUGI TERKAIT, GANTI
RUGI TIDAK LANGSUNG, ATAU GANTI RUGI KONSEKUENSIAL BAIK YANG DIPERKIRAKAN ATAU TIDAK, BAHKAN
APABILA PERUSAHAAN TELAH DIBERITAHU MENGENAI KEMUNGKINAN GANTI RUGI TERSEBUT, YANG
DIAKIBATKAN ATAU DITIMBULKAN DARI, ATAU DENGAN CARA APAPUN TERKAIT DENGAN, KONTRAK INI ATAU
PENGGUNAAN ATAU PENJUALAN BARANG, DAN DISEPAKATI DAN DIPAHAMI BAHWA PERUSAHAAN MAUPUN
PEMASOKNYA TIDAK BERKEWAJIBAN MEMBERIKAN GANTI RUGI KEPADA PELANGGAN ATAU PELANGGAN
DARI PELANGGAN ATAS SEGALA KERUGIAN ATAU KERUSAKAN TERHADAP ORANG ATAU KEKAYAAN YANG
TIMBUL DARI ATAU DENGAN CARA APAPUN TERKAIT DENGAN KONTRAK INI ATAU PRODUK APAPUN.
Perusahaan tidak membuat pernyataan atau jaminan dalam hal apapun mengenai pasar Barang atau potensi
pendapatan Pelanggan melalui penjualan kembali atau penggunaan Barang.
10. KERUSAKAN DALAM PENGIRIMAN. Pelanggan wajib bertanggung jawab atas segala risiko, kerugian
dan/atau kerusakan atas Barang sejak Barang telah diterima oleh perusahaan pengangkutan. Perusahaan
tidak akan mengasuransikan suatu pengiriman pun, kecuali diinstruksikan secara tertulis untuk melakukannya
oleh Pelanggan. Seluruh beban asuransi akan ditagih kepada dan dibayar oleh Pelanggan.
11. PEMERIKSAAN, LAPORAN ATAS PENGIRIMAN YANG RUSAK DAN BARANG YANG RUSAK/CACAT.
Pelanggan bertanggung jawab untuk segera memeriksa Barang pada saat penerimaannya dan setiap
kekurangan atau kerusakan harus dilaporkan secara tertulis kepada Perusahaan dalam waktu 7 hari sejak
Barang diterima. Tidak akan ada laporan atas kerusakan-kerusakan atau kekurangan tersebut yang akan
dilayani, kecuali dilakukan dalam jangka waktu yang telah ditetapkan. Perusahaan wajib memproses dan
melakukan investigasi atas setiap laporan. Dalam hal kerusakan dan/atau kekurangan disebabkan karena
pengiriman yang rusak, Perusahaan akan membantu Pelanggan untuk melaporkan hal itu kepada perusahaan
pengangkut.
12. PENGEMBALIAN BARANG. Apabila Barang dikembalikan kepada Perusahaan untuk alasan yang dapat
diterima oleh Perusahaan, maka pengaturan tentang penerimaannya sudah harus diadakan sebelumnya
dengan Perusahaan. Kecuali persetujuan dan pengaturan tersebut telah diadakan sebelumnya, maka
Perusahaan dalam keadaan apapun tidak bersedia untuk bertanggung jawab atas Barang yang dikembalikan.
Jika pengembalian dana dibutuhkan untuk Barang yang dikembalikan, maka Pelanggan harus
memberitahukan kepada Perusahaan tanggal, tempat penyerahan, nomor-nomor dokumen yang berkaitan
dengan penyerahan yang semula dan harus mendapatkan bukti penyerahan kepada Perusahaan. Jika Barang
dikembalikan oleh Pelanggan karena alasan-alasan yang lain dari penyerahan dalam keadaan rusak, Barang
rusak/cacat atau garansi, kecuali disepakati lain, maka pengembalian dana yang dapat diberikan tidak melebihi
80% dari nilai bersih Barang yang ditagih pada tanggal pengiriman. Kecuali dalam hal pengembalian karena
penyerahan dalam keadaan rusak, Barang rusak/cacat atau garansi sebagaimana diverifikasi sebagai
demikian oleh Perusahaan, maka Pelanggan akan bertanggung jawab atas seluruh biaya pengiriman dan
pengangkutan ke Gudang-gudang Perusahaan.
13. PEMBATALAN PESANAN. Pembatalan Pesanan hanya dapat dilakukan dan diterima berdasarkan terjadinya
Keadaan Kahar yang dapat diterima oleh Perusahaan. Pembatalan atas dasar alasan apapun lainnya akan
membebankan Pelanggan kewajiban untuk menanggung semua biaya yang dikeluarkan dalam melaksanakan
pesanan ini sampai dengan tanggal pembatalan, dan tuntutan yang dilakukan oleh Perusahaan untuk hal yang
diatur dalam Poin 13 ini adalah final dan mengikat.
