Dear records administrator,

Under the Colorado Open Records Law 24-72-201 et seq., I am requesting an opportunity to inspect or ob-
tain copies of public records regarding the claims filed against the City and County of Denver for calendar years
2010 through Feb. 28, 2017.
More specifically, I am interested in obtaining or inspecting records detailing a breakdown by department (i.e. Den-
ver Department of Public Works, Denver Office of Economic Development, etc.) of annual claims filed against the
city and county, the corresponding dollar amounts those claims are valued at and the amount the city and county
paid each year to resolve those claims. If available, I would prefer to receive this information in an electronic format
(i.e. Microsoft Excel file, CSV, etc.).
According to the City Attorneys Offices website, Denver collects information detailing for each claim the name
and title of any public employee involved, if known; whether the claimant reported if the employee was personally
responsible for the damage or merely knew about the circumstances; a concise statement of the nature and extent of
the damages claimed to have been suffered; and a statement of the amount of monetary damages being requested.
Therefore, the city likely maintains records detailing what department each claim corresponds to. If for whatever
reason this is not the case, please exclude a breakdown by department (i.e. Denver Department of Public Works,
Denver Office of Economic Development, etc.) of from the above paragraph and process the request.
If there are any fees associated with obtaining these records, please inform me of the anticipated cost. However, I
would also like to request a waiver of all fees in that the disclosure of the requested information is in the public in-
terest and will contribute significantly to the publics understanding of how the city/county are handling claims with
residents.
The statute requires a response to this request within three days following receipt of this letter. If access to the
records I am requesting will take longer, please contact me with information about when I might expect copies or the
ability to inspect the requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the
information and notify me of the appeal procedures available to me under the law.

Mr. Garcia:

Pursuant to your most recent CORA request dated March 7, 2017, you are seeking: a breakdown by
department (i.e., Denver Department of Public Works, Denver Office of Economic Development, etc.) of
annual claims filed against the city and county, the corresponding dollar amounts those claims are
valued at and the amount the city and county paid each year to resolve those claims. On March 9,
2017, you spoke with Rob Nespor, Director of Litigation for the City Attorneys Office, and revised your
request as follows: for the time period of 2010 to present, (1) a list identifying the top 5 City
agencies/departments claims were filed against; and (2) a breakdown, by year, of the total number of
claims filed against the Denver Department of Public Works, the total number of claims denied, the total
number of claims paid, and the total amount of the claims paid.

In partial response to your revised request, from January 1, 2010 through February 28, 2017, the five
City agencies/departments with the most claims filed against them are: the Department of Public Works,
the Department of Safety, the Department of Parks and Recreation, the Department of General Services,
and the Denver Public Library.

As for the remainder of your information request, the City Attorneys Office does not keep any records
of the annual statistics you are seeking. In order to provide the breakdown of claims filed against the
Department of Public works you requested, we estimate that 1870 claims filed would need to be
researched, and that a total number of 470 staff hours would be required to conduct the necessary
research and provide you with all of the information you have requested. Therefore, your cost for
research and retrieval would be 469 hours at $30 per hour after the first free hour pursuant to CORA
and Denvers CORA policy found at https://www.denvergov.org/content/denvergov/en/city-of-denver-
home/cora.html.

If you decide to proceed with your request, upon receipt of payment of $14,070, we will proceed to
search for and produce all of the information within the scope of your revised request. If it takes less
time than we have estimated, you will receive a refund. You can send a check made out to the
Manager of Finance to Denver City Attorneys Office, 201 W Colfax, Denver CO 80202, Attn. Jennifer
Dempster.
This response applies only to public records within the custody of the City Attorneys Office and is
governed solely by CORA.