14. INFORMASI MUTU DAN TEKNIS. Kecuali ditentukan lain dalam penawaran harga atau konfirmasi order dari
Perusahaan, maka semua Barang akan memenuhi desain dan cara pembuatan yang sesuai standar, dan
sesuai dengan standar-standar yang ditawarkan, diperiksa dengan teliti dan apabila diperlukan, diserahkan
untuk diadakan uji standar di pabrik Perusahaan sebelum pengiriman. Gambar, ilustrasi dan spesifikasi akan
tetap menjadi hak milik Perusahaan dan tidak dapat dikomunikasikan oleh Pelanggan kepada pihak ketiga
tanpa mendapat izin tertulis terlebih dahulu dari Perusahaan. Gambar, ilustrasi yang berkaitan dengan
penawaran harga dari Perusahaan atau yang dimuat dalam daftar harga tidak mengikat mengenai dimensi,
spesifikasi atau perinciannya, kecuali dinyatakan dengan tegas secara tertulis.
15. MELAKUKAN PEKERJAAN DI TEMPAT PELANGGAN. Kecuali dimana diatur lain, apabila pekerjaan dalam
bentuk apapun harus dilakukan oleh Perusahaan di tempat Pelanggan atau tempat atau properti lain yang
ditunjuk oleh Pelanggan, maka Perusahaan tidak bertanggung jawab untuk kerugian atau kerusakan apapun
yang terjadi terhadap pihak ketiga atau para pekerjanya, yang timbul karena sebab apapun yang dengan cara
bagaimanapun berkaitan dengan pekerjaan tersebut, kecuali untuk memenuhi kewajiban sebagaimana diatur
dalam Point 16 di bawah ini.
16. KESELAMATAN, KESEHATAN DAN LINGKUNGAN (SHE). Pada saat kegiatan-kegiatan Perusahaan
dilaksanakan di wilayah Pelanggan, maka Perusahaan wajib untuk menjaga kebersihan, mencegah setiap dan
seluruh kerusakan-kerusakan, kecelakaan-kecelakaan dan insiden terhadap lingkungan, melaporkan
secepatnya atas setiap dan seluruh kecelakaan kerja yang terjadi di tempat Pelanggan. Perusahaan wajib
tunduk terhadap kebijakan dan prosedur mengenai keselamatan, kesehatan dan lingkungan berdasarkan
peraturan pemerintah dan kebijakan Pelanggan. Perusahaan menolak segala pengenalan atau tanggung jawab
Perusahaan atas peraturan keamanan dan standar lainnya atas Produk di tempat di mana Barang akan dipasang.
Pelanggan akan bertanggung jawab penuh atas pemenuhan peraturan dan standar-standar tersebut, termasuk, tidak
terbatas, modifikasi yang diperlukan atau dikehendaki terhadap Produk atau desainnya.
17. KODE ETIK BERBISNIS. Perusahaan memiliki kode etik untuk berbisnis dan individu dengan standar yang
tinggi; di mana Perusahaan melekatkannya pada kebijakan-kebijakan internal Perusahaan dan secara nyata
tunduk pada seluruh peraturan perundang-undangan yang berlaku di negara-negara dimana kegiatan usaha
Perusahaan dilakukan. Perusahaan menjunjung kejujuran dalam setiap keadaan dan menghindar dari setiap
kepentingan yang dapat menimbulkan benturan kepentingan dengan Grup Atlas Copco.
18. KEADAAN KAHAR. Perusahaan tidak bertanggung jawab dalam bentuk apapun atas kerugian, kerusakan atau
keterlambatan yang timbul dari terjadinya Keadaan Kahar, kecuali dalam hal dimaksud pada Poin 13.
19. WANPRESTASI. Waktu merupakan hal utama berkenaan dengan pelaksanaan oleh Pelanggan atas
kewajiban-kewajibannya, termasuk tapi tidak terbatas pada kewajiban melakukan pembayaran secara penuh
dan tepat waktu atas harga pembelian dalam hal pembayaran dengan angsuran dimaksud dalam Poin 5 di
atas. Apabila dalam hal tersebut Pelanggan wanprestasi dalam pembayaran jumlah yang akan dibayar
berdasarkan transaksi dimaksud dalam dokumen ini, atau salah menyebutkan atau menyembunyikan fakta
material sehubungan dengan transaksi dimaksud dalam dokumen ini atau gagal melaksanakan suatu
kewajibannya dalam Perjanjian ini, dan wanprestasi dimaksud berlanjut selama sepuluh hari, atau jika Barang
tersebut digunakan melebihi kapasitasnya atau dengan cara yang tidak layak atau disalahgunakan, atau
apabila Pelanggan adalah subyek dari proses hukum berdasarkan undang-undang kepailitan atau menjadi
tidak mampu membayar atau berupaya menjual,mengalihkan, membebankan, menyewakan kembali atau
menjual kepemilikan atas Barang, atau jika Perusahaan menganggap pihaknya tidak aman, maka Perusahaan
berhak untuk, tanpa keterlibatan pengadilan dan dengan atau, atas pilihan Perusahaan sendiri, tanpa
pemberitahuan sebelumnya ke Pelanggan, untuk memasuki tanah dan bangunan dimana Barang
ditempatkan/disimpan dan memindahkan dan menguasai kembali Barang, dalam hal mana harga penjualan
yang belum dibayar akan seketika menjadi jatuh tempo dan harus dibayar, hak Pelanggan untuk
menggunakan Barang berhenti segera dan Perusahaan dapat menjual atau menyewakan Barang kepada
pihak ketiga dengan ketentuan-ketentuan yang ditetapkan oleh Perusahaan. Pelanggan akan tetap
bertanggung jawab atas pembayaran lainnya yang jauh tempo berdasarkan transaksi dimaksud dalam
dokumen ini. Dalam hal dilakukannya penguasaan kembali tadi, Pelanggan akan berkewajiban kepada
Perusahaan untuk menanggung semua biaya dan kerugian Perusahaan dalam mengamankan penguasaan
kembali Barang, termasuk biaya pengacara, dimana dalam hal penguasaan kembali tersebut peralatan berada
dengan baik adalah dalam kondisi seperti kondisinya sewaktu Pelanggan pada awalnya menerima peralatan,

Any repossession under this document shall not in any way be considered an act of trespassing or any
violation of law.
The remedies provided herein shall be in addition to any other remedies which the Company may have under
applicable law. No failure on the part of Company to exercise, nor delay in exercising any right or remedy which the
Company may have shall operate as a waiver thereof, nor shall any single or partial exercise by the Company of any
right or remedy preclude any other or further exercise thereof of the exercise of any other right or remedy.
20. LANGUAGE. English language which shall serve as the governing language of the Term and Conditions of
Sales. If requested by a party, the parties will sign a Bahasa Indonesia of this Term and Conditions of Sales.
In the absence of a Bahasa Indonesia Version, the parties hereby disclaim any benefit from, or any right to
cancel or declare this Term and Condition of sales null and void because of the absence of a Bahasa
Indonesia version pursuant to the Indonesian Law No. 24 of 2009 concerning National Flag, Language,
Emblem and Song. If there is any inconsistency between the English version of this Term and Condition of
Sales and any translation thereof, the English version shall always prevail.

hanya aus dan kerusakan yang wajar (yang sepenuhnya merupakan pertimbangan tunggal dari Perusahaan)
yang diakibatkan oleh penggunaan yang wajar dan bebas dan bersih dari setiap dan semua hak agunan atau
hak-hak lainnya dari orang manapun baik yang timbu atau tidak dari pemindahan dan pengalihan tersebut.
Penguasaan kembali papun sebagaimana dimaksud dalam dokumen ini, tidak akan, dengan cara apapun, dianggap
sebagai tindakan pelanggaran hukum atau penyimpangan hukum.
Tindakan-tindakan remedial yang diatur dalam dokumen ini merupakan tambahan terhadap tindakan-tindakan remedial
lainnya yang mungkin dimiliki oleh Perusahaan berdasarkan hukum yang berlaku. Tidak ada kegagalan di pihak
Perusahaan untuk melaksanakan, atau keterlambatan dalam menjalankan suatu hak atau tindakan remedial yang
mungkin dimiliki Perusahaan, akan dianggap sebagai pengesampingan atas hak atau tindakan remedial tersebut;
demikian juga bahwa penggunaan suatu hak atau tindakan remedial tertentu atau sebagian oleh Perusahaan akan
dapat menghalangi penggunaan lainnya atau lebih lanjut atas pelaksanaan hak atau tindakan remedial lainnya.
20. BAHASA. Bahasa Inggris merupakan bahasa yang berlaku didalam Syarat dan Kondisi Penjualan. Jika
diminta oleh satu pihak, maka kedua belah pihak akan menandatangani Syarat dan Kondisi Penjualan dalam
Bahasa Indonesia. Dengan tidak adanya versi dalam Bahasa Indonesia, para pihak dengan ini menyatakan
tidak menggunakan manfaat dari atau hak untuk mebatalkan atau menyatakan bahwa Syarat dan Kondisi
Penjualan ini batal demi hukum karena tidak adanya versi Bahasa Indonesia sebagaimana ditetapkan didalam
Undang-undang No.24 2009 tentang Bendera, Bahasa dan Lambang Negara, serta Lagu Nasional. Jika terjadi
ketidaksesuaian antara versi Bahasa Inggris dan versi Bahasa Indonesia tentang Syarat dan Kondisi
Penjualan, maka versi Bahasa Inggris yang dinyatakan berlaku.
